First the good news, StillRay is being inducted into the Sturgis Freedom Fighter Hall of Fame, congratulations StillRay. And our own Charity Stuart recieved a Hometown Hero award for her service in Operation Enduring Freedom. Dee and I were both there to show support. We are all proud of her. Now the sad news as we are all mourning the passing of Pops of the Limey Riders M/C.. Condolences have poured in from across the state and we will all miss him. On to what's happening at the capitaol, SB1086, the anti-profiling bill, went down in flames.We needed 16 votes on the Senate floor and only got 14. There were 14 for 14 against and 2 who did not vote. So we will start again for next year, and again I can not say this enough: time to talk to your legislator and let them know how you feel. If you get pulled over for any reason document it. Most new cell phones take incredible video, that it's no longer “he said, you say”. We are still looking for a sponsor for the Lane Advancement bill. The threat of toll roads is still there, one more item to take to your legislators. Well, I'm back again with more newsabout what is going on in our world.

First the good news, StillRay is beinginducted into the Sturgis FreedomFighter Hall of Fame, congratulationsStillRay.

And our own Charity Stuart recieved aHometown Hero award for her servicein Operation Enduring Freedom. Deeand I were both there to show support.We are all proud of her.

Now the sad news as we are allmourning the passing of Pops of theLimey Riders M/C.. Condolences havepoured in from across the state and wewill all miss him.

On to what's happening at the capitaol,SB1086, the anti-profiling bill, wentdown in flames.We needed 16 votes onthe Senate floor and only got 14. Therewere 14 for 14 against and 2 who didnot vote. So we will start again for

next year, and again I can not say thisenough: time to talk to your legislatorand let them know how you feel.

Hello to all my Brothers and Sisters,

Motorcycle Day at the Dome 2013 wasshall we say different! This year wonthe prize for 3 different seasons in oneday here in the Valley. I asked that thisyear be a memorable MDATD. So westarted off with heavy rain then sun-shine and finally snow. I had fo rgottenhow much fun it is since I moved herefrom Chicago. All things considered wehad a good turnout of bikers. Many whohad made appointments with their legis-lators met with them under the tents orin their offices. I would like to congrat-ulate and thank everyone who attendedthis year’s event. A very Special ThankYou goes out to ALMA MC andHooligans MC who helped direct theparking of the bikes on the street infront of the Senate & House. LimeyRiders MC, ABATE and MMA mem-bers, for their assistance signing inattendees and helping locate legislators.

I was very fortunate to attend a privateshowing, along with 200 + other bikers.I am by no means a movie critic howev-er I very much enjoyed the movie. Themovie has many Brothers and Sistersfrom clubs throughout Arizona. I rec-ommend seeing the movie and see howmany people and places you recognize.Bikers, Babes, Bikes and Beer it’s allthere what more could you wish for?Treat yourself and a friend go see themovie.

Goodbye “Pops”

Limey Riders MC has lost a Brother,Mentor, friend and legend. As far as Iknow he was the most elder biker inArizona. Pops died peacefully at hishome last month.

Everyone who knew Pops instantlyliked him. His warm smile and friendlydemeanor welcomed old friends andnew acquaintances. Pops was born in1921 and named, Glen Richards. Popslater attended York College in York,Nebraska. After graduation he contin-ued to do graduate work at the college.In 1933 Pops first started riding fromLincoln Nebraska to his work 45 milesone way.

When WWII broke out Pops enlisted inthe Army. He was assigned to theAleutian Islands with the Army Corp ofEngineers. Pops later had other assign-ments until his discharge. Pops returnedto Nebraska and continued his love formotorcycles. He joined the White SpotsMC which later evolved into theModern Knights MC.

Sometime in the late 40’s Pops had anEnfield motorcycle that he used to raceand also use for transportation. Afterriding the bike in a race, the next dayhe started a journey from Nebraska toCalifornia, which I’m sure took him tomany interesting places.

Pops later found his way to Arizona set-tling in the Phoenix - Glendale area. Heworked for the State of Arizona as aSocial Worker until he retired at age 62.Well his retirement didn’t last long.Pops started working for the distributorof the Arizona Republic Newspapers.He delivered pallets of papers to distri-bution centers until he turned 80. Popsnever had a bike with an electric startuntil he turned 87. Pops then had anelectric starter put on the bike as anoption. The bike still had the originalkick starter but as Pops was gettingolder it seemed it wasn’t starting a fastas it used to.

When Pops turned 88 he bought anewer Enfield in 2010, this bike had anelectric starter. Pops rode untilSeptember 17, 2010. That was the daythat Pops’ was hit while riding his bikewhich put him in the hospital for alengthy recovery. After the accident

MDATD was an OK turnout probablywould have had more in attendance hadit not been for rain and snow.

ACMC Bill – Elimination of emissiontesting for motorcycles. There was aproblem with the information sent toEPA from ADEQ. EPA requests theinformation be sent again. New targetdate is May 1st 2013 for EPA to dis-solve motorcycle emission testing inMaricopa County.

SB 1086 Discrimination Bill - The billwas brought up for a vote which was atie vote. Lobbyist tried to save Bill byasking for a voice vote but that alsofailed. Bill 1086 has been declareddead. Lobbyist will try again next year.

Jimmy Page would like to step down asState PAC Officer. If anyone is interest-ed please submit your desire to anyState Officer or BOD member.

President’s Report (continued)Pops didn’t feel comfortable riding hisnew bike and side car. He was hesitantbecause riding the bike didn’t feel likesecond nature to him, and until it did hesaid he wasn’t comfortable riding in traf-fic.

Pops had the distinct privilege of attend-ing the 1st, 2nd and 50th. Sturgis motor-cycle rally. It’s believed he attendedsome more over the years but those werethe important ones too him.

