YEARLY REPORT

2016

RESPONSE TO RESISTANCE ANALYSIS

The review of the Response to Resistance forms submitted in the time period, January 2016

through December 2016, has been completed. Particular attention was given to any patterns

that might suggest problems with training, equipment, or policy of this Department. The first

section of this review contains a narrative synopsis or the data, followed by the second section

which contains the specific data in numerical form.

Note: Response to Resistance Analysis statistics reflect the data obtained from the Blue Team

software generated from less than lethal Response to Resistance incidents only. As always with

human data entry, there is a potential for human error such as, omissions or erroneous entries

within some of the submitted response to resistance reports. All parties involved entering/

approving BlueTeam data should exercise more diligence in accurately completing the response

to resistance incidents to ensure that future data more accurately reflects the actions of those

involved.

Authority

Memphis Police Department Policy and Procedure, Chapter 2, Section 8, Page 5, Section 3,

states:

All reported Response to Resistance Incidents will be reviewed by the Inspectional Services

Bureau. The Inspectional Services Bureau will be responsible for the maintenance of the original

Response to Resistance Forms, as well as the data generated by the forms. This review will

examine the following elements of the incident: (1.3.7)

Was department policy and procedure adhered to?

Is the applicable policy clearly understandable and effective in covering the incident?

Is current departmental response to resistance training adequate?

Is department equipment adequate?

Are there tactical issues that should be addressed in training?

An annual analysis of response to resistance incidents will be submitted from the Commander

of ISB to the Director of Police Services. This report will summarize the data extracted from

reported response to resistance incidents and include written recommendations regarding any

policy or training issues that need to be addressed by the department. All training issues

should also be forwarded to the Commander of the Training Academy for review. (1.3.13)

Synopsis:

As of January 5, 2016, the data reflects that of the 585 reported incidents, involving 1051

officers, the use of physical force exceeded all other types of response to resistance during the

noted time period. Data submitted also reflects that physical force was utilized predominately

to arrest suspects.

Data submitted revealed that the leading charge against suspects, where some level of force

was initiated, was resisting/ evading arrest. Of all reported incidents (585), 67% or 393 were

linked to suspects resisting/ evading arrest.

Data submitted also revealed that of reported correlating workstation arrests, workstations

reported responding to resistance an average of 0.78% of the time. The highest percentage was

at Mt. Moriah Station with .97% and the lowest percentage was at Airways Station with 0.59%.

Of all arrests reported by all departmental units, the Memphis Police Department responds to

resistance 0.81% of the time.

Summary:

Officers respond to resistance predominately to effect arrests. The primary type of

response to resistance used in reported incidents was the actual use of physical force. In 67% of

reported response to resistance incidents, suspects were charged with resisting/evading. This

reflects a 0% change compared to 2015. Suspects are arrested in 93% of response to resistance

incidents. Most of the arrests were for misdemeanor crimes.

There are no elements of departmental equipment issues that need to be addressed based on

this data. Present equipment appears to be adequate.

Recommendations:

The following are recommendations as to policy changes to ensure more accountable, efficient,

and accurate reporting of data:

1. Require in Response to Resistance policy that all members shall enter incidents into

BlueTeam and /or forward them by the end of their shift.

2. Discontinue use of hard copy Response to Resistance form and use BlueTeam

exclusively for Response to Resistance data.

a. This will reduce inefficiencies, confusion, and duplication of effort amongst

members.

b. This will also improve accountability in routing of incident information compared

to forms.

3. Consider allowing patrolmen to enter their own Response to Resistance incidents in

BlueTeam.

a. This will allow more accurate reporting and reduce the burden on first line

supervisor. The first line supervisor will no longer have to create the BlueTeam

incident. They will instead review them for accuracy.

b. This will allow each officer to write their, own first hand, account of what

happened during the response to resistance event.

c. This will require each officer to be trained. First line supervisors should be able

to train their officers. If not, ISB could provide training to personnel, if needed.

