McGowan’s Musings

No tales of my intrepid adventures involving

international travel in this issue, this time the

world of the music industry came to me –

well, not just me personally, but to my home

city of Brighton - by the sea on the South

coast of England. They came in their hordes

on the Wednesday May 18, for the third

edition of the Music Cities Convention, then

on the following day for the three days of the

11th sold out edition of The Great Escape.

(See brief reports in this issue) Both these

events took place at the same time as the

Brighton Arts Festival and the Brighton Fringe

Festival. Busy or what!? What was your VIP-

News Editor to do under such pressures?

What he, I that is, did, was the sensible thing

and sat in the office, also known as the

outdoors area of the Waggon and Horses

pub, and welcomed all of those international

guests that inevitably passed by the hostelry.

The weather was distinctly varied, but I sat

through rain and shine, sharing local ales

with our visitors. The fact that dinner in my

local one evening involved the organisers

of Dutch and Canadian conference and

showcase events, a long established French

Festival, several Chinese festivals, Swiss Music

Export, gives you an idea of the global spread

of the delegates. A more than convivial time

was had by all - if you weren’t there I suggest

you should be next year!

Of course there were other things going on

in the world of music, and unfortunately

some of them were tragic. Eight people died

recently over two days at concerts. Five people

lost their lives at Manila based open-air dance

event Forever Summer. They had all collapsed

after experiencing difficulty breathing and

were rushed to hospital but died of heart

attacks. There is no positive explanation, but

there is some suspicion that spiked drinks

were responsible. Two people also died at a

rock concert hosted by motorcycle club The

Lords in Nenzing, Austria, when a 27-year-

old suspected neo-Nazi named as ‘Gregor

S.’, fired into the crowd, another 11 people

were injured. According to local police, the

gunman returned to his car and shot himself.

Also in a follow on from the killings in the

Bataclan in Paris last November, Eagles

Of Death Metal were dropped from the

Rock En Seine and Cabaret Vert festivals in

France in response to statements made by

frontman Jesse Hughes claiming that security

guards at the venue were involved with the

terrorists that carried out the attack. He had

apologized after making the claims in a Fox

News interview, but again claimed that the

attackers had somehow gained early access

to the venue, in a subsequent interview with

Taki’s Magazine.

So, let’s hope that awful incidents such as

these can be put behind us, and we can all

hope for and look forward to a festival season

free of tragic incidents, be they accidental or

deliberate.

Returning to a lighter note, I was surprised

to see that The Eurovision Song Contest,

an event often not taken seriously by many

of us including myself, although it is the

world’s longest running annual TV music

competition, was watched by 204 million

people across 42 markets – 5 million more

than in 2015. Just goes to show, what do I

know? Also, talking of millions, if you’ve got

a spare 20 of them, in pounds sterling, Noel

Gallagher says he’ll reform Oasis for you, for

one gig. Any takers?

And just before I go, I’d like to point out

that the festival due to take place at a secret

location in Kent, UK, on June 17-19, known

as the Wildfire Adventure Camp, including

the “Top Secret” Officers Mess Party and

the Cupid’s Singles Club amongst others,

will include ‘Naked Knitting’ in the planned

attractions – see you there?

Two French music festivals have cancelled

Eagles of Death Metal`s concerts this

summer in reaction to comments by the

band`s frontman over the Paris attacks.

The Rock en Seine concert in Paris and the

Cabaret Vert festival in northern France

said in a statement Friday they are “in total

disagreement with Jesse Hughes` recent

allegations.”

Hughes told the Libertarian webzine Taki`s

Magazine last week that he saw some

“terrorists” in the Bataclan concert hall

before the Nov. 13 show and saw “Muslims

celebrating in the street during the attack.”

In March, Hughes made similar statements

about the attacks -- namely that he

believed some Bataclan security guards

knew the club would be targeted -- and

later apologized. “I haven`t been myself

since November 13,” he said at the time.

“I realize there`s no excuse for my words,

but for what it`s worth: I am sincerely sorry

for having hurt, disrespected or accused

anyone.”

The band`s performance on Nov. 13 turned

into a bloodbath when suicide bombers

stormed in as part of near-simultaneous

attacks in Paris.

The band had previously returned to France

to perform a show in Paris on Feb. 17.

The organisers of Glastonbury Festival have been fined £12,000

after admitting allowing human sewage to leak from a tank and

pollute a stream.

The leak happened at the Worthy Farm site in Somerset in June

2014, damaging water quality and killing fish.

At Bristol Magistrates` Court, District Judge Simon Cooper ordered

the festival to pay £19,000 in costs.