Pops out lived all his relatives. His momdied at age 82 in 1979. Although Popsdidn’t have any blood relatives, he had avery close knit family within the motor-cycle community. His Club Brothers and

Sisters were his immediate family andthe rest of us were just, very privilegedto have known him. Pops was truly avery good man and a legend, who shallnot be forgotten soon. Pops you will bemissed.

LEGISLATION WOULD PROHIBITE15 GAS PENDING FURTHER INVES-TIGATION

Congressman Jim Sensenbrenner (R-WI)has introduced H.R. 875, which wouldrequire the Environmental ProtectionAgency to stop the use of gasoline con-taining 15% ethanol (E15) until its harm-ful effects are investigated further.

H.R. 875, introduced on February 28,would repeal the EPA’s waiver decisionapproving the use of E15 and the authori-ty of the agency to grant further decisionsuntil the EPA seeks an independent scien-tific analysis of the effects of the E15blend.

“There have been several tests and warn-ings highlighting E15’s harmful effectson engines and their components, butthey have all been dismissed by the EPA.Therefore, we must force the EPA to stopthe use of E15 fuel until the serious safe-ty, durability, performance and environ-mental concerns have been addressed,”announced Rep. Sensenbrenner.

Sensenbrenner has introduced severalbills to address the risks associated withE15, and his latest legislation to halt thesale of the 15% alcohol blended fuel untilfurther studies are completed, came lessthan a week after witnesses from automo-bile and motorcycle industry and con-sumer groups testified before the Science,Space and Technology Committee thatmore testing is needed.

“We have a responsibility to ensure thatAmericans using gas-powered machinery– whether it be cars and boats or chain-

saws and lawnmowers – are not put atrisk due to faulty fuel that has not beenadequately vetted,” Sensenbrenner said.

BILL INTRODUCED IN CALIFORNIATO REGULATE LANE SHARING

No sooner had the California HighwayPatrol published guidelines on how tosafely maneuver your motorcyclebetween lanes of slow-moving traffic,than SB 350 was introduced by StateSenator Jim Beall (D-San Jose) to codifythe rules into law.

California is the only state that allows“lane sharing” or “lane splitting,” precise-ly because there are no laws against it;though officers have a variety of chargesthey can levy against a reckless rider suchas unsafe lane change or too fast for con-ditions.

Beall’s bill would restrict the practice byprohibiting motorcycles from splittinglanes unless specifically allowed;“…when a highway has been divided intothree or more clearly marked lanes fortraffic traveling in the same direction, aperson operating a motorcycle shall notpass another vehicle in a portion of a laneoccupied by that vehicle unless the fol-lowing conditions are met:

(1) The passing occurs during traffic con-gestion.

(2) The passing occurs at a safe speed.”

Following furious feedback from motor-cyclists opposed to over-regulating an actthat 87% report doing almost daily duringcrowded commutes, Sen. Beall soonpulled his proposal and turned it into atwo-year bill for future reconsideration.

In the meantime, although ABATE ofCalifornia did not initiate the measure,

the group will work with Beall to amendthe language, and vows “…our goal is toultimately submit a bill that addresses theconcerns of the motorcycle community; abill that can be supported and endorsedby the ABATE membership. If the finalbill doesn’t meet ABATE’s requirements,ABATE will vigorously oppose the billand try to kill it.”

DRIVERS CAUSE MOST CRASHESWITH MOTORCYCLES, RESEARCHSHOWS

For motorcycle riders, people in "cages"bear a disproportionate share of the blamefor the high number of motorcycle crash-es, while car drivers feel careless motor-cyclists careening in and out of traffic areputting their own lives at risk.

So who's mostly to blame when four-wheel and two-wheel vehicles collide?According to a recent Florida Departmentof Transportation study, bikers are right.Motorists driving cars and trucks aremostly at fault, often failing to yield theright of way to the smaller vehicles.

In analyzing 10 years of Florida motorcy-cle crashes, Chanyoung Lee, a seniorresearcher at the University of SouthFlorida's Center for Urban TransportationResearch, found that 60% of the timemotorists in other vehicles are at faultwhen they collide with motorcycles.

But the study uncovered more: Whenlooking at all motorcycle crashes, motor-cycle operators bear a lot of responsibilityas well. They have a significantly highernumber of single-vehicle crashes thanother drivers. Some 34% of motorcyclecrashes involve one vehicle, according tothe study, compared to only 19% of carcrashes involving one vehicle. Whenlooking at really severe and fatal motor-cycle crashes, 50% involve just the

motorcycle and no other vehicle, butwhen multiple vehicles are involved,greater blame falls on four-wheeled driv-ers. And most motorcycle crashes involveother vehicles.

But it's also a matter of awareness,according to Lee, who is part of FDOT'sMotorcycle Safety Coalition. In driversurveys, FDOT has asked people howoften they see motorcycles. Those withmotorcycle endorsements on their driver'slicenses report seeing motorcycles all thetime, while those without endorsementswho live in the same area report occa-sionally seeing motorcycles.

Due to minimal levels of protection totheir riders, approximately 80% of motor-cycle crashes result in injury or fatality,according to the Network of Employeesfor Traffic Safety, while only 20% of pas-senger car crashes injure or kill the vehi-cle occupants.

MMA HELPS DEFEAT SOUND WAR-RANT IN YARMOUTH, MA

The Massachusetts MotorcycleAssociation (MMA) is pleased to reportthat a town bylaw proposal has been suc-cessfully defeated in Yarmouth. Withshort notice, the MMA in concert with theYarmouth Chief-of-Police and DeputyChief attended a recent Board-of-Selectmen meeting and were successfulin convincing the board that such aBylaw would be unsuccessful.

