We have also accessed a copy of the Environmental Study Report and Appendix D (Heritage Impact Assessment) available through Utilities’ Kingston website. MTCS has a mandate, under the Ontario Heritage Act (OHA), to conserve, protect and preserve Ontario’s cultural heritage resources, including: archaeological resources, built heritage resources and cultural heritage landscapes. Based on a review of the Environmental Study Report and the Heritage Impact Assessment, we have the following comments. Environmental Study Report, May 17, 2013 (the “ESR”) Section 4.9.1 Archaeological Assessment The following sentence “In order to ensure that any heritage features of importance are not negatively impacted by the proposed improvements at the Cana WWTP, a Stage 1 Archaeological Assessment was conducted” (emphasis added) should be revised to clarify that the archaeological assessment addressed archaeological resources. The term “heritage resources” could apply to a broader range of above-ground resources that are not intended to be addressed by an archaeological assessment. This section indicates that MTCS has not yet “concurred” that additional archaeological assessment (i.e. Stage 2) needs to be undertaken for the proposed project, but that confirmation “is likely to follow in the near future”. As noted in our letter dated January 4, 2013, the Stage 1 Archaeological Assessment has been entered into the Ontario Public Register of Archaeological Reports without a technical review. Unless specifically requested, MTCS will not

provide additional comments on this report or the need for further assessment. For questions regarding this process please contact [email protected]. Section 4.9.2 Ecological Assessment This summary of the ecological assessment states that “the area was identified as a cultural landscape”. To distinguish this classification from a cultural heritage landscape, please indicate that “the area was identified as a cultural landscape according to Ecological Land Classification typologies”. This is particularly important, considering the stipulation in the following section 4.9.4 that the area is not considered a cultural heritage landscape. Section 4.9.4 Heritage Impact Assessment This section outlines mitigation measures to ensure that the Rideau Canal UNESCO World Heritage Site is not impacted by the proposed project works. We have concerns with the following mitigation measure:

• Following the completion of construction activities, municipal heritage staff should be notified and inspect the property to ensure no unanticipated impacts on the Rideau Canal have been experienced. (emphasis added)

We recommend including an additional, pro-active, commitment in the Environmental Study Report that municipal heritage staff be engaged during the detail design phase of the project to ensure that the design of the proposed new Cana WWTP is sensitive to the Rideau Canal. We trust that, consistent with the City of Kingston Official Plan policy, that Parks Canada will also be engaged in the detail design phase, to protect the cultural heritage resource significance of the Rideau Canal. Table 6 Potential Effects Caused by Proposed Works and Proposed Mitigation Measures We recommend revising the row under the “Potential Effects” column currently labelled “Heritage Resources” to read “Cultural Heritage Resources”. This broader term is more consistent with current terminology and includes: archaeological resources, built heritage resources and cultural heritage landscapes. Please revise the same row under the “Mitigation Measures” column to read “…The new building enclosure should be designed to incorporate natural colours to minimize the visual impact”, to be consistent with the Heritage Impact Assessment. Please also include the additional mitigation measure recommended above, namely, “During detail design, municipal heritage staff should be provided an opportunity to review and comment on the proposed building and landscape design”. Heritage Impact Assessment, May 2013 (“HIA”) Was the Heritage Impact Assessment sent to the local Municipal Heritage Committee for review? If not, please circulate this document to the Municipal Heritage Committee’s attention prior to EA approval. 1.3 Heritage Resources The report states in this section that “Properties owned or leased by the provincial government and prescribed public bodies (as defined in Regulation 157/10 of the Ontario Heritage Act) were not expressly considered in this report”. MTCS has an interest in whether or not there are provincially owned properties that will be impacted by the proposed project works, as these may be (un-assessed) potential heritage properties. Please clarify whether or not there are any provincially-owned properties that will be impacted by the proposed project works.

In addition, for information on whether or not provincially-owned properties potentially impacted by the proposed project works are of cultural heritage significance, please contact [email protected]. 4.2 Cultural Heritage Landscape It is unclear in this section why the Town of Caledon’s criteria were applied to evaluate the Cana WWTP site as a cultural heritage landscape, as opposed to simply the criteria in O. Reg. 9/06. On page 38 the HIA states that the Cana WWTP site would be considered a designed landscape, as a suburban development, and as an evolved landscape, to acknowledge ongoing human activities on the site. Are the Town of Caledon’s criteria for evaluating cultural heritage landscapes tailored towards this particular type of landscape? If so, please clarify this point in this section. In addition, a statement is needed in this section to clarify the consistency of the Town of Caledon’s criteria for evaluating cultural heritage landscapes with O. Reg. 9/06. 4.3 Rideau Canal How close is the Cana WWTP to the Rideau Canal? This section does not clarify whether or not the WWTP is within the 30 metre buffer zone required by the City of Kingston Official Plan. 7.2 Implementation and Monitoring As noted above in our comments on the Environmental Study Report, we have concerns with the recommendation that municipal heritage staff inspect the property following the completion of construction activities. We recommend that municipal heritage staff be engaged during the detail design phase of the project activities to assess whether the proposed design has the potential to affect the cultural heritage values of the Rideau Canal. We trust that, consistent with the City of Kingston Official Plan policy, that Parks Canada will also be engaged in the detail design phase, to protect the cultural heritage resource significance of the Rideau Canal Concluding Remarks Thank you for the opportunity to provide comment. We would be pleased to discuss any of our comments and/or provide additional information. We would also appreciate being kept informed regarding the manner in which MTCS’ input has been considered, and wish to remain on the circulation list for this project.
