Dear Reader,Welcome to the second edition of “Preview”. Our fi rst edition was greatly received by you and it is our aim to again bring you an exclusive publication by the entire Eview Group of our current properties for sale and lease. The response out there was so positive and we appreciate your support and we will endeavour to be informative to you. We feel really proud to be embraced by the local community and we feel that offering a publication of highest standards is our way of saying thank you. A special thank you to all of those who entered the colouring competition from last month’s “Preview”. There were many great entrants.

Despite the negativity being portrayed by the media, last month was an incredible month for the Eview Group. There were plenty of sales and record prices being achieved amongst all agents, offi ces and areas. Potential sellers can be comforted in the fact that the clearance rate is on the rise and this can only mean good things for property owners and potential sellers. The Federal Reserve Bank of Australia kept interest rates on hold and there is talk of them potentially going down. Low interest rates are a great thing for property owners and it will give fi rst home owners and investors the confi dence to come back into the market place. These groups of buyers were the most noticeable of buyers last month for the Eview Group.

Australia is still experiencing great population growth in all states and our economy is positioned well for the benefi t of property prices in the coming years. Our economy is riding high on the back of the resources boom and Asia is very important to our future. Foreign ownership is on the rise and the Federal Governments changes in the laws and restrictions to foreign ownership can only have a positive impact on property prices in Australia.

Rental properties are also in high demand and across our offi ces we are constantly handing out rental lists. Vacancy rates are at all times lows of less than 1% and investing in a rental property is becoming more and more popular in Australia. There are plenty of good value properties available and with the current market conditions there has never been a better time to talk to us about investing in the local area or seeing if we can help you maximise the rental return of your investment property.

Position is still the biggest factor when buying a property and being positioned near to the beach and public transport are some of our areas greatest assets. At the Chelsea offi ce we always experience greater buyer activity in the warmer months and the area tends to attract more people coming down to experience our pristine beaches. Rossdale Golf Club, opened in June 1949, but the course itself dates back to the mid 1920’s and has twice hosted the Australian PGA Championship. In your search to improve your return on your investment dollar you may have heard of the concept of Negative Gearing. In this month’s issue of Property News we examine the concept and how it applies to investing in rental properties.A word of caution: negative gearing on investment property is not as straightforward as it appears, so do not for one moment consider our guide to be complete!We advise strongly that you seek advice from your accountant or fi nancial advisor before making any fi nal decisions.But to help you get started with your understanding of negative gearing we have put together a summary of the concept and how it may or may not help you when building your portfolio of investment properties.How does negative gearing apply to properties?A rental property is negatively geared if it is purchased with the assistance of borrowed funds, and the net rental income, after deducting other expenses, is less than your monthy repayments.What are the Tax savings?The overall taxation result of a negatively geared property is that a net rental loss arises. In this case, you may be able to claim a deduction for the full amount of rental expenses against your rental and other income, i.e. salary, wages or business income – when you complete your tax return for the relevant income year. In a nutshell negative gearing is a way of reducing tax by claiming investment losses.Negative Gearing decreases your overall tax liabilities.Let’s say that you receive a rental income on your

investment property of $2,000 per month. At the same time we deduct your expenses; interest on loan, maintenance council rates, etcwhich say totals $2,600. You are now left with a shortfall of $600 per month.The above example shows how an investment asset may be negatively geared.The net loss of $600 per month ($7,200 per annum) may be claimed as a tax deduction. Upon claiming this amount against your yearly income, and subject to your marginal tax rate, will determine the actual overall loss for the year. So just say you were paying 42c in the dollar on your income, the $7200 claim will theoretically only cost you $4176 out of pocket income.Again, this equates to a weekly income of approximately $80 which you will need to fi nd to support. So the question you may be asking, what’s the benefi t?Well, the assumption is that property increases at an approximate rate of 7% per year. Therefore if you had a property valued at $400,000 this would increase to $428,000; a net gain in wealth of $28,000 for the year. This certainly offsets the actual out of pocket costs of $4176! Again, we have not taken into consideration personal Tax positions and the above is purely an example of how it all works.How can you tell whether negative gearing is for you?Unfortunately, without knowing your circumstances we cannot give you a defi nitive answer.You would need the advice of your accountant or fi nancial advisor before heading down the negative gearing path. Like all investment decisions, it depends on your fi nancial situation, your goals and your timeframe.