Armed with prior testimony used success-fully around the state, including used tooverturn a similar bylaw passed inFalmouth and subsequently struck downby the Commonwealth Attorney General,MMA Legislative Director Rick Gleason

Our meeting started out on a disap-pointing note. SB1086 failed to pass theArizona Senate (14-14-2). I have con-tacted my Senator again and expressedmy disgust of his decision. If you donot know who your state representa-tives are, you can find them on theArizona Legislative websitewww.azleg.org. Use the LegislativeDistrict to determine your state repre-

sentatives. You can also find USCongressmen and Senators atwww.house.gov and www.senate.gov.The congressional district, fromazleg.org can be use to determine yourUS Congressman.

Another important meeting topic ispolice are getting tough on motorcycleendorsements. Insurance companiesmay also reduce or deny a claim if youhave no endorsement. Statistics showthat 70% of motorcyclists currentlyhave their endorsement.

We also welcomed two new members. Ido not currently have their nams butwill post them in the next Masterlink.

Our next meeting will be held on April14th at the Arizona American ItalianClub, located at 7509 North 12th StreetPhoenix, Arizona 85020. Breakfast,served by the Arizona American ItalianClub staff, starts at 10:00 AM for $5/perperson, Meeting begins at 10:30.

Yavapai ChapterOur March meeting was held onSunday, March 10th at the Taj MahalRestaurant in Prescott, AZ.

We had a good turnout and severalissues were discussed for the comingmonths, including:

Our membership run will be held onSaturday, March 23rd. We will haveregistration at Roberts Market off Hwy.89a from 8-10am. KSU at 10am. Cost is$10 per person and will have severalstops at business members across theHwy. 69 then on to Wilhoit and theBurro Inn. All riders will receive a freepoker hand during the ride and therewill be a fashion show and raffle at theBurro Inn.

Our annual Run to the Hills event is onJune 1st in Jerome, AZ at the Gold KingMine. Our live music on the event daywill include: The Persuaders, Voodoo SexCult and Moondog. More being added.

We also agreed as a chapter to supportand attend the Jester’s run on May 18thin Cottonwood, Az. The event will be atribute to Pat Fitzgerald. We invite all ourmembers to ride with us to the event.Details on a group meet-up and ride forthe event will be sent out soon.

Yavapai chapter will be organizing ourservice commitment to TBfS at our nextmeeting.

We are calling for anyone that knows ofpatch holders out east to try and get themto attend the Beast of the East on April19th. Also anyone that is going andwants to ride with Still Ray, let himknow ASAP.

Our next meeting is on Sunday, April14th at the Taj Mahal.

NCOM NewsThe AIM Attorneys are helping withthe legislation to deal with the elimina-tion of Motorcycle Only Check PointStops. Luckily for us here in theWestern US we have not yet had to per-sonally deal with this issue and arethankful and hopeful that we neverwill.

For the past several years now our AZMotorcycle Lobbyists have been run-ning Lane-Splitting or Lane-SharingBills to safely move Motorcyclists for-ward in heavy congested traffic situa-tions. Unfortunately without enoughpractical background statistics and notenough positive feedback from ourlocal Traffic Authorities, the Bills didn'tgo anywhere. Some of the reasoningbehind wanting to get this type of legis-lation signed into Law is that we,Arizonian's live right across the Borderfrom CA, where Motorcyclists freelyskirt the Lane lines on a regular basis.Finally after many years of allowingCA Motorcyclists to scoot through traf-fic CA Officials are to unveil Lane-Sharing Rules. Basically what is beingaddressed is: You should Lane-Split nofaster than 10 MPH over the speed oftraffic around you, and recommend rid-ers not split at all if the Traffic is fasterthan 30 MPH. Now with specific Rulesin place for Lane-Splitting hopefullywe will be able to get this done here inAZ during our next Legislative Session.

You should All know that the biggestthing we have going here in AZ for our

Motorcycle Rights Issues is Our Anti-Profiling Bill SB 1086. At last countwe were only one or two votes fromgetting our Bill to continue moving for-ward. We did have a really great showup of Motorcyclists for the SenateHearing with over 250 Bikers signingin to give Testimony about their specif-ic Harassment they had to endure forbasically wearing Biker Atire while rid-ing their Motorcycles. During the sametime period we also had our MotorcycleDay at the Dome, (MDATD) set up forMotorcyclists to Visit with their localLegislators to let them know what ourcurrent Issues are and what they can bedoing for us, as OUR elected Officials.we are asking for Bikers to make theirphone calls and send their emails to getseveral of the Legislators on the com-mittee to change their votes, and I'mhoping this has gotten done.

Every year since 1994, bikers have gath-ered together to support Riley Hospitalfor Children. And every year since thenthey have ridden by the hospital and outto the the track of the famousIndianapolis 500 - courtesy of theIndianapolis Motor Speedway and theHulman/George family. One of riding’sbiggest rushes is to enter the Indy 500track and head down the main stretchwith around 8000 other bikers on yourtail. Holy mackerel; it only takes aboutan hour for all of them to get around it.Amazing to go two and half milesaround the track before you see the restof your pack entering the turn you start-ed on. It is hard to keep your speeddown, but you must. As you head intothe first turn, recall names and eventsthat make the track what it is today -

Foyt, Unser, Mears, Andretti (all ofthem), Peske, McLaren, Rahal-Letterman, Patrick, Borg-Warner Trophy,and of course Parnelli Jones, who led theMiracle Ride a few years back. And whatabout the Red Bull MotoGP, withKentucky native Nicky Hayden, andCasey Stover? Or the Brickyard 400with Gordon, Stewart, and Johnson orthe United States Grand Prix withMontoya and Villeneuve? This ride hap-pens at the Holy Grail of racing - ofevery kind. And you can be part of itand help the kids at Riley.

