Chair and Chief Executive’s Foreword

We started the year with our membership survey which gave us valuable insight into members positive view of our performance and what our priorities should be. Members ranked training and learning opportunities as one of the key benefits of being part of our family. We hope more members will participate in 2020, especially as a highlight of the past year has been the unveiling of our dedicated training suite. Based at Resolution HQ in central London, this space allows us to offer members a wider array of training opportunities than ever before. We have also prioritised the development of online learning to ensure that all members, regardless of location, can participate and benefit from the training and learning venue.

Significant progress was made in our campaign to secure no-fault divorce and despite some set-backs (a general election) which were out of our (and anybody else’s)

control, this now looks certain (fingers crossed!) to be made law in 2020. Our wider policy work will continue on issues such as cohabitation reform, Brexit, championing early legal advice and ensuring that more of the public are aware of and benefit from the full range of dispute resolution techniques and multidisciplinary approaches that Resolution members can provide. We have learned a huge amount from our work and engagement with policy and law makers on the no-fault campaign. We will work closely with our expert committees to provide ministers, MPs and officials with advice and compelling arguments to improve family law legislation and policy in 2020.

Members’ survey

Members’ surveyIn Spring 2019, we undertook a major member research project to help us understand our members; what they need and want, how they make use of their membership and identify areas where Resolution could have a greater impact. We benchmarked results against a previous one taken in 2016.

The big highlight: A +64 Net Promoter Score A Net Promoter Score (NPS) is used to gauge the loyalty of an organisation’s members/customers and their willingness to recommend it to someone else. Scores range from -100 to +100, with a positive NPS score considered good and a score above 50 considered excellent.

In 2016, Resolution’s NPS score was a strong +40, however we are thrilled to have seen this increase to an exceptional +64. A key contributing factor to this score is the pride our members feel – more than 90% of respondents said that they are proud to be a Resolution member.

Shifting perceptionsOur Code of Practice continues to form the foundation of Resolution’s work. It remains a major reason for joining Resolution and satisfaction in this area among our members is increasing. However, we are so much more than the Code of Practice and are pleased that the perception of Resolution as a single-issue organisation is shifting.

There has been a sharp rise in the number of members who believe the main purpose of Resolution is challenging and improving existing models of practice, up from 14% to 24%. Over 85% of members told us that Resolution membership supports their professional development.

Campaign priorities We work hard to raise awareness of the issues that affect those working in family law, and you can read elsewhere (Pages 10 – 11) about some of our policy successes. In recent years we have rightly focused on the introduction of no-fault divorce. Our survey showed 96% of members believe that, without Resolution, the government would not have committed to changing the law.

We want to see those sorts of numbers replicated across all our campaigning work, and over the next couple of years we will be looking to involve all our members in a big piece of work to set out our vision for a family justice system that works for everyone.

Diversity and Inclusion

Diversity and InclusionA remarkable 48% of members contributed to Resolution’s first membership diversity survey. These findings will underpin the work of the Equality, Diversity and Inclusion (EDI) Committee as they develop a strategy for creating a more representative and welcoming organisation for all.

The survey found that the ethnic background of Resolution's membership broadly reflects that of the whole UK workforce. It does not, however, reflect the population of lawyers, with Resolution members disproportionately white.

Over half (53%) of our members state they are Christian with over 30% of members having no religious affiliation. In comparison with the population of lawyers, those of Muslim faith are most underrepresented in the Resolution membership, as are Hindu, Buddhist and Jewish although to a lesser extent.

The lesbian, gay, bisexual and transgender (LGBT) membership is reflective of the general population but more of our members are gay or bisexual than across the wider lawyer population.

7.5% of Resolution members declared themselves as having a disability whilst just under half of members have caring responsibilities for children, the elderly or someone with a disability.

This snapshot of our membership will inform our work and act as a baseline to measure the success of the action we take now and in the future.

Now we have the data it is incumbent upon us all to become more inclusive; to really think about how we can achieve a truly diverse membership. You can expect lots of hard work by the EDI Committee. We can’t bring about an inclusive welcoming organisation alone. But together with all of you and the staff team, we can.

