5/24/12 – Sea Level Rise, Planning for the Future

The Wetlands Program planned, hosted and presented our annual Tidal Wetlands Workshop at VIMS. This years

workshop informed 120 wetlands board members, county and state agency staff, and other interested parties

on sea-level-rise state-of-the-science; living-shorelines research and general permit; and how to use CCRM’s

decision-trees.

In a cooperative effort, Wetlands Program staff also attended wetlands board meetings where VMRC presented

information on the legislative requirement for a living shoreline general permit. We attended ten of these

meetings between October 2011 and January 2012, to listen to issues and concerns, and to answer technical

questions. In addition, Wetlands staff began developing the framework and content for eleven online education

modules. Significant effort was put towards evaulating software needed to convert our content into electronic

learning courses that include testing and feedback. These automated Shoreline Best Management Practices

modules are intended to be online next year to help make training more accessible for local government staff.

Impact assessment statement:

This year we have no numbers to report that would comprehensively reflect tidal wetland permitted losses.

VIMS has recently experienced significant losses in funding which have resulted in changes to our operations.

We no longer conduct site visits and produce impact and alternatives assessments for every permit application.

We do still maintain and serve digital records of permit applications and associated documentation. We do

supply permit assessments for complex and controversial projects when requested.

CCRM/VIMS had twice, with Virginia Coastal Zone Management partnership, sought funding to resolve the issue

of tracking tidal shoreline resources in Virginia without success. It is unfortunate that the NOAA review team did

not understand the complexity of tracking tidal wetlands actions in Virginia and opted not to fund the project on

the first round and that the funding was pulled on the second round.

Perhaps VMRC has some numbers to report.

EXISTING SITE CONDITIONS AND PROPOSED ACTIONS:

This application is for several activities associated with a proposed grain terminal on the Southern Branch of

the Elizabeth River. The proposed modifications include a bulkhead, dredging, and fill to construct a wharf

designed to accommodate ships with trans-Atlantic and Panama Canal capability in addition to upland

transfer and loading facilities. The project site has been used for industrial purposes in the past (formerly

known as the Allied site). It is immediately adjacent to the Atlantic Wood Industries Superfund site, which

is an active remediation project being managed by the US Environmental Protection Agency. The proximity

of the proposed activities to this remediation project warrant careful environmental considerations as

described below.

The proposed improvements will require significant modifications to the existing site conditions. There will

be resource impacts to jurisdictional beach, non-vegetated tidal wetland, and subaqueous habitats. The

existing sand beach is approximately 35-50 ft wide and has been impacted by previous land uses and solid

waste disposal. Although the habitat condition is not pristine, sand beaches are not common in the Elizabeth

River. The proposed loss of this feature would eliminate a unique sandy habitat from the local area.

The largest impact area will occur due to the proposed dredging and filling in subaqueous habitat. The

proposed dredging area includes existing upland, wetland, and beach habitat as well as deepening areas

within the remediation project dredging area. The current proposal also includes approximately 1.0 acre of

fill into remediated subaqueous habitat to create fastland for terminal development. The proposed fill area

is located where contaminated bottom sediments are planned to be removed by the EPA-funded

remediation project and sequestered behind an adjacent seawall.

An on-site tidal wetland compensation area is also proposed on the north part of the parcel. The proposed

design is a straight channel with low marsh and side slopes stabilized with riprap. A tidal connection will be

provided through the proposed bulkhead at the mid-tide level.

THE PREFERRED APPROACH FROM AN INTEGRATED MARINE ENVIRONMENTAL VIEWPOINT:

The Southern Branch of the Elizabeth River has been a restoration target area for several years with both

public and private partners and funding sources. Although intense industrial uses continue in the vicinity,

this section of the river is a confirmed anadromous fish use area and it is designated as Essential Fish Habitat

for 14 federally managed species. There are several oyster restoration reefs and living shoreline projects

nearby some of which were constructed following sediment remediation activities. Evidence of ecosystem

resilience and living resource recovery has already been demonstrated at these restoration project sites,

such as the Money Point project being managed by the Elizabeth River Project.

