CITY OF INDIANAPOLIS APPLICATION

PROGRAM YEAR 2017 - HUD ENTITLEMENT PROGRAMSCommunity Development Block Grant (CDBG)

The City of Indianapolis, Department of Metropolitan Development (DMD) is now accepting applications for projects to be part of the 2017 U.S. Housing and Urban Development (HUD) Entitlement Programs. The application will be made available June 15th, 2016. All applications will be required to be submitted by noon on July 27th, 2016 to Suite 2043 of the City County Building, 200 East Washington Street, Indianapolis, IN 46204.

Application reviews will occur during the month of August. Project applicants will be asked to be available for a short question and answer session during this time. The date of the session will be tentatively scheduled for August 18th, 2016.

Award announcements are anticipated to be made September of 2016. The City of Indianapolis tentatively estimates a CDBG award for 2017 in the amount of $3,000,000.

Federal Funds through the City’s 2017 entitlement are contingent upon approval of the 2017 federal budget. The amount of project funding may be affected by federal budget cuts. The City may not be aware of its 2017 allocation of federal funds until June or July 2017. Likewise no contracts with the City can be executed until HUD approves DMD’s 2017 Action Plan – thus, contracts may not be fully executed until mid-2017.

DMD staff will not know how much total funding is available until closer to the application deadline. This funding is contingent upon the entitlement funding from HUD.

Eligible Applicants Any non-profit or for-profit organization may apply for and administer CDBG federal funds. Eligible organizations include (but are not limited to) local Community Development Corporations (CDCs), real estate developers, schools and hospitals (per 24 CFR Part 84 & 24 CFR

Part 85).

To be eligible, projects must meet at least one HUD approved National Objective. In addition, all projects must meet at least one eligible activity, and must benefit low to moderate income individuals and families, per funding guidelines.

Special Note:This application is not for CDBG owner occupied repair or public service activities. Contact the CDBG Manager for applications for these activities. Projects submitted in response to this application for owner occupied repair or public service activities will not be funded. However you may mention those activities to demonstrate additional activities you are focusing in specific areas.

Application Submittal GuidelinesTo be considered for funding, applicants must submit:

Three paper original signed and typed applications on 8.5’’ x 11’’ paper

Three paper copies of all attachments. If attaching a large document, such as an Environmental Phase 1 or 2 or Neighborhood Plan, only the relevant pages are required to be submitted as paper copies and with relevant sections highlighted.

Three paper copies of the completed Budget and Finance Supplement Excel spreadsheet(s) applicable to this project.

One electronic copy of the typed application, all attachments, and the applicable Budget and Finance Supplement Excel spreadsheet(s) on a flash drive.

Applicants must also adhere to the following general guidelines for preparing the application for CDBG funding:

Project specific questions will not be accepted after June 15th, 2016. General questions relating to eligible activities and programmatic regulations will still be allowed.

The application must be submitted with the required content and in the format requested. Do not submit any handwritten documents. Documents submitted in an inappropriate format will not be transferred to the review committee or evaluated.

Applications must address the items specified in the Project Narrative section and must be organized exactly as specified. Applications that have incomplete responses to questions or which are improperly organized will be given lesser consideration.

Submit only the documents specified in the Required Documentation sections. Do not submit annual proposals, video tapes, flyers, paraphernalia, or any other materials not requested at this time. Additional materials will not contribute to the evaluation process and will be discarded.

Submit ALL DOCUMENTATION requested. Only complete applications will be considered. A complete application includes ALL requested forms and documentation. Applications that are missing any required documentation will not be evaluated. All attachments and documents will be required to be submitted as separate digital files with descriptive titles.

If an applicant is submitting applications for multiple projects, each project should have a separate application response. However, the specific projects may have multiple activities. For instance, a housing project may have different construction, rehabilitation and remediation activities that should be part of one application response; that project should be submitted separately from a commercial project with its distinct activities. Those responses may indicate through maps or narrative how each project supports a larger redevelopment plan for the area.

Do not deliver applications to any other City department or office staff person of the City of Indianapolis. DMD will not review late applications.

