GUIDELINES FOR ONLINE VISA TO COLOMBIA (Courtesy translation)

The Visa Online service allows you to apply for a visa from your home or office. This service is available 24/7 and may accessed from any location worldwide. You will only have to visit the Consulate to get the stamp of your visa on your passport if your application has been accepted. Remember that in the event that the application is made through a third person, it should include the corresponding power of attorney granted before the relevant authority, and he/she must appear personally with the corresponding identity document and the passport of the applicant. PLEASE NOTICE:

1. DOCUMENTS OF SUPPORT. The documents to support your Visa application must be in PDF format and the combined size of all scanned or uploaded documents must not exceed 3 MB.

2. PHOTO. Passport styled face photograph / White background / 3cm of width X 4cm of height / max. 300 KB in size / MUST BE IN .jpg FORMAT.

PROCEDURE

1. Go to https://tramitesmre.cancilleria.gov.co/tramites/enlinea/solicitarVisa.xhtml

This link will take you to the new online Visa application form (in Spanish).

Select the option VISA, under the menu EN LINEA

The system will show you the following screen:

Write your NUMERO DE PASAPORTE = Passport number and your NACIONALIDAD = nationality and then click on CONTINUAR

2. The screen SOLICITAR VISA will be shown:

In the field GRUPO: please state if you are part of a group and select de type of group. If you are applying for your own visa, select NINGUNO.

In the field SOLICITUD DE, select VISA

In the field CLASE DE VISA, select the type of visa you are applying for o NEGOCIOS (Business) o TEMPORAL (Temporary) o RESIDENTE (Resident)

In the field CATEGORIA DE LA VISA, select the type of visa you are applying for o NE-1, NE-2, NE-3, NE-4 (for Business) o TP-1, TP-2, TP-3, TP-4, TP-5, TP-6, TP-7, TP-8, TP-9, TP-10, TP-11, TP-12, TP-13) o RE

If you are not sure what type and code is your visa, please confirm the information on http://www.cancilleria.gov.co/en/procedures_services/visas/types Also you can check the last page of this document for a quick overview.

Then click on CONTINUAR.

3. The screen SOLICITANTE will be shown:

In the field TIPO DE SOLICITANTE, select TITULAR, if you are applying for your own visa or you are the head of a group (such as a family group).

In the field TRAMITADA POR, select DIRECTAMENTE POR EXTRANJERO (directly by foreigner).

If you have lived in Colombia and you have the document called “Cédula de Extranjería”, please write the number. Otherwise, leave it blank.

In the field: TIENE OTRA NACIONALIDAD (do you have another nationality?): If your answer is NO, then click on CONTINUAR. If your answer is YES, then complete the information required (Nationality and passport number).

And click on AGREGAR, to add the information.

If you have more than 2 nationalities, click on CREAR and included the information. Then, click on CONTINUAR

Remember to check your email address, All information regarding the application will be sent there.

NEXT TEPS:

1. PLEASE SEND (EMAIL/TRAVEL AGENT) THE EMAIL YOU RECEIVED FROM THE ‘CANCILLERIA’ TO THE CONSULATE IN NEW DELHI ([email protected]) including:

The number of your application (previous image, in the red circle), your passport number, your name and mobile number. This will allow the Consul to be aware of your information.

2. THE CONSULATE STUDIES YOUR APPLICATION AND PROVIDES FEEDBACK (via email from the online system)

a. INSUFFICIENT DOCUMENTATION:

i. You would be asked to send the information required or

ii. You would be asked to re-submit the application again if there are discrepancies within the

application. In such a case, the study fees must be paid again.

b. NEGADA (Denied): in case your visa won’t be approved

c. APROBADA (Approved).

3. With this confirmation (email), proceed to pay the fees for your visa at the KOTAK MAHINDRA BANK of your

convenience (same details than above). Please contact immediately the consulate for the exchange rate.

4. After payment, please SEND/ BRING YOUR PASSPORT TO THE CONSULATE ALONG WITH THE RECEIPT OF THE

MONEY YOU DEPOSITED FOR YOUR VISA.

5. THE CONSULATE PRINT AND STICK THE VISA IN YOUR PASSPORT

6. YOU CAN COLLECT YOUR PASSPORT WITH THE VISA.

ARTICLE 20th. –About Permissions. The Colombian Migration Special Administrative Unit may grant Entry and Residency Permit, as well as Temporary Residency Permit to foreign visitors who enter the national territory without the intention to stay in the country and who do not require a visa, prior compliance of the requirements established by administrative act, in the following manner:

PIP (as per its initials in Spanish). Entry and Residency Permit. This permit will be granted by the Colombian Migration Special Administrative Unit to foreigners at the moment of their entry, who do not require a visa, for ninety (90) calendar days, with the exception of the Entry and Residency Permit technical mode (PIP-7), which will be only granted for thirty (30) calendar days.

