You may want to familiarize yourself with these bills as they can be good beginnings to conversations, when you urge your representatives to pass them. “Motorcycle Day at the Dome! Whether it’s a law effect- ing motorcyclists or one that affects you as a home owner or parent, you want them to know who you are. You can build relationships with them on this level that can carry over to other areas. This is an election year and many legislators are up for reelection, offer to help with their campaign. You may not be able to donate much money, but you could volunteer your time, whether it’s handing out fliers, answering phone calls or knocking on doors. Remember, we’re not having a luncheon this year and it is certainly a step into the unknown. I’ve heard pros and cons on the issue, but I hope the new approach will be the begin- ning of more dialog and mutual respect. We as a community have the opportunity to make the first move to become involved in the process. It is much more difficult than offering food; it means we are actually offering support. Membership needs to be informedon the legislators in their area.

I think first and foremost the thingwe as PAC officers need to do is toget our members up to speed onwho their legislators are and feelcomfortable contacting them. Thiswould be achieved in such ways aspresenting form letters on the properways to address the legislators, get-ting the new district maps , and con-tact lists for the Leg. Then prepareour own contact list so when theneed to contact our legislators ariseswe will have the means in place todo so. Our job as PAC officers is tolearn the workings of our govern-ment and be able to explain theprocess to our membership. Also tobe able to explain exactly how why,and what our lobbyists are doing.

State Officer Meeting Minutes

Hello to all my Brothers &Sisters,

Wow, February already, for thoseof us who live in or around thevalley this is beautiful ridingweather. Last month even thosewho live just a little further northgot a pleasant surprise with theweather cooperating.

The other day I received an emailasking if Too Broke for Sturgiswas going to happen this year. Iimmediately wrote back andadvised that YES, it definitelywas on. I also gave him the dateof our event which is, July 27,28, and 29, 2012! So that got methinking, if one person ques-tioned if TBFS event was still onthen there are probably manymore people who have the samequestion. A flyer will be designedand available for distribution assoon as possible from the TBFSCommittee. As of Feb. 1st. thereare only 177 days before TooBroke, that time goes by almostin the blink of an eye. The goodnews is that the TBFSCommittee will be ready to puton Arizona’s best old fashionBiker Party in the State. Now,this is where all ABATE mem-bers come in, we need your helpin spreading the word of ourannual event. We will also needmembers’ participation in helpingout your Chapter’s responsibili-ties. Volunteers will be neededfor Security, Registration,Merchandise sales, Gate duty /Traffic Control and First Aid.

For a successful event allChapters need to ensure that theyhave sufficient members to covertheir Chapter duties. If you’re abiker and have attended thisevent, you know how much funit is. There is no other event inArizona that compares to TooBroke. You also should knowhow much work it takes to assurethat everyone in attendanceenjoys themselves for the entireweekend. This doesn’t just hap-pen, it happens because volun-teers like yourselves, give upsome of your personal time andwork to ensure our guests havean enjoyable weekend. If every-one donates a few hours of theirtime we all can enjoy Too Broke.

In the next few months yourChapter Coordinators will havesign-up sheets available at yourmeetings. Now is the time tostart thinking about how you cansupport your Chapter, by volun-teering some time to supportABATE of Arizona and TooBroke For Sturgis.

February 22, 2012.ABATE ofArizona is encouraging all motorcy-clists who attend to make appoint-ments with their Legislators before-hand to visit with them in theiroffice, as opposed to waiting forthem to come to us. There will be atent provided for shade but no foodwill be provided. All motorcyclistsare welcome and encouraged toattend. Event starts at 9:00AM –3:00PM.

*ABATE’S Rider Advantagewhich provides motorcycle trainingfor all riders in Arizona. The neworganization will be a 501© 3.Money donated and money for mem-bership fee are all tax deductible. Allthat is required for membership is a$5.00 minimum donation per year.This allows the donor/member votingprivileges when officer elections areheld. Chapter ReportsEast Valley Chapter

First off let me say hello and congratula-tions to all the new State and Chapterofficers. Thank you for volunteering tokeep our organization going and also toall the returning officers let me say thanksfor your continued support. I have somebad news. We at the East Valley Chapterhave lost one of our own. Robert Vasquezpassed away on Jan. 14th of this year.Robert has been our Sgt. of Arms for thelast few years and very active in ourchapter. He will be deeply missed. Lookfor an article on Robert in this issue.

On to upcoming events at East Valley.Our Valentines party will be held on Feb.11th at the Monastery bar & grill at 4810E. McKellips & Falcon Rd.(McKellips&48th St.) at Falcon Field Airport. Theparty is from 5:00 to 10:00pm. We will beselling raffle tickets for a Samsung laptopand case that will be raffled off that night.Look for the flier in this issue. It will be agreat time for all so try to make it.

Here I sit now for my 30 minute allot-ment that my doctor allows me. Yes Ibroke my back at work . Yes I'm in painand yes I envy you riders right now . Iwant to thank Billy for stepping up to runour meetings until I am able to get backon my feet again !

Well here in the high country the weatheris a little cooler now so dress up warmcause you can always take it off. Here ourchapter is getting things in motion forWild In The Weeds ! I'm sure this eventwill be better than last year’s !