Since 1994, around 4 million dollarshave been raised for the kids at Riley,and 99.9 percent of those funds havebeen raised by volunteers. The MiracleRide Foundation has just a skeleton staffthat is paid for their work. So manythanks to those who volunteer time, dol-lars, motorcycles and expertise. I amtempted to start naming names of thosegood hearted volunteers that make thisevent happen, but I would do so at therisk of leaving some unrecognized (andit would be one long list). Safely, Iacknowledge the HOG Chapters, HarleyDavidson dealerships - South Side, WestSide, Mann, Bloomington and all of

those who operate the poker run sites,Miracle Ride Board of Directors,Miracle Ride Committee, Bob & Tom,Gino Johnson (the world’s best CPA) andthe folks at Rock Solid. Finally, wecouldn’t do without Lucas Oil, TuckerRocky, IMS and Riley Hospital stalwart -Cassie Martin.

DID YOU KNOW THAT THE FIRSTRACE AT THE INDY 500 WAS AMOTORCYCLE RACE? AS SUCH,BIKERS SHOULD OWN IT.

Motorcyclists need to own the Red BullIndianapolis GP Race - emotionally ofcourse. One of the best motorcycleevents to hit the tracks is the Red BullMotoGP and has been since 2008.Upwards of 100,000 riders crowd thestreets of downtown Indy with nothingbut motorcycles. But not enough of ustake the next step and go to theIndianapolis Motor Speedway to take inthe actual race. Why? With hard coreracing, Nicky Hayden, pit walk abouts,IMS Kid’s Club, vendor marketplace,camping and tailgating there is some-thing for everyone, so it is hard to under-stand why more of us don’t go. Did Imention Motorcycles on Meridian?

What more can you ask for? Here is theissue as I see it. Many of us are boule-vard bikers, pleasure/country cruisersand the like. Let’s face it, we just like toride. While some of us have developed ataste for flat tracks and hill climbs, theplain truth is that we are mostly riders.

This leads me to the following. I haveconcerns that the best race in the countrywill go away unless we bikers support it.Sure, there are 100,000 of us that showup on Meridian Street in downtown Indy.And no biker could ever have a bettertime than at that event. But by the timethe crowd gets out to the Speedway,there are fewer than 65,000 of us left.We and the IMS need 100,000 to makethis race one of the greatest spectacles inmotorcycle racing. How do we do it?Just go. And remember that there areover 1,000,000,000 registered bikers ifyou just include the surrounding states.Unfortunately, some of us have not takenthe time to increase our motorcycle parl-ance from flat tracker talk to MotoGPtalk. From there, it is simply a matter ofeducation - old bikers, learning new

ROADSIDE SECURITY, OR ROAD-SIDE BRIBE, TRIAL BY SKYPE?

Q: I got a speeding ticket recently. Thecop asked for a cash payment of $50.00on the spot. When I informed the offi-cer that I didn’t have $50.00 cash, thecop asked if I had any money at all. Ionly had a couple of bucks with me, sothe cop took my license and told me Iwould get the license back after the tick-et was paid. I think this sounds bogus.Have you heard of this? ABATE MEM-BER

A: Surprisingly, the law supports theofficer. Most states are members of aninterstate compact for enforcement oftraffic tickets - if you don’t appear incourt and pay the fine, your home statewill be notified and suspend your license

until you deal with the out-of-state tick-et. The Driver License Compact (DLC)also provides that the home state wouldtreat the offense as if it had been com-mitted at home, applying home statelaws to out-of-state offense. The actiontaken would include, but not be limitedto, points assessed on a minor offensesuch as speeding and suspension oflicense for a major violation such asDWI/DUI. It is not supposed to includenon-moving violations like parking tick-ets, tinted windows, loud exhaust, etc.All states are members except forGeorgia, Michigan, Wisconsin, andTennessee. Nevada repealed the author-izing legislation in 2007, though it stillgenerally conforms to the agreementthrough regulations.

Michigan is not a member of the inter-state compact. Pursuant to MCL257.749, the officer is empowered toreceive from the offender a cash bond tosecure the offender’s appearance incourt to answer for the ticket. If theoffender cannot post the bond (in cash,

We had Motorcycle Day at the Dome andit was mixed bag as far as successes go.On one hand the weather didn’t cooperatewith us and half of the state was snowedin. We even got graupelled here inPhoenix. Yep That’s the first time I‘veheard that word too. I guess it meansslushy snow. On the other hand though, alot of representatives came out to say hi

to those that did make it out to the event.We did have a fairly decent crowd there,but it wasn’t the rumblefest I was hopin’for but it got the job done.

Well Guys, This will be my last articlefor a while. I’m stepping down frombeing State PAC for a bit. No, no don’tread anything to it. Nothing is wrong andit’s nothing to do with anyone or any-thing. There are a few reasons. One isbecause of my working situation. I’mpretty much incommunicado from five inthe morning till six at night. In today’spolitico world something can start and beover in that amount of time. By the time Isee something going on and am able toget the information to you guys. It’s toolate or already reported in spades. Alsohaving two full time lobbyists makes thePAC position a little redundant. So Ithought I might do something in the

organization that isn’t so time sensitive.

I think what I’d really like to do is helpCharity with the communications job.One of the things I’d like to do is bringour methods of communication up todate. I want to make it easier for folks inthe outlying parts of the state to do StateOfficer and TBFS committee jobs. Sodon’t think just because I’m not PAC, I’mgoing to be on a beach somewhere, sip-pin’ Mai Tais. Wait a minute that soundslike fun. What am I sayin’? A-lo-ha ami-gos.