Changing practices

Changing practicesResolution constantly looks for ways to support members through the ever-changing environment they work in.

Resolution has partnered with Law for Life to create Affordable Advice

Legal aid cuts have resulted in a huge rise in the numbers of Litigants in Persons (LIPs). In response Resolution has partnered with legal charity Law for Life to launch Affordable Advice – a referral service which blends online step-by-step guidance with offline legal advice from a panel of Resolution members. This project delivers affordable fixed fees, price transparency and unbundled legal advice. It encourages early intervention and addresses the obstacles that have, in the past, prevented people accessing legal advice.

We support members through campaigning, training, good practice guidance, and regular articles and content about the changing face of family justice. Members are updated through the year with our regular e-mail bulletins and the bi-monthly magazine, The Review.

In 2019 your responses to our court survey gave us compelling evidence to present to MPs investigating the court modernisation programme. Nearly half (49%) of respondents said courts they had historically used for family cases have closed. Three quarters of members said that the ability to easily access the right information in a reasonable timeframe from the court by email or telephone has got worse or much worse.

The Justice Select Committee's final report called for HMCTS to set and publish ambitious targets for divorce completion, an immediate moratorium on court closures and recommended that planned staffing cuts do not go ahead. This is another example of how Resolution allows members voices’ to be heard in the corridors of power.

Some of the cases are already being shipped off to courts 80 miles away. We are hearing stories of people who just cannot make a half hour appointment over in Brighton or Hastings when they have childcare responsibilities. So our predominant concern is access to justice.

Family law reform

Family law reformOur campaigning to improve the family justice system accelerated in 2019 with major progress to secure no-fault divorce, support for members through Brexit uncertainty and putting our members and your issues front and centre in the General Election campaign.

Divorce without blame Our 30-year campaign to get no-fault divorce on the statute books looked as if it was finally secured when the Government called a General Election throwing the legislative agenda into disarray. Frustrating as this was, Resolution put no-fault divorce at the centre of its Fairness for Families manifesto, gaining firm commitments from all the main parties that they would introduce legislation in the next Parliament. Finally, Resolution’s three decades-long campaign to end the blame game, driven forward by members, looks as if it is about to be realised.

Resolution hosted a roundtable discussion in March to solve the 'mad riddle' of Brexit.

The Brexit question?Resolution provided regular briefings to ensure members were kept up to date and advised on how to future proof their work as Brexit approached. During the implementation period, all EU family law instruments will continue to apply, and the UK will remain subject to the 2005 Hague Convention. However, if an EU-UK deal is not finalised by the end of 2020, no-deal is firmly on the table again. Fortunately, Resolution hosted a roundtable discussion in March with prominent family lawyers to make sense of the ‘mad riddle’ of Brexit, and the implications of a no deal scenario.

Domestic Abuse BillMembers continued to campaign to end the cross-examination of domestic abuse victims by their alleged perpetrators, with legislation due to be re-introduced soon. Resolution will also work with our partner organisations to continue calls for many of the measures already commonplace to protect vulnerable people in the criminal courts – such as privacy screens, separate waiting areas and the ability to give evidence by video link – to be implemented in family courts.

Family law reform

In the run-up to the December election, Resolution published its Fairness for Families manifesto which focused on four key areas of reform:

1. No-fault divorce

2. Legal protection for cohabiting couples at the end of their relationship

3. Protecting victims of domestic abuse

4. Funding for early legal advice for separating couples

All three parties committed to two or more of our asks in their election manifestos which is a huge achievement for our organisation.

Professional development

To support members’ professional development, Resolution runs a programme of conferences, courses and events supplemented by a range of digital resources.

Financial Planning on Divorce and Separation ConferenceRun by the financial advisors on the Specialist Accreditation Committee, this inaugural conference covered a range of different topics. It included sessions on: financial remedies, safeguarding, mortgages, expert reports on pensions, and understanding the role of family consultants. It also looked at the specialist accreditation that Resolution offers financial planners.