We also are doing a thing up here forsafety and awareness month in May.

Now we all know Feburary isM.D.A.T.D. I hope to see alot of mybrothers and sisters there ! That's the22nd of this month.

Phoenix/ShadowMountain Chapter

Welcome to 2012! I hope that everyonefound their ways through the Holidayssafe, sound and pleasurable.

My name is Melissa Everest and I amtaking over Communications for CaseyYates. Casey has done a great job for thepast 2 years and is ready to be a 1 posi-tion gal as State Secretary! Good JobCasey!

We held our first meeting of the year onJanuary 8th. It was a short meeting againthis month as the State meeting was heldimmediately following.

Mikki Aaronson reported that that wehave 17 new members and that we areslightly down from 230 to 186 members.She encouraged everyone to renew theirexisting memberships and to recruit,recruit, recruit more members!

Our Safety Coordinator Pam Costellogave us tips on safety while riding ingroups. She suggested arriving early witha full tank of gas for group rides and con-duct a meeting prior to the ride with stopsand destination information provided. Sherecommended going to motorcyclesafe-ty.org for more information and check thesight on a regular basis to keep skills

fresh. Use your standard hand signalswhen riding! On the subject of insurancebe aware that a company can deny yourbenefits if you aren’t wearing a helmeteven though the other person is at faultand we are a helmet free state. This issomething that also needs to be addressedin the future.

Carole O’Reilly is hard at work forMotorcycle Day at the Dome 2012 to beheld on February 22nd, 2012. We will notbe hosting a lunch this year and she asksthat everyone make appointments withyour state reps to have a one on one meet-ing to discuss the main talking points. Atthe top of the list is anti-profiling and lanesplitting.

Jean Cooper our State Safety Officer willteaching Accident Scene ManagementTraining at Buddy Stubbs Feb. 11th 9-4 .The basic class is $ 50.00 and Abate willpay ½ for members. The ASMT advancedis Feb. 12th 9-4 and the cost is $55.00 allstudents pay total cost. Space is limitedsign up at www.accidentscene.org [email protected]. Hope to see you there!

Northern Arizona ChapterWith snow on the ground the NorthernArizona Chapter had our first officialmeeting in Show Low. We had a goodturn out including a few guests, TimO'Reilly, ABATE State President, andCarol O'Reilly our ABATE StateDesignated Lobbyist and Mike McCall thePresident of the Mountain MotorcycleAssociation of AZ. As of our first meetingwe have 20 members and 1 businessmember, with no doubt we will be signingup more very soon. We have some goodmembers already but unfortunately westill have a few officer positions open soanyone in the area that might have won-dered what ABATE is about we welcomeyou to come to a meeting. Our meetingsare held at JB's in Show Low the 2ndSaturday of the month at noon. We will beplanning a membership drive in the verynear future and hope to see you all there.Well, with 1 meeting under our beltsthere's not much to report but, keep youreye on us we plan on getting a lot accom-plished in our first year here!.

L&RNorthern Arizona Chapter

Southern Arizona ChapterThe meeting called to order by Ron Koolat 9:09 am. Pledge of Allegiance was ledby Ron with a moment of silence forthose in harm’s way. 26 members attend-ed this meeting.

I may have attributed the wrong membersas far as motion, seconds, etc. The dogate the notes, really, oh well it didn’t workin grade school either.

The high light of my entire year was tosee Rich Montgomery drive himself to themeeting from Sierra Vista. Rich thankedeveryone for their continued encourage-ment and all those who visited him at therehab center in Tucson and at his home inSierra Vista. Rich spends a lot of hisrehab time in a swimming pool. He isable to handle his rehab without comingto the VA in Tucson. Rich is one of theoriginal three members who started ourchapter in 2007. It’s amazing he is withus.

Some people will fake a coma and go ona ventilator just to get out of their officerduties early!

Safety: Last month we talked outT_CLOCK and how to check your bikebefore you go on a ride. This month thetopic steered toward items you shouldcarry with. Although Jim wasn’t presenthe had emailed in his report. One item isto carry some of the glow sticks. Theyalert other drivers when you are stoppedon the shoulder. They can even be tied toyour tail / brake light. Carry one of thedisposable cameras since the digital pic-tures can be altered so easily. With theArizona Sun carry a collapsible umbrella.

How about some aspirin to chew on incaseof heart failure? Members with the baggerscan carry more. I carry a small set ofjumper cables. Besides bungees carrysome of the parachute cord to tie thingsdown or up with. Another good item is asiphon hose. It takes up minimal space.Don’t forget zip ties. Other ideas membershad were duct tape and of course a first aidkit. Be sure your first aid kit has ointmentfor burns and latex gloves. Since we soldour stock we will order replacement firstaid kits. Carry some female napkins. Theypack small and are great for coveringwounds. Carry some of the hand wipes.Remember how our excessive heat affectsour items. Some members carry a little aircompressor. Due to space limitations somemembers carry the small compressed CO 2cartridges. I also carry a plug kit for thesolid tires. You should always end yourpacking with as much water as you cancarry. Did you remember your differ setsof glasses. When your day ride turns into anight ride don’t be stuck with only sunglasses.