4. Update BlueTeam software to Version 5.

a. This update has native incidents for K9 and Show of Force.

i. K9 incidents can track/ segment K9 incidents and calculate bite ratios

ii. Show of Force incidents can document all pointed weapon incidents.

1. The incident type can be set to not alert officers and still be able

to obtain the data.

2. This eliminates the need for a separate Pulled/drawn weapon

form which introduces some of the same

inefficiencies/accountabilities issues seen with the response to

resistance form.

3. Considerations should be given to allow patrolmen enter this

information in BlueTeam as well.

Overview of 2017 Firearm Discharges

The following is intended to provide an overview of Firearm Discharge incidents in 2017. This is not intended to provide a detailed analysis, nor is it intended to convey a qualitative determination as to the lethal response to resistance.

1. FD2017-007 (Missed Suspect) On Sunday, April 23, 2017, at approximately 1:30 p.m.,

an off-duty officer was confronted by robbery suspects, after he exited the Mapco

convenience store located at 2185 Winchester Road. One suspect pointed a handgun at

the officer, ordered him against the building and demanded his keys and money. He

complied. The officer then fired one shot from his department-issued SIG ARMS P229

.40 caliber weapon at the armed suspect. The suspects then fled on foot behind the

business. The officer was not injured and his bullet struck a wooden fence and garbage

dumpster. JUSTIFIED.

2. FD2017-010 (Missed Suspect) On June 21, 2017, at approximately 11:23 p.m., an

officer, assigned to the North Main Station, witnessed an aggravated assault/carjacking in

progress at the Twins Food Mart located at 766 Jackson Avenue. While attempting to

affect an arrest, the officer was fired upon by the unknown suspects. The officer returned

fire. The unknown suspects dropped their weapons and fled the scene on foot. Additional

Officers were called into the area, but no arrests were made. Shooting JUSTIFIED;

however, administrative charges were issued related to use of BWC (SUSTAINED).

3. FD2017-015 (Critical Wounding) On September 9, 2017, at approximately 6:30 p.m.,

officers responded to the Advance Auto Parts at Rangeline and Frayser, regarding armed

parties in front of the business. Upon arrival, officers were advised the subjects had

crossed over to the Kroger Business complex in the 2600 block of Frayser. An officer

observed a male running north along the businesses and he pursued in his marked squad

car. Once at the rear open area, the officer pulled close to the suspect and the suspect

turned towards the officer in the front seat of his squad car armed with a handgun. The

officer fired two rounds from the front seat of his car at approx. 2 feet away. The suspect

was struck once and taken into custody. A loaded Jiminez .380 was recovered.

4. FD2017-016 (Missed Suspect) On Sunday, October 22, 2017, at approximately 2050hrs,

an officer was flagged down in the area of Shelby Drive and Crumpler, by a complainant

who advised someone stole his vehicle and fired shots at him. The complainant advised

he spotted his vehicle across the street at the Phillip 66 gas station. Officers put out a

broadcast and responded. Officers spotted the suspect vehicle at 6546 E. Shelby Drive

and one officer fired two shots from his duty issued MPD shotgun at the suspects. The

suspects fled and one was taken into custody, after a brief vehicle pursuit and crash.

There were no injuries. Shooting JUSTIFIED; however administrative charges were

issued for Neglect of Duty, Careless Handling, and Discharging Firearms. While in route

to the call, one of the officer’s ICV recorded him driving recklessly with one hand and

loading his shotgun with the other hand. Once on the scene, the officer pointed his

shotgun at a citizen, while ordering the citizen to leave the scene. After this officer fired

at the suspects, he picked up his shell casings got into his vehicle and joined in the

vehicle pursuit. He never advised the dispatcher that he had fired at the suspects.

RESPONSE TO RESISTANCE ANALYSIS

The review of the Response to Resistance forms submitted in the time period, January 2017

through December 2017, has been completed. Particular attention was given to any patterns

that might suggest problems with training, equipment, or policy of this Department. The first

section of this review contains a narrative synopsis or the data, followed by the second section

which contains the specific data in numerical form.

