31 This document sets down the parking and moving traffic contravention kerbside management

and enforcement protocols in the City of Westminster Parking is covered in section 2 of the document moving traffic in section 3 and engine idling in section 4 It is primarily intended for use by WCCrsquos Marshals a term which also includes camera operators (see section 100) but has been made readily available via WCCrsquos website for the publicrsquos information

Deliver a high quality parking service to all road users in a fair and consistent manner in line with our Fair Parking Policy

Ensure there is clarity of the kerbside policies and enforcement requirements for all and

Be a single point in which kerbside and enforcement policy is documented and can be updated

33 Document Format

Each main area of kerbside use and enforcement is covered by a separate section An amendment history is included to track changes to the previous version of this document

34 Temporary or trial changes will not be listed in this document and it generally omits specific or

ad hoc instructions referring to individual streets or locations These will continue to be communicated to the kerbside management provider via formal instruction

35 Illustrations and Photographs in this Document

The illustrations and photographs included in this document are examples used for illustrative purposes only intended to promote ease of use of this document and may not reflect the actual signage or restrictions in place on-street In the case of moving traffic contraventions the contraventions are not limited to the signs illustrated in this document

The information within this document should be used in conjunction with the Operational Manual The KMECOP document specifies the kerbside and enforcement protocols Marshals should employ when enforcing parking moving traffic and engine idling contraventions on behalf of WCC whereas the Operational Manual outlines operational procedure and best practice

60 Definitions

61 Marshals Camera Operators and CEOs

Marshals are fully qualified CEOs as defined in section 76 of the TMA 2004 being persons authorised by or on behalf of WCC to enforce road traffic contraventions The term lsquoMarshalrsquo is used to reflect their additional ambassadorial role However as they are still fundamentally CEOs they are still referred to as such on statutory documents Camera operators are also fully qualified CEOs

62 Waiting Parking and Stopping

Parking contraventions are contraventions of the relevant TMOs As described in the Road Traffic Regulation Act 1984 parking and waiting are synonymous Waiting consists of stopping a vehicle where restrictions apply and can be described as occurring where the vehicle has been permitted to remain at rest

63 Where drivers are not present Marshals are not required to locate the driver Finding and

advising a driver to move the vehicle is not practical and is in no way necessary prior to the issue of a PCN 64 LoadingUnloading

This activity needs to be visible and the process (ie the deliverycollection and the obtaining of any necessary signature etc) needs to be continuous in order to satisfy the concessions for loading and unloading This document details where loadingunloading is and is not permitted and if so for how long

65 Private vehicles are only afforded loadingunloading concessions when goods are being

loadedunloaded that are too heavy or bulky to be carried from a legal parking place The



vehicle must therefore be parked at the particular location as a matter of necessity rather than mere convenience This stipulation does not apply to commercial vehicles

66 Picking UpDropping Off of Passengers

The definition of picking upsetting down is stopping at the kerbside in order to allow a passengerpassengers to board or alight the vehicle and to loadunload their luggage In such cases the vehicle should generally not be left unattended This document details where picking upsetting down is and is not permitted and if so for how long

67 Light and Heavy Goods Vehicles (LGVsHGVsrsquo)

HGVs are vehicles over 35 tonnes in weight They may have chevrons at the rear although if present these only indicate vehicles that are over 75 tonnes A commercial vehicle of 35 Tonnes or less is classified as an LGV

70 Exemptions to this KMECOP

71 Exemptions and observations listed in this document do not apply

If it appears to the Marshal that the vehicle is not being used in accordance with the exemption or concession which is being relied upon For example an observation period should not be given to a commercial vehicle parked on a yellow line if it is evident that the crew are having lunch in a nearby cafeacute etc

Where vehicles are known to use the maximum observation times under these protocols and then move the vehicle only to immediately re-park in contravention Instant PCNs may be issued upon the vehicle parking in contravention for the second time

72 If a Marshal feels a particular concession or exemption is being abused they may override or

disregard the protocols detailed in this document when enforcing parking or moving traffic regulations on behalf of WCC If doing so however full notes and an explanation must be recorded