Membership: We have 138 active mem-bers and 6 business members. We havebeen working on getting members strictlyon the insurance policy. $2500 insurancefor $25 a year is cheap. We have two newbusiness members. The Eclectic Café onEast Tanque Verde. They have excellentfood and tend to lean towards the healthyselections. We have Paul’s SE Arizona RVRentals in whetstone. He is on our roadcleanup mile and Bob signed him up whiledoing our cleanup!! Speaking of membersremember the membership contest startedon January 1st, 2012.

Old Business: Thanks all around for ourpast officers and thanks for those steppingup to fill officer positions for 2010. Allpositions are filled except for Secretary.I’m not sure if Rich realizes he is secretaryuntil he finds his own replacement. In factas soon as you are elected you should startlooking for your replacement! Our newofficers are already having an impact. Thenew coordinator Jim brought in cards forall of our business members. Instead ofmailing them we went as a group anddelivered them in person.

As we reported last meeting Bob Weltonhad gone down on the fourth avenue trolleytracks. We have since learned that in addi-tion to the many law suites the TucsonPolice do not allow their motor officers toride on any street that has the tracks. Manyof the daily crashes are bicycle riders. Wehave some contacts with the main bicyclegroup. We may be able to join forces to getthese tracks removed.

All T-Shirts are discounted to $5 and wesold several.

Jim DeYoung won the 50/50 for $ 16.50.Jim also won a scratcher lotto ticket, poten-tially worth thousands of dollars! The firstmeeting Art ever attended he won the dol-lar jar and we will never let him forget!

Art Burke won both the gas card and thehome depot card. Art was seen giving Rona kick back since he drew the numbers.

The dollar jar was $83 and won byAngelique Perea who was not present. Itrolls over to the next meeting. For the firsttime ever next month’s dollar jar will beover $100. Remember you must be presentto win.

The short meeting was adjourned at 9:30And followed by the Gala gift exchange wedo every year.

This report is being written the day afterour first chapter meeting of 2012. Wow,where does the time go? So, how do you

think our first meeting went? One word,great, no better than great, fantasticallygreat. I do tend to exaggerate, let’s just sayit went very well. Thirty plus peopleturned out, some regulars plus many newfaces as well; we even managed to secureseveral new memberships. 2012 is begin-ning to look like an excellent year forYavapai Chapter, maybe even better than2011 and that one would be hard to beat.We had some lively conversation includinga riveting report from our BOD Rep.Stillray Fitzgerald. He certainly knowshow to get people motivated and inspires afighting spirit, especially when it comes toprofiling bikers which in turn trickles downto all citizens of this exceptional country. Ihighly recommend getting your hands on acopy of the Jan. /Feb. 2012 MRF ReportInformation Bulletin. On page 19 is theMRF Motorcycle Club Committee PositionPaper that Stillray was the driving forcebehind. Read it, it should make you madas hell when you realize what crap the fedsare trying to pull. This is a perfect examplewhy organizations like MRF, ABATE,MMA, all MROs are so very important inour fight for freedom. Please join ABATEof Arizona, MRF or any other MotorcycleRights Organization. It’s going to take anation to stop this injustice in its tracks.Oh man, I told myself “self, no preachingallowed when writing this report”. Guessyou can’t teach an old dog new tricks,especially one named “Gabby”.

Pour another cuppa Joe, time for the funstuff starting with our first run of the year,the March 17th Luck of the IrishMembership Ride and Poker Run. Sign in9:00am, kicks stands up @ 10:15am at TheJackass Bar in Prescott Valley, $5.00 perperson, free poker run. Second stop isDrunken Lass in Prescott then on to TheBurro Saloon in Wilhoit, back to Prescottfor the last stop Gurley St. Sports Pub.We’ll have a Bike Show, raffles, music andmuch more. If you attended last year’sMembership Drive you know how muchinsane fun you had. It was crazy good.

Bike Nite will start in March this year backat The Drunken Lass. Be on the lookoutfor flyers for more info. Remember Run tothe Hills last year? We’re doing it againthis year on May 19th at the Gold KingMine in Jerome. This is still going to be aweekend event following in the “oldschool” tradition. Once again look out forthis flyer coming soon to a neighborhoodnear you.

Now, how about a really fun event that isalso for a good cause? Well, I have one forya; on Saturday February 15th there will bea Horseshoe Tournament to benefit localkids for Pay to Play Sports. Three clubshave banned together, Red IronBrotherhood, Journeymen MC. and Windand Fire MC to organize this worthy event.Registration is 9:00am – 10:00am at TheRoadrunner Restaurant & Saloon, 47801 N.Black Canyon Hwy in New River. Thishorseshoe tournament is single elimination,$30.00 per team, max 32 teams with a 1st,2nd and 3rd place winners. There will bemusic for your entertainment along withfood and drink specials.

Guess I better sign off soon before you getcaffeine jitters. Oh, oh I just rememberedto mention one more thing, you know me, Ican’t shut up but this is a good one. Twoof our chapter officers now have keyABATE State positions. Our P.A.C. OfficerHandi is now State Membership Officerand our Treasurer from last year Paul isState V.P. We’re proud of them and areconfident they will do a great job for stateas they did for Yavapai Chapter. We sadlylost Paul, he’s got enough on his plate now,but Handi is staying on as our P.A.C.Officer. Yeah!