However, he found that organisers had “low culpability”, and

praised their response and systems.

“I am still slightly amused that it has been necessary to go to this

level of detail,” Judge Cooper said. “I am concerned that these

proceedings have set the Environment Agency somewhat against

Glastonbury Festival Ltd.

He added: “I am satisfied that there was proper planning for the

festival and no criticism is made of that. The Environment Agency

were in an advisory capacity and signed off the sanitary facilities

plan. There was a waste management plan, there was a rivers and

streams management plan.”

The court heard that 42 fish were killed after a “large quantity” of

sewage filtered into Whitelake River.

Sensors in the stream alerted the Environment Agency to increased

ammonia levels. The court was told that fish - including protected

brown trout - died as a result.

Festival founder Michael Eavis told an earlier hearing in Yeovil that

the sewage had been contained in a £100,000 slurry tank.

The third edition of the fast growing

Music Cities Convention brought together

high level speakers from Australia, US,

Canada, Indonesia, Holland, Denmark, UK,

France, Germany, Russia and Iceland. The

programme of discussions left no doubt

that City authorities are increasingly aware

of the importance of music as a driver for

the night time economies, and a positive

way of engaging communities. Warnings

were sounded that the closure of venues, as

has been happening all too often in London

for instance, can result in musical creativity

being pushed to the edge leaving a soulless

City.

Speakers presented a vision for the night

time economy emphasizing that properly

and responsibly run music shows should

not be continually considered as creating

noise and encouraging misbehavior, but

should be welcomed and protected as

‘the other 9-5’ . Studies of the economic,

social and cultural impact of nightlife on

a City, such as that completed by the San

Francisco Entertainment Commission were

recommended as a positive method of

impressing policy makers. Brighton is to

undertake a study over the next year or so.

This year, the Reeperbahn Festival

Conference is planned to be bigger than

ever. Around 250 events – including

sessions, networking events, meetings,

showcases, and awards shows – will be

part of the programme. From September

21-24 The organisers expect around 4,000

industry professionals from 40 countries to

attend – more than ever before.

The first confirmed speakers for the

conference’s sessions programme have also

been announced:

John Giddings is one of the biggest and

best-known music agents and promoters in

the world. Responsible for many of the most

high-profile tours of recent years, including

tours by The Rolling Stones, Madonna,

Genesis, Celine Dion, Iggy Pop, and David

Bowie, he is a key player in the world of global

stadium touring. John also revived the Isle of

Wight Festival, which, thanks to his efforts,

has grown in stature and calibre. Today the

festival is as much part of the British calendar

as Wimbledon and the Proms. Reeperbahn

Festival looks forward to an exciting and

entertaining tour through John’s career, and

to hearing about his relationships with some

of music history’s most inspiring pop artists,

his plans for the future, and his views on

today’s global live music business.

Chelsea Collier is immersed in Austin’s

startup scene more than just about

anyone; Austin (Texas) is considered to

be Silicon Valley part two. She has been

involved in the launch of more than a dozen

companies and advises and counsels a

multitude of startups through her consulting

firm, Intercambio, which develops

partnerships and expands influence in

economic development, tech policy, social-

civic impact, and entrepreneurship. She is

co-founder of Impact Hub Austin, a hub for

entrepreneurs that is connected to 11,000

international members focussed on making

a positive impact in the world. In her talk,

Chelsea will showcase the Austin ecosystem,

providing both a historical perspective and

recommendations for future action.

Benji Rogers is the most outspoken

Blockchain evangelist; in recent months this

one word has continuously popped up in

discussions about the future of the music

business: PledgeMusic founder and chief

strategy officer , is coming to Hamburg to

promote this technological revolution at the

Reeperbahn Festival Conference., and to set

out his idea for a fair trade of music data

based on smart technology.

As referred to in the Musings, this year’s

edition of The Great Escape sold out,

attracting 16,500 festival goers to see 450

bands present 625 shows in 35 venues

throughout Brighton. The Conference

element drew 3,500 delegates representing

45 countries.

VIP-News asked organizer Kevin Moore

for his reaction to the success of the

event:

I’m truly delighted with this year’s edition

of The Great Escape. Moving into our 11th

year we knew that we had a hard task ahead

after last year’s 10th birthday celebrations

and so we challenged ourselves to deliver

the best and freshest TGE yet and I strongly

believe we did just that.

We delivered a fantastic Street Party for

the people of Brighton and created a real

festival atmosphere, we breathed new

life into our delegate hub, booked our

strongest and most diverse line up yet and

delivered strategic partnerships across the

board all in the name of new music and

discovery.