73 Problem Areas ndash Arrangements to Lift KMECOP Requirements

Where vehicles are known to park in contravention at a given location or locations on a regular or continuous basis that location and the appropriate VRM(s) will be briefed to Marshals and may be subject to immediate enforcement without observation

74 Bases will be requested to provide details over a 2 week period where documented evidence

(eg other PCNs Marshal notes) shows that continuous non-compliance is taking place The notes and evidence provided will then be produced in the case of challenge or appeal against the PCNs subsequently issued

75 Note 71 to 74 above do not apply to the statutory 10 minutes grace period introduced by the

Deregulation Act 2015 This must be granted wherever appropriate 76 Extension to Controlled Hours

Warning Notices should be issued for 2 weeks during the extension period Normal enforcement should be carried out during previous core controlled hours Note this does not apply to locations converted from SYL to DYLs

77 Introduction of New Restrictions

Where brand new restrictions are introduced Warning Notices only should be issued for the first 2 weeks of controls This may not occur however where existing restrictions are merely being enforced by new or different enforcement methods

78 Moving On and lsquoAppropriate Actionrsquo

Attended vehicles parked in contravention should only be moved on or be subjected to lsquosoftrsquo enforcement if this is considered to be the appropriate action However a Marshal is under no obligation to ask a motorist to move on before beginning PCN issue

80 PCN Types

81 Three different types of PCN are issued by WCC

Regulation 9 on-street PCNs which are either fixed to the vehicle or handed to the person appearing to be in charge of it by a Marshal

Regulation 10 Vehicle Drive Away PCNs which are issued where a motorist drives away whilst the Marshal is in the process of issuing the PCN and



Regulation 10 CCTV parking PCNs where a parking contravention is observed remotely by a CCTV camera operator From 1 April 2015 this PCN type can only be issued in very limited circumstances

82 Regulation 10 PCNs are issued by post

83 Engine idling is enforced by FPN which are issued to the driver

90 Marshals

91 As per paragraph 61 above Marshals are fundamentally CEOs with an enhanced

ambassadorial role the main objective of which is to establish positive working relationships with motorists and businesses The Marshalrsquos role therefore is to provide guidance to motorists advising where they can legally park and service However Marshals can still issue a PCNFPN and therefore follow the protocols outlined in this document

100 Parking Enforcement by CCTV

101 From 1 April 2015 parking restrictions can only be enforced by CCTV in very limited

circumstances as prescribed by the Deregulation Act 2015 These are school clear markings bus stopstand clearways bus lanes and red routes

102 CCTV Enforcement and CCTV Cars

For those few parking contraventions still enforced by camera the same exemptions and observations apply as to enforcement by on-street Marshal unless stated The requirement to move vehicles on where the driver is present does not apply to CCTV or CCTV car enforcement Section 2 of this document highlights which parts apply to both Marshal and camera enforcement and which parts refer to Marshal enforcement only

103 In most instances camera operators are instructed to observe footage for 121 seconds before

issuing a PCN This is to give parking enforcement by camera uniformity with on-street enforcement as the process of a Marshal issuing a PCN obviously takes a certain amount of time

104 CCTV COP

The information within this document should be used in conjunction with WCCrsquos Corporate CCTV COP and SOP The KMECOP document specifies the kerbside management and enforcement protocols Marshals should employ when enforcing parking and moving traffic contraventions by CCTV whereas the CCTV COP outlines best practice and the CCTV SOP outlines operational procedures

110 Marshal Activities

111 As well as carrying out parking enforcement Marshals carry out the following supplementary

activities

Aiding directing and marshalling motorists

Identification and reporting of incorrect missing contradictory vandalised and unauthorised street furniture This includes signs lines and faulty machines

Checking of parking suspensions

Identification and reporting of unauthorised suspensions

Identification and reporting of unlicensed skips

Identification and reporting of untaxed vehicles

Identification and reporting of abandoned vehicles

Identification and reporting of technology failure (for example Marshalrsquos inability to access the Pay-to-Park system)

Identification and reporting of suspected permit or badge fraud and abuse

Reporting of negative interaction with a member of the public resulting in assistance from supervision andor the Police