Note: Response to Resistance Analysis statistics reflect the data obtained from the Blue Team

software generated from less than lethal Response to Resistance incidents only. As always with

human data entry, there is a potential for human error such as, omissions or erroneous entries

within some of the submitted response to resistance reports. All parties involved entering/

approving BlueTeam data should exercise more diligence in accurately completing the response

to resistance incidents to ensure that future data more accurately reflects the actions of those

involved.

Authority

Memphis Police Department Policy and Procedure, Chapter 2, Section 8, Page 5, Section 3,

states:

All reported Response to Resistance Incidents will be reviewed by the Inspectional Services

Bureau. The Inspectional Services Bureau will be responsible for the maintenance of the original

Response to Resistance BlueTeam incidents, as well as the data generated by the incidents.

This review will examine the following elements of the incident: (1.3.7)

Was department policy and procedure adhered to?

Is the applicable policy clearly understandable and effective in covering the incident?

Is current departmental response to resistance training adequate?

Is department equipment adequate?

Are there tactical issues that should be addressed in training?

An annual analysis of response to resistance incidents will be submitted from the Commander

of ISB to the Director of Police Services. This report will summarize the data extracted from

reported response to resistance incidents and include written recommendations regarding any

policy or training issues that need to be addressed by the department. All training issues

should also be forwarded to the Commander of the Training Academy for review. (1.3.13)

Synopsis:

As of January 12, 2018, the data reflects that of the 758 reported incidents, involving 1045

officers, the use of physical force exceeded all other types of response to resistance during the

noted time period. Data submitted also reflects that physical force was utilized predominately

to arrest suspects.

Data submitted revealed that the leading charge against suspects, where some level of force

was initiated, was resisting/ evading arrest. Of all reported incidents (758), 63% or 498 were

linked to suspects resisting/ evading arrest.

Data submitted also revealed that of reported correlating workstation arrests, workstations

reported responding to resistance an average of 1.18% of the time. The highest percentage was

at Mt. Moriah Station with 1.89% and the lowest percentage was at Airways Station with

0.49%. Of all arrests (62,611) reported by all departmental units, the Memphis Police

Department responds to resistance 1.21% of the time.

Summary:

Officers respond to resistance predominately to effect arrests. The primary type of

response to resistance in reported incidents was the actual use of physical force. In 66% of

reported response to resistance incidents, suspects were charged with resisting/evading. This

reflects a 1% decrease compared to 2016. Suspects are arrested in 95% of response to

resistance incidents. Most of the arrests were for misdemeanor crimes.

There are no elements of departmental equipment issues that need to be addressed based on

this data. Present equipment appears to be adequate. However, in order to have accurate

reporting, all members of the department must do a better job of ensuring reports are

submitted in a timely fashion.

Recommendations:

There are no recommendations as to policy changes. However, management must ensure that

subordinates are submitting reports in a timely manner. Timely report submissions are required

for accurate reporting.

2017 LTL Response to Resistance Employee Race and Sex

As of January 18, 2018, data reflects that employees responded to resistance 843

times. In 773 of the responses, employees were male. In 73 of the responses,

employees were female.

Note: The above demographic data represents demographic breakdowns of suspects and employees in response

to resistance incidents that were completed and submitted only as of January 18, 2018. It does not include

data from incidents that are still in progress. Also, there could be some variances in the data due to

reporting methods utilized to July 8th, 2017. Prior to this date, the department was allowing multiple

Overview of 2018 Firearm Discharges

The following is intended to provide an overview of Firearm Discharge incidents in 2018. This is not intended to provide a detailed analysis, nor is it intended to convey a qualitative determination as to the lethal response to resistance.

1. FD2018-006 (Wounded) On Saturday, April 14, 2018, Raines Station officers responded

to an armed robbery of a business at 4675 S. Third. An officer observed the suspect’s

vehicle traveling east on Shelby Drive, while he was traveling west bound. The officer

conducted a traffic stop in the 4500 block of Millbranch. The suspect exited his black

Chrysler 300 and a physical struggle ensued. Thereafter, the suspect pointed a weapon at

the officer. The officer was able to push the suspect’s weapon away in a close combat

situation and fired three rounds from his duty issued Sig P229 striking the suspect twice,

once in each leg. MFD unit #9 made the scene and transported the suspect to Regional

One Hospital. The officer was not injured and there was no property damage. BWC was

activated and used during the incident; however the camera was knocked off Officer

Collins, during the struggle. Case FD2018-006 is active.