Loans and Pro-Forma RequirementsThe City will be underwriting all of the projects that are chosen from this application. The ability of organizations and their associated projects to support loans in lieu of grants will be evaluated. Preference will be given to projects that can support debt. The City may still choose to fund projects through grants where appropriate. However, projects agreeing to the ability to accept a loan can be held to this selection.

Economic Development projects will be asked to complete an economic pro forma to determine the project’s ability to support a loan. Terms of any loans will be requested from the applicant but will be subject to DMD review and approval.

Processing of Applications

DMD will convene a review committee to evaluate eligible applications in terms of federal and local program priorities.

The selected projects will be included in the 2017 Action Plan that will be submitted to HUD for approval.

Before submitting an application, applicants should consider the following: Capacity to complete the requested forms and submit the required documentation by

July 27th, 2016 deadline; If the proposed CDBG activities conform with objectives outlined by the City and are

defined as eligible activities that are listed in this application; Past experience with federally-funded programs, experience managing affordable

housing programs and facility development of: o Commercial/Industrial Developmento Rehabilitation of Unsafe, Blighted, or Abandoned Structures o Affordable Housing Developmento Unsafe Building Demolition/Brownfield Remediationo Rehabilitation/Reuse of Historic Sites, Vacant Buildings or Properties

Ability to deliver proposed projects, activities, or services within an eligible timeframe and meet expected program outcomes and deliverables within 2017 or within 18 months of the contract execution;

If other impediments to complete the project, such as staff capacity, financial stability and site control, would prohibit the project from moving forward and delay both the obligation and the draw of funds in 2017;

Ability to comply with municipal and federal regulations including reporting standards related to these HUD entitlement programs.

Organizational history of failed or terminated projects and/or a record of failure to expend federal funds in a timely manner.

All eligible projects will be underwritten and any project that can support debt will be funded by a loan. Those projects that cannot support debt may be funded as a grant at the discretion of DMD staff. A project’s ability to create program income, that doesn’t create administrative burdens, will be considered for funding.

Funding Priorities:The City of Indianapolis has outlined several priorities as part of this application. Preference will be given to applicants who meet these priorities.

Capacity Priorities1. Organizational Experience and Capacity

Demonstrate organizational capacity to develop affordable housing within HUD timelines and to properly manage the property through the affordability period. Past award experience and monitoring results will be considered.

2. Coordinated and Leveraged Investments Demonstrate how the project leverages other public and private resources to

enhance the financial feasibility of the project and how it investments by multiple

partners in the area partners to provide a positive neighborhood impact.

3. Project Readiness Preference shall be provided to projects that can demonstrate readiness and

ability to commence the project no later than June 2017 with construction mostly completed and funds drawn by December 2017. Applicants must demonstrate readiness through a variety of methods, including, but not limited to: site control, zoning approval, and building plans.

Housing Priorities1. Mixed Income

Preference for projects with a mix of affordable and market rate units integrated within one building or development. Preference for a mix of affordable income levels: 30% area median income (AMI) and below, 30 to 50% AMI, and 50 to 80% AMI.

2. Mix of Rental Unit Sizes and Bedrooms per Unit Particularly in multi-family rental developments, preference toward the provision

of a mix of unit sizes and bedrooms per unit to accommodate a range of household sizes.

3. Mixed Use Mixed use buildings or sites are encouraged, particularly non-residential uses that

can demonstrate benefits to project residents.

4. Permanent Supportive Housing Housing for individuals experiencing chronic homelessness which pairs safe and

stable housing with supportive services.

Economic Priorities1. Business Creation and Growth

Support business expansion and new businesses by job creation activities providing employment opportunities for neighborhood residents, particularly low to moderate income.

2. Sustainable Business Models Utilize funding to encourage sustainable development models independent of

CDBG or City funds to continue operation and impact.

3. Live/Work Communities Create job opportunities within close proximity to residential development

encouraging a live/work community for potential employees.