It’s been a lot fun writing to you guys. I’llmiss it immensely. Although Mr. Editormight not think so from all the cattle produse that he has to inflict to get my articlesin on time.

Arizona Town Has Photo Enforcement Lobbyist Conduct AuditReprinted from thenewspaper.com

In response to allegations of wrong doingwith its photo enforcement system, thetown of Prescott Valley, Arizona turnedto industry insider John D. Wintersteen toconduct an audit. The results were pub-lished earlier this month.

In December, Prescott Valley officialshad tasked Wintersteen with investigatingan anonymous tip that police officerswere dismissing photo radar ticketsissued to family members. The allegationwas taken seriously because it wascopied to the Arizona Peace OfficersStandards and Training (AZPOST) board,and the complaint turned out to be wellfounded. Wintersteen gathered fromRedflex copies of any tickets for vehiclesregistered to town police officers thatwere rejected. In most cases, the citationswere intercepted long before they couldbe dropped in the mail.

"It is clear from interviews of the traf-fic lieutenant, sergeant and corporal thatincidents for which a citation could notbe legitimately issued and mailed, andfiled with the court, by Redflex, were infact being 'rejected' at the first review orlater in the process within the policedepartment, on incidents involving vehi-cles registered to police employees,"Wintersteen wrote. "Both the traffic lieu-

tenant and sergeant confirmed to thechief that they customarily electronically'rejected' incidents in SmartOps whenthey involved a vehicle registered to aPrescott Valley police officer in whichthe police officer was not driving."

The officers involved referred to lettingoff family members as being an exampleof "officer discretion" mirroring the spe-cial treatment afforded such drivers whenpulled over by a live police officer. ChiefBill Fessler, who claimed he had no priorknowledge that this was going on,ordered the practice stopped. Wintersteenassumed this was a factual statement.

"I did not detect even the slightest indi-cation any of the four involved in review-ing incidents or dismissing citations elec-tronically were not being truthful; to thecontrary, all four had been particularlyopen and relaxed during the entire inter-view," Wintersteen wrote.

The officers explained they neverwould have paid the tickets had theybeen mailed.

"He stated that besides police discre-tion as a reason all seven incidents wererejected, the main reason he rejected theincidents in which his wife was driving avehicle registered to him is that had anNOV [Notice of Violation] been issued,he would have declined to respond to itby nominating his own wife, as is the

right of every registered owner whoreceives a NOV," Wintersteen wrote."Thus, he said, there was no purpose tohaving a NOV issued in any of the inci-dents."

Wintersteen has been a spokesman forAmerican Traffic Solutions through itsfront group, the National Coalition forSafer Roads. Wintersteen has also lob-bied the courts on behalf of RedflexTraffic Systems of Australia. As a result,Wintersteen's primary concern was thenegative impact on his industry of theofficers' conduct.

"It is also clear to me based on myinterviews that they did not considerpublic perceptions of this practice, thatmany outside the police departmentwould regard this practice as inappropri-ate and unfair, and thus potentially havean effect on public support for the photoenforcement program in Prescott Valley,"Wintersteen concluded.

The report included a number of rec-ommendations designed to increase thenumber of tickets issued and to collect$26 in "service fees" from motoristswhose citations were dismissed.

The MMA has long held strong opposition tothe use of the OEM EPA Stamp on stockexhausts as an enforcement tool, because it isa consumer protection mechanism and notmeant to be used against the consumer. It isalso hard to locate on many models of motor-cycle, hidden under seats on sport bikes, undersaddle bags of cruisers, or simply facing thewrong way for aesthetic reasons. Most criti-cally, per the very regulation that entitles it, itexpires in one year or 3,729 miles, whichevercomes first!!

Instead, the MMA(www.MassMotorcycle.org) continues to holda firm belief that the existing laws on thebooks are sufficient if properly implementedand enforced, specifically that simple test pro-cedures do exist for muffled exhaust, whetherreplaced with after-market or not, with a rea-sonable sound level.

LICENSE PLATE CAMERAS - A NEWWAY TO NAB SCOFFLAWS

First came red light cameras attached to trafficlights to catch drivers trying to beat the light;then came speed cameras along the roadwayto ticket lead-footed speeders; but now policeare deploying cameras in their cruisers to scanour license-plates in order to get instant feed-back on unpaid tickets and other warrants.

It also allows authorities to monitor whereaverage citizens might be at any particulartime. That bothers some privacy advocatesand organizations like the ACLU that opposepublic intrusions into individual privacy. Thegroups are becoming more alarmed aboutlicense plate tracking as a growing number ofpolice departments acquire the technology for

electronic surveillance of traffic on publicstreets.

Little Rock, AR Police Chief Stuart Thomassaid the law enforcement benefits outweighany concerns about possible abuse of theinformation, which, as a public record, islegally available for anyone to see.

Lawmakers in several states, includingMinnesota and Utah, have suggested setting atime limit for their departments regarding howlong such data can be collected and stored, butmany places like Little Rock have no set poli-cy and have a growing archive of license platephotos, along with time stamps and the loca-tions, showing where motorists were at certaintimes.

Privacy advocates worry about the potentialuses for such outside law enforcement, fromsnooping by stalkers and private investigatorsto businesses that sell personal data. "Givenhow few rules are currently on the books toprotect our privacy, it's plausible that privateinvestigators and data-mining companiescould acquire this location data," said ACLUstaff attorney Catherine Crump, adding thatthe organization has requested more informa-tion from government agencies, but hasn'tfiled any lawsuits.