2. FD2018-007 (Fatal) On Saturday, April 21, 2018, officers at Tillman Station were

working several shootings / robberies in the Berclair area. Officers spotted a male that

matched the broadcasted suspect’s description walking towards Summer Ave. from

Berclair. A lieutenant advised over the radio that he was pulling up behind the male. The

male noticed the police behind him and took off running. The lieutenant attempted to run

after the male and the male fell to the ground. The lieutenant gave verbal commands to

the male to stay down and show his hands. As the male lay on the ground in a fetal

position refusing to show his hands, he made threats to the lieutenant. The male then

suddenly moved (as if pulling a weapon). The lieutenant then fired his duty issued

handgun striking the male. MFD Unit #5 made the scene and transported the suspect to

ROH, where he was pronounced DOA. The entire incident was recorded by body worn

cameras. TBI handled the investigation. Case FD2018-007 is JUSTIFIED.

3. FD2018-009 (Wounded) On Tuesday, May 8, 2018, a Tillman Station officer was

driving in the 1400 block of Depass, when a four door Hyundai passed him. The vehicle

did not have a rear bumper and was occupied by three males. The officer attempted to

conduct a traffic stop on the vehicle. The driver of the Hyundai pulled into a driveway

and a rear male passenger immediately exited the vehicle, with a weapon in his hand and

ran from the scene. The officer gave chase and verbal commands to the suspect. The

suspect stumbled on the loose gravel and fell to the ground. The officer caught up to the

suspect and a struggle ensued. The officer continued to order the suspect to drop the

weapon, during the struggle. The suspect broke away from the officer and began to run

towards the backyard, still armed with the handgun. As the officer started to go after the

suspect, the suspect turned towards the officer and the officer fired his duty weapon at the

suspect. The suspect then continued to run from the officer. It was unknown if the

suspect was hit or not. Additional officers found and followed a blood trail that lead to a

residence on Saleem. Officers entered the residence and located the suspect. The suspect

was taken into custody and transported to ROH in non-critical condition by MFD Unit

#5. The suspect’s weapon was recovered. The other occupants of the vehicle were also

taken into custody for another weapon and drugs found in the vehicle. Case FD2018-009

is JUSTIFIED.

4. FD2018-011 (Fatal) On Wednesday, July 25, 2018, Raines Station officers conducted a

traffic stop at Mitchell and S. Third. The driver produced a handgun and officers began to

back away from the vehicle. Officers heard a shot and they fired their duty issued

weapons striking the driver. The driver was transported to ROH by MFD where he was

pronounced DOA. The incident was captured on BWC. TBI was notified and handled

the investigation. Case FD2018-011 is JUSTIFIED.

5. FD2018-013 (Missed) On Wednesday, August 22, 2018, at approximately 1430 hours,

Raines Station officers were dispatched to an Auto Theft call at 4096 Elvis Presley.

While on the scene, they were advised of a domestic violence incident that was occurring

on the same parking lot. Officers engaged the suspect and the suspect refused to comply

with commands and attempted to flee. While running from officers, the suspect

brandished a weapon causing one officer to fire two shots from his duty issued Sig P229.

The rounds missed the suspect and he was taken into custody without further incident.

The suspect was seen throwing something into a trash can at 4097 Elvis Presley. Officers

recovered a black and gray handgun from the trash can. The weapon appeared to be a

Memphis Police Department weapon with altered serial numbers. There were no injuries

to the suspect or officers. Case FD2018-013 is JUSTIFIED.