PTP (as per its initials in Spanish) Temporary Residency Permit. This permit (extension), will be granted to foreigners that request residency in the national territory after having used the Entry and Residency Permit (PIP). This permit will be based in two conditions:

o For foreigners that enter the country as visitors. o For foreigners that need to clarify any administrative or legal situation

within the Colombian territory. In both of the previously indicated conditions, the Temporary Residency Permit will be granted for ninety (90) calendar days and may be extended in accordance to the established by the migratory authorities, for foreigners that need to clarify any administrative or legal situation within the Colombian territory.

PGT (as per its initials in Spanish). Transit Group Entry Permit. This permit will be granted to transit group foreign passengers from ships of touristic cruises that visit the sea or river ports that board the same ship. For such effects, no visa or the proceeding of any migratory card will be required from the passenger. Also, it will not be necessary to place an entry or exit stamp on the passport or traveling document. A migratory control will be made to transit group passengers from ships of touristic cruises that board at the sea or river ports in order to go to another country of destination by any migratory control post. For the situation described in the paragraph above, the foreigners that require a visa to enter the country shall present it before the migratory authority.

ARTICLE 21st.-Entry and Residency Permit. The Colombian Migration Special Administrative Unit may grant Entry and Residency Permit (PIP) in the following cases:

PIP-1. To the foreigner that wishes to enter the national territory and whose presence shows a particular importance for the Colombian State, or else, when the nature of said entry responds to the development or compliance of agreements or international treaties. In the present case, the permit shall be granted for ninety (90) calendar days.

PIP-2. To the foreigner that wishes to enter the national territory for the development of non-regular academic programs that do not exceed one (1) semester taught by educational centers in the country, or in virtue of an exchange or student practice making academic agreement. Likewise, when the foreigner wishes to enter the national territory to be trained in an art or profession. In the present case, the permit shall be granted for ninety (90) calendar days.

PIP-3. To the foreigner that wishes to enter the national territory in order to receive medical treatment. In the present case the permit shall be granted for ninety (90) calendar days.

PIP-4. To the foreigner that wishes to enter the national territory to clarify their personal situation in legal or administrative procedures. In the present case the permit shall be granted for ninety (90) calendar days.

PIP-5. To the foreigner that wishes to enter the national territory for leisure or recreation activities as tourists. In the present case the permit shall be granted for ninety (90) calendar days.

PIP-6. To the foreigner that wishes to enter the national territory in order to attend or participate in academic, scientific, artistic, cultural or sports events without any working links in order to present an interview in a process of selection of personnel for public or private entities, corporate training, contacts or commercial or corporate administration and journalistic coverage. In the present case the permit shall be granted for ninety (90) calendar days.

PIP-7. To the foreigner that does not require a visa and wishes to enter the national territory in an urgent manner with the purpose of providing specialized technical support to a public or private entity. In the present case, a permit of thirty (30) calendar days per year shall be granted. If the specialized technical support takes an additional time and the foreigner has already received said permit during the calendar year, he/she shall make the corresponding visa request proceedings.

PIP-8. To the foreigner that requires a visa or not, and wishes to enter the national territory as a crew member from an international transportation company. In the present case, a permit of seventy two (72) hours will be granted.

It is a discretional competence of the Colombian government, founded in the principle of State

sovereignty to authorize the entrance, stay and exit of foreigners from the national territory.

Without prejudice of international treaties, the entrance, stay and exit of foreigners from the

national territory will be ruled by Decree 0834 of 2013.

A visa is the authorization granted to a foreigner to enter Colombian territory and issued by the

Ministry of Foreign Affairs.

The permanence is the time allowed for a foreigner to be in Colombian territory.

The validity of the visa is the time comprised between the date of issue and the date of expiry

printed on the visa.

The requirements for the issue of visas have been established by ministerial resolution.

TP 1: For the foreigner that wishes to enter Colombian territory as a student, student-intern,

professor, professional or titled technician whose purpose is to carry out internships, conferences

or language assistant and enters Colombia based on existing international cooperation treaties in

which Colombia is a member or sponsored by the ICETEX – Mariano Ospina Perez; and/or

when sufficient proof can be demonstrated that accounts for cultural or academic exchange

programs or activities.