Well guys,As promised we are going to startlearning the legislative procedure forgetting a bill through our state legis-lature.

ZZZZZZZZZZZZZZZZZZZZZZZ.CLAaaAAS. CLASS! WAKE UP!!!!Thank You.

Ok the first thing that needs to bedone is what they call Stake Holdermeetings. That is where you meetwith all affected parties and elimi-nate all opposition. (No, Not Sons ofanarchy style), but through showing

the need for a law to be passed. Thenext step is to draw up verbiage. It ishelpful to use existing legislation, ifany.

It will be then the job of the lobby-ist to find a legislator that believes inour bill and will follow it through.This will be our sponsor. OurSponsor and lobbyist will get togeth-er and approve a draft and re-submitit to the Legislative council. The Legcouncil writes the bill in proper formand sends the bill to the “Hopper”.(Not Dennis) Now will be the timeto find Co-sponsors and work withthe legislators to build interest in thebill. After a first read By the Speakerof the House it will be assigned tothe proper committees and the ChiefClerk for Printing. It will beassigned a number and Committees.Rules committee is always a given.They check the language and makesure the bill is Constitutional and inproper form.

At this point the bill can be tracked

online. It’s important that we knowwhen the committees will be dis-cussing the Bill and the order it’sbeing heard so our lobbyist can…Well, lobby. This is the time for pub-lic testimony.

Rules Committee will then place thebill on the active calendar and theSpeaker sets the order that the billswill be heard. It is then heard by thecommittee on the whole. This is aninformal session of the entire Houseacting as one committee. The billwill be debated; amended, injected,infected and selected………Whoopswrong song. ANYWHO Then it’stime for the third read roll call andformal vote. If passed, it goes to thesenate where the whole processstarts again. The senate might acceptit in its form or amend it If it comesback to the house in its originalform, it will be sent to the Governorfor signing or Veto. If it is in a dif-ferent form the House and Senatewill set up a Conference Committeeto hammer out the differences. After

they are in agreement they will senda report back to each house foradoption. After Final passage it willthen (Finally Jeesh) go to theGovernor.

HamstertimeGood Morning America. The onlygood thing about February is that it'sonly 28 days long. It's usually cold,gray and dreary here in Indiana butnext to North Dakota the place feelslike the tropics. I LOVE North Dakotabut you have to be one tough individ-ual to call it home year around.Blizzards, White outs, snow drifts 12feet deep, 25 straight days of minus 20below zero.... just another day for myNorth Dakota Brothers and Sisters. Ithink that Krogers Supermarket spon-sors every weather forecast when theweather turns bad, because at thereporting of the first snowfall, peopleflock to Krogers and attack it like buz-zards on a carcass.

When the weather turns to crap herein Indiana and people start bitchin' andwhining, I look fondly at a patch onmy leather vest that says; What wouldFridge do? Then I find myselfremembering my last visit to theABATE State Party in Mandan, NorthDakota and just smile. Fridge is one ofthose North Dakota Brothers that justleave an indelible impression on a per-son. One of the many people fromNorth Dakota I consider family.

So, if it's February 1st., Spring will behere in about 28 days so just shut upand deal with it. OK, according tothose devil worshiping nose pickerswho try to continually confuse peoplewith their over zealous ego and under-used sense of humor factors, theythink otherwise . They spew and oth-erwise pontificate crap like..(Makingthat clearing of the throat sound )........Spring, otherwise known as the VernalEquinox... (see I told you they wereconfusing) starts officially at 7:21 PMEastern Daylight Time on March 21st.for those of us in the NorthernHemisphere...................... Well LA DIFRICKIN' DA !

So, I may not be technically or politi-cally correct but if you look at a cal-endar; there are 12 months and 4 sea-sons. Do the math and when you lookat it my my somewhat jaded point ofview, March 1st is my official start ofSpring. So on March 1st. my moodimproves dramatically and hopefully,so will yours ! Of course, you couldjust sit around moaning about the longcold, miserable winter all the whiletaking great pride in that fact that yourone of those politically correct snobswho uses words like Vernal Equinoxregularly in the course of your normalvocabulary and stay depressed for an

extra 21 days of Winter while lifepasses you by.

We only have about 3 months of realbummer winter weather around theOhio Valley where we call home,where as in North Dakota, their win-ter's start about September 7th and lastuntil early May and they are some ofthe happiest people on the planet.Their secret? Well, I guess you justhave to visit North Dakota and findout for yourselves. A word of warninghere.. if you do visit North Dakotayou had best bring a powerful thirstand a mighty hearty appetite for a realgood time because they do know howto party !

Speaking of parties..... ( nice lead inhuh?) The V-Twin Expo will be hittingCincinnati like a freight train. Brothersand Sisters from all over the US willconverge on The Duke Energy Centerto bring out the latest and greatestmotorcycle aftermarket productsknown to man. We always have tonsof columns about what we see andexperience at these shows. This is nota public event but downtownCincinnati should be rocking androlling after the show closes for theevening.