6. FD2018-014 (Missed) On Thursday, August 23, 2018, at approximately 0310 hours,

Organized Crime Unit officers were conducting an undercover operation in the area of

2588 Young Street when a male exited that residence and fired multiple shots at the

officers. Neither of the officers was injured by the suspect’s rounds, but their OCU

vehicle was struck by a round. One of the officers returned fire at the suspect, using his

duty issued Sig P229. The suspect retreated and the officers left the scene to assess

whether or not there were any injuries to them or damage to their vehicles. The suspect

was later taken into custody without any further incident. The suspect was not injured. A

weapon was later recovered in the backyard area of 2588 Young Street. Case FD2018-

014 is JUSTIFIED; however administrative charges were issued related to “Notification

Procedures When Weapons Are Fired” (SUSTAINED).

7. FD2018-018 (Wounded) On Monday, September 17, 2018, at approximately 1830

hours, Airways Station Task Force officers conducted a traffic stop on a red Malibu,

driven by a suspect in the area of Pillow and Gill. The suspect fled the scene in the car

and a pursuit ensued. The suspect ultimately bailed from the Malibu in front of 1268 Gill.

An officer was involved in a brief foot pursuit, while the suspect ran towards the front

door of residence. The officer fired several rounds from his duty issued Sig Sauer P229

striking the suspect multiple times. The suspect was transported by MFD #3 in critical

condition. A handgun was recovered by responding officers inside the front door of 1268

Gill. No officers were injured. The case was picked up by TBI on September 18, 2018.

TBI handled the investigation. On February 15, 2019, the officer resigned from the

Memphis Police Department. Case FD2018-018 is HELD IN ABEYANCE).

8. FD2018-021 (Missed) On November 1, 2018, members of the Organized Crime Unit

(OCU) and the Criminal Apprehension Team (CAT) established surveillance on a suspect

and observed five drug transactions in the area of the Red Oaks apartments. OCU

detectives requested additional assistance from the Criminal Apprehension Team to

initiate a traffic stop on a 2012 grey Chevy Malibu occupied by the suspect at Mimosa

and Carpenter. Two marked CAT police units drove west on Mimosa near Carpenter and

pulled in front of the Malibu. The suspect then accelerated backwards, striking an

unmarked vehicle and fled east on Mimosa. An officer discharged his duty weapon three

times at the suspect’s vehicle. The suspect’s vehicle was later located at Walnut Grove

and Tillman, involved in a two-car crash with several bullet defects on the driver side

door. The suspect fled on foot in an unknown direction. The Chevy Malibu was towed to

the City Impound lot and placed on hold for the Homicide Bureau. The encounter was

captured on a Sky Cop surveillance camera. Case FD2018-021 is NOT JUSTIFIED.

9. FD2018-023 (Fatal) On Thursday, December 13, 2018, at approximately 2158 hours,

Old Allen Station Officers responded to reports of an armed party, waving a handgun at

passing motorists on James Rd near Austin Peay. An officer responded to the scene and

immediately upon exiting his squad car encountered the suspect and gave verbal

commands. The officer fired shots from his duty issued Sig Sauer P229 .40 caliber

striking the suspect. The suspect was transported to ROH by MFD and pronounced dead.

TBI was notified immediately and the scene was secured and held for their arrival. BWC

/ ICV were activated and recorded the incident. TBI handled the investigation. Case

FD2018-023 is active.

RESPONSE TO RESISTANCE ANALYSIS

The review of the Response to Resistance forms submitted in the time period, January 2018

through December 2018, has been completed. Particular attention was given to any patterns

that might suggest problems with training, equipment, or policy of this Department. The first

section of this review contains a narrative synopsis or the data, followed by the second section

which contains the specific data in numerical form.

Note: Response to Resistance Analysis statistics reflect the data obtained from less than lethal

Response to Resistance incidents only. As always with human data entry, there is a potential for

human error such as, omissions or erroneous entries within some of the submitted response to

resistance reports. All parties involved should exercise more diligence in accurately completing

the response to resistance incidents to ensure that future data more accurately reflects the

actions of those involved.

Authority

Memphis Police Department Policy and Procedure, Chapter 2, Section 8, Page 5, Section 3,

states:

All reported Response to Resistance Incidents will be reviewed by the Inspectional Services

Bureau. The Inspectional Services Bureau will be responsible for the maintenance of the original

Response to Resistance BlueTeam incidents, as well as the data generated by the incidents.

