Motion to Enter into Public Hearing
Mr. Gartz: Number six is the mo�on for public hearing for the adjustment of 2017-2018 Connec�on Fee. Mr. Gatto: Move that. Mr. Johnson: Second. Mr. Gartz: Do I need a roll call, or do I just turn it over to you? Mr. Mehr: You can do roll- well, don’t, just [inaudible]. Mr. Gartz: All in favor. All Commissioners: Aye. Mr. Gartz: Alright. Presentation of Evidence
Mr. Mehr: Okay, uh, you are all aware at this meet- again, the first part of the mee�ng’s dedicated to substan�a�on of proposed Connec�on Fees for upcoming year. Normally what we do is we mark into evidence all the preliminary stuff that we have to, uh, [inaudible] group over there, uh, which will be filed and kept with the cer�fied copy of this mee�ng, which will be done now off of tape, uh, [inaudible].
Exhibit number one (1) is an affidavit cer�fying for publica�on of the hearing no�ce and the advert for press published June the 9 th , 2017. Exhibit two (2) is an affidavit cer�fying the publica�on of the hearing that was in Star-Ledger, published again the same date, June 9 th , 2017. Exhibit three (3) is cer�fied le�ers no�fying members of the municipali�es of the public hearing, dated June 12 th , 2017. Uh, exhibit four (4) is Mo� MacDonald’s 2016 cer�fied wastewater flow le�er, dated as of February 3 rd , 2017. Exhibit five (5) is MRRSA’s memorandum to Holman Frenia Allison PC detailing the calcula�on of the 2017-2018 Connec�on Fee dated June the 5 th , 2017.

Those are all of the exhibits and, uh, we will mark them into evidence, and we’ll have them tes�fied to by the audience who are here. Uh, we have two witnesses here tonight. One’s Brian Brach, obviously, as Execu�ve Director of the Authority, and the second is Peter Kocsik from Mo� MacDonald. [inaudible] and so I’d like to start with, um, Mr. Kocsik, and he needs to be sworn please. [inaudible]
Do you swear to tell the truth, the whole truth, and nothing but the truth, so help you, God? Mr. Kocsik: I do. Mr. Mehr: Okay. Please sit, state your name, and your affilia�on for the record. Peter Kocsik: Peter Kocsik. It’s K-O-C-S-I-K. I’m Senior Vice President with Mo� MacDonald and the Ac�ng
Authority Engineer for the Manasquan River Regional Sewerage Authority. Mr. Mehr: The-the- One of the exhibits that was marked was exhibit four, the Mo� MacDonald 2016
cer�fied wastewater flow le�er, dated February 3 rd , 2017. Was that either prepared by you or under your supervision?
Mr. Kocsik: Uh, yes. It was prepared under my supervision, um, and it pre�y much summarizes the, uh, the
flow data for the year 2016. Um, the Authority measures, uh, wastewater flow from the five towns that make up the Authority. The metering system consists of fi�een (15) loca�ons. Ten (10) of the flowmeters are owned and operated by the Authority, and five are owned and operated by the Ocean County U�li�es Authority. Uh, this February third le�er presents a summary of the total flow from each of the five (5) towns, uh, of the fi�een (15) flowmeter loca�ons.
For the year 2016, the total flow from all five towns was 2 billion, 223 million, 539 thousand (2,223,539,000) gallons of wastewater. This equates to an annual average daily flow of 6.091 million gallons per day. Approximately 99.7 percent of all the flow, um, goes through the MRRSA system to OCUA, and the other 0.3 percent discharges to the Brick Township MUA. Uh, the total flow that went to Brick Township MUA was 7 million, 209 thousand (7,209,000) gallons, and that comes from a por�on of Wall Township. That flow, which flows to Brick Township, is not part of the Connec�on Fee calcula�on for tonight’s hearing.
Mr. Mehr: Was there anything else that you wanted to add to the report? Mr. Kocsik: Um, no, that’s- that’s basically it. I will say that the flows in 2016, um, was the lowest flow total in
20 years. Um, weather is a big factor with wastewater flows. Uh, last year was a- a somewhat dry year. There were some drought warnings in effect for part of the year, but the flow totals, um, it’s hard to explain or ra�onalize, but they were lower than 1996, actually, with all the development that has taken place. Um, but it’s- the data comes from OCUA is basically what they’ve cer�fied too, and that’s our total flow.
Mr. Mehr: Now, the calcula�ons that you made, are they in accordance with the statute regards to-
regarding what’s necessary confirming sewage flow? Mr. Kocsik: Yes, they are. Mr. Mehr: Uh, um, next, uh, is the le�er sent- actually, a memorandum, from Brian (Brach) to HFA
Associates. Brian, that was the one we marked, that is exhibit number five (5). Uh, would you please explain to the Board what that included and [inaudible]?