We agree with concerns already raised by the US EPA, the NOAA Fisheries Service, the US Army Corps of

Engineers, and the Elizabeth River Project. Additional justification is still needed to demonstrate that the

proposed, substantial resource impacts are in fact necessary and unavoidable. In particular, the proposed

filling of 1 acre of remediated subaqueous bottom habitat to create fastland is apparently not needed to

support the adjacent EPA bulkhead, as declared by the applicant. Also, according to VMRCs subaqueous

guidelines, filling on State-owned subaqueous land for the purpose of reclaiming or creating highland

property is generally not permitted. If special circumstances warrant such fill, an appropriate royalty will be

assessed on a square foot basis. Clean material from an upland source is generally preferable to dredged

material for use as fill. (Section III Filling and Dredged Material Placement).

If the project is allowed as proposed, then strict water quality controls and a detailed on-going monitoring

plan during all phases of construction are essential for reducing environmental impacts from this project.

These could include, but are not necessarily limited to, floating turbidity curtains and oil booms, water and

sediment testing during dredging activity, avoiding dredging during sensitive times for migrating anadromous

fish and larval fish, the use of hydraulic instead of mechanical dredging if possible, upland erosion and

sediment control devices, and stormwater management controls.

The extent of Polycyclic Aromatic Hydrocarbons (PAH) contamination in the project vicinity has been

thoroughly investigated by the EPA and others for the adjacent remediation project. However, our

experience with other contaminated sites and remediation projects in the Elizabeth River revealed there is

no guarantee that all potential sources of upland and subaqueous contamination have been located.

The applicant does propose monitoring for remnant contamination in the dredged material prior to disposal

or using it for bulkhead backfill. If it is not already included in the dredge material management plan, soil

testing in the proposed upland excavation area is also recommended to look for unknown upland

contamination sources that might be released during dredging.

The on-site wetland compensation area will provide some low marsh habitat within an industrial setting at

least for the short term. This wetland will likely be affected by the surrounding land uses and stormwater

runoff, solid waste, atmospheric deposition, and other pollution sources associated with the proposed

terminal operations. The long-term ecosystem services of this wetland feature will also depend on how

much sedimentation occurs for suitable marsh elevations to persist given the expected rate of local sea level

rise.

If additional compensation is not specifically required by the Code of Virginia for remediated subaqueous

habitat loss, the applicant is at least encouraged to continue developing a voluntary partnership with the

Elizabeth River Project and others to participate in river stewardship projects and the pursuit of restoration

goals for this watershed.

Another environmental concern relates to future monitoring and maintenance of the adjacent remediation

project, which will apparently be the Commonwealths responsibility. Portions of the remediation projects

infrastructure appear to be located on the applicants property with contaminated material remaining

behind the EPAs bulkhead. It is assumed that some type of formal agreement and institutional controls will

be developed between the applicant, the EPA, and the Commonwealth to ensure that grain terminal

operations over the long-term do not result in contaminated material being re-introduced into the river.

RECOMMENDATIONS SUMMARY:

* Provide additional justifications for proposed encroachments; demonstrate that less impacting alternatives

are not feasible

* Conduct soil tests to verify absence of unknown upland contamination sources

* Implement water quality control measures throughout construction

* Consider participating in Elizabeth River restoration partnership projects

* Confirm that agreements for long-term maintenance and monitoring of adjacent remediation project will

be developed

NOTE

The Virginia Institute of Marine Science (VIMS) applies an integrated coastal management perspective

during the review of proposed activities on tidal shorelines. The coastal ecosystem has dynamic

connections between wetlands, coastal waters and the surrounding landscape. This provides valuable

ecosystem services, such as maintaining water quality, shoreline stability, and wildlife habitat.

Activities should be designed to avoid adverse impacts to coastal resources. When impacts are

unavoidable, every effort should be made to minimize impacts and provide compensation as required.

Product 3: Publications

Center staff produces two biannual newsletters – the Virginia Wetlands Report and Rivers & Coast. The Virginia

Wetlands Report informs readers of near-shore environmental science and related issues to influence better tidal shoreline decisions, and serves to announce upcoming workshops and educational opportunities. The

Rivers & Coast newsletter covers one relevant topic in more detail through use of charts, graphs, maps and photos in an 8-page color publication. Both newsletters are mailed to all local wetlands board members and their staff. Additionally, they are available online and announced through CCRM’s e-newsletter to approximately 1450 email addresses which include local and state agency personnel, General Assembly members, and interested private citizens. CCRM e-News provides the reader with reminders, and quick links, by summarizing a variety of issues that support integrated management of coastal zone resources, and by pointing the reader to more detailed information on our website.