AUSTRALIA BANS BROTHERS BEHINDBARS

Since last Nov 19, the Australian State ofQueensland in Northeastern Australia hasbanned the distribution of the monthlynewsletter “Brothers Behind Bars” in its pris-ons. Brothers Behind Bars is a digest of bikerclub and motorcycle news edited by retiredSons of Silence patch holder Iron Mike Davis,and is an outreach program supported by theNational Coalition of Motorcyclists (NCOM).BBB is specifically aimed at motorcycle clubmembers and is stubbornly non-partisan.

Mike Davis was notified that the words hepublishes were illegal in Oz with a perempto-ry, unsigned form letter from the governmentof Queensland that read in full: “On 7th ofNovember 2012 Queensland CorrectiveServices issued a directive from head officethat all correspondence between prisoners whoare members of an Outlaw Motorcycle Gang(OMCG) & OMCG members & associateswas to cease immediately. As a result theauthor of this letter has been identified to beeither a member or associate of an OMCG assuch your mail has been returned to you.”

Iron Mike recently told The Aging Rebel(www.agingrebel.com), “Something I’ve saidfor years: ‘Australia today, Canada tomorrow,and the U.S.A. the day after.’ I truly believecountries like Canada, Germany, U.S.A., andothers are watching to see what works inAustralia to outlaw motorcycle clubs – start-ing with the 1%er ones.”

The Aging Rebel article went on to describe“Anti-Bikie Laws” down under: “Queenslandhas been trying to outlaw motorcycle clubssince 2009 when the state passed legislationformally called the Criminal Organisation Actof 2009. These anti-bikie laws give police thepower to declare which organizations arecriminal & which are not. Similar sets of lawshave been passed in the Australian states ofNew South Wales & South Australia, and havebeen challenged in the courts by the HellsAngels, Finks & Rebels MCs. Australia’sstrategy has been difficult to implement in theUnited States because the U.S. Constitutionspecifically guarantees citizens’ & visitors’rights to move freely, assemble peaceably, tokeep & bear arms & to express themselvesfreely in numerous ways including the right towear a patch on your back. Various Fed policeforces in America including the FBI, the ATF& increasingly the Dept of Homeland Securityhave attempted to subvert these Constitutionalguarantees using the Racketeer InfluencedAnd Corrupt Organizations Act (RICO) & in

several recent cases trademark law.”

Premier Brad Wall says “maybe mistakes weremade” and the Saskatchewan government willrevisit motorcycle insurance rate hikes pro-posed recently by Saskatchewan GovernmentInsurance. “Our MLAs are reporting a lot offeedback on the issue, not just from those whoare riders or have motorcycles, but others ingeneral who note that these increases seem tobe very high,” Wall told reporters.

When the legislature reconvenes for its springsession next week, the Saskatchewan Partycaucus will discuss its next steps, Wall said.He said he’s not convinced SGI has exhaustedall of its options to help eliminate a $9-milliondeficit between crash injury payouts and feescharged to motorcyclists. “Obviously, what’sbeing proposed by SGI for the rate rebalanc-ing means huge increases and immediateincreases, if approved, for riders,” Wall said.

SGI’s proposal to the Saskatchewan RateReview Panel would mean a sudden 73%jump in insurance costs for the average motor-cycle owner, compared to an overall vehicleinsurance rate increase of 1.03%. The moveprompted a backlash from bike enthusiastsand business owners, who fear a big blow tonew and used bike sales which could devas-tate the motorcycle industry.

If approved, the rate increases would takeeffect in August, but Wall said the chance is“slim” the proposal will stay as is. He wantsthe government and SGI to look at other cre-ative options, such as using better price incen-tives to reward motorcyclists who have takentraining courses.

Even with our focus on riding motorcy-cles, there is still an education gap. It isthe ages 3-15. It is the ages when kidsare most impressionable. Kids do stupidthings when they see a motorcycle fromfascination to rock throwing. With thatbeing said we also need to educate themwith responsibility and being responsi-

BIKE THEFT COVERAGE - BIGCHAIN, BIG DOG NEEDED

Q: My husband had a bad crash on hismotorcycle, but is recovering. Theinsurance company has agreed to pay usfor the damage to his bike and hasallowed us to keep it less the salvagevalue. We are paying a fair price for awrecked bike (salvage) and can fix it fora reasonable amount. Is that normalpolicy for an insurance company to dothat? Also, the insurance premium isdue soon. Is it okay to cancel the poli-cy? Is there any downside to can-celling? We need to save all the dollarswe can until my husband recovers fromhis injuries and gets back to work, butwe do not want to jeopardize the settle-ment funds and the deal for the bike.Rod, we need your advice. ABATEMEMBER

A: Most Insurance companies allow itsinsureds to “buy” the salvage, so buyingthe salvage is normal. When a companytotals your motorcycle, they are obligat-ed to pay you the “value” of the motor-cycle. At that point, the insurance com-pany owns the wrecked and totaledmotorcycle (salvage). You can thennegotiate with your insurance companyas to the salvage. If you are mechani-

cally inclined, this may be an opportuni-ty to get a “good deal” if the motorcycleis repairable. The insurance companywill deduct this salvage amount fromthe value of your motorcycle and sendyou a check for the balance. Be sureand investigate the effects of a “salvagetitle”, especially as to the insurability ofyour bike. If you still have questionscall or email me.

Regarding your other question, you cancancel your policy and it will not affectyour motorcycle settlement or the otherobligations of the policy in effect at thetime of the crash. The greater portion ofthe premium you pay on your policygoes toward liability coverage for theother guy if you are involved in a crash.Since your bike is not road-worthy, con-tinuing to pay the liability part of thecoverage is a waste. Your policy mayhave theft coverage so you will lose thatfor the bike upon cancellation. Don’tcount on theft coverage because theinsurance company may consider yourbike personal property and not a “vehi-cle” for coverage purposes. But somepolicies do provide theft coverage for astored bike in damaged condition - andsome don’t, so be sure to ask youragent. If you do not have theft cover-age, get a big chain and a bad dogbecause the economy has made yourkind of bike a prominent theft target.