And for a holder of a diplomatic passport who enters the country temporarily in order to develop

activities different from those purely diplomatic.

And for an international dissertation jury of a Master’s or Doctor’s degree, or as a conference

speaker, expert, invited member of academic investigation programs; or as a personality of

recognizable international prestige invited to develop projects and programs that promote the

transfer of knowledge and new technologies in different disciplines without the existence of

contractual bonds whatsoever.

By virtue of Law 1556 of July 9th, 2012 that “encourages Colombia as a place for international

cinematic footage”, and whose a part of the artistic, technical and production crew necessary for

the production of the said movie.

Attach the document described in the first four bullets and in virtue of the treaties or

standing international agreements in which Colombia is a part of, the following: a) Proof

of inscription from an education center recognized by the Ministry of Education or b)

Certificate that an internship will be executed or c) Invitation letter to speak at a

conference or be a language assistant or d) Certificate issued by ICETEX, signed by the

competent public official where its stated that the applicant has been granted the

"Mariano Ospina Perez" scholarship or e) Certificate of the according institution that

validates the academic or cultural exchange, or

Attach the documents described in the first four bullets and certificate of the institution

where you will be international jury of Masters or Doctors degree, or

Attach the documents described in the first four bullets and certificate of the pertaining

institution to be an invitee to the processes/activities of investigation, or as a personality

of recognizable international prestige invited to the development of projects and

programs that promote the transfer of knowledge and new technologies in different

disciplines, or

Attach the documents described in the first four bullets and a certificate that proves your

condition of artistic, technical or foreign production personnel coming to Colombia to

produce films in the territory. A copy of the medical insurance valid for the same time of

your stay in the country will be necessary.

company responsible of the International Transport Service, indicating the activity to

carry out and the company's obligation to respond to the Colombian government for your

stay and departure, b) certificate of existence and legal representation (attach the pages

that contain: identity, social object, legal representatives, capital or stock composition and

function of the legal representative) in the event its a foreign company, attach the

certificate of existence, legal representation or its equivalent, c) When you arrive to the

country for technical reasons, a copy of the permit issued by the Maritime General

Direction for ships and boats.

Fishing boat crew - Attach the documents described in the first four bullets and a) Letter

from the legal representative of the company responsible of the International Transport

Service, indicating the activity to carry out and the company's obligation to respond to the

Colombian government for your stay and departure, b) certificate of existence and legal

representation (attach the pages that contain: identity, social object, legal representatives,

capital or stock composition and function of the legal representative) in the event its a

foreign company, attach the certificate of existence, legal representation or its equivalent,

c) Letter from the legal representative of the responsible entity, where it manifests its

attainment to the regulations concerning the hiring of foreign nationals. In this case you

should present proof that the indicated above was dutifully informed to the Maritime

General Direction d) Corresponding company permits to carry out fishing activities

issued by the corresponding authority.

Dredger - Attach the documents described in the first four bullets and a) Letter from the

legal representative of the company responsible of the Dredger, indicating the activity to

carry out and the company's obligation to respond to the Colombian government for your

stay and departure, b) certificate of existence and legal representation (attach the pages

that contain: identity, social object, legal representatives, capital or stock composition and

function of the legal representative) in the event its a foreign company, attach the

certificate of existence, legal representation or its equivalent, c) Permit issued by the

Ports and Maritime General Direction for your operation.

Attach the documents described in the first 5 bullets and letter of acceptance, where it

references the agreement between the sponsor institution and the educational institution,

in the event the object is an exchange student, or

educational institution that accredits that in the course program an internship or training

program is required, in the event the object is a student - intern, or

Attach the documents described in the first 5 bullets and in cases of studies different than

elementary, high school, technical, technological or higher education such as

issued by the educational institution proving that the hour intensity is of a minimum of 10

When the case concerns underage foreign nationals, attach power of attorney subscribed

by the parents designating a legal guardian or tutor of the student during his/her stay in

must come from he/she who has legal custody of the minor.

summary page of each bank statement of the last 6 months that present an account

average balance of more than 100 current legal minimum monthly salaries or c) In the

event of an individual, it is required the first page or summary page of each bank

statement of the last 6 months that present an account average balance of more than 10

current legal monthly salaries and copy of the Colombian ID or d) In the event of an

NGO, valid document that shows the legal capacity of the entity (attach the pages that

contain: identity, social object, legal representatives, capital or stock composition and

functions of the legal representative), first page or summary page of each bank statement

of the last 6 months that present an account average balance of more than 50 current legal

minimum monthly salaries.