For example, if you have no income, you’ll get no cash benefi t from a negatively geared property as there will be no tax deductions to claim. However, if you are a high income earner then you will get benefi t from having a refund come back to you, or having the expenses to claim some tax reduction.So what is a positively geared property? Many investors search high and low for ‘positively geared’ properties. Unlike negatively geared properties, these properties generate a surplus of income over and above the total expenses of a property in any fi nancial year. Many properties start off as negatively geared, and over a relative period of time, the rental income overtakes the expenses total, and thus surplus funds have been made. Astute property investors once they reach this stage venture out and purchase a second or third property, continuing to leverage the ‘gearing’ and relying on “capital growth” to increase their personal wealth position. Interestingly enough, approximately 10% of property investors only go on to purchase their second, third or more homes. The other 90% only hold the one investment property.Many books have been written on building property portfolios, and strategic purchases in key suburb areas with historic capital growth is often the most sought after acquisitions. Remember, everyone’s circumstances are different. There have been just as many positive reports as there have been adverse reports about negative gearing – in all matters think before you act!

With gardens at their best and the warmer weather just around the corner; Spring is always a peak selling period.

It goes without saying when people often ask ‘when is it the best time to sell’ you will almost say that 100% of the responses would select “Spring.”

Spring is a pretty up-beat time of year. Most sellers see this as an opportunity to showcase their property at its best, with fl ourishing & blooming gardens, extended daylight and warmer weather; buyers are more prepared to go house hunting. Also, many families look to match their purchase with the end of the school year and the lead up to Christmas and the New Year.

But is the market full of buyers? Reality is, the supply and demand cycle in any given season is relative to many factors. For example, Government incentives are a signifi cant factor in the number of fi rst-home buyers in the market place at any one time.

Other factors such as the unemployment rate, economic climate and interest rates all have a bearing on the property market. This year, we have seen a signifi cant softening of demand as a direct result of the international economic instability and interest rate hikes from the Reserve Bank. Recent reports of possible interest rate decreases by the end of the year may also restore confi dence in the consumer to take the plunge and enter the property market. An important factor also to consider are those entering the market to sell, in most cases are entering the market to buy! So in real estate talk, “the seller is the buyer, and the buyer is the seller!”

For those considering placing their property on the market, determine what your ‘destination’ plan is. Are you upgrading, downsizing, moving to a new area or freeing some tied up equity in an investment property? Whatever the reason, make sure that you have calculated your ‘changeover costs’ prior to selling. This will give you a great snapshot and budget of your fi nancial capacity to fulfi l your goals.

TIPS FOR RUNNING A SUCCESSFUL BUSINESSThere are many reasons why people start businesses - fl exibility, earning money, better lifestyle. Starting a business is the easy part, creating a successful business is more challenging.

It is so easy to get caught up in the day to day running of your business that you can often get lost and start to feel very overwhelmed and alone.

1. Know what you want to achieve - Having defi nite objectives will help you to work towards your goals. Break them down into smaller goals that you can achieve as you work towards your ultimate goals. It is much better than having everything going round in your head and being unsure whether you are actually achieving anything.

2. If you haven’t already you need to research your market - Keep abreast of what your competitors are doing. Also fi nd out about your customers. Who are they? What and why they purchase from you? This will help you to get more of the right type of customers.

3. Review and Improve - This is critical. On a regular basis you need to continuously review and monitor your progress and where you are. Monitoring the progress means that if something

isn’t working you can modify it immediately. This will help you to take your business to the next level.

4. Discard the myth that you can do it all yourself - you will pay a high price if you do. Get help from experts - use their knowledge to help you grow your business. Recruit a PR person, a bookkeeper, an admin person etc.

5. Balance your time - Plan your family and business time. Make a clear distinction between the two and avoid working in family time.

6. Get yourself a’ buddy’ - Surrounding yourself with other like-minded people is a must and so is getting yourself a’buddy’. Bounce ideas off and also get a “kick”from your buddy is essential.

7. Take time out for yourself - We often get lost in our businesses, especially when it is new so try and take time out for yourself on

a regular basis. Treat yourself to lunch with friends, get your hair/nails done, play golf, go shopping etc.

