REPUBLIC OF ETIllOPIAWHEREAS, the Organization of the preceding ex-

ecutive body was not conducive for the brilliance andpromptness of activities;

WHEREAS, the executive body is required to carry outthe Schedule of its activitieswith due promptness;

WHEREAS, it is found necessary to reorganize theExecutive Organs of the Federal Democratic Republic ofEthiopia;

NOW, THEREFORE, in accordance with Article 55(1)of the Constitution of the Federal Democratic Republic ofEthiopia, it is hereby proclaimed as follows:

1. Short TideThis Proclamation may be cited as the "Reorganizationof the Executive Organs of the Federal DemocraticRepublic of Ethiopia Proclamation No. 256/2001"

2. DefinitionIn this Proclamation:1) ~'ProclamationNo: 4/1995" means the Definitioriof

Powers and Duties of the Executive Organs of theFederal Democratic Republic of EthiopiaProclamationNo.4/1995; .

2) "Region" means a Region under Article 47 of theConstitutioli'asamember of the Federal DemocraticRepublic of 5thiopia; .

3. Members of the Council of Ministers

1) The Council of Ministers shall have the followingmembers:

(a) The Prime Minister;

(b) The Deputy Prime Minister;

(c) Ministers that head the Ministries specifiedunder Article 4 hereunder;

. (d) Other officials to be designated by the PrimeMinister.

2) Where any Ministerreferred to in Sub Article (1) (C)

of this Article is unable to attend the meetings of tneCouncil, his deputy or, in case where there are more

than one deputies, the deputy spe~ificallydelegatedshall take part iri the meetings of the Council as asubstitute member.

3) A Deputyreferred to iriSub Article (2)of this Articlemay have the rank of Minister, Minister of State orVice Minister as may be appropriate.

4. Establishment of Ministries

The following Ministries are hereby established:

1) Office for the Coordination of Capacity Building;2) Ministry of Trade and Industry;3) Ministry of Rural Development;.4) Ministry of Development Infrastructure;5) Ministry of Finance and Economic Development;6 Ministry of Federal Affairs;7) Ministry of Agriculture;8) Ministry of Education;9) Ministry of Health;

Cultural Heritage;(b) National Archives and Library Agency;(c) Ethiopian Conference Centre;(d) Ethiopian National Theater.

11) The Ethiopian Geological Survey shall be accoun-table to the Ministry of Mines.

PART THREEPowers and'Dutiesof Ministries

6. Office for the Coordinationof CapacityBuildingThe Office for the Coordination of Capacity Buildingshall have the powers and duties to:1) initiate'national capacity building policies, prepare

programmes and budget and, upon approval, im-plement same;

2) ensure that the necessary capacity is created for thenational capacitYbuilding;

3) supervise and coordinate the. executive organsreferr~ to in Article 5(1) of this Proclamation,

4) "support regions in promoting capacity buildingactivities;

5) Perform other activities necessary for the enhan-cement of capacity building.

7. Ministry of TradeandIndustry1) The Ministry of Trade and Industry shall have the

2) ensure that conducive conditions are created for thedevelopment,processingand supply of inputs neces-sary for rural development.

3) monitor the F09d Security Programme;4) supervise and coordinate the executive organs

9. Ministry of Development Infrastructure1) The powers and duties given to the Ministry of

Transport and Communications, the Ministry ofMines and Energy with respect to Energy and theMinistry of Wor~ and Urban Development byArticles 18 and 15 and Sub Articles (1)-(6) and (12)of Article 16 of Proclamation NoA/1995 and otherlaws respectively are hereby given to the Ministry ofDevelopment Infrastructure.

12. Ministryof AgricultureThe Ministry of Agriculture shall have the powers andduties given to it by Article 12 of Proclamation No. 4/1995 and other laws.

10. . Ministry of Financeand Economic Development

1) The powers and duties given to the Ministry ofEconomic Development and Cooperation and theMinistry of Finance by Articles 13 and 19 ofProclamation No. 4/1995 and other laws respec-tively are hereby given to the Ministry of Financeand E':::;2ilamicDevelopment.

2) Withoutprejudiceto Sub Article (1)ofthis Artic~e,the Ministry of Finance and Economic Develop-ment shall supervise and coordinate the executiveorgans referred to in Article 5(5) of thisProclamation.

11. Ministry of FederalAffairs

1) The Ministry of Federal Affairs shall have thepowers and duties to:

(a) In cooperation with the Regions, ensurethat public peace and order is maintained;

(b) without prejudice to the provisions ofArticles48 and 62(6) ofthe Constitutionofthe Federal Democratic Republic ofEthiopia facilitate the resolution of misun-derstandings arising between Regions;

(c) give assistance to the Regions with par-ticular emphasis to the less developedones;

(d) supervise and coordiate the executive or-gans referred to in Article 5(6) of thisProclamation.

2) Withoutprejudice to Sub Article (1)ofthis Article,the powers and duties given to the Ministry ofWorks and Urban Development by Sub Articles(7)-(11) of Article 16 of Proclamation No. 4/1995are herebygiven to the Ministry of Federal Affairs.

14. Ministry of Health

The Ministryof Health shallhave the powers anddutiesgiven to it by Article22of ProclamationNo. 4/1995 andother laws.

15. Ministry of Justice

gence of a healthy and responsible youth~(c) provide the necessary support to enable the

youth to actively participate in the building of ademocratic society based on the principlesenshrined in the Constitution~

(d) encourage the youth to respect and promote thecultural values of the peoples of the country~

(e) perform, in cooperation with the concernedorgans and in particular with the Regions, otheractivitiesnecessary for promoting the all rounddevelopment of the youth~

24. OtherExecutive OrgansNeither the accountability nor the attributions of anyfederal executive organ not mentioned herein may beaffected by this Proclamation.

25. Repeal1) Article 6 and 9 of Proclamation No. 4/1995 are

hereby repealed.2) No law, directive or practice shall, in so far as it is

inconsistent with this Proclamaiton, have force oreffect with respect to situations provided for by thisProclamation.

26. Transferof Ri:;h!sand Obligations1) The rights and obligations of the Ministry of

Transport and Communication and the Ministry ofWorks and Urban Development are, hereby trans-ferredto theMinistryof DevelopmentInfrastructure,

2) The rights and obligations of the Ministry ofEconomic Development and Cooperation and theMinistry of Finance are hereby transferred to theMinistry of Finance and Econmic Development.

3) The rights and obligations of tlie Federal' Govern-ment Revenues Board are hereby transferred to theMinistry of Revenues..

4) The rightsand obligationsof the Ministryof Cultureand Informationare hereby transferred to the Minis-try of Information.

5) The rights and obligationsof the SportsCommissionare hereby transferred to the Ministry of Youth,Sports and Culture.

6) The rights and obligations of the Ministry of Minesand Energy are hereby transferredto the Ministry ofMines.

27. Effective Date

This Proclamation shall enter into force as of the 12thdayof October, 2001.