In group - Attach the documets described in the first 4 bullets and a) Download, fill and

sign the "Resumen de Contrato Grupo" form that you will find at www.cancilleria.gov.co

and b) In case of corporate entity, declaration of assets, certificate of existence and legal

representation and first page or summary page of each bank statement of the last 6

months or c) In case of an individual first page or summary page of each bank statement

of the last 6 months or d) In case of NGO, valid document that credits the legal capacity

of the entity (attach the pages that contain: identity, social object, legal representatives,

capital or stock composition and functions of the legal representative), first page or

summary page of each bank statement of the last 6 months.

In case that the employers are organs, entities or institutions of the Colombian State,

International Governmental Institutions, Diplomatic missions or Consular offices in

Colombia you will only require letter issued by the legal representative or he/she who

acts as such.

Letter issued by the legal representative or hierarchical superior of the religious

community in which it specifies the mission that the foreign national will be carrying out,

the bond between the foreigner and the religious organizations and takes responsibility

before the National Government to respond for the foreigner and his/her expenses during

his/her stay in Colombia and the departure from the country and return to the country of

origin or last place of residence, as well as his family is this is the case.

representative of the organization describing the activities the foreign national will be

carrying out in the country, the work program he will undertake, the length and agenda,

the assumption of all cost responsibility during the stay of the foreigner in the country as

well as the expenses for his/her return to his/her country of origin or last place of

residence of the foreigner and his/her family according to the case and

Certificate signed by the NGO legal representative where it shows that experience and

competence of the foreigner in relation with the activities he/she pretends to carry out in

the country or that the foreigner is an intern and

Valid document that credits the legal capacity of the non profit organization, or NGO

(attach the pages that contain: identity, social object, legal representatives, capital or

stock composition and functions of the legal representative) issued by the competent

Colombian authority or similar document from a country different from Colombia with a

minimum antiquity of 5 years and issued in the last 3 months. Both requirements could be

substituted by a document that proves that the organization has consultative status of the

Economic and Social Council of the United Nations (ECOSOC)

exercise of professions or independent work activities.

monthly stipend of no less than 3 current legal minimum monthly salaries, or

Attach the documents described in the first 4 bullets and certificate where the rent is

clearly stated issued by public entity, banks, financial corporations, social security

institutions, insurance companies or any other private company, recognized by the

respective government that pays or wires the rent; or the original of the contract that

permits the proof of the rent. In both cases, the amount cannot be less than the equivalent

to 15 current legal minimum monthly salaries, or

Attach the documents described in the first 4 bullets and certificate of legal representation

issued by a colombian Chamber of Commerce within the 3 months prior to the

application of the visa, in which it states that the foreign national is a partner or owner of

a company legally constituted and registered with a capital or assets registered and paid

by the foreigner with a worth no less than 100 current legal minimum monthly salaries

(attach the pages that show: legal identity, social object, legal representatives, capital or

stock composition, functions of the legal representative), for an anonymous society a

certificate of stock composition must be signed by the fiscal revisor, precising the worth

of the stocks owned by the foreign national, which cannot be less than 100 current legal

Certificate issued by a legally capable medical institution indicating the medical

Communication issued by the Departament of International Exchange of the Bank of the

Republic in which the Foreign Direct Investment is registered in order for the foreigner to

buy a property in his name, for an amount of more than 350 current legal minimum

monthly salaries and the Certificate of Tradition and Liberty issued by the respective

Office of Public Instruments, with an issue date of no more than a month in which the

property ownership by the foreigner is shown. The value of the property cannot be less

than the one stated in this paragraph, or

Letter issued by the applicant indicating the activities he/she will develop in Colombia,

accompanied by the Curriculum Vitae in which the work experience in the field is proven

and with at least 2 certifications of work background as well as a bank statement of the

last 6 months where the average balance is more than 15 current legal minimum monthly

salaries.