GETTING THE FIXER FIXED

Q: I have a problem with getting mymotorcycle repaired. The mechanicwho is supposedly fixing it has had itfor many weeks now and is not fixing iteven though I have paid him over$1,000.00. What can I do? ABATEMEMBER.

A: First, try to work out an agreement

that works for both of you. If that fails,the fastest way to address this problemis to file a complaint in your county’ssmall claims court, or as the lawyerssay, “sue the bastards.” Visit the courtand introduce yourself to the court per-sonnel. Don’t be bashful - ask for help.Most court staff enjoy introducing thepublic to the legal process. The courtwill, after a relatively short period, setyour case for trial. Bring your witness-es and documents that support yourclaims and present your case chronolog-ically. Small claims courts are designedto work without lawyers, but we will behappy to give you some guidance in theprocess.

House Subcommittee Holds Hearing onMid Level Ethanol Blends

On Tuesday, February 26th, the UnitedStates House of RepresentativesCommittee on Science, Subcommittee onEnvironment held a hearing entitled "MidLevel Ethanol Blends: Consumer andTechnical Research Needs." The hearingpanel consisted of three witnesses, theAmerican Automobile Association(AAA), the American MotorcyclistAssociation (AMA) and the CoordinatingResearch Council (CRG). Vice ChairmanChris Stewart (R-UT) chaired the hear-ing.

Vice Chairman Stewart had this to say,"Unfortunately, the more E15 is studied,the more concerns are identified. Besidespotential widespread impacts on vehicleengines, the EPA has led a haphazardtransition to E-15 usage marked by regu-latory confusion, bungled implementa-tion, and a lack of consumer education."

The hearing covered a lot of ground butall panelists endorsed one commontheme, the need for more research whenit comes to using E-15 as a common fuel.E-15 is fuel that has 85% fossil fuel and15% ethanol or distilled corn fuel.

The Clean Air Act (CAA) allows for upto a 10% blend of ethanol. In 2010 theEnvironmental Protection Agency (EPA)issued a waiver of the CAA allowing forup to a 15% blend of fuel in model years2001 and newer. The EPA did this afterthe Department of Energy (DOE) did astudy and found the blend to be accept-able, sort of.

The study did not do any testing on apower train or the fuel delivery systems.The only aspect that was tested was theemissions control system, which is trou-bling to the Motorcycle RidersFoundation.

Ethanol was first introduced to the mar-ketplace in the early 1990's. It was foundthat the higher oxygen content was ableto help bring down carbon monoxide inthe tailpipe exhaust of carburetor fedinternal combustion engines and there-fore, the reduction of smog. Todays mod-ern fuel injected engines can self adjustusing oxygen sensors, basically eliminat-ing the need for ethanol.

One witness went into detail about howethanol is detrimental to engines bothlarge and small. One witness went so farto say that 95% of all vehicles on theroad should not use E-15. Two passengervehicle manufactures have retooled thepower train of their vehicles to work wellwith E-15, the rest have not.

AAA said that there are 169,000 gas sta-tions in the US and just around 20,000are selling E-15. They went on to empha-size that this is why we need moreresearch now before it's a more widespread problem.

All three witnesses also agreed that theenvironmental impact and cost savingsare a wash when it comes to using E-15.The biggest problem with E-15 is the fact

that it can harm the engine and the nega-tive side effect of lowering the miles pergallon.

Draft legislation was also unveiled at thehearing, authored by long time motorcy-cle defender and a MRF Champion, Mr.James Sensenbrenner (R-WI). TheSensenbrenner bill would halt the use ofE-15 until proper, real world testing isconducted on the effects of E-15 on cars,trucks and motorcycles.

Another issue that was revealed in thehearing was the fact that no one seems towant to take responsibility for any dam-age done by E-15. Most auto and motor-cycle manufactures will not honor war-ranties when the engine is damaged by E-15 and the fuel providers, who were notat the hearing, do not seem to be standingbehind their product.

In June 2011, Rep. Jim Sensenbrennersent letters to 14 automobile manufactur-ers inquiring as to the relationshipbetween vehicle damage resulting fromthe use of E-15 and vehicle warranties.All 14 companies responded with lettersoutlining their concerns with E-15 useand affirmed the potential for E-15 tonegatively impact their vehicles andcause engine damage. Furthermore, themanufacturers indicated that their vehiclefleets were not designed to operate on E-15, and stated that the warranties wouldnot cover damage resulting from E-15.

This is not the first time this country hasdealt with a change in the fuel supply.When this country switched from leadedto unleaded fuel we had a similar fuel-mislabeling problem. That was fixedwhen gas stations and auto manufacturesagreed to change the filler tube on thevehicle to a different size. This made itnearly impossible to fill a car notdesigned for leaded gas. No one is sug-gesting that type of a fix this time around.

One of the witnesses was asked howother countries, such as Brazil have beenable to fuel the countries cars with blendsup to 50% ethanol. The answer wasshocking. He said that the higher blendessentially "ate the cars apart" and leftBrazil unable to import cars. They had tocompletely redesign the power train andnow Brazilians can basically only buyBrazilian made cars. He also added that itwould take a decade for the US to com-pletely turn over the entire nation's fleetof cars to work perfectly with E-15.

Senator Frank Lautenberg (D-NJ) hasannounced he will not seek re-electionnext year. Lautenberg has served five 6-year terms in the US Senate and at theage of 89 is the oldest member in theSenate.

