OVERVIEW VIRTUAL 4 March 2021 | 9am to 5pm The recent years saw the Philippines enact several new laws which significantly affect employment relationships and business operations in the country, such as the Safe Spaces Act, Expanded Maternity Leave Act, Telecommuting Act, and the Mental Health in the Workplace Act. These new developments vastly change the landscape of Philippine labor law affording employees with additional levels of protection. An equally important focal point in Philippine labor law are the developments brought about by the Covid-19 pandemic. The Philippine government was constrained to update its regulations concerning work-from-home and telecommuting arrangements; the national health insurance program; compensation during calamities; and new regulatory compliance for the operation of businesses, including scenarios involving closures and/or mergers or acquisitions. These new regulations are critical, as some of these are being required for Philippine businesses to continue operations in the country. Apart from new laws and regulations, there had also been changes in existing doctrines and accepted Philippine best business practices. For instance, given the quarantine and mobility restrictions imposed by the Philippine government, there have been emerging trends, queries, and changes in appreciating the commensurability of employee discipline today whenever health or mobility-related issues are involved. Mastery of these changes in Philippine labor law and business regulatory compliance today is, thus, essential for businesses to adapt and stay ahead of the curve in the Philippine business landscape. Ms. Pomoy represents domestic andinternational clients on all aspects ofemployment and industrial relations. Sheprovides clients with timely and accurateadvice, delivered in the mostcomprehensible manner. Ms. Pomoyfrequently assists clients in draftingemployment policies, handbooks,releases and severance agreements, aswell as non-competition agreements.   Ms. Pomoy also has extensiveexperience litigating single and multi-plaintiff cases before the National LaborRelations Commission on a wide range ofemployment issues.  Ms. Pomoy has conducted seminarsand lectures, local and international onPhilippine labor law. Ms. Pomoy is aco-author of the Philippine chapter ofthe Tenth and Eleventh editions of theEmployment Law Review.

THE TRAINERS

Atty. Herrera has extensive experiencein the field of Labor and employment,including conciliation, mediation andarbitration of labor disputes.   He hasalso assisted clients and renderedadvice on the labor aspects of mergersand acquisitions, redundancy,retrenchment, labor compliance audit,job-contracting, illegal dismissal cases,and labor and industrial relations. Atty.Herrera regularly counsels clients onrestricted covenants, employmentagreements, and laws and regulationson recruitment of employees both forlocal and overseas employment.  Atty. Herrera was among the lecturerswho conducted a masterclass onPhilippine Employment Law inSingapore in 2019. Atty. Herrera obtained his law degreefrom the University of the PhilippinesCollege of Law in 2015. He became amember of the Integrated Bar of thePhilippines in 2016.

Mr. Consignado provides counseling andadvice to local and foreign investors onPhilippine labor laws in general, andassists multinational companies in theirday-to-day employment-related issuesand concerns. He handles employmentissues in corporate restructuring,including mergers and acquisitions. Healso contributes to Lexology and writesarticles in legal journals andpublications. Apart from labor and employment law,Mr. Consignado’s practice also includesinternational and domestic arbitration,civil and criminal litigation, familyrelations, estate planning andsettlement, intellectual property law,corporation law, and contract law. Mr. Consignado is a member of theIntegrated Bar of the Philippines (“IBP”)and of the Intellectual PropertyAssociation of the Philippines (“IPAP”). Heearned his Bachelor of Arts (2012) andJuris Doctor (2016, Second Honors) fromthe Ateneo de Manila University.