This review will examine the following elements of the incident: (1.3.7)

Was department policy and procedure adhered to?

Is the applicable policy clearly understandable and effective in covering the incident?

Is current departmental response to resistance training adequate?

Is department equipment adequate?

Are there tactical issues that should be addressed in training?

An annual analysis of response to resistance incidents will be submitted from the Commander

of ISB to the Director of Police Services. This report will summarize the data extracted from

reported response to resistance incidents and include written recommendations regarding any

policy or training issues that need to be addressed by the department. All training issues

should also be forwarded to the Commander of the Training Academy for review. (1.3.13)

Synopsis:

As of January 13, 2019, the data reflects that of the 972 reported incidents, involving 978

officers, the use of physical force exceeded all other types of response to resistance during the

noted time period. Data submitted also reflects that physical force was utilized predominately

to arrest suspects.

Data submitted revealed that the leading charge against suspects, where some level of force

was initiated, was resisting/ evading arrest. Of all reported incidents (972), 65% or 629 were

linked to suspects resisting/ evading arrest.

Data submitted also revealed that of reported correlating uniform patrol workstation arrests,

uniform patrol workstations reported responding to resistance an average of 1.18% of the time.

The highest percentage was at Mt. Moriah Station with 2.24% and the lowest percentage was

at Raines Station with 1.11%. Of all arrests (62,654) reported by all departmental units, the

Memphis Police Department uniform patrol officers responds to resistance 1.52% of the time.

Summary:

Officers respond to resistance predominately to effect arrests. The primary type of

response to resistance in reported incidents was the actual use of physical force. In 61% of

reported response to resistance incidents, suspects were charged with resisting/evading. This

reflects a 5% decrease compared to 2017. Suspects are arrested in 95% of response to

resistance incidents. Most of the arrests were for misdemeanor crimes.

There are no elements of departmental equipment issues that need to be addressed based on

this data. Present equipment appears to be adequate. However, in order to have accurate

reporting, all members of the department must do a better job of ensuring reports are

submitted in a timely fashion.

Recommendations:

There are no recommendations as to policy changes. However, management must ensure that

subordinates are submitting reports in a timely manner. Timely report submissions are required

for accurate reporting. Additional data entry training is recommended for field units to improve

reporting accuracy and efficiency.

Overview of 2019 Firearm Discharges

The following is intended to provide an overview of Suspect Firearm Discharge incidents in 2019. This is not intended to provide a detailed analysis, nor is it intended to convey a qualitative determination as to lethal firearm discharge related response to resistance.

1. FD2019-001 (Fatal) On January 2, 2019, Raines Station officers received a DV

disturbance call to 1317 Timothy at approx. 2010 hours and arrived on scene at 2021

hours. As officers arrived they observed a male in front of the residence armed with a

knife. The male charged at officers and officers fired at the suspect with their duty issued

Sig P229 .40 caliber weapons, fatally wounding the suspect. TBI has completed their

investigation and it has been review by the District Attorney General’s office who

advised there would not be any charges filed against officers. Case FD2019-001 is

JUSTIFIED.

2. FD2019-005 (Off Duty Fatal) On Tuesday, February 19, 2019, an off duty officer was

involved in a disturbance in Horn Lake MS. The officer was traveling westbound on

Goodman Road in Horn Lake MS when he realized he was being followed by a Chevy

Sonic. After several minutes of being followed, the officer pulled into the parking lot of

the Walgreen’s located at 4028 Goodman Road. The officer parked in a designated

parking spot, and citizen stopped his car directly behind the officer’s car, blocking it

in. Both men exited their vehicles and an argument ensued. At some point during the

argument, the citizen stabbed the officer in the neck with a knife. The officer responded

by pulling a Springfield XP-9, serial #S3795246, and firing it several times; fatally

wounding the citizen. After firing his weapon, the officer walked into Walgreen’s and

called 911 from his cell phone. The Horn Lake Police and Fire Departments

responded. The citizen was pronounced deceased on the scene. The officer was

transported in critical condition by Horn Lake Fire Department Unit 3 to Regional One

Hospital in Memphis, TN; where he went into surgery shortly after arrival. On

Wednesday, February 20, 2019, the officer was released from Regional One.