On February 18th. we will be hittingthe ABATE of Indiana Daytona WarmUp dance at Agner Hall . Agner Hallis located on the grounds of theLawrenceburg Fairgrounds. I'm notsure how long this event has beenhappening but I've never missed one.It's always a great time and a goodchance to catch up with a lot of folks Ionly see once a year. It starts at 6PM.

There are tons of really good eventsand rockin' good times ahead just takea look through the calendar in thismagazine, lace up your boots and letthe good times roll. I want to leave yathis month with a great quote byFather James Keller;..."What thiscountry needs is more people toinspire others with confidence, andfewer people to discourage any initia-tive in the right direction. More to getinto the thick of things, fewer to sit onthe sidelines, merely finding fault.More to point out what's right with theworld, and fewer to keep harping onwhat's wrong with it and more whoare interested in lighting candles, andfewer who blow them out..........somehow, that quite just feels right .Peace... New York Motorcycle Stops - We WereDone In By A Cop Getting AGovernment Grant For His Master’sDegree. Is His Ph.D. Next?

I have written a couple of times about themotorcycle-only checkpoints that havebeen springing-up around the country.Motorcyclists have not taken it lyingdown. Suit was filed in a New York fed-eral court, asserting that the stops wereunconstitutional and demanding that thestate stop using them. The first round ina longer struggle has concluded in NewYork, with the Federal Court there find-ing that the stops did not violate therights of motorcyclists. If you read thedecision, you will discover somethingvery interesting starting on page three.The judge noted that, “As part of hisMaster’s course work at the StateUniversity of New York at Albany,Defendant Lt. James Halversen, the com-manding officer of the New York StatePolice Motorcycle Unit, wrote a thesis onthe increasing rate of motorcycle fatali-ties for riders over forty-years old. Withthe help of Defendant Lt. Daniel Larkin,Halversen submitted a grant applicationto the GTSC in 2007 to fund the check-points. The GTSC, which is chaired byDefendant David J. Swarts, approved theapplication and funded the initiative withfederal grant money “provided byNHTSA and [Federal HighwayAdministration (“FHA”)].” What theCourt failed to note was that the primarycause of death in that age group wasspeed and alcohol usually involving otherdrivers.

I find it hard to stomach that motorcy-clists were done in by a governmentfunded thesis for a Masters Degree. Andthat, my friends, is why New York iswhere it is regarding illegal stops ofmotorcyclists. If only Officer Halversenhad applied for a grant to be used forenforcing alcohol and speeding lawsregarding the general driving public,wouldn’t that have been a better use oftaxpayer funds? Now, instead of enforc-ing alcohol and speeding laws whichreally saves lives, we have cops all overNew York pulling us over on our time offand looking at our helmet stickers.Thank God Officer Halversen didn’trequest money to study the elimination ofmotorcycles in general. Who knowswhere that would have gone? With thatkind of thinking, can anybody doubt thatABATE and the MRF are needed nowmore than ever? Let’s hope the officergets his degree sooner than later as wecan’t afford anymore education disguisedintrusion on our constitutional rights.

She Fought The Law And She Won -Lawyering Drone Style

ABATE member Benitta Yearton and herdaughter Rene (16) are fighters and theyknow their rights. When Renee wasgiven a bogus ticket by Hebron’s best,every bit of their “fight city hall” explod-ed all over the face of the arresting policeofficer. Here is what happened and howwe became involved.

Benitta called us knowing that we do notdo traffic tickets, but we were her last

great hope. And her question was a goodone: “should you pay a traffic ticket thatwas issued without evidence to back itup?” The answer in a perfect world isnever, but in today’s economy, there isnot a lot of money for traffic ticketlawyers, especially for the type thatwould just plead her to a lesser offenseand a lighter fine. And who has time tofight city hall?

So what to do when you didn’t do it?Here is the plan that Benitta and Ihatched. I would advise her along theway and she and her daughter should goto court and do battle. You know “mil-lions for defense, but not one cent fortribute.” The Yeartons would actually betheir own lawyers for a day. With mycell number and me on stand-by, it waslike a remote controlled drone situation.

Here are the facts: Rene, age 16, has aperfect, but short driving record. That isuntil now when “Officer Misguided”appeared. When the traffic citation wasissued, the arresting officer advised thathe had “heard” that Rene was speedingtwo days before. The officer was not awitness to anything, and had only beengiven a report by a crossing guard. Thecrossing guard could not identify Rene asthe driver of offending vehicle and didnot get a plate number. Rene drives aChevolet Blazer S-10. I wonder howmany of those there are in Hebron?

Day of trial. When he heard the Yeartonsweren’t going down easy, the prosecutorscurried out into the hall to talk plea bar-gain with Benitta and Rena. He offered areduced $50 fine and 100 days of courtsupervision. Stunned at the rejection ofhis “deal,” the prosecutor mumbled tohimself all the way back into the courtroom saying he could not believe wewere turning down such a good deal.

State’s first witness was the errant officer.That was easy. He did not see or hearanything, wasn’t there and couldn’t proveanything. He just took the word of thecrossing guard. Can anyone say“hearsay?” Next witness, the crossingguard, who testified that a ChevroletBlazer that looked like Renee’s wasspeeding, but astonishingly, could not tes-tify to anything else. Are you wonderinghow the case got this far? So were weand so did the Judge. After ruling infavor of Rene and against the State, hecomplimented Rene’s handling of thecourt proceeding and her mother’s sup-port - remember, Rene is only 16. Ofcourse, I was proudly stashed in myoffice and satisfied with the thought thatour system works “most” of the time. Aswe all know, “most” is a lawyer hedgeword.