Mr. Brach: Okay, so the memorandum that I had sent to Holman, Frenia, and Allison, I also sent to the Board
in a July 14 th memo a�ached to the mee�ng agenda, and the memorandum just explains the five (5) components that make up the calcula�on for the Connec�on Fee, and this is a statutory calcula�on. Um, the first component is the- is determining the average daily flow for the- the wastewater system in 2016. As Pete tes�fied to, um, we had an average daily wastewater flow of 6.091 million gallons per day. Uh, the second component of the calcula�on is taking the total flow and determining how many equivalent units we have. The Authority’s equivalent dwelling unit calcula�on is one EDU for every 300 gallons a day. So, if you take the total flow of 6.091 million gallons per day, divide it by 300 gallons per day per EDU, you get 20,303.33 equivalent dwelling units. That’s how many units we have in our system as per this calcula�on.
The third step is determining what the debt service was prior to January 1 st , 2016, and, uh, this
was taken from the Connec�on Fee hearing last year. Prior to January 1 st of 2016, the Authority had accumulated $42,856,978.06 in, uh, capital expenditures and debt service over the prior years.
The fourth component of calcula�on takes that prior debt service and adds what we spent in
capital outlay and debt service for 2016. So in the calendar year 2016, the Authority spent, or had, $1,168,939 in both capital outlays and debt service expenditures.
So, the final component kind of �es everything together. We take the total debt service and capital outlays that we’ve had to-date from the Authority, and that’s a total of $44,025,917.06. Divide that by the number of EDUs that we calculated, which was 22,303.33 EDUs, and you come up with a Connec�on Fee of $2,168.41 per equivalent dwelling unit. As is prac�ce with the Authority, we round that number to the nearest dollar, so for 2017-2018, the calcula�on, uh, substan�ates a Connec�on Fee of $2,168.00 per equivalent dwelling unit.
Mr. Mehr: How does that compare with the current? Mr. Brach: It’s actually an increase of $135.00 from the current Connec�on Fee. Mr. Mehr: Uh, now you-you sent that to HFA for them to verify the methods and calcula�ons, correct? Mr. Brach: Correct. Mr. Mehr: And you received a le�er back from them dated June the 20 th , 2017, and that- what did that le�er
indicate? Mr. Brach: The le�er basically indicated that, um, the calcula�on that I had submi�ed was correct and, uh,
being the auditor for the Authority, Fred Holman reviewed it, and he confirmed that that is the correct calcula�on.
Mr. Mehr: Uh, do you- do you a�ribute, based upon what Peter said and what your-your- your knowledge is
of such as to why there is such a difference in the- in the resul�ng, uh, Connec�on Fee from last year over the prior year?
Mr. Brach: Yeah, correct. It has to do with an inverse rela�onship between flow and Connec�on Fee, so less
flow, typically has a higher Connec�on Fee, on top of the fact that the Authority spent some money in capital outlays as well on top of that, so we had more debt service, um, more capital outlays, lower flows. That resulted in a higher Connec�on Fee.

Mr. Mehr: Okay. So, now the new rate, the $2,168.00, when will that go into effect?
Mr. Brach: That new rate goes into effect as of tomorrow, July 20 th , 2017.
Mr. Mehr: Uh, we actually don’t have any- any approvals tonight, do we?
Mr. Brach: No. We don’t have any approvals tonight.
Mr. Mehr: So, so we don’t have to worry about whether they apply or not.
Mr. Brach: Correct.

Enclosed is a copy of the Notice of Public Hearing to consider and take formal action and adoption of
fees to be collected from Applicants desiring connection to the Authority's system, as well as other
miscellaneous fees, as deemed appropriate by the Authority's Board of Commissioners.
The Public Hearing is scheduled for Wednesday, July 19, 2017 at 5:30pm at the Authority's
Headquarters located at 89 Havens Bridge Road, Farmingdale, New Jersey 07727. The regularly
scheduled Public Meeting will immediately follow the hearing.

