No. 540 .IN pursuance of the provisions of section 10 ofthe Fisheries Act, 1905-1964, I, the Governor ofthe State of Western Australia, by and with theadvice and consent of the Executive Council, dohereby prohibit all persons from taking any fishwhatsoever by means of fishing nets in any ofthe portions of Western Australian waters speci-fied in the schedule hereto for a period of five yearsfrom the date of publication of this Proclamationin the Government Gazette .

Schedule .All that portion of the Gascoyne River (near

Carnarvon) lying south of a line drawn due eastfrom the north-east extremity of Babbage Islandand all that portion of Western Australian waterswithin a radius of one half of a mile of the southentrance to the Gascoyne River .

Constitution Act, 1889 .ORDER IN COUNCIL.

F.D. 1224/60 .WHEREAS the enactment contained in section74 of the Constitution Act, 1889, whereby the ap-pointment of all public officers under the Govern-ment of the State is vested in the Governor inCouncil, does not apply to minor appointmentswhich by Act of Legislature or by Order in Councilmay be vested in the heads of Departments orother officers or persons within the State ; andwhereas it is desirable that the appointment ofpersons as employees of the Forests Departmentand its branches at a daily or weekly rate of wagesshould be vested in Alastair Donaldson Mather orany person s appointed to temporarily act in placeof such officer : Now, therefore, His Excellency theGovernor, by and with the advice of the ExecutiveCouncil, hereby vests in Alastair Donaldson Matherand any person appointed to temporarily act inplace of such officer the appointment of personsas employees of the Forests Department and itsbranches at a daily or weekly rate of wages.

WHEREAS by section 33 of the Land Act, 1933-1963, it is made lawful for the Governor to directthat any reserve shall vest in and be held by anymunicipality, body corporate, or other person orpersons to be named in order in trust for the likeor other public purposes to be specified in suchorder; and whereas it is deemed expedient asfollows :-

Corres . 10496/09.-That Reserve No . 12614 (Ning-han Location 360) should vest in and be held bythe Shire of Dalwallinu in trust for the purpose ofPreservation of Flora .

Corres . 1582/22 .-That Reserve No . 19887 (Sus-sex Location 3150) should vest in and be held bythe Shire of Augusta-Margaret River in trust forthe purpose of Recreation and Community Centre(Forest Grove) .Corres . 842/55.-That Reserve No . 25035-Albany

Lot 1120 should vest in and be held by the Minis-ter for Education in trust for the purpose of aYouth Club Site.

Corres. 447/43-That Reserve No . 27446-SwanLocation 7804 should vest in and be held by theShire of Belmont in trust for the purpose of Parksand Gardens .

Now, therefore, His Excellency the Governor, byand with the advice and consent of the ExecutiveCouncil, doth hereby direct that the beforemen-tioned reserves shall vest in and be held by theabovementioned bodies in trust for the purposesaforesaid, subject nevertheless to the powers re-served to him by section 37 of the said Act .

Metropolitan Water Supply, Sewerage andDrainage Act, 1909-1963 .ORDER IN COUNCIL .

M.W.S. 606557/64 .WHEREAS by the Metropolitan Water Supply,Sewerage and Drainage Act, 1909-1963, it is pro-vided that, subject to the provisions of the Act,the Metropolitan Water Supply, Sewerage andDrainage Board shall, with the approval of theGovernor, have power to construct, provide andextend Water Works, Sewerage Works and Metro-politan Main Drainage Works ; and whereas thepreliminary requirements of the said Act have beencomplied with, and plans, sections and estimates inrespect of the works hereinafter mentioned havebeen submitted to and approved by the Governorin Council : Now, therefore, His Excellency the Gov-ernor, with the advice and consent of the Execu-tive Council, does hereby empower the Metropoli-tan Water Supply, Sewerage and Drainage Boardto undertake the construction of the followingworks under the said Act, namely :-

Metropolitan Water Supply .Shire of Kalamunda .

The construction of a reinforced concretesummit tank of one and a half million galloncapacity, as shown in red on plan M .W.S .S . &D.B.W.A. No. 9147 .

This Order in Council shall take effect from the2nd day of April, 1965 .

Details of Scheme .1. Responsible Authority.-The authority re-

sponsible for enforcing the observance of thisscheme is the Shire of Bayswater (hereinafter re-ferred to as "the Council") .

2. Areas.-The Scheme shall apply to the landscontained within blue borders on the Control Plan .Portions of the said lands are also containedwithin blue borders on each of Sheets A, B and Cof Plan No . 1 and on each of Sheets A, B and Cof Plan No. 2 . The said lands are hereinafterreferred to as "the Area." The lands within anorange border on Sheet C are hereinafter referredto as the "Subdivided Area ." The remainder of"the Area" is hereinafter referred to as the"Undeveloped" Area.

3. General Objects.-The general objects ofthe Scheme are :-

(a) To improve and develop the Area to thebest possible advantage .