Reporting of an event andor incident which has the potential to bring the WCC into disrepute or negatively impacts the publicrsquos perception of WCC

Identification and reporting of problematic locations or hotspots within the City

Low-level highways reporting

Collation of reports requested by other service partners (eg Metropolitan Police Service)

Kerbside management and enforcement of engine idling

Exemptions

1 Any vehicle - do not issue for the first and last 3 mins of controlled hours on SYLs 2 Notification has been received from Parking Services that special permission has been given to loadunload

for as long as necessary at a particular location

3 Vehicle is displaying a valid and correctly completed PIB issued by WCC or a London HAUC board issued by a utility company as long as the vehicle is not affecting free flow of traffic and is parked in compliance with the boardrsquos conditions of use

4 Vehicle is identified as having a valid WCC-issued SYLDYL dispensation

5 Vehicle is in the Whitehall Security Zone

6 Domestic and office removal vehicles for as long as necessary whilst actively loading unloading

7 Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere This includes building demolition and excavation street

maintenance improvement reconstruction cleansing or lighting installation alteration cleaning or repair of sewers installation or repair of gas water or electricity mains pipes or apparatus or telecommunications systems placing maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work

8 Gate or barrier to premises which the vehicle needs access to is being opened or closed and there is no

other practical place for vehicle to wait This applies equally to vehicles waiting to enter a loading bay or other off-street area

9 Visible signs of unavoidable vehicle breakdown or if a recovery service vehicle in attendance

10 Vehicle being used for Fire Brigade Ambulance or Police purposes

11 London Fire Brigade Vehicle displaying Identifier Board

SECTION 2 - PARKING


12 The main funeral or wedding vehicle as well as 2 other family vehicles in the funeral or wedding cortege All

other vehicles must park legally

13 WCC formal instruction to disregard Observations

1 There is evidence of loadingunloading bulky or heavy items For private loading activity the goods must be

too heavy or bulky to be carried from a legal parking place Take logging then give a minimum of 20 mins casual observation 0830-1100 - If loading still taking place after 20 mins give further 20 mins casual observation If no

loading observed after 20 mins give 5 mins constant observation before issuing PCN if loading is not observed during this period If loading is seen repeat procedure 1100-1830 - If vehicle still in situ after 20 mins issue PCN Multi-drops that may take longer than 20 mins

are permitted as long as the vehicle is moved in the process A fresh 20 minute casual observation should be given if vehicle moved

Note the TMO allows continuous loading activity for as long as necessary before 1100 but 20 mins max from 1100 to 1830

2 Evidence of picking upsetting down passengers and their luggage observed Sufficient time must be

allowed for this activity (for as long as necessary) Driver should be with vehicle

3 Vehicle displaying valid HEB should be kept under casual observation for 60 mins before PCN issued

4 Vehicle is displaying an exemption board which allows vehicles to wait for 10 mins outside a named hotel

as agreed by WCC while picking upsetting down passengers

5 Give 5 mins constant observation to vehicles displaying a valid disabled badge to ascertain whether picking upsetting down is occurring Issue instant PCN after this period if none seen If activity observed allow as long as necessary

6 Vehicles displaying a valid resident permit for the same zone (or interim permit or URN) to be given 5 mins

constant observation on a SYL If no loadingunloading activity observed after this time PCN should be issued If concession blatantly being abused PCN can be issued without 5 mins observation but full notes must be made

7 Vehicle displaying hospital car service identifier whilst parked in close proximity to hospitalclinic give 20

mins casual observation to allow for picking upsetting down passenger(s) andor patient(s) If no activity seen after 20 mins issue instant PCN Record hospitalclinic name

SYLs not active therefore no enforcement unless timeplate extends hours in which case enforcement is identical to DYLs below for the duration of the extended period However no PCNs to be issued for the first and last 3 mins of extended period DYLs ndash1830-0830

Where there is evidence of loadingunloading bulky or heavy items take logging then give 20 mins casual observation If loading still taking place after 20 mins give further 20 mins casual observation If no loading observed after 20 mins give 5 mins constant observation and if loading still not observed during this period issue code 01