The Festival ended with a sell out show

at the Brighton Dome by Stormzy. As in

the last couple of years many shows were

over subscribed and fans had to get in line

pretty early to make sure of getting in to

see many of the sought after acts. I was

lucky to get on the guest list to see Songhoy

Blues, and I also recommend James Grant

from Switzerland. Amongst the acts that

received good reports were Skinny Girl

Diet, Exmagician, Anna Meredith, DBFC,

and two South Korean bands whose names

I’ve temporarily misplaced! All are worth

checking out, in general it was agreed that

the standard of acts was extremely high.

Biffy Clyro will perform at Reading and Leeds this year for the tenth

time. The 2016 headliners will also present an exclusive acoustic

performance at Headrow House, Leeds, on Wednesday 1 June..

All Reading & Leeds ticket holders will be able to enter a ballot

for the chance to win tickets to this exclusive performance. All

successful ballot entrants will receive a confirmation email, with

a link through to ticket collection, from 8:30am Friday 27 May.

A transaction fee of £3.50 will be payable for each ticket. All

proceeds will be matched by Leeds Festival and donated to local

charity, Martin House.

An Agency, Not A Start Up...Manfred Tari [email protected]

For more than two decades the Berlin

based Dirq Niemann was part of Powerline

Agency, an agency that still has the

reputation of being a rock solid boutique

agency.

However, the Powerline co-founder and

previous stakeholder has moved on and at

the beginning of 2016 launched his own

company DQ-Agency.

VIP-News asked Niemann about his new

company and his new challenges.

VIP-News: What lead you to start your

own company after so many years with

Powerline Agency? What’s happened

since then and are you pleased with

the results you’ve achieved so far?

Dirq Niemann: Indeed, there were many

good reasons for me to make the decision

and finally leave Powerline Agency at the

End of 2015. to launch dq agency straight

after leaving, on January, 4th 2016.

After setting up the first team, we moved

into an office community with Staatsakt

Label, where I had already taken care of the

booking for a couple of artists, and whom

we will do even more co-productions with

from now on. This is helpful for both sides

as it makes the communication between

Label and Agency so much easier and way

more productive.

Being in the lucky position to have booked

tours from February on, I can say it was a

smooth start. I managed to find the right

people for my team, who are interested

and willing to put a lot of effort into the dq

agency ‘project’

VIP-News: Please tell us about your

company policy and development

strategy for DQ-Agency...

Dirq Niemann: As a small and new company

on the market, I have to count on my

credibility and reputation, resulting from

my experience and work at Powerline

Agency for the past 22 years. These are the

resources I can work from. So the main focus

is to build up a strong newcomer roster on

top of all the artists that followed me from

Powerline. As we all know, the subculture of

today will be the culture of tomorrow; and

I´m still curious about new bands and scenes

to explore.

VIP-News: In these days isn’t it a bigger

risk to start a complete new company

rather than joining an established

company? Various other players within

the German concert market have rather

decided to join or to move on to bigger

concert companies instead of launching

their own business.

Dirq Niemann: Of course, it is a bigger risk

to found a new company, than joining a

bigger player, but honestly, I come from the

90’ies DIY scene and have always been my

own boss. I prefer the freedom of making

my own decisions, not that I would say that

this couldn´t change within the next years.

Never say never!

VIP-News: What was the reaction of

artists that you had already worked

with when you were still part of

Powerline when it came to setting

up DQ-Agency? And how has your

business network responded to the

move?

Dirq Niemann: The reactions from all sides

have been absolutely positive, from the

artists, who all followed me, as well as

from my business network. I got even more

positive statements and respect for this step

than I had expected. I mean actually there

is no big change for all of them, they know

who I am and how I work.

VIP-News: Is there anything you miss

now since you have to oversee your

own company?

Dirq Niemann: What do I miss? Of course

the financial comfort zone, but nothing

much else. I mean I´m really kind of proud,

that I have been part of Powerline Agency

and what we developed from our ideas. I

think it was a really great booking agency,

but also, this is nothing, that isn´t doable

again. Even though there is less time for it.

We started Powerline in our twenties and

had all the time in the world to do what we

wanted as we liked it. Obviously I´m a little

bit older now and lead a different life, so

there is the need to get the company built

up faster. But I like applying the necessary

combination of creativity with experience,

that is what makes it really exciting to do.

VIP-News: The market situation for

festivals and tours in Germany is

changing, basically led by market

consolidation and concentration. Do

you consider these developments as a

burden for smaller companies and what

are your expectations regarding the

impact these developments will have

on the concert market?