P.S. Rene plans to be a teacher. I bet shewill have a great story to tell her futurestudents about the time she tried her owncase at age 16-and won. I think maybeour system won too.

Yellowstone, U.S. 14, And The Big HornMountains

The Road To Paradise - Ride It BeforeYou Die

While out in Sturgis, I had the chance to

ride Yellowstone and took U.S. 14 to getthere. That road was built in 1926 to getthe hordes of Ford Model A’s there ingood style. It goes from Chicago and fol-lows I-90. I call it the road to paradise.If it ever had an Indian name, that has tobe it.

I used to suffer under the illusion that allU.S. highways could have no more thanan 8% grade. Not so! If you want a rid-ing experience that will test your skills,ride U.S. 14 into Yellowstone. Comingfrom the East, cut through Sheridan,Wyoming and head to Burgess Junction.A few miles out of the Junction, you willbe treated to some of the best riding andscenery God ever made as you are smackdab in the center of the Big HornMountains. Once you get to the top andstart the down-hill slide, stop at the onlyrest area on the way down and take amoment to collect your skills - you willneed it as old U.S. 14 gets narrower andthe switchbacks get scarier. Some folkssay that the Big Horn Basin was possiblythe site of the greatest mammal explosionthe world has ever seen. This is ridingwith knowledge, folks.

As you shoot into Cody on the way toYellowstone, there are beaucoup camp-sites that are reasonable and fit the billfor bikers. If you like guns, take inBuffalo Bill’s Museum. And if you don’ttake in the Cody rodeo. People from allover the world flock to see this All-American experience. Sitting behind uswere Germans, to our left - French, andto our right were a bunch ofScandinavians. The world comes to seeus there as this event underscores ourAmerican image. But if anyone wouldhave yelled “fire” few would have under-stood.

As you come out of the rodeo, hang aright. It takes you straight to theYellowstone gate. What will strike you isthe size of the park. It is at least 60x70miles so calling it a “park” is misleadingas it is bigger than some states. Callahead for campsites (I was not so smart)and live in paradise. You can be just likeJim Bridger, Kit Carson and JeremiahJohnson for at least one night.

You can’t get enough of “Old Faithful.”It is more impressive than I imagined.Some say that it is part of a super vol-cano that it will erupt like no other vol-cano has in the last few million years.When it does, they claim that ash fromthe volcano will go all the way toDelaware Street in Indianapolis. Butdon’t fret, as that is not supposed to hap-pen for a few more million. As you leaveparadise, you are joining the likes ofTeddy Roosevelt and just about anybodythat was somebody in the world. Andthey and you will say that there is noother place like it. Do it and do it again,before you die.

As Ientered one of the parking lots, my backtire slipped on the painted surface and Iwent down and was pinned under mySportster. I broke my right ankle and ahad a class three sprain in my right kneeand had a possible rotor cuff tear in myleft shoulder. Have you have heard ofsimilar accidents like this and is there isanything that can be done to stop this pro-cedure of putting glass beads in the paint-ed surfaces of roadways? A: There isn’t much literature outthere on the effect of these types of paint-ing methods on motorcycle traction.Tales told among motorcyclists have longcautioned that riding across painted areasis dangerous, and the advent of thermo-plastic road decals have proven the col-lective wisdom of motorcyclists over andover. I suspect that the same applies tothe use of reflective glass beads in paint.Since the use of such paint procedures isapproved by national transportation offi-cials, if not encouraged, it will be difficultto get their use stopped. Which meansABATE LEGAL needs to get involved onthis one. Once again, the legitimate con-cerns of motorcycles gets short shriftfrom the powers that be. Probably ourbest course of action would be to increaseour education and outreach efforts so that

riders understand the risks of these paint-ing techniques. In the meantime, keepsending those RoadHazard reports in andwe will continue to notify the appropriateofficials about our concerns. We will askWolf Technical if they will provide someneeded expertise on the coefficient offriction regarding the glass beads and willsupplement this report.

Happy 2012 Everyone! Welcome newand returning ABATE Chapter SafetyOfficers!

Safety is everyone’s business. We rely onthe Chapter Safety Officers to share infor-mation and keep us aware, but all of usare responsible for our own safety and the

safety of those with whomwe ride.

ABATE has, as part of itsmission, a dedication to edu-cate riders and drivers aboutmotorcycle safety. Thereare many ways for all of usto participate in ABATE’Ssafety goal. Here are just afew:

Take a skills update course.It is good to renew yourskills at least every 5 years.

The longer we are riding, the morechance to become complacent and lessattentive to proper riding techniques.

Attend an Accident Scene Managementcourse. We have learned that we cannotalways prevent motorcycle crashes. So, itis important to know what to do shouldyou encounter a crash scene. Take a firstaid course. Take a first responder course.Ask your Chapter Safety Officer about

how to enroll.