PCN If loading is seen repeat procedure Loadingunloading is permitted for as long as necessary For private loading activity the goods must be too heavy or bulky to be carried from a legal parking place Exemptions and observations as per pages 8-9

1 Wide streets in C zone Do not enforce outside CPZ hours unless vehicle is preventing free flow of traffic Full notes and photograph required

1 If evidence of loadingunloading heavy bulky items seen and no other kerbside parking place available for vehicle nearby ndash

0830-1100 - give 20 mins casual observation If loading still taking place after 20 mins give further 20

mins casual observation If no loading observed after first 20 mins give 5 mins constant observation before issuing PCN if no further loading observed

1100-1830 - same applies but if vehicle still in situ after first 20 mins issue PCN

2 If evidence of picking upsetting down passengers seen allow as long as is necessary If no evidence seen

unloading is observed repeat process up to 1100 If no evidence of loadingunloading after 45 mins a PCN may be issued 1100-1830

Casual observation for 20 mins and if vehicle is still in situ a PCN may be issued Multi-drops that may take longer than 20 mins are permitted as long as the vehicle is moved in the process A fresh 20 minute casual observation should be given if vehicle moved The back of vehicle should be checked to see if driver in attendance and for evidence of loadingunloading activity Full notes to be made by Marshal HGVs only give 40 mins casual observation A PCN may be issued if vehicle still in situ after this period

1830ndash0830 on DYLs - As per 0830ndash1100 above

Note the TMO allows continuous loading activity for as long as necessary before 1100 but 20 mins max from 1100 to 1830 There is no restriction on the nature of goods for commercial loading activity

2 Royal Mail vehicles deliveringcollecting postal packets Give 20 mins casual observation 3 BT vehicles loadingunloading Give 20 mins casual observation except outside exchange where 5 mins

constant observation should be given

4 Evidence of delivering mail or postal packets by couriers in which case 20 mins should be allowed before issuing a PCN Apply observations as per observation 1 above

5 Give 2 mins observation to licensed Hackney Carriages to ascertain whether loadingunloading andor picking upsetting down

6 Hospital Car Service vehicle displaying hospital car service identifier parked in close proximity to

hospitalclinic give 20 mins casual observation to allow for picking upsetting down passenger(s) andor patient(s) If no activity seen after 20 mins issue instant PCN Record hospitalclinic name

7 Cash collection vehicles actively involved in the deliverycollection of cash to be given 40 mins casual

observation As long as necessary should be given up to 1100 with 40 mins max thereafter

8 Prisoner Transport vehicles in vicinity of Police station or Magistrates court ndash give 20 mins casual observation

Note for double parking to be occurring the vehicle must be parked more than 50cm away from bothall kerbsedges of the carriageway Do not issue code 26 PCNs in narrow streets but revert to waiting and loading restrictions as per pages 12-13 Exemptions

1 Cleansing and refuse vehicles collecting rubbish from the side of the road (Note this applies to both WCC and commercial refuse company vehicles)

2 Vehicles used in connection with building operations or highway maintenance in or adjacent to street where

the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere This includes building demolition and excavation street




Observations

1 0830-1100 - give 20 mins casual observation If loading still taking place after 20 mins give further 20 mins

casual observation If no loading observed after first 20 mins give 5 mins constant observation before issuing PCN if no further loading observed HGVs only give 40 mins casual observation then additional 5 mins constant observation If no evidence of

loadingunloading after 45 mins a PCN may be issued

photograph 1830-1100 the next day

Allow as long as necessary for loadingunloading the vehicle Give one hour casual observation If no loadingunloading seen give 5 mins constant observation If loadingunloading observed repeat process Every attempt should be made to contact the driver during the constant observation period to determine if activity is taking place or vehicle could be moved If no activity seen and the driver cannot be found issue code 61 or 62 PCN as

The footway regulation applies at any time Footway is defined as any part of an urban road over which the public

have right of access on foot and can include private land vehicle crossovers and pavement lights etc unless a physical barrier prevents access It does not include private roads The same enforcement applies to vehicle crossovers and pavement lights as it does to pavement parking Whilst footway is generally separated from the carriageway by a raised kerb bollards or barriers some new schemes in WCC comprise of flush surfaces where both the carriageway and footway are level and the kerb-line is clearly defined by the use of rectangular paving stones of a different material to that of the carriageway and footway Where there is no footway (eg in Mews) enforcement should be as per restricted street regulations (see pages 8-18) and pedestrian areas should be enforced using code 01 or 02 PCN as appropriate (see pages 19-20)