(b) To plan within the Area suitable roads .(c) To ensure the proper drainage of so much

of the Area as is low-lying and to makesuch portion of the Area available forbuilding purposes .

(d) To ensure the provision of adequatedrainage compensating basins .

(e) To make provision for land to be used forpublic recreation, public open space andlocal authority purposes .

(f) To facilitate and co-ordinate progressivesubdivision and development of landwithin the Area .

4. Acquisition of Land .-The land within the"Subdivided Area" or so much thereof as is neces-sary to implement the Scheme shall be resumedor otherwise acquired by the Council .4A. When acquired by the Council whether by

purchase or resumption the lands described here-under shall vest in the Council free of all reserva-tions as to the use of the said lands contained inthe Certificates of Title thereto and all rightsand trusts in respect thereof .

Lands referred to.-Those portions of the landcomprised in Certificate of Title Volume 38, folio308, which are therein stated to be reserved fora Town Hall and to be reserved for schools re-spectively and coloured green on the plan on theCertificate of Title. That portion of the land com-prised in Certificate of Title Volume 38, folio 309,which is therein stated to be reserved for a Churchand coloured green on the plan on the Certificateof Title .

5. Works to be Carried Out.-The followingworks shall be carried out within the SubdividedArea :-

(a) The Subdivided Area shall be re-surveyedin conformity with the design shown onPlan No. 2 .

(e) Drainage works will be carried out .6. Method of Dealing with New Lots in Sub-

divided Area.-The lots shown on Plan No. 2within the Subdivided Area shall be dealt withas follows:-

(a) The new lots shown in Column No. 2 ofthe Schedule hereto shall be offered tothe owners of the old lots on Plan No . 1shown opposite in Column No. 1 of theSchedule. The offer shall be made on thebasis that the owner shall-

(i) pay to the Council upon the ac-ceptance by him of the said offerthe sum of money (if any) shownin Column No. 3 opposite his oldlot in Column No . 1 ;

(ii) accept the lot or lots so offered infull satisfaction of all claims forcompensation in respect of theresumption from him of the lot onPlan No. 1 in respect of which theoffer is made and otherwise in re-spect of the operation of thisScheme .

Offer of Lots .-The offer referred to inclause 6 hereof shall be made in writing to eachof the said owners and posted by certified post tohim at his address as appearing in the Rate Bookof the Council and shall specify the lot on PlanNo. 2 the subject of the offer and the old lot onPlan No. 1 in respect of which the offer of thereplacement lot is made .

8. The offer shall state the amount of money(if any) payable by the owner on the acceptanceof the offer .

9. The offer shall specify a date not being lessthan twenty-eight (28) days after the posting ofthe said offer within which the offer may beaccepted .

10 . The offer may be accepted by notice in,writing to the Council at any time before the datespecified in the said offer and if not acceptedwithin such time shall subject to clause 32 hereofbe deemed to have been rejected . No acceptanceof the offer shall be deemed a valid acceptanceunless all rates and taxes due by the owner inrespect of land within the Area have been paid .

11. Registration of Transfers.-The Councilshall cause to be prepared and sent to those ownersentitled transfers in respect of each offer of a re-placement lot which has been accepted by the ownerin accordance with this Scheme. If an owner shallfail to complete the transfer in accordance withthe Transfer of Land Act, 1893-1959, to make thepayment of the amount payable by him and toreturn the transfer to the Council for registrationwithin twenty-eight (28) days after having beencalled upon so to do by notice sent by certifiedpost to the owner at his address last known to theCouncil (which notice may be served with thetransfer) the Council may rescind any agreementwhereby such owner is entitled to have the landthe subject of the transfer transferred to him andthereupon such owner shall have a claim againstthe Council only for compensation for the re-sumption of the land in respect of which the offerof the replacement lot or lots was made and theland the subject of the transfer shall be treatedas a rejected lot .

12. Rejected Lots.-If an owner does not acceptan offer made to him by the Council in accordancewith this Scheme or fails to complete a transferof the said lot or make the said payment in manneraforesaid the Council may deal with the lots soaffected as hereinafter appears.

13. Sale of Lots .-The Council may sell anysurplus lots and any rejected lots either by publicauction tender or private contract as a whole orin separate lots upon such terms and conditionsas the Council shall think fit . In the event of asale by private contract the price shall not be lessthan the price recommended by the Chief Valuerof the Taxation Department of Western Australiaunless after submitting the land for sale by publicauction or tender that price has not been obtained .

14. Overall Planning .-It is intended that asand when owners of land within the UndevelopedArea desire to develop and subdivide their landsuch development and subdivision shall be accord-ing to a plan which will be capable of formingpart of an overall plan of subdivision and develop-ment for the Area .

15. The plan of subdivision shown in Plan No .2 forms a basis for subdivision and developmentof the Area but the Council may permit alterationsor variations to the plan where circumstancesjustify such action provided that no such altera-tion or variation shall be permitted if in theopinion of the Council it shall impede the sub-division and development of the Area as a wholeor without the consent of the Town PlanningBoard .