Get involved in spreading the wordabout motorcycle awareness. Become aMotorcycle Awareness Program (MAP)presenter. MAP presenters are volunteersto present information to high school stu-dents who enrolled in driver’s educationclasses at their high schools. Currently,there is a small group of presenters whoare providing the educations in some highschools around the state. More volun-teers are needed. For more information,contact your Chapter Safety Officer.

Get involved, if your ABATE Chapterdoes not have a Safety Officer considerstepping up to the job, or share withsomeone.

Attend Day at the Dome. On February22, ABATE is sponsoring the event tomeet legislators and demonstrate thatmotorcycles have the power of supportinglegislators who are sensitive to the rightsand concerns of the motorcycling public

through our right to vote. Being aware oflegislation that affects our motorcyclingrights goes hand-in-hand with safety. We,as voting motorcyclists, have the respon-sibility to know what laws affect our rid-ing, thus affect our safety. Show theArizona Legislature the motorcycle com-munity is watching by attending theevent. If you cannot attend the event,learn who the legislators are that repre-sent you and contact them to see howthey support you on motorcycle issues.

Practice Defensive Riding. TheNational Highway Traffic SafetyAdministration published their annualreport last fall. You can visit the websitewww.nhts.gov to see the report. The takehome message for me is that DIS-TRACTED DRIVERS are now thebiggest menaces on our roadways. Wemust be ever vigilant to avoid them run-ning us down.

Making a DifferenceARIZONA MOTORCYCLIST MEDICAL CARE PLAN (AMMCP)

“BIKERS HELPING BIKERS” Arizona Motorcyclist Medical Care Plan(AMMCP) founded by MedievalMaidens MC as a Non-Profit corporationhas created a way for patients to getexpedited care while removing some ofthe hassles and cost of obtaining qualitymedical care. AMMCP will provide coor-dination of all primary care needs includ-ing office visits, arranging referrals, labwork, outpatient diagnostic testing, tele-phone consultations, and prescriptionrefills by contracting with a primary carephysician.

The plan will allow for every patient tohave one complete physical at first visitand two other office visits per calendaryear. We will make every attempt to con-sult with patients regarding their medicalproblems over the telephone, however,some problems may require a physicalexamination by the physician to diagnoseand treat the problem. We will be able tofill out paperwork for you as well with a

limit of three forms per year includingFMLA, Short Term Disability, disabilityplate/placard for the Motor VehicleDepartment, etc. This excludes medicalnarratives. The enrollment fee for ONEYEAR in The Plan is in 3 levels--$300for a single member; $500 for family of 2members; and $750 for a family of 4members. A $75 administration fee perplan will be charged.

We offer a Payment Plan to help in thesetough times. Three (3) consecutive pay-ments and you are a Member of AMMCPfor ONE YEAR. $300 + $75 = $125 permonth. $500 + $75 = $192 per month.$750 + 75 = $275 per month. That easy!

Within this Plan we are able to managepatients with chronic conditions as wellas patients who may rarely need to see aphysician. Patients with chronic condi-tions such as diabetes, high cholesterol,high blood pressure, etc., might be asked

to send in an update form occasionally tokeep the physician informed of your cur-rent condition(s). This form will includeyour vitals (blood pressure, weight, etc.),an area to update your family and person-al medical history, and a section for youto make notes related to your medicalcondition(s). The physician may requireyou to also have your blood tested peri-odically if you are on certain medicationsor for some medical conditions, i.e.: thy-roid, diabetes, and high cholesterol. Thisis in accordance with the standards ofmedical care that all physicians mustadhere to. There may be other medicalconditions which require frequent moni-toring by either the update form and/orlab work.

This Plan can be purchased and used inconjunction with your insurance with theexception of Medicare, MedicareAdvantage, and AHCCCS plans.

We do have other services available notincluded for an addition fee outside ofthis base price includingOMT/Manipulations, weight loss, adultimmunizations, and minor skin proce-dures. If additional visits are neededbefore the calendar year is up, these willbe at the cost of $25 each. We have animaging facility and a lab who haveagreed to provide discounts for ourpatients without insurance. Those wouldbe billed to you separately.

Exclusions of The Plan include chronicpain management, and any psyche diag-nosis other than mild depression or anxi-ety as determined by physician.

According to the National Highway Traffic Safety Administration 3% of Roadway crashes involve motorcyclists but 17% of roadway fatalities were motorcyclists. Statistically, another motorcyclist is the first to be on the scene of a motorcycle crash. The purpose of Accident Scene Management Bystander Assistance Programs is to reduce injuries and fatalities to motorcyclists through First Response Education.

100 series: Bystander Assistance Program “A Crash Course for the Motorcyclist”

This course is designed for the average motorcyclist. No prior training is necessary. “BAP” classes have made an impact on over 10,000 motorcyclists! Don’t miss your opportunity to learn the specifics of motorcycle trauma care. Rescuer Safety, Assessment & Treatment, Mechanisms of Injury, Good Samaritan Laws are all covered in this seven hour course. There are no other classes like it! A.B.A.T.E. of Arizona has lost anothergreat freedom fighter.

It is with a very heavy heart that I writethis letter to you all.