Instant code 61 or 62 PCN regardless of street narrowness or vehicle type unless exemption below applies Check

7 Under the Greater London Council (General Powers) Act 1974 loadingunloading is permitted whilst parked

on the footway only if both the following apply and the vehicle is not parked on the footway adjacent to

where a loading restriction is indicated on the carriageway - (i) The loading or unloading of the vehicle could not have been satisfactorily performed had the vehicle

not been so parked and

(ii) The vehicle was not unattended at any time whilst parked If this is the case as long as is necessary is permitted and Marshals should give 20 mins casual observation (40 mins for HGVs) then additional 5 mins constant observation If loadingunloading observed repeat process If no evidence of loadingunloading after 25 mins (45 mins for HGVs) a code 61 or 62 PCN may

be issued PCN may also be issued if vehicle left unattended at any time during the process

Dropped Footways PCN Code 27 ldquoParked in a special enforcement area adjacent to a footway cycle track or verge lowered to meet the level of the carriagewayrdquo


The definition of the contravention under section 86 of the TMA 2004 is as follows ndash (1) In a special enforcement area a vehicle must not be parked on the carriageway adjacent to a footway cycle track or verge where ndash

(a) The footway cycle track or verge has been lowered to meet the level of the carriageway for the purpose of ndash (i) Assisting pedestrians crossing the carriageway (ii) Assisting cyclists entering or leaving the carriageway or (iii) Assisting vehicles entering or leaving the carriageway across the footway cycle track or verge or

(b) The carriageway has for a purpose within Paragraph (a)(i) to (iii) been raised to meet the level of the footway cycle track or verge

However code 27 should only be enforced where the footway has been loweredraised for the purpose of assisting pedestrians crossing the road We will not enforce code 27 where the footway has been loweredraised to assist vehicles to enterleave the road (eg driveways) The dropped footway should therefore have a corresponding dropped footway on the opposite side of the road or a central pedestrian haven Code 27 should only be enforced on stretches of SYL outside of controlled hours (code 01 appropriate during controls) Code 27 should not be enforced on areas of DYLs (code 01 appropriate at all times) and cannot be enforced within designated bays No signage is required Where a dropped footway contravention is occurring instant code 27 PCN Full notes to be made

fire hoses to shoot water or chemical solutions at high pressure Emergency Ambulance - These are emergency vehicles with patient treatment facilities on board staffed by

paramedics who treat patients on arrival before transfer to hospital for further treatment They are tall vehicles with sufficient space at the rear to carry the injured on trolleys while medication is administered Emergency Ambulances are equipped with a wide range of emergency care equipment and a variety of drugs for medical and traumatic emergencies Private Blue Light Ambulance - These are NHS-contracted patient-transport services that ferry patients tofrom

hospital for routine visits They are unlikely to carry patient treatment facilities on board although some are adapted for this purpose Commonly they are essentially private cars painted in Ambulance and NHS colours

Vehicles Involved In Accidents and Abandoned Vehicles All locations


Accidents

If vehicle has clearly been involved in a road traffic accident but no emergency services are in attendance and no driver is present then the Abandoned Vehicles Removal Service (AVRS) should be notified If emergency services are already in attendance then no Marshal action is required Abandoned Vehicles

An abandoned vehicle can be defined as

Vehicle with no road tax disc or a road tax disc that has expired by over one month and

Vehicle left on any land in the open air in such circumstances or for such a period that it may be reasonably assumed to be abandoned or if the vehicle had been brought to the piece of land for the purpose of abandonment

Marshal should issue a PCN on the first day a vehicle is seen parked in contravention (as appropriate) and believed to be abandoned The AVRS should be notified On the following day a second PCN should be issued A lsquoSuspected Abandoned Vehiclersquo notice should be placed on the vehicle Full details should be passed to the AVRS as below The AVRS will require the following information

