    JosephAddisonBullen-JosephBullencametotheDuluthareain1853tofoundapermanentsettlement.HemadeclaimtoMinnesotaPointandthepresentsiteof

    Duluth,althoughthiswasIndianTerritoryatthetime.HealsomadelegalclaimtotheshoresofAllouezBay,upLeftHandRiveranduptheshoresofSt.LouisBay.Hewassentbyeasternbusinessmenwhobelievedtheareacouldbeeconomicallyviable.ThetrialtookplaceattheDouglasCountyCourthouse.

    JudgeWilliamR.Foley(W.R.Foley)wasthepresidingjudge.

    JudgeFoleywasborninMaidenRock,WIonOctober10th,1869.HeattendedtheUnviersityofWisconsinandgraduatedlawschooltherein1892.In1893helocated

    toSuperior,WI(NeedtotrackdownBulletinoftheStateBarAssociationofWisconsinVolume13Page86)HediedonJanuary18th,1940athishomeinSuperiorafterabriefillness.

    ThecasewasheardintheWisconsinCircuitCourtinSuperior,WI.

    J.B.ArnoldwasfromDuluth,MNandH.W.DietrichwasfromWestSuperior,WI.

    HewenttopublicschoolinEauClaire,WI,highschoolinMerril,WIandcompletedundergraduateandlegaldegreesattheUniversityofMinnesota.HewasacourtclerkinSuperior,WIandwasadmittedtotheMinnesotaBarin1888andtheWisconsinBarin1889.HepracticedlawinSuperiorfrom1889-1903,andbecametheAssistantDistrictAttorneyinSuperiorin1896andendedthatin1897,afterwhichhewentintoprivatepracticeinDuluth.

    H.S.ButlerandT.L.McIntoshweretheattorneysforthedefense.

    T.L.McIntoshwastheCityAttorneyfortheCityofSuperior.TherearemanyothercasesinwhichheasCityAttorneyandHanitch,Hartley&McPhersonhadalignedinterests.

    PeterLemieuxismy3rdGreatGrandUncle.HewasbornonWisconsinPointin1851.HisfatherwasFrankLemieux.Hewasborninahousethatby1920wasnolongeronthePoint.

    IntestimonyPeterLemieuxstatedthatheknewwherethehousehegrewupwasbecause,[Myparents]toldmewhereitisandIsawtheoldlogsusedtolaythereanditwasallrottenthatisallIseethere,kindofrottenstuffthere.[Myfathersaid]Thatishouseyouusedtolive.

    PeterLemieuxisaskedaboutthehousebuiltbyJohnBardon.Apparentlyinthefallof1919PeterLemieuxwenttothePointandmadeabookofmeasurementsforthepurposeofbeingabletotestifytothelocationofthevariousLemieuxhouses.HewentouttothePointwithhisbrotherJohnLemieuxwhoisalsomy3rdGreatGrandUncle.Idothemeasuring,pacingandmybrothertakethemeasurements.HewasaskedhowtheymadethemeasurementsandherepliedUsedthesamewayIusedtolocatesomelandinthatcountry.

    ThetestimonymovestothefourthhousewhichisstillstandingonthePoint.Hedoesntknowtheyearthefourthhousewasputupsoheuseslifeeventstomakeatimeline.

    Hesayshewasmarriedin1872atage31.Whenhegotmarriedhetookhiswifebackhometothatoneroomhousewhichhisfamilywasstilllivingin.Theylivedthereandhissister,my3rdGreatGrandAuntMaryLaviergegotmarried,Idontrememberwhatmonth,MayorJune,Icouldntsay,aftershegotmarriedwenttoGradPortagethatsummerMysisterand[her]husband;heworkedforgovernment;governmentblacksmith.Ithinkhewentawayforacoupleofyearsandhecamebackanystayedtogetherin[thethird]house.

    FrankLemieuxandIsabelleOsaugielivedinthefourthhouse(withtheirchildrenincludingMaggieMartineau).MaryandJoeLaviergelivedinthethirdhouseandPeterLemieuxandhiswifelivedinthesecondhouseallofwhichwereonthePoint.

    PetercametoSuperiorin1879.Hecamebecausehewantedmyoldestgirltogoto

    schoolandIlivedinSuperior.AtthispointhehadlivedinSuperiorforover40years.HesaysaboutthePoint,ofcourseIcampthereonceinawhiletimemyfolksusedtolivethere,usedtogohometwiceorthreetimesaweek.

    RegardingthefourthhousePetersaid,Well,[myfather]toldme,hefiredacoupleofmentohelphimputitup.
