It is a process based on the Order and we have to determine whether it is PD under Part 6 and whether prior approval is required for the siting and appearance of the building. Hi Laura, While I remember – please see the neighbour comment that is on Anite dated 16th June 2013. This was not entered into Uniform under all of the neighbours. As its an AGDET I don’t think this is a major issue but we did inform Mrs Giddings (the one ‘other’ neighbour) that wrote in. I wondered whether when we receive the details for prior approval we need to either add the others or not inform any neighbours – I seemed to think we didn’t normally for AGDETs anyway even if we received comments?

From: David Mead [mailto:[email protected]] Sent: 11 June 2013 08:40 To: Holland, Jackie (Planning) Subject: RE: 1300792AGDET - Storage building I can confirm that the holding trades under the name of Mr David Hopkins. Land is owned at Pidley and Hemingford Grey. The vast majority of land is used for grazing. Pigs and cattle are reared and sold from the holding. The application site has been used for the production of hay for well over 10 years, hence an open field. A site visit will show that there is currently hay stored on site and simply covered with a tarpaulin. This is not sufficient and a building is required. The hay is stored and then sold on. The building has been designed to accommodate the hay that can be taken off the field.

To be able to consider submissions under Part 6 Class A of the Town and Country Planning (General Permitted Development) Order 1995 the application must be for development on agricultural land in an agricultural unit which are reasonably necessary for the purposes of agriculture within that unit. Within the GPDO (Part 6 D.1) “agricultural land” means land which, before development permitted by this Part is carried out, is land in use for agriculture and which is so used for the purposes of a trade of business, and excludes any dwellinghouse or garden and “agricultural unit” means agricultural land which is occupied as a unit for the purposes of agriculture..” In light of the above please provide additional information relating to the agricultural trade or business that this application would relate to being undertaken on the land– Agricultural Holding number, company name etc. The submitted application form states that the land on which the proposed development would be located has been in use for agriculture for the purposes of a trade or business for 10 years – can this be demonstrated? The planning history held by the department shows that the land was previously open field and part of the former restored Marsh Lane Gravel Pits. The history is not clear on the use of the land. As such please provide additional information by no later than Friday 7th June. If the information provided is considered acceptable the application will be registered and the prior approval details considered. Following HDC's comments to him regarding the relocation of his proposed storage building, he has initiated the Appeal process for his original application and put in a second for the wakeboard cable, changing rooms and retention of car park and road. Dear Lesley, We have a current Agricultural Determination prior approval submitted to us for the above site. I am emailing you as it appears from our system that it is likely that we have sent you a consultation letter this is in error. This relates to a proposed storage building and the details can be viewed on Public Access under reference 1300792AGDET. You will note that there is a document called Important Information which states that Comments cannot be accepted on this application. May I take this opportunity to explain the process of an Agricultural Determination submission. Under the Town and Country Planning (General Permitted Development) Order 1995 Schedule 2 Parts 6 and 7 – certain agricultural development is ‘permitted development’ (PD) and does not require the submission of a planning application. This is similar to the PD rights that householders benefit from for certain sizes of extensions. The Order can be viewed following the link below: - http://www.legislation.gov.uk/uksi/1995/418/contents/made The Order requires the person undertaking the development to apply to the planning department in advance of works commencing for a determination. This determination is required to give the Council a chance to decide whether it is necessary for them to give prior approval of the siting, design and external of the building. It is these matters only that are considered. Development cannot commence until a decision notice from the Council has been issued stating that prior approval is not required or 28 days has passed since the date on which the Council received the application and the Council has not made a formal decision. Comments: The size of the proposed building and the nature of its construction is not in keeping with a hay barn. The area of land suitable for growing hay is only 2.83 hectares - the rest beng lake. The description of the site given in a previous application as ‘an informal water ski lake’ has now conveniently changed to agricultural use. However the size of the building off set against the size of the pasture just does not add up. Given that the landowner previously wanted to turn this agricultural land into a watersports centre/caravan/camping site and has later proceeded with works that required planning permission. What would come next, once a part-brick building of such a size was constructed? It would be very interesting indeed to see what type of foundations the landowner

would be laying for this purported agricultural storage building. Could this later be converted into a boat or club house or five individual holiday chalets the size of the completely self-contained ‘store’ at one end already indicated in the plans? Could the proposed construction also store the MasterCraft speed boat the owner currently possesses, along with any other watersports equipment in connection with the intended use previously declared?
