To Whom It May Concern,

As per our variance application, here is a letter of justification. When we purchased theapartment building at 5200 Ballman Ave, in Brooklyn, in 2001, it contained six apartments. Fiveof the six were rented, and the sixth one was occupied by the owners of the building at the time.

Upon taking ownership, there was a fire in the building which damaged part of thesouthern end of the building. This was the section of the house where the previous ownersresided. It was substantially more square footage than the other five apartments. When werepaired the damaged areas, we divided the previous owners' apartment into two apartments. Wethen obtained licenses to legally operate the building as a seven apartment building.

Over the course of the last seventeen years, we have continued to operate that way,maintaining our license to reflect seven legal apartments. There has never been any complaintsreported to the county, or state, regarding the density being at seven apartments.

We are respectfully requesting that the density for 5200 Ballman Avenue to be perfected,to reflect the seven apartments that we have been legally operating for almost twenty years.

We appreciate your concern and consideration in this matter.