DR Conference The 2019 DR conference in Nottingham was sold out, with over 200 delegates from across the country. Highlights included a keynote address from Mr Justice Cobb and the Henry Brown Lecture delivered by Angela Lake-Carroll. Debates at the conference included: Forcing people to mediate/collaborate: can that ever be a realistic option?

YRes Conference

Over 160 practitioners attended YRes Conference which focused on professional development and wellbeing. The President of the Family Division, Sir Andrew McFarlane, delivered the keynote speech that explored the state of the family court, the future and wellbeing among practitioners. Vice Chair Matthew Richardson made a compelling case for promoting wellbeing and how focusing on oneself can lead to better outcomes for businesses as well as for clients.

National ConferenceFormer chair Nigel Shepherd was awarded honorary lifetime membership of Resolution at our National Conference in Manchester in recognition of his three decades of campaigning for no-fault divorce. Workshops covered parental conflict, practitioner self-care, pensions, Brexit, cohabitation claims, the future of family law and much more.

Resolution is run by members, for members. Committees lead the way on much of our work and we’d like to thank committee members for their time and expertise.

Your committees in 2019

The Children’s Committee gave evidence to the President’s Working Group for Medical Experts, promoted their Parenting Plan and delivered a workshop at National Conference. In 2020, they’ll produce the private law children orders precedents, publish a Good Practice Guide for Public Law proceedings and hold more training events and workshops.

The Cohabitation Committee published new Cohabitation Claims and Cohabitation Agreements and hosted a workshop at National Conference. In 2020, they plan to raise awareness about the lack of legal protections for cohabiters and schedule training at the YRes National Seminar.

The Collaborative Working Party issued regular e-bulletins, made training available on Learn Resolution and conducted POD visits to support collaborative and multi-disciplinary working. In 2020, they will add podcasts and internet-based training to their e-bulletin, work with regional groups to support collaborative practice, and support PODs with marketing advice.

The Drafting Committee launched its online drafting resource allowing members to build consent orders without needing to use a paid product. This tool can be accessed on the Resolution website. The committee will roll out the nuptial agreements precedent in 2020.

The Dispute Resolution (DR) Committee produced guidance for mediators on drafting consent orders, created a model for Child Inclusive Mediation with the FMC and developed new models of working for the future of family law. In 2020, they will continue to promote new models of family law practice and develop training to enable, particularly YRes members, to train in DR earlier in their career.

The Domestic Abuse Committee produced a new toolkit to screen for domestic abuse and has promoted core issues, such as securing justice for and protecting victims, in the Government’s Domestic Abuse Bill. In 2020, they’ll campaign for a simplified means and merits test for victims and will investigate training available for members dealing with abuse cases.

The Equality, Diversity and Inclusion Committee produced the results of Resolution’s diversity monitoring survey and recommended equality training for committee chairs, NC, staff teams and themselves. In 2020, they will publish guidance notes on disability, modern families, religions and culture.

The Innovation Group provided affordable legal advice to separating couples through the Affordable Advice project and developed processes for reviewing new ideas, services and technology for members. In 2020, they will produce a workshop and seminar, review technology for members and takeover Resolution’s national Twitter account for a time.

The International Committee advised the government on Brexit and achieved key amendments to no-deal legislation. They also provided regular Brexit briefings for members and recorded a round table discussion about the impact of Brexit. In 2020, they will highlight the impact of online divorces on international cases and push for changes to the system including the need for effective issuing and service of petitions.

The Legal Aid Committee responded to consultations on the introduction of £25,000 limit on certificates, expert witness and on new digital ways of working. In 2020, they want to increase the type of certificates with a £25,000 limit, work with LAA to make VHCC cases easier to manage, as well as improve interim advocacy payments to solicitors.

Your committees in 2019

The Training and Learning Committee provided strategic oversight on the delivery of training. In 2020, they will identify skills that would enhance members’ practice and develop training packages around these. They will support work to make DR processes more mainstream and develop a new approach to accreditation based on modules.

The YRes Committee held their second conference with their Chair and Vice Chair presenting a session that detailed how being good to yourself can be good for business. They also laid out a timetable for a Wellbeing Policy set to be implemented by 2021. Over the next year, they will gather data on wellbeing to inform their policy and a YRes Chairs Forum is planned for October.