Dirq Niemann: The current tendencies of

consolidation and concentration started in

the 90’ies already. So this is a process that´s

been going on for a long time now. These

days companies with their own impact and

interests own the festivals, but this goes

only for the fully commercialized part of

the German market. On the other hand,

there are a lot of nice, less, or even non-,

commercial festivals established and I think

right now there is still enough room for

small agencies and acts to find their way

to the stages. And last but not least, it is

always about the act you talk about.

In general I think the bigger festivals

will become even more boring, because

there is less room for experiment and

new influences. They need a strong and

safe billing which fits their audience and

competes with the competition between

these major festivals, I´m sorry for them

being in that position.

But I´m a really optimistic character, or

possibly absolutely mad!

Always good to see artists taking an active role by expressing their

opinions on how `their` business is run! Mumford & Sons and Little

Mix, very different acts but with shared opinions, are leading calls

to combat ticket touts. They are calling on live music fans“stand

up” to rip-off ticket touts and to petition parliament to take further

and decisive action on the activities of ticket resellers. Fans are

encouraged, using the hashtag ToutsOut, to sign a petition so that

tougher penalties for touts can be debated in Parliament.

The hope is that public support will engender 100,000 signatures

for a debate to be held about tougher sanctions for resale websites,

aimed at forcing ticket resellers to reveal their identities. So far,

more than 12,000 people have signed the petition.

Mumford & Sons issued the following message on their website

that links to the petition:

“If getting onstage is one of the best things about being a

musician, seeing your audience get ripped off is undoubtedly the

worst.“At M&S HQ we try hard to ensure that true fans have the

best opportunity of getting into shows, at the right price, but are

often powerless when faced with organised industrial-scale ticket

touting.

“At the moment, the law makes it easy for these shady operators

to hoover up tickets and profit at your expense – so we are joining

with others across the music and creative communities to support a

petition that demands politicians tighten up consumer legislation.

“If 100,000 of you sign it, then the government will be pressurised

to consider the issue for parliamentary debate.”

The petition is headlined Enforce the Consumer Rights Act to

protect music, arts and sport fans from touts.

It states: “On a commercial scale, touting deprives the Treasury of

VAT, and performance copyright holders of royalties that should be

paid on the mark-ups. It also denies artistes the ability to ensure

their events are priced so anyone can attend.”

A Department for Business, Innovation and Skills spokesman said:

“In the Consumer Rights Act, the government committed to an

independent review of online secondary ticketing.

“The review has been considering a wide range of stakeholders’

responses to consider how best to represent consumers’ interests.

We are expecting the review report in late May 2016.

UK consumer magazine Which? Has

published a research report stating that

some of the biggest secondary ticketing sites

are routinely listing tickets unlawfully. It says

GetMeIn!, Seatwave, StubHub and Viagogo

all offer music and theatre tickets for sale

without adhering to the rules laid out in the

previously reported Consumer Rights Act,

which introduced some light regulation of

the ticket resale sites last October.

The magazine sampled 200 listings for

a variety of shows, including Beyonce’s

‘Formation’ tour., finding that information

on the face value of tickets, seating

information, and restrictions were regularly

not being provided, despite such information

now being required by law when tickets are

resold.

StubHub responded, saying that “there are

instances where sellers may not have access

to this information at the time of listing, as

some primary vendors do not provide this at

the time of purchase”.

But, when Which? Posed as a seller, they

found that some sites are simply not

displaying information that has actually

been provided to them. Viagogo, for

example, makes it mandatory for sellers to

input the exact face value cost, but then

does not always display this figure.

It is possible that seating information may

sometimes be unavailable at the time of

purchase, but there could be a fear that if

this is made available then some promoters

and artists wouldl cancel those tickets.

None of the Viagogo listings that Which?

checked had a seat number, and other sites

also failed to provide them on all listings.

None of those checked demanded that

sellers provide seating details covering

tickets for specific seats.

Which? Director Of Policy And Campaigns

Alex Neill. Commented, “We’ve found

evidence of tickets being sold unlawfully.

This means people will struggle to find basic

information on tickets, such as face value

and seat location. It is clear the protections

put in place by the Consumer Rights Act

aren’t being followed by some of the biggest

players in the market, and no action is being

taken against them. The government must

crack down on bad practice so that people

know what they’re buying and don’t get

ripped off”.

Which? is calling on the government to

clarify that it is the secondary sites, rather

than individual sellers, who are responsible

for ensuring that the required information

is displayed, something that has been of

much debate since the Consumer Rights

Act became law. The research comes ahead

of the publication of the results of the

government’s latest review of the secondary

ticketing market, which is due but not

available as VIP-News went to press.

AEG Live has appointed industry veteran

Jorge Melendez as its chief financial officer.