4. New and Emerging Economic Markets Foster encouragement of expansion and development of new and emerging

markets, particularly as it relates to small business and local entrepreneurs with investment history to and ties with in the city.

5. Section 3 Promotion of the Section 3 principles of job training, employment, and contract

opportunities for low or very low income residents in connection with projects and activities in their neighborhoods.

6. Costs savings and Fiscal Responsibility Preference for projects which promote savings and financial benefit to the

neighborhood, community organization, or City as a whole beyond increased tax base. For example, resources allocated annually to short term fixes to a dilapidated building could now be freed up in a budget for new community development projects.

Design Priorities1. Green Building

Promote green building practices through the design, construction, and operation of affordable housing, with a preference toward development which integrates the standards of LEED, National Green Building Standards, Energy Star, or Enterprise Green Communities. Protect the site’s existing natural features.

2. High Quality Architectural Design Develop attractive, high quality buildings which fit the neighborhood context and

contribute to the overall aesthetics of the area.

3. Accessibility and Visitability Preference for projects that are accessible or vistable, particularly for new

construction projects. Visitable homes have at least one zero-step entrance, doors with at least 32 inches of clear passage space, and a half or full bathroom on the main floor.

4. Crime Prevention Through Environmental Design and Secured by Design Preference will be made for developments designed using Crime Prevention

Through Environmental Design (CPTED) or Secured by Design principles to discourage criminal activity.

Location Priorities1. Transit

Preference for projects within a half a mile radius of an existing IndyGo bus stop, with the highest preference for projects within a half a mile radius of a proposed transit station of one of the following IndyGo rapid transit lines: Red, Blue, and Purple.

2. Pedestrian and Bicycle Infrastructure Preference for projects with access to or resulting in the installation of sidewalks in

the adjacent public right-of-way and, for larger projects, on the site as well. Preference for projects within a half mile radius of bicycle infrastructure such as

bike lanes, multi-use trails, and cycle tracks.

3. Walkable Community Amenities Projects which create housing in areas with access to walkable community

amenities such as retail, grocery stores, schools, universities, parks, healthcare, and places of employment are encouraged.

4. Access to Natural Resources and Green Space Projects which create additional access and proximity to water access, parks, trails,

and other desirable green spaces.

5. Diversity Preference for projects proposed in economically, racially, and ethnically diverse

neighborhoods.

6. Areas without HOME or LIHTC Housing Preference for projects that propose affordable housing in Census Tracts without

HOME or Low Income Housing Tax Credit (LIHTC) housing.

7. Historic Projects which propose rehabilitating structures that are within an Indianapolis

Historic Preservation Commission (IHPC) district, on the National Register of Historic Places, or listed as Contributing, Notable, or Outstanding on the City’s interim report are encouraged.

8. Infill Projects within existing developed areas which make use of existing infrastructure

and city services will be prioritized.

9. Enhanced Proximity to Retail Food Options Creation or expansion of retail food selections for areas significantly lacking access

to fresh fruit, vegetables, and other healthful whole foods vendors including, but not limited to, grocery stores, co-ops, and healthy food providers.

Neighborhood Priorities1. Comprehensive Revitalization

Develop a multi-faceted redevelopment strategy which integrates neighborhood stabilization programs, private market activity, and promising trends, which links multiple activities into a comprehensive effort. Applicant should, using a robust market analysis, indicate the likelihood of catalyzing development, stimulating private investment, and enhancing the tax base.

2. Partnerships Create unique partnerships that benefit the neighborhood and development

residents and provide a more creative approach to neighborhood and community revitalization. Partner examples include, but are not limited to, partnerships with educational institutions, youth organizations, merchant associations, and health

organizations.

3. Located within a Neighborhood Priority Area Priority for projects located within the IndyEast Promise Zone, a Great Places 2020

place, or a Department of Public Safety focus area.

4. Slum and Blight Reduction Removal of abandoned, blighted, or hazardous structures detrimental to

neighborhood safety and success that enhance additional development in the area to promote comprehensive and coordinated development.