Robert Vasquez passed away on Jan.14th, 2012 after complications due tohealth problems. He passed away with hiswife Cheryl and his family by his side.Robert was a devoted husband, father,grandfather and freedom fighter.

Robert was an A.B.A.T.E. East ValleyChapter member and our Sgt. of Arms.Robert and Cheryl, his wife of 34 yearshave been very active in our chapter. Youmight not have heard Robert because hewas a quiet guy but he and Cheryl werealways in the background making sureeverything got done and went smoothly.They were always ready to volunteer forwhatever needed to be done at everyevent we had. From running a stop for

the Hard Ass Run to helping out at thespaghetti feed or helping with security,registration ormerchandise atToo Broke.Even if his bikewas down,Robert woulddrive his truckand haul every-thing we need-ed for an event.He was alwaysready to lend ahand to anyonewho needed it.He has been atrue asset to theEast ValleyChapter. Hewas truly a bigpart of our fam-ily

Robert was born in Colorado onSeptember 22nd, 1957. Robert and

Cheryl came tous from Oregonwhere theywere veryactive inA.B.A.T.E. ofOregon withtoy runs, campouts, poker runsand member-ship drives.They moved toArizona inApril of 2000.They joined theEast ValleyChapter whenthey came totheir first meet-ing and havebeen very

active with us ever since. I just can’t say

enough about Robert and Cheryl andwhat they have meant to all of us.

We are all blessed to have had Robertwith us if even for a relatively short time.I am honored to have known Robert andvery proud to call him my friend and mybrother.

Ride free Robert. We’ll all be up to seeyou someday.

Report Says Arizona Has Second-Worst Traffic-Safety Laws in the Nation

WASHINGTON - Arizona got a failinggrade Wednesday from a national high-way safety group that said the state hasadopted fewer than five of the 15 laws thegroup considers basic to traffic safety.

Only South Dakota ranked lower thanArizona in the ninth annual report fromthe Advocates for Highway and AutoSafety. It rated Arizona poorly for its fail-ure to adopt strict laws on teen driving,seat belt and motorcycle helmet use, anddistracted driving, among others.Arizona has "some of the weakest lawsand yet they're surrounded by states thathave better laws," said Jacqueline Gillan,the group's president. "This is really a callto action for Arizona to step up and startpassing these laws."

Her group said crashes killed more than700 people in Arizona in 2010, at a costestimated by state officials at $2.7 billion.

"It doesn't make sense when you look atthe economic cost and carnage on theArizona highways that they are stillignoring some really effective publichealth interventions that could reallybring down deaths and injuries and costsfor the state," Gillan said.

But state officials challenged the report,saying the laws it identified as crucial"aren't going to help us."

A report on the website of the Governor'sOffice of Highway Safety says trafficdeaths in Arizona of unrestrained vehicleoccupants, alcohol-impaired drivers,motorcyclists without helmets and teendrivers all fell from 2006 to 2009. This ina state that does not have the strict lawsfor enforcing seat-belt use, requiringmotorcycle helmets and restricting teendrivers that the highway safety group saysare needed.

"We are following what our indicators areand pushing to do safety programs to saveand prevent tragedies," said AlbertoGutier, director of the Governor's Officeof Highway Safety. "We don't have toconsult or react to anything the rest of thecountry does."

Gutier said traffic deaths across the nationhave fallen steadily in recent years. Thattrend is mirrored in Arizona, where thenumber of highway fatalities went from1,293 in 2006 to 807 in 2009, accordingto both the state and the NationalHighway Traffic Safety Administration.

The number fell again to 762 in Arizonain 2010, according to the Advocates forHighway and Auto Safety report.

Gutier and Gillan agreed that part of thedecline has been driven by the poor econ-omy, which made gas relatively moreexpensive and resulted in fewer driverson the road.

But Gutier said there are other factors,noting that Arizona was one of five statesto earn a five-star ranking from MothersAgainst Drunk Driving in a reportreleased in November. That ranking wasbased on drunken driving countermea-sures, such as ignition interlocks andsobriety checkpoints.

"Law enforcement has done a fantasticjob in Arizona," of enforcing laws alreadyon the books, Gutier said.

The report by Gillan's group did scoreArizona relatively well for its drunkendriving laws, noting that the state hadalmost all of the recommended restric-tions: a ban on open containers, a require-ment for ignition-interlock devices fordrunken drivers and stiffened penaltiesfor drunken drivers who endanger chil-

dren. The state only got half-credit for itslaw requiring blood-alcohol tests on driv-ers killed in crashes; the report prefersthat those tests also be required on driverswho survive crashes in which someone iskilled.

Gutier said his office plans to allocate themajority of its funding to preventing traf-fic fatalities.

"I'm questioning the whole ranking andthe whole report," he said.

Ray "Still Ray" Fitzgerald, chairman ofthe 7,000 members ArizonaConfederation of Motorcycle Clubs, saidit would be difficult for state lawmakersto require that all motorcyclists wear ahelmet, which the report would prefer.

Fitzgerald, a motorcyclist of more than 40years, said motorcycle-rights organiza-tions like his support a "pro-choice"stance on helmets. The Prescott residentsaid he wears a helmet when it snows.

"I'm not against wearing helmets, I'magainst being told that I have to,"Fitzgerald said.