Terrapin By‐Catch Reduction Strategies for Commerical and Recreational Blue Crab Fisheries   The Center for Coastal Resources Management is researching ways to reduce the impact of blue crab trap by-catch to diamondback terrapins (a species of high conservation need). Research has begun to develop a "Vulnerability Index" of terrapin habitats which will integrate:

* Natural habitat features used to define terrapin habitat - tidal marshes, tidal creeks, and nesting beaches, and * Stressors - crabbing pressure, developed lands.

This study will focus on:

* developing a framework for assessing suitable terrapin habitat in relation to man-made stressors, such as crab fishing, and * identifying potential resource conflict areas where crab traps correspond to essential terrapin habitat for the targeted application of management options to reduce terrapin by-catch.

Results from this study will allow managers to identify areas where terrapins are most likely to encounter threats and allow for targeted conservation efforts in those areas. The Virginia General Assembly passed Senate Bill 964 which requires that VIMS develop comprehensive coastal resource management guidance for each Virginia tidewater locality. The Center will begin developing Comprehensive Coastal Resource Management Plans (CCRMPs) which contain information, strategies, and recommendations compiled from CCRM, the public domain, and scientific literature. Localities will be required to incorporate the guidance at the next scheduled review of their comprehensive plan. Each locality's CCRMP is envisioned to include the following components:

1. Best Management Practices (BMPs) for Erosion Control, 2. Local Inventory Data for Tidal Wetlands and Shoreline Condition, 3. Planning Information and Guidance for Climate Change Risks &

Adaptations, and 4. Managers Toolbox.

Virginia's Comprehensive Wetlands Program Plan   Virginia has a newly approved Wetland Program Plan (WPP). Virginia developed a wetland plan to assess current management activities, identify actions to improve efforts, and communicate those ideas. Action Items Monitoring and Assessment: Virginia will maintain wetland monitoring and assessment efforts over the next 5 years. Living Shorelines: Develop a general permit for living shorelines. Management Assessment: Continue the assessment of tidal wetland decision-making. Modify CCRM outreach efforts based upon this assessment. Track Wetlands: Track unpermitted wetland impacts. DEQ is working to locate and quantify unpermitted wetland impacts. Voluntary Efforts: Develop and implement a voluntary wetland restoration geo-referenced database. Water Quality Standards: Continue to assess the relationship between wetlands in the watershed and ambient water quality, particularly water quality impairment. Planning: Develop Comprehensive Coastal Resource Management Plans (CCRMPs). Information: Obtain iterative landcover data set. This effort is critical to a comprehensive picture of Virginia's wetlands with regard to human and/or natural losses of wetland acreage and ecosystem services. Planning for the Future - Spring 2012 CCRM Tidal Wetlands Workshop   The Center for Coastal Resources Management (CCRM) will host a workshop at the Virginia Institute of Marine Science (VIMS) for local government staff, advisory board members, marine contractors, permitting agents, environmental consultants, and anyone else interested in coastal resources management in the Commonwealth. Living Shorelines Policy: The Integration of Shoreline Management and Planning On July 1, 2011, Virginia Senate Bill 964 became a new law pertaining to shorelines. It states that Virginia has a preference for the use of living shorelines as a management approach to shoreline erosion. 40th Anniversary of the Virginia Tidal Wetlands Act July 1, 2012 marked the 40th anniversary of the Virginia Tidal Wetlands Act which recognized the environmental value of tidal wetlands; established a permitting system for their protection; and authorized a network of local wetlands boards to make decisions on development projects within individual localities. The passage of this law in 1972 was ground-breaking, since the federal Clean Water Act was expanded that same year to include wetlands regulation. The Virginia Tidal Wetlands Act of 1972 states: "Therefore, in order to protect the public interest, promote the public health, safety and the economic and general welfare of the Commonwealth, and to protect public and private property, wildlife, marine fisheries and the natural environment, it is declared to be the public policy of this Commonwealth to preserve the wetlands, and to prevent their despoliation and destruction and to accommodate necessary economic development in a manner consistent with wetlands preservation."