2016 Certified Wastewater Flows

Dear Mr. Brach:
As requested by the Authority, Mott MacDonald has reviewed the flow metering records for 2016 and prepared this Certified Wastewater Flow Report. The final flow records are based upon our review of certified flow data received from the Ocean County Utilities Authority (OCUA), as well as our review of final flow data from ten (10) MRRSA flow meter stations. The results of our review are presented on theenclosed graphical summary sheets for each member municipality. The 2016 FinalFlow report presents a monthly comparison of flows from 2014 to 2016 bymunicipality, as well as the results of the estimated total flow versus the Actual finalflow for 2016.
The total metered flow from January 2016 through December 2016 was 2,223.539 MG (excluding meter 8MC-1), which is the lowest since 2002 or in the past 15 years. The annual flow is 248.461 MG below the estimated flow of 2,472.000 MG or 10.1% below anticipated. The fourth quarter of 2016 was by itself 95 MG below the historical average for the same time period or approximately 1 million gallons per day.
Based upon the certified flow data from OCUA and using the internal MRRSA flow data, below is the summary of the total flow for each member municipality for 2016:

As noted above, 2016 appears to be a very abnormal year in regard to wastewater
flow. In year 2016, the Authority's service area experienced below average (41.13") rainfall conditions. The National Oceanic and Atmospheric Administration's (NOAA) National Climatic Data Center reports that 2016 was the 40st driest period in 121-years of collected data. The final wastewater flow totals were tower than projected

and the total flow for 2016 was approximately 85 MG less or 3.68% lower than the wastewater flow recorded for 2015.
It is difficult to rationalize the extreme low flows recorded in 2016, although we have a few observations. The flow from Nestle's in Freehold Borough has dropped 36
MG per year since 2014 and seems to be at its lowest in at least 5 years at only 123.8 MG for 2016. Further it does appear that a very dry period in October and November contributed greatly to the lower flow as confirmed by drought condition
alerts issued by the State late last year. Although December was more normal, flow patterns have not returned to their historical trends.
It is also important to note that during our review of MR RSA flow data we noticed an
inconsistency with Meter 2MC2. Starting in July the data received from 2MC-2 was steadily decreasing through the end of the year and showed a historical low in
these months. We note that on August 11th the Authority reset the transducer to fix a problem however the data did not correct itself. Historically this meter averages 0.6 MGD with a low flow of 0.2 MGD but the data showed approximately 5-6 hours a day with zero flow conveyance. Due to these errors in the totalizer, we have
discarded the data from 2MC2 for six months or for July through December. We have calculated a flow for this time period using the past 3-year averages for each respective month and then each average was multiplied by the annual percentage drop for each year in overall flows from OCUA to following the trending decrease in total flow. The result was that 2MC2 was approximately 3 MG or 3% less than 2015 consistent with the overall system drop of 3.68%.
In summary, the flow data from OCUA does establish the Authority's overall annual sewer bill and sets the total flow for MRRSA at 2,223.539 for 2016.

The calculation of the Authority's 2016/2017 com1ection fee rate is detailed below and has been provided
to document revision to the Authority's current rate of $1,900.00. The Authority requests that you please
review and respond in writing by Friday, June 24n, as to the accuracy of the calculation .

1 attested to. Which was 6.324 million gallons per
2 day. That's what flowed though our system.
3 Component number two, is taking the
4 total flow, dividing it by the number of
5 equivalent dwelling units. The Authority accounts
6 for equivalent dwelling units as 300 gallons per
7 day. So using that calculation, there were 21,080
8 equivalent dwelling units in our system last year.
9 Component number three and
10 component number four calculate the total debt
11 that the Authority has incurred since inception.
12 So component number three is the total debt that
13 the Authority has incurred prior to January 1st,
14 2015.
15 That number was $42,113,278.06 of
16 debt and capital expenditures that we incurred up
17 to that point.
18 Component number four is
19 calculating how much debt service, capital outlay
20 and capital expenditures we incurred during the
21 calendar 2015 year. That number was $743,700.
When you add the debt that we
incurred prior to 2015 to the debt that we
incurred during 2015, he total debt and ca
expenditure incurred to the end of 2015 on the

number by the 21,080 EDUs. You come up with
$2,033.06 per equivalent dwelling unit.
As the Authority has done in the
past, we round to the nearest dollar. That's

15 which comes out to a seven percent increase over

The calculation and statistical information is as shown in your letter dated June 5, 2017. This confirmation is based upon your calculations as submitted, taking into consideration all debt service and capital expenditures actually paid prior to January 1, 2016 added to the debt service and capital expenditures paid during 2016 divided by the number of equivalent units.
The equivalent units (EU) calculation is based upon the rules and regulations of the Manasquan River Regional Sewerage Authority and consistent with data provided by the New Jersey Department of Environmental Protection.