On Thursday, February 21, 2019, the officer submitted to a mandatory drug screen at

Mid-South Drug Testing. He subsequently tested positive and was served with a

Statement of Charges. On March 11, 2019, the officer resigned from the Memphis

Police Department, prior to the hearing regarding his statement of charges. Case

FD2019-005 is HELD IN ABEYANCE.

3. FD2019-015 (Missed) On July 2, 2019, an officer responded to a suspicious vehicle call

to 2675 Getwell. He observed a vehicle parked at the gas pump. The driver appeared to

be asleep. He woke the driver and attempted to get identification from the driver. The

driver started the vehicle and drove off, dragging the officer alongside the vehicle. The

officer pulled his duty weapon, fired one shot, but missed the driver. Case FD2019-015

is JUSTIFIED.

4. FD2019-019 (Missed) On September 6, 2019 at 0420 hours, an officer responded to a

stolen vehicle call to 1243 Lamar on the parking lot of the convenience store. As the

officer approached the vehicle from the front, the driver gunned the engine and headed

straight for the officer. As the officer dove out of the path of the speeding vehicle, he

fired one shot from his duty weapon. The round stuck the vehicle, but missed the driver.

The driver jumped from the vehicle and ran, but was apprehended after a short foot

pursuit. No officers, civilians nor the suspect were injured during this incident. Case

FD2019-019 is JUSTIFIED.

5. FD2019-020 (Fatal) On September 18, 2019, MGU and Shelby County FAT were

serving an arrest warrant at 1230 Haven Circle North. The officers and deputies had

received information that the suspect was in the residence hiding in a secret room behind

a bookcase. They called for MPD canine to attempt to locate the suspect. The canine

unit did hit on a small bookcase in a small front room. As SCS deputies were attempting

to move the bookcase, the suspect opened fire on them. The deputies along with a MPD

officer returned fire fatally wounding the suspect. One Shelby County deputy was hit by

the suspect’s fire and transported critical to ROH. TBI investigation is still underway.

Case FD2019-020 is active.

6. FD2019-025 (Missed) On December 2, 2019, Mt. Moriah officers responded to a

suspicious persons call to 4760 Showcase Blvd. (Fairfield Inn). Upon arrival, they began

checking the parking lot and located a stolen vehicle. The hotel clerk advised officers

that the individuals that got out of the vehicle were inside the hotel on the second floor.

As officers began to check the second floor, they were spotted by the suspects. The

suspects then ran from officers back to the parking lot. Officers gave chase and the

suspects got into a silver Toyota. The officers attempted to detain the suspects at

gunpoint. The driver of the vehicle accelerated from the parking spot causing two

officers to fire their weapons at the vehicle. The officers were not injured and one

suspect was taken into custody. The officer was found to be in violation of DR-101

Compliance with Regulations to wit: Use of Deadly Force. Case FD2019-025 is NOT

JUSTIFIED.

7. FD2019-026 (Fatal) On December 26, 2019, officers responded to a prowler call at 3642

Hallbrook. Officers cleared the prowler call and observed two males involved in a

physical altercation in front of their location. One male was holding a gun in one hand

and striking a male with a club which was in his other hand. Officers gave several loud

verbal commands for the male to drop his weapons, but he refused. Civilian witnesses

observed the suspect raise his handgun and point it at officers. Officers fired their duty

weapons, fatally wounding the male. The officers were not injured. Case FD2019-026 is

active.