Make and model

Colour

Registration number

Exact location eg outsideopposite number

General condition of vehicle Marshals are also expected to report suspected abandoned vehicles where they are not parked in contravention Vehicles without VRMs should be reported immediately

WARNING NOTICES AND RELOCATIONS

Warning Notices

Warning Notices will mainly be issued in specific circumstances for certain contraventions as outlined below When issuing a Warning Notice Marshals must -

Tear off the payment slip at the bottom of the PCN template

Place the Warning Notice in a yellow Warning Notice envelope rather than a blue PCN envelope before fixing to the vehicle

Circumstances When Warning Notices to be Issued

Marshals will mainly be required to issue Warning Notices in the following circumstances for the following contraventions Note for a vehicle to be relocated a Marshal must issue both a Warning Notice and a code 00 PCN otherwise it will not show on the system and relocation details will not transfer to TRACE The code 00 PCN must not be placed on the vehicle

Marshals should issue one Warning Notice per day where above applies Code 00 relocations may also still be necessary in other circumstances Further ad hoc Warning Notice issue may be required for the introduction of new schemescontrols as and when required Service provider to be instructed when this applies Note 24u 40y amp 40z are not genuine codesuffix combinations as per London Councilsrsquo current list but have been

used by WCC only for the purpose of Warning Notices to enable us to convey to the motorist the error they have made These codes must not be used for PCNs

The Warning Notice makes it clear to the recipient that no payment is required but inevitably some motorists will still be confused and may question a Marshal or call the Contact Centre If so the motorist should be assured that no payment or further action on their behalf is required

SECTION 2 - PARKING



Relocations

Since 2008 rather than clamping andor removing vehicles parked in contravention we have only relocated contravening vehicles to near-by paid-for bays (contravention dependent) Below outlines the protocols for relocating contravening vehicles following the issue of a PCN a Warning Notice or a code 00 dummy PCN Relocation Policy

Relocation should only generally occur in conjunction with the following contravention codes 16 21 23 40 41 42 45 47 48 amp 99

A common sense approach should be taken and all relocation activity should be proportionate (eg relocation may not be appropriate from an otherwise empty rank of bays)

Disabled badge holders should only be relocated if absolutely necessary

Aligned to the above relocation should only be considered in the following circumstances ndash o Where a vehicle is denying a specialist permit holder a space in a specialist bay (PCN codes 16 23 or

40) o Where a vehicle is denying a vehicle a space in a non-permit designated bay (PCN codes 23 41 42

45 or 47) o Where a vehicle is parked on zig-zags (codes 48 or 99) o Where a vehicle is parked in a suspended bay when the suspension is active (code 21) o Where an external request to relocate has been received from the Police from a Utility company

attending emergency works or from WCC Special Events

Approval for relocation can be made by WCC Parking Services WCC Special Events the Control Room and the Police Outside of the hours of 0845-1345 Mon-Fri relocations will only be approved by the WCC Suspensions team (Mon-Fri 1345-1700) and by the Control Room (Mon-Fri 1700-0845 and all weekend) in emergency or extraordinary circumstances only The control room must complete a full record of all relocation requests with full justification for each The table below shows the contraventions where we would consider relocation to be appropriate the time constraints (if any) that the TMA 2004 places upon vehicle removal and WCCrsquos relocation policy

When relocating vehicles will be relocated to a paid-for bay as near to the original location as possible Only resident permit holders should be moved to other resident bays Other vehicles should only be relocated to resident bays or onto yellow lines as an absolute last resort A vehicle that has been relocated should not be issued with a further PCN at its new location for the rest of that day If the vehicle remains parked in contravention at its new location when controls recommence the following day a new PCN may then be issued Driver returns

If the driver or the person appearing to be in charge of the vehicle returns before the vehicle has all its wheels on the truck the vehicle should be released but any PCN remains payable Even if the vehicle is on the truck we should still look to release wherever practicable Unmoved vehicles post-relocation

Vehicles are to be left in situ at the new location unless it is necessary to relocate them again due to a suspension or Police request If the vehicle has not moved from the position it has been relocated to a PCN can be issued from the beginning of controlled hours the next day If the vehicle remains parked after this the AVRS procedure should be followed (see page 81)