8. Believe in yourself - Every one of us has the ability to achieve our goals and dreams. So believe in yourself, believe that you can do it and with help and support from your friends and family this is

Hi it’s Lisa again from Lisa Davies & Associates Conveyancing. I had such an overwhelming response to my inaugural column in Preview, I would like to thank the people who emailed me at [email protected] with their questions about property law. This week’s topic I discus how the condition of a property is to be delivered to you at settlement. Everyone has different expectations as to levels of cleanliness and condition. Ultimately the contract you enter into with the Vendor sets out these rules.

Contract PromisesEntering into a standard form of contract to buy real estate sets a benchmark as to how a property is to be delivered to you on the settlement day. The contract states the property is to be delivered to you in the same condition it was on the day of sale. In most circumstances this is the day the Vendor accepts your offer to buy the property. This means if the property is neat and tidy on the day of sale then this is how it is to be delivered to you at settlement. If the property is a mess, with rubbish, holes in the wall, dirty fl oors and an unclean oven this is how the Vendor is to deliver the property to you. Many Purchasers feel the property must be delivered in a clean and tidy state. Unfortunately this is simply not the case. You need to remember a contract to buy real estate is not the same as a rental agreement where rental agreements in most circumstances requires the tenant to steam clean carpets and clean the home prior to vacating.

Before Settlement DayNo one likes to do the packing when moving house and in most instances mess is everywhere when you are getting ready to move. The Purchaser under the contract is entitled to inspect the property prior to the settlement to ensure the property is being delivered in the same condition it was at the time of entering the contract. This is where issues can arise especially when

furniture is moved and blemishes, holes in plaster and carpet stains can be more visible. If you notice these, contact your conveyancer. However be mindful the Vendor will most likely respond to say the damage was like that at the time of signing the contract. Unfortunately you will be the one to prove to say it wasn’t like that condition and this is where arguments can start. It is always good to make detailed notes about the property when you sign the contract to support any issues. Important Note: The Vendor is under no obligation to allow you back through the property after signing the contact with the exception of a fi nal inspection.

Fair Wear and TearThere are always exceptions and fair wear and tear is one of them. If an event such as an old fence falling over before the settlement was to occur, the Vendor would be under no obligation to repair it as they could argue the fence was in poor condition and the effect of the weather blew it over. Fair wear and tear does not cover accidental damage such moving bumps and grazes in walls and the Vendor should have these repaired. Ultimately when you are spending hundreds of thousands of dollars on a home you would hope the Vendor would do the right thing by ensuring the property is left in a clean and tidy state. However should something different occur you will need to rely on the contract and the rights and obligations it creates for both Vendor and Purchaser.

is urgent. If you request urgent repairs, the landlord or agent must respond without delay.

• If a repair is urgent and you are not getting a prompt response from your landlord or agent, you can authorise the repair for up to $1000.

• You can give your landlord or agent a notice asking that they pay you back for the cost of the urgent repairs. Your landlord or agent has 14 days to pay from the date they receive the notice.

• If the landlord or agent does not complete the urgent repairs and they are going to cost more than $1000, or you cannot afford to pay for them, you can apply to VCAT, which will hear the application within two (2) business days. VCAT can order the landlord or agent to arrange the repairs.

Founded in 1865, in LaTrobe Street, Melbourne, the Latrobe Street Ragged School and Mission was established for the ‘rescue of waifs and strays and the relief of the destitute poor.” Mr William Minton became the honorary superintendent in 1891 instituting many activities and services for children and their families. After ten name changes over the years the organisation is now known as Menzies. Inc.

In 1901 the organisation, then known as the Melbourne Ragged Boys Home under the direction of Mr William Minton moved to Oliver’s Hill on the Mornington Peninsula. On William Minton’s retirement in 1924 the name was changed to the Minton Boys Home and in 1943 there was a further name change to The Menzies Home for Boys to honour the work of the long time president, Mr James Menzies (father of Sir Robert Menzies).

Today Menzies Inc continues to provide a high standard of support for young people in need. Menzies Inc is a non-profi t organisation which provides a broad range of innovative programs and services designed to equip young people who can no longer live with their natural families with the life skills they need to lead independent, fulfi lled lives.

Home, residential care services provides full-time care and support to sixteen young people. There are four homes with four young people in each home. The homes are located in Frankston, Seaford and Mount Eliza. Menzies also specialises in caring for young people with disabili-ties, including autism. The children are referred to Menzies from the Department of Human Services and other local agencies.