8. FD2019-027 (Fatal) On December 31, 2019, officers responded to a

Robbery/Kidnapping complainant in the area of Avalon and Court. There was a male

victim, forced at gunpoint, into the trunk of a White 4 door Nissan Maxima with temp

tags. Officers located the vehicle in the area of Avalon and Madison. Officers activated

their emergency equipment in an attempt to stop the vehicle, but the driver refused to

stop. Officers pursued the suspects until they exited at Mound City Road, West Memphis,

AR (exit 281) and came back east bound on I-40. The Arkansas Highway Patrol joined

the pursuit and performed a pit maneuver near the Weigh Station. The passenger of the

vehicle fled the scene on foot and was pursued by officers. Officers saw what appeared to

be a weapon in the suspects hand and gave loud voice commands for him to drop it, but

he refused. Officers fired rounds from their duty weapons, fatally wounding the male.

There were no reported injuries to the officers. Case FD2019-027 is active.

RESPONSE TO RESISTANCE ANALYSIS

The review of the Response to Resistance (RTR) reports submitted in the time period, January

2019 through December 2019, has been completed. Particular attention was given to any

patterns that might suggest problems with training, equipment, or policy of this Department.

The first section of this review contains a narrative synopsis or the data, followed by the second

section which contains the specific data in numerical form.

Note: Response to Resistance Analysis statistics reflect the data obtained primarily from less

than lethal (LTL) Response to Resistance incidents. As always with human data entry, there is a

potential for human error such as, omissions or erroneous entries within some of the submitted

response to resistance reports. All parties involved should exercise more diligence in accurately

completing the response to resistance incidents to ensure that future data more accurately

reflects the actions of those involved.

Authority

Memphis Police Department Policy and Procedure, Chapter 2, Section 8, Page 5, Section 3,

states:

All reported Response to Resistance Incidents will be reviewed by the Inspectional Services

Bureau. The Inspectional Services Bureau will be responsible for the maintenance of the original

Response to Resistance BlueTeam incidents, as well as the data generated by the incidents.

This review will examine the following elements of the incident: (1.3.7)

Was department policy and procedure adhered to?

Is the applicable policy clearly understandable and effective in covering the incident?

Is current departmental response to resistance training adequate?

Is department equipment adequate?

Are there tactical issues that should be addressed in training?

An annual analysis of response to resistance incidents will be submitted from the Commander

of ISB to the Director of Police Services. This report will summarize the data extracted from

reported response to resistance incidents and include written recommendations regarding any

policy or training issues that need to be addressed by the department. All training issues

should also be forwarded to the Commander of the Training Academy for review. (1.3.13)

Synopsis:

In 2019, the officers of the Memphis Police Department responded to 884 incidents requiring

the application of some level of force. Our response to resistance incidents decreased 9.05%

from 2018. Data reflects that, the use of physical force exceeded all other types of response to

resistance during the noted time period. Data submitted also reflects that force was utilized

predominately to arrest suspects.

The most common service performed that lead to force was arresting suspects. Data submitted

revealed that the leading charge against suspects, where some level of force was initiated, was

resisting/ evading arrest. Of all reported incidents (885), 69% or 609 were linked to suspects

resisting arrest.

Total arrests associated with some level of force decreased by 8.86% from 2018. Data

submitted revealed that of all arrests (57,000) reported by all departmental units, the Memphis

Police Department responds to resistance 1.55% of the time. The workstation with the highest

percentage was Mt. Moriah Station with 1.99% and the workstation with the lowest percentage

was Tillman Station with .080%.

Summary:

Officers respond to resistance predominately to effect arrests. The primary type of

response to resistance in reported incidents was the actual use of physical force. In 62% of

reported response to resistance incidents, suspects were charged with resisting/evading. This

reflects a 1% increase compared to 2018. Suspects were arrested in 95% of the response to

resistance incidents. Most of the arrests were for misdemeanor crimes.

There are no elements of departmental equipment issues that need to be addressed based on

this data. Present equipment appears to be adequate. However, in order to have accurate

reporting, all members of the department must do a better job of ensuring reports are

submitted in a timely fashion.

Recommendations:

There are no recommendations as to policy changes. However, management must ensure that

subordinates are submitting reports in a timely manner. Timely report submissions are required

for accurate reporting. We are continually looking for ways to improve our reporting and with

new employees and software upgrades; additional data entry training is recommended for field

units to improve reporting accuracy and efficiency.