Lautenberg has been a thorn in the side ofmotorcyclists for decades. He has beenthe chief champion of mandatory helmetlaws serving in government today.

In 2005 he introduced an amendment thatwould have put mandatory helmet law inplace for the entire country, trampling onthe States rights. Due solely to the workof the Motorcycle Riders Foundation andits members that amendment was defeat-ed 68-29.

Lautenberg said; "While I may not beseeking re-election, there is plenty ofwork to do before the end of this term,and I'm going to keep fighting as hard asever for the people of New Jersey in theUS Senate".

"This is not the end of anything, butrather the beginning of a two-year mis-sion to pass new gun safety laws, protectchildren from toxic chemicals and createmore opportunities for working familiesin New Jersey."

Politicians are much like the end ofMarch in the Midwest, as the old sayinggoes, "it can go out like a lamb or outlike a lion". Many politicians spend therefinal days helping staff find new jobs,raising money to pay down any campaigndebt they may have or simply just walkaway. Others use there time to fight anylast political fights or take on controver-sial issues that may have otherwise costthem tremendous political capital.

Sensenbrenner Introduces EthanolLegislation

Congressman Jim Sensenbrenner (R-WI)introduced HR 875, a bill that wouldrequire the US Environmental ProtectionAgency (EPA) to conduct a thoroughindependent study of the effects of gaso-line/ethanol blends above 10%. Currentlythe EPA is allowing the use of blends upto 15%.

Sensenbrenner had this to say, “Therehave been several tests and warningshighlighting E15’s harmful effects onengines and their components, but theyhave all been dismissed by the EPA.Therefore, we must force the EPA to stopthe use of E15 fuel until the serious safe-ty, durability, performance and environ-mental concerns have been addressed.”

The bill would halt the sale of E-15, the15% blend, until the studies findings havebeen completed.

Call for MAP InstructorsThe Motorcycle Awareness Program(M.A.P.) is an educational programaimed at the target audience of highschool students in driver’s educationclasses. There has been a small group ofinstructors who have volunteered to pres-ent the M.A.P. to students throughout thestate. But, we need more instructors.

Remember, that ABATE stands for EDU-CATE. Our purpose is to spread theword about safe motorcycling and pro-mote a positive image of motorcyclists.What better way than to speak to thefuture drivers of our state. The studentshopefully, will not only be betterequipped car and truck drivers but willalso be more aware and watch out for us.

To become an instructor you must:

1. Be available during the day:The presentations in the high school dri-ver’s education classes last about an hourduring the school day. There may be asmany as 5 classes in one day.

2. Be willing to stand up in front ofa group of about 30 high school stu-dents and speak: That sounds easierthan you think. You need to be able togently maintain control of the group.

3. Know the material being pre-sented: There is an outline for all pre-senters to follow so there is uniformity in

the material presented.

4. Commit to teaching at least 2classes per school year: We hope tohave at least one volunteer instructor ineach ABATE Chapter. That person willattend and instructor class (about 4hours), attend a M.A.P. with an experi-enced instructor, teach a class with anexperienced instructor in attendance.When the new instructor is comfortableand the experienced instructor assesseshim/her to be ready the new instructormay begin teaching alone. The mentorprogram assures that everyone is teach-ing the same material and everyone hassupport.

5. Provide record of teaching tothe M.A.P. Coordinator on a consis-tent basis.

A bill requiring police to be trained onthe wrongs of profiling motorcyclists felltoday in the Senate Committee of theWhole.

Sen. Steve Yarbrough, R-Chandler, andSen. Rich Crandall, R-Mesa, voted withthe Democratic caucus to kill SB1086 ina 14-14 roll call vote. Yarbrough led theeffort to kill it, arguing that to pass thebill would open the door for theLegislature to decide on other protectedclasses.

“Once we start down the road of tryingto micromanage the syllabus for thepolice academy, we will indeed regrethaving done so,” Yarbrough said. “Howabout persons who wear military uni-forms? Certainly they ought to be pro-tected as a class. What about young peo-ple, or what about little old ladies withgray hair? All of those might be worthyof being a protected class so they’re notprofiled by the police.”

The bill’s sponsor, Sen. Judy Burges, R-Sun City, said she will have to discusswhether to bring the bill back with bikersand the Arizona Citizens Defense

League, which lobbied for it.But JohnDreyfus, a lobbyist with the ArizonaConfederation of Motorcycle Clubs, saidhis group will push for another bill nextyear.

“We’re not going away,” Dreyfus said.“They’re looking at us and saying, “Hey,they got it out of committee.’”

Dreyfus said he was unhappy withDemocrats because some showed himhis support and turned around to vote ina bloc.

The bill created a big splash when morethan 100 bikers wearing their leathersand club insignia roared in on theirHarley Davidson motorcycles Feb. 7 fora hearing in Senate Committee on PublicSafety.

Bikers gave personal anecdotes of howpolice targeted them as outlaw bikersbased on nothing more than their attireand fact they were riding a motorcycle.They said police use the pretense oflegitimate traffic stops to interrogatethem on the roadside about their motor-cycle clubs and tattoos and inspect theirmotorcycles before letting them go with-out a citation or a citation for a minorinfraction. One biker told how he wasinterrogated at gunpoint.

But some bikers showed up sportingNazi symbolism, spurring Sen. SteveGallardo to draft an amendment allowingpolice to use “hate symbols” as criteriafor a stop. He also drafted a secondamendment to add requirements for les-sons on racial profiling, but he didn’toffer either one.

Dreyfus said bikers missed an opportuni-ty when rain kept away large numbers ofthem Feb. 20 for a planned rally at theCapitol. He said if something isn’t done,then a motorcyclist will probably bekilled by police.