The Litigants in Person Committee created resources to ensure LIPs were better informed, easier to work with and knew when to seek advice. They created packs for courts to send to LIPs when issuing various applications. In 2020 they’ll look at ways to promote the resources, link up with other organisations involved with LIPs and create resources for mediators.

The Parenting After Parting Committee launched podcasts highlighting resources available to members, fed into Private Law reform consultation and arranged a takeover of the national Resolution Twitter account to promote the work of the committee. In 2020, they will produce a new comprehensive guide for members to use with clients and continue to develop training.

The Pensions, Tax and Financial Remedies Committee published a Pensions Advisory Group report, participated in a Financial Remedy Pilot and coordinated two workshops on tax and pensions at National Conference. In 2020, they will monitor the impact of Brexit on financial remedy matters as well as other changes in law and practice that will affect members.

The Publications Board updated the Resolution Handbook and developed practice notes on culture, diversity, religion, domestic abuse and crime. In 2020 they will publish practice notes on pensions and pensions implementation as well as looking at information for non-lawyer Resolution members. The handbook will be published in the autumn.

The Specialist Accreditation Committee created a video highlighting benefits of the scheme and continued the Assessors’ Day to evaluate the scheme. In 2020 they will encourage members of the Bar to become specialists, launch new portfolios of multi-disciplinary practice and FGM as well as open a dialogue with the Scottish Family Law Association over cross border jurisdictional issues.

The Standards Committee updated the Code in Practice course and the Good Practice guide on communications. In 2020, they will support a campaign to relaunch the Code, complete a Good Practice Guide on dispute resolution as well as ensure all Good Practice Guides are easily accessible.

In June 2019, we held our second National YRes Conference in London, supported by the President of the Family Division, Sir Andrew MacFarlane. The goal of the conference was to provide delegates with the tools and confidence to make changes and be the best family lawyer they can be; examining the personality traits of family lawyers and what drives them.

Wellbeing has been a major priority for YRes over the last three years. In March, our Chair and Vice Chair presented at National Conference on wellbeing and how being good to yourself can be good for business. This past year paved the way for the foundation of our Wellbeing Policy. Collaborating alongside external partners, our aim is to put wellbeing at the heart of Resolution and provide members with support throughout their career.

Financial overview

In 2019, Resolution’s income totalled £2,326k. Of this, over half came from member subscriptions with much of the rest generated by training and learning activities.

Financial overview

Membership continues to be at the heart of our organisation, in terms of the focus of our core activities, the promotion of our Code of Practice, and our financial performance, through subscriptions and training income. Our ongoing work means our member numbers remain strong and on an upward curve, which in turn means we are in a sound financial position, enabling us to constantly and consistently improve our service to members.

Overall, our total income (including subscriptions) increased by 9%, and total expenditure increased by 4% reflecting our prudent approach to spending in the current market and acknowledging our commitment of £122K of reserves for project work.

During 2019 we continued the careful investment of our reserves, in line with the strategic objectives and activity previously agreed by the Board – chiefly on the development and launch of our new website, as well as specific projects around membership, and training & learning. We ended the year with an overall surplus of £88.8k, chiefly due to a combination of strong trading performance, operational savings and careful cost control.

This careful financial control is particularly important in the context of our office merger and relocation in 2018, together with investment in a new training and learning suite. Both of these have led to greater efficiencies, as well as having more control over our training supply and costs, as we work to deliver further improvements to our training offer to

members. This has already seen a better than expected income from training, and the development of new and increased learning content for members.

The launch of our new website is already delivering benefits for members in terms of raising their profile, making it easier to book onto training, and providing a more streamlined online joining process for new members.

Breakdowns of income and expenditure are detailed opposite, and the audited accounts can be found in the members’ section of the Resolution website.

We will continue to monitor our financial position closely to ensure continued support for members, structured through our seven areas of strategic intent. 2020 will see work to further enhance our Resolution membership experience, with activity to make more family professionals aware of the benefits of Resolution membership.