To satisfy the growing need of youth issues in the Frankston and Mornington Peninsula region, Menzies purchased Sages Cottage Farm in 2003.

The programs provided to young people at Sages Cottage Farm include:

• Springboard Traineeship program offers Certifi cate II & III in Horticulture and Certifi cate II & III in Hospitality at Sages Cottage Café.

• Making Tracks Animal Assisted Therapy program encourages young people to form friendships at school and interact better with their families, which assist them in understanding pro-social behaviour.

• Enhanced Visitation Centre provides supervised access visits between parents and their children.

• Making Waves – Kids on Air encourages young people to voice their opinions on current issues on Community Radio 3RPP each Tuesday from 4-5 pm. All young people on the Peninsula are invited to participate.

The cost to run the Making Tracks Animal Assisted Therapy Program: $150,000 per year ($2,844 for one child to participate)

The cost to pay for other unfunded programs at Sages Cottage Farm is $200,000. These include volunteer management, community develop-ment programs, Sages Cottage Café, Community Kitchen Garden, animal care and maintenance.

Today, Menzies Inc is governed by a volunteer Committee of Management, supported by the Chief Executive Offi cer and an Executive Team of managers in fi ve departments. Menzies has 70 full and part-time employees and over 50 volunteers who work on the heritage listed Sages Cottage Farm. Corporate employees volunteer their time to assist in special projects on the Farm.

Members of the wider community are encouraged to become involved by:

• Making a donation

• Becoming a corporate partner

• Volunteering time and or services

• Leaving a gift in a Will

• Becoming an ambassador

• Hosting fundraising events and making a donation through Everyday Hero (online)

Current sources of income are:Government – 85.9%, Bequests, 0.2%, Grants and Trusts – 4.6 % and Community Support 9.3%.

The demand far exceeds the income. Menzies Inc can only thrive through the generosity of the community.

Ingredients:3 eggs185g softened butter½ cup caster sugar1 ½ cups Almond meal420g pear halves (canned – drained)1/3 Cup passionfruit pulp (optional)

Method:Pre heat oven to approximately 180°C

Lightly grease and line a 30cm x 20cm lamington tin

In a medium sized bowl blend the butter and sugar and mix until light and fl uffy

add the eggs one at a time, beating until all is combined then stir in the almond meal

Pour the mixture into the prepared tin and

top with the pear halves

Bake for approximately 45 minutes

Once out of the oven, let it rest for 10 minutes before removing from the tin

Once cooled pour over the passionfruit pulp (optional)

Your swimming pool fi lter sand is very rough when it’s new. This roughness is what makes the sand effi cient at fi ltering out the particles of dirt in your swimming pool water. The dirt particles are caught in the rough sand. As this roughness is smoothed out - as stones in a stream wear smooth over time - your swimming pools fi lter’s effi ciency goes down. This means that your fi ltration system has to run more frequently and for more hours to accomplish the same task. We recommend changing the sand at least every 4 to 5 years.

Leaving it longer between sand changes is not recommended as it increases the amount of sanitizer used and needing to increase fi ltration times. Having your sand changed regularly will prevent potential increased chemical costs and increased power usage and cost. Now is a great time to have your sand changed, before the seasonkick in.

The recent falls in the stock market, both here and overseas, are a timely reminder about the benefi ts of diversifi ed investment portfolio which includes property.

The last 20 years have shown that investment in Melbourne property has provided better returns than the stock market, a factor that will provide further comfort to property investors.

A recent study by Dr Ashton de Silva and Professor Gavin Wood published by RMIT University showed that, in addition to satisfying the basic need of accommodation, housing was also a very solid long-term investment.

Their study compared the typical rates of appreciation across 108 different segments and 500,000 sales between 1990 and 2010. This period of time includes the 1991 recession, Asian Financial Crisis, the 2001 recession and the recent Global Financial Crisis.

The outcome was compared to that gained from a balanced portfolio of Australian shares as measured by movements in the Australian All Ordinaries Index over the same time.

The study showed that that the quarter-on-quarter percentage increases for property was 1.6 per cent compared to 1.3 per cent for shares.

Not only were the returns greater but they were subjected to less volatility.

The study also found that in over 80 per cent of the market segments reviewed there was very little or no correlation between the share market and returns from the residential property market. This means that broadening an investment portfolio to include property is likely to provide not only stability to the outcomes but can also help to counter balance signifi cant shifts in the stock market.