Regulatory Considerations:

If the organization is selected as a sub-recipient under a Development/Rehabilitation category, the organization must comply with the following:

1. Davis Bacon and Prevailing Wages : The General Contractor is responsible for full compliance with the requirements of Davis Bacon/Prevailing Wage laws for all contractors, subcontractors, and any lower-tier subcontractors as provided by the Davis-Bacon Wage Determinations established by the U.S. Department of Labor (provided by the Division of Housing Assistance).Davis Bacon regulations can be found at Title 29 CFR Parts 1, 3, 5, 6 and 7. (Title 29 CFR Parts 1, 3, 5, 6 & 7 Guide).

2. If funded, the Project Developer will be required to submit a Davis-Bacon Applicability Form to the City’s Davis-Bacon Compliance Officer to make a determination as whether this project triggers Davis Bacon Wages. Project Developers should also assume construction projects will trigger Davis-Bacon.

3. Environmental Review Process : The City will perform an environmental review as the project site per HUD regulation that can be found at 24 CFR 570.604 and at 40 CFR Part 1500-1508. Note that this full process may take 90-120 days; no work may start until this full process has been complete.

4. Reporting : To ensure compliance, the developer must submit concise reports to be discussed with City staff.

5. Monitoring : All recipients of federal funds will be monitored by City staff to verify project details.

6. Timely Competition : Recipients under contract to receive City and/or federal funds must complete work within the timeframe specified in the contract. Failure to complete the project work may be grounds, at the City’s discretion, for cancellation of the contract.

Insurance Provisions for All Awarded Projects

1. The Applicant shall maintain adequate workers’ compensation insurance for its employees involved in the Project.

2. The Applicant shall maintain, and shall insure that any subcontractor or other third-party retained by Applicant in connection with the project maintains, adequate property damage, automobile, public liability, and/or professional liability insurance coverage as is reasonable under the circumstances given the scope of the project.

3. The Applicant shall also comply with all bonding and insurance requirements of the DMD Policies and OMB Circular No. A-110. The DMD may designate the initial insurance requirements and the DMD may, in its sole discretion, require the Applicant to furnish different or additional insurance during the term of an agreement.

4. Certificates of insurance, naming the City of Indianapolis as an additional insured and showing the coverage that is in force shall be filed with the DMD prior to the commencement of work on the project. These certificates shall provide that coverage under the policies will not expire or be cancelled until at least sixty (60) days prior written notice has been given to DMD. In the alternative, the Applicant shall present evidence to the DMD of adequate self-insurance.

Other City Funding:The City of Indianapolis will be utilizing its Section 108 Loan Guarantee funds from HUD to aid low to moderate income families. These funds have similar requirements to the CDBG program. Section X: Certifications

A Certifying StatementsPlease have a representative officer of the applicant organization initial by each individual certification and sign off below. Please initial on all copies of the application.DMD reserves the right to restrict the release of funds until all of the proposed additional project sources have been secured. If those funds are not secured in a timely manner, DMD may choose to rescind the award and reallocate to a “shovel ready” project.

          

CDBG eligible expenses will be paid out on a reimbursement basis. No funds will be provided prior to incurrent of the costs unless given prior approval by DMD staff.

          

Projects utilizing CDBG funds may trigger Davis Bacon wages. The budget provided as a part of this application will account for Davis Bacon wages unless directly specified by DMD staff prior to application.

          

Project Applicant understands an Environmental Review process (outside of a Phase 1 or Phase 2) will be required of all projects and can take up to three to four months to complete. Until the time of completion, no costs can be incurred or work be done on the project site whether funded by CDBG or with outside funds.

          

Project sites that are not zoned appropriately may take several months to complete and delay project timeline. Zoning is approved and processed outside of the CDBG staff’s application.

          

Projects will be required to follow Lead Based Paint requirements outlined in the CDBG Policies and Procedures Manual, including, but not limited to, full abatement of a project site exceeding $25,000 in CDBG funds.

          

Final architectural plans for a project may be subject to review by a City staffed review team before construction if a grant funds:

o Account for at least 33% of total project costs; oro Any projects for which the grant amount is greater than $400,000