The above protocols do not affect abandoned vehicles which can still be removed once the required notifications have been given and statutory time limits have been followed Non-contravention relocations

We will continue to receive external requests to removerelocate in certain circumstances such as from the Police for security reasons emergency utility company works WCC Special Events etc The process for necessary relocations where a contravention is not occurring remains the same but in these instances a dummy code 00 PCN will need to be created Relocation may be required without PCN issue when a code 21r Warning Notice is issued (see page 82) Note for a vehicle to be relocated in these circumstances a Marshal must issue both a Warning Notice and a code 00 PCN otherwise it will not show on the system and relocation details will not transfer to TRACE The code 00 PCN must not

be placed on the vehicle but returned to the Base ManagerSupervisor

SECTION 3 ndash MOVING TRAFFIC


MOVING TRAFFIC CONTRAVENTIONS

Camera Enforcement of Moving Traffic Contraventions

The KMECOP for enforcing parking contraventions by CCTV where this is permitted under the Deregulation Act 2015 is outlined throughout Section 2 of this document Enforcement of moving traffic contraventions by CCTV is unaffected by the Deregulation Act 2015

Enforcement of Moving Traffic Contraventions

Directional signs on the carriageway only apply once the sign has been passed The direction is only active in the area behind the sign These are all lsquopositiversquo instruction signs Enforce showing the sign in the footage and the vehicle passing it However it is not necessary for the footage to show the front of the sign




Box Junctions PCN Code 31 ldquoEntering and stopping in a box junction when prohibitedrdquo

Evidence must show vehicle approaching entering stopping and leaving the box junction The intention is to only penalise motorists for entering the box junction when the exit is not clear and having to stop in the junction as a consequence of this action Preferably the footage should show the vehicle entering the junction or at least show the vehicle moving before stopping behind another stopped vehicle at the blocked exit Footage merely showing a vehicle stopped in a box junction is not considered evidence that the contravention has taken place Exemptions

1 Vehicle may be delayed by oncoming traffic waiting to turn right in which case do not issue

2 Vehicle forced to stop in the junction due to the braking of traffic ahead although the exit was clear at the

time the vehicle entered the box junction





Directional Instructions PCN Code 32 ldquoFailing to drive in the direction shown by the arrow on a blue signrdquo

Turn left or right signs

Usually found on traffic islands and at junctions these are intended to instruct traffic to proceed in the direction indicated by the arrow to prevent entering the path of oncoming traffic These signs are listed under the TSRGD 2002 as diagram 609 Proceed in the direction indicated by the arrow signs

These signs listed under the TSRGD 2002 as diagram 606 Vehicular traffic must proceed in the direction indicated by the arrow only apply to the junctions where they are sited The signs only instruct vehicles not to turn at that junction and to proceed in the direction indicated and do not apply anywhere in the street other than the junction Vehicles may be ticketed for turning at the junction where prohibited but not for performing U-turns within Piccadilly One-way traffic signs

RESTRICTED PRACTICES

Engine Idling FPN Offence Description ldquoOffence of failing to switch off engine in a stationary vehiclerdquo


It is an offence for a driver to idle a vehiclersquos engine unnecessarily when stationary If a driver fails to turn the vehiclersquos engine off after being asked to do so by an authorised officer the driver can be issued with a Fixed Penalty Notice (FPN) Unless exemption applies a Marshal should ask the driver of a stationary vehicle observed unnecessarily idling to switch off their engine Instant FPN if the driver refuses to do so The Marshal must show the driver hisher authorisation card if asked by the driver for identification If a parking contravention is being committed at the same time as an idling offence this should take precedence over the issuing of an FPN for engine idling In such an instance the driver should still be requested to turn off the vehiclersquos engine When issuing a FPN the Marshal must speak to the driver to obtain their name address and record this information on the FPN (along with VRM and details of the offence) The FPN must be issued to the driver of the vehicle Vehicle idling should not be issued by a code 63 PCN An FPN should not be issued if the Marshal has reason to believe any of the below exemptions apply

9 A driver of a school bus or school mini-bus with any passenger on board