Melendez, joins AEG Live from rival Live

Nation, where he served as chief financial

officer of touring and the global artist rights

divisions for more than nine years. During his

tenure at the company, he was in charge of

managing the overall business unit`s profit

and loss, coordinating worldwide touring

activities and ensuring the operational

efficiency of the division.

Reporting to the company`s chairman and

CEO Jay Marciano, Melendez will oversee

the division`s financial operations including

financial governance, regional finance teams

and risk management across its touring,

festival and venue.

“We are very pleased to welcome Jorge to

AEG Live’s senior leadership team,” said

Marciano. “He joins us with more than 25

years of global experience in finance and

operational management and brings a

wealth of knowledge and expertise as we

continue to build our business around the

world.”

Before joining Live Nation, Melendez served

as EVP and chief financial officer for EMI’s

Latin America Business. He also spent 17

years at Sony Music International where he

held senior management positions, most

recently serving as EVP of Sony Discos, the

company’s US Latin Label.

“I am thrilled to join the talented team at

AEG Live, which has an incredible track

record of success,” added Melendez. “With

the continued demand for live music globally,

this is an exciting time to join this dynamic

company.”

Global Entertainment launched last year as a

combined management, publishing and label

operation out of Los Angeles and London,

now the company cut back on staff.

The company appointed ex-AEG boss Randy

Phillips as CEO, as it brought together Global’s

established publishing division – including

clients such as Ellie Goulding, Corinne Bailey

Rae, LMFAO, The Script, The Vamps and The

Vaccines – with label, artist management,

promotion, live concerts, events, touring,

branding, sponsorship and marketing teams.

A month later, it announced a string of

high profile appointments: ex-Universal

publishing exec Monti Olson and ex-Capitol

exec Bob Semanovich joined the Los Angeles

HQ alongside ex-Modest! manager Nicola

Carson. Meanwhile, former James Grant

management exec Ben Karter was drafted

into Global Entertainment in London as GM

of Recorded Music.

Alarm bells struck just six months later, when

Randy Phillips left the business. We were told

he would be appointed to a “specific project

to be announced in due course” – but it

never publicly materialized.

Now Global Entertainment on both sides of

the Atlantic has been cut back to skeletal

staff, incurring heavy job losses.

Following a redundancy process at the end

of last month just two or three individuals

CTS Eventim- Top Ratings By Analysts

On May 26, CTS Eventim announces its business results for Q1/2016.

Already various analysts have recommended buying the company’s

shares, although the share price targets vary significantly from each

other.

The Berenberg Bank, who earlier this year was the focus of

investigations following on from revelations by the Panama Paper,

predicts a price target of 46 Euro. A research report by Commerzbank

expects a price of 44 Euro, and the analysts of Bankhaus Lampe and

the investment bank Oddo Seydler both assume a price of 37 Euro.

The previous reported share price on April 25 was 29.99, on May 23

when this edition went to press the share price was at 31.54 Euro.

DEAG- Annual Meeting On June 23

DEAG are launching a new department for corporate events, serving

the increase in popular artists being available for gala events; the

roster of acts for these kinds of events featuries artists such as Till

Brönner, David Garrett, Chris de Burgh, Jamie Cullum, Bryan Ferry

and Zucchero.

However in the media DEAG faced one more critical article for its new

festivals and the financial losses resulting from those. At beginning

of May the German news-magazine Spiegel released a one-page

article about the development and difficulties the introduction of

the festivals caused for DEAG. The story itself did not include any

new news and mainly reads as a summary of the various legal battles

in which DEAG has recently been involved.

For investors the next relevant date will be the annual meeting to be

held on June 23 in Berlin. On the agenda amongst other items, are

questions about the issue of new shares with a value of 8 million Euro.

Anyhow, since the last issue of VIP-News the share went down from

3.80 to 3.70 Euro.

Live Nation- Revenue Up, Debts Up, Loss 2 Cent Down

The business report for Live Nation for Q1/2016 once again delivered

increased revenue results, but also increased debts and a slightly

lower loss compared to last year’s results for Q1/2015.

In the first three months of 2016 the revenue of Live Nation went up

10%, from $1.120 to $1.230 billion. The net loss results improved

from previously minus $66.5 to just $55.9 million and lead to net loss

per share of $0.29 instead of $0.31.

The results for total liabilities and equity moved up from $ 6.156 to

$6.927 billion, the total current liabilities summed up from $2.1 to

$2.9 billion.

The share price is also on the move up, from a previous $21.57 to

$23.07 at New York Stock Exchange. Within one year the share price

of Live Nation went down 18.68 percent.