In the event the applicant is a beneficiary of an entrepreneurship program or activity

sponsored by the Ministry of Commerce, Industry and Tourism a certificate issued by the

Ministry should be presented. The said certificate must clearly state that the foreign

national is a beneficiary of an entrepreneurship program or activity, public or private,

recognized by the entity.

its a purchase of a real estate on monthly quotas and it is in construction, an authentic

copy of the public statement which credits the promise of purchase or b) In case of

acquiring titles of participation issued as a result of a title grant of real estate o

construction proyects or through real estate funds, document issued by the entity that

emits them as proof of the acquisition.

companion of a Colombian national.

months before applying to the visa and b) Copy of the Colombian ID of your Colombian

spouse and c) Letter from the Colombian national requesting the issuance of the visa for

Visa NE1: to the foreigner who wishes to enter the country with the purpose of

undertaking commercial and entrepreneurial activities, promoting economic

exchange, making investments and creating companies. Visa NE2: to the foreigner who wishes to enter the national territory temporarily as a

business person within the framework of international instruments in force, among

others: free trade agreements, association agreements and within the scope of the

Pacific Alliance with the purpose of carrying out entrepreneurial management

activities; promoting business transactions; developing investments; establishing the

commercial presence of a company; promoting the trade of cross-border goods and

services, or other activities defined in said instruments.

Visa NE3: to the foreigner who wishes to enter the national territory as the head or

representative of a governmental foreign commercial foreign office, or to the one

acting as such, for the promotion of economic and commercial exchange in or with

Colombia.

Visa NE4: to the foreigner who wishes to enter the national territory as the president or

senior executive of a multinational company to make investments and create

companies.

NE 1: For the foreigner, who wishes to enter the country with the purpose of carrying out

commercial and business endeavors, encourage economic exchange, invest and create companies

in the country.

the country. Please attach documents that contain: legal identity, social object, legal

representatives, capital or stock composition, functions of the legal representative, or

Official communication of the legal representative of the commercial, industrial or

service company legally established in Colombia that sponsors your visit. The letter must

contain a description of the activities you will be carrying out in Colombia, the economic

sector in which they will develop and the investment plans for these activities. Also it

must contain an explicit phrase in which the company takes responsibility of your stay in

Invitation/presentation letter regarding the applicant for a Business Visa written by a

Chamber of Commerce or official commercial or foreign investment promotion office

applicant will be carrying out in Colombia.

Recomendations

The authority in charge of the issuance of visas shall have the power to conduct

interviews and request more documentation in the cases it considers it is convenient,

whether personally or through an adequate means of communication.

The holders of the visas whose duration exceeds three (3) months, as well as their

beneficiaries, shall register at the foreigners’ registry of the Special Colombia

Migration Administrative Unit within the fifteen (15) calendar days counted from their

entry into the country or from the issuance date of the visa if it was issued in the national

territory; or within the fifteen (15) days following their entry into Colombia if the visa

was issued at a Consulate.

All the necessary documents for the granting of any of the visas, in Colombia or abroad,

must be legalized or must have an apostille, as the case may be, and translated by an

official translator into Spanish, if written in a different language.

The documents issued in Colombia, supporting or being part of the requirements of a visa

applied for before a Colombian consulate abroad, do not need to be legalized and do not

need an Apostille.

In the event of any mistake found in the data of the visa granted, as long as they are

typographical or spelling errors not affecting its essential data, the holder shall have a

maximum time period of thirty calendar days to request their correction. Once this period

has expired, the holder must request the visa transfer.

Remember that if your application is not admitted you must submit it again and make a

new payment for its study (Document analysis).

NOTA 1. RESPONSABILIDAD O COMPROMISO

De acuerdo con lo dispuesto en las normas migratorias colombianas, el empleador o contratante, sin perjuicio de las acciones legales

correspondientes que se desprendan del cumplimiento del contrato, prestación de servicios, acuerdo interadministrativo o acto

administrativo, se compromete ante el Gobierno Nacional a sufragar los gastos de regreso al país de origen o al lugar de residencia del

extranjero contratado o vinculado, así como de su familia o beneficiarios, según el caso, a la terminación del contrato, vinculación, período

de transferencia, o en situaciones que le impidan cumplir las funciones o actividades objeto del contrato, o cuando proceda la cancelación

de la visa, la deportación o la expulsión. Esta obligación cesará cuando el extranjero obtenga Visa Temporal como cónyuge o compañero

permanente de nacional colombiano o Visa de Residente.

NOTA 2. PROFESIONES REGULADAS

De acuerdo con lo dispuesto en las normas colombianas vigentes, si la actividad a realizar que se desprenda del cumplimiento del contrato,

prestación de servicios, acuerdo interadministrativo o acto administrativo, se enmarca dentro de una profesión regulada, las partes se

comprometen a cumplir con los requisitos legales establecidos para el ejercicio de cada profesión u oficio en el territorio nacional.