16. An owner of land within the UndevelopedArea who desires to subdivide and develop hisland either alone or in conjunction with otherowners shall submit a plan of proposed sub-division to the Town Planning Board as requiredby the Town Planning and Development Act ofWestern Australia.

17. Open Space and Drainage Reserves .-It isintended that the tracts of land coloured green onPlan No. 2 be reserved for public recreationpublic open space and road drainage purposes .

18. It is intended that the tracts of landcoloured blue on Plan No . 2 be reserved for drain-age compensating basins and local authoritypurposes .

19. The Council may acquire the said landcoloured green and the said lands coloured blueor any parts thereof by purchase or resumptionor partly by one method and partly by the other .20. Subject to clause 21 each owner of land

within the Undeveloped Area shall when sub-dividing his land pay to the Council an amountequal to one-tenth of the value of his land at thedate on which the subdivision of his land isapproved by the Town Planning Board of WesternAustralia. If the Council so agrees the said pay-ment may be specified wholly or in part by thetransfer of land to the Council .The said valuation shall be made on the basis

that the whole of the owners land is offered forsale, taking into account that the subdivision canbe approved, but not on the basis of the total ofthe values of the individual lots in the subdivision .

21 . Certain roads in the Area have beendesigned as roads of a width greater than theusual width of one chain . Where an owner inaccordance with the terms of this Scheme makesland available for any of the said roads, theamount of land which he makes available for suchroads which is in excess of the amount of landwhich he would have been called upon to concedeif the road had been of a width of one chain shallbe valued as at the date on which the subdivisionof his land has been approved by the TownPlanning Board of Western Australia . The valueof such land shall be deducted from the amountwhich such owner is required to contribute underclause 20 hereof .

22. For the purpose of clauses 20 and 21 thevalue of the owners' land shall be determined bythe Chief Valuer of the Taxation Department ofWestern Australia or some person recommendedby him. If the owner objects to the value so deter-mined he may give notice of such objection to

the Council within twenty-eight days after havingbeen informed of the said value and in that eventthe value shall be determined by arbitration inmanner hereinafter provided .

23 . So much of the land which is colouredgreen on Plan No . 1 which is not coloured greenon Plan No. 2 is no longer required for publicopen space and shall subject to the consent ofthe Minister for Lands be transferred by theCrown to the Council free from encumbrances andfree from any obligation as to its use for anyspecified purpose .

24. The Council shall apply the moneys re-ceived by it under clause 20 or so much thereofas is necessary for that purpose in the purchaseof or the payment of compensation on the resump-tion of those parts of the Area which are colouredgreen on Plan No . 2. If the Council is or shallbecome the owner of any of the said areas colouredgreen on Plan No . 2 otherwise than in pursuanceof this Scheme it may debit this Scheme with thevalue of such land as at the date upon which suchland was made available by it for this Scheme.

25 . Drainage Works.-Those portions of theUndeveloped Area which are contained within apink border on Sheet A shall not be drained aspart of this Scheme. The remainder of the Un-developed Area is hereinafter referred to as the"Drainage Area." Each of the owners of landwhich is within Drainage Area shall pay to theCouncil the sum of thirty-five pounds (£35) foreach subdivisional allotment of land in his planof subdivision which is situated wholly within thedrainage area . The said payment shall unlessotherwise agreed between the owner and theCouncil be paid to the Council at the time hisplan of subdivision shall be submitted to the TownPlanning Board of Western Australia .

26 . The Council shall construct or cause to beconstructed drains, earthworks and carry out orcause to be carried out such other works as shallbe necessary to drain and make the drainage areafit for building purposes . Such works may becarried out in stages and as and when the Councilshall determine. The Council may contract withthe Metropolitan Water Supply, Sewerage andDrainage Department or other authority or personto carry out the said works or any of them orany part thereof .

27. An owner of land within lands containedwithin a pink border on Sheet A who desires todevelop and subdivide his land shall be responsiblefor the filling and draining of his land .

28. New Roads.-All new roads within theUndeveloped Area shall be constructed and drainedby the Council at the expense of the owners ofland therein in manner following. Upon theapplication by an owner for the approval of aplan of subdivision of his land within the Un-developed Area the Council shall ascertain theaverage cost of the construction and drainage ofroads within the Area at that date . Each suchowner shall pay to the Council the said averagecost of the construction and drainage of seventy-five (75) links of road for each allotment of landin his plan of subdivision ; excluding lots alreadyfronting existing constructed roads at date ofScheme .29 . Closure of Roads.-All surveyed roads

within the Area which are shown on Plan No . 2as roads to be closed shall be deemed to havebeen closed as from the date on which thisScheme shall come into operation and the landwithin the closed sections shall, except in the caseof the lands edged brown on Plan No . 2 becomepart of the lot or lots shown in Plan No . 2 of whichthey form part and upon the subdivision of theland the fee in the road so closed with the excep-tion of the lands edged brown shall vest in theowner of the said lot or lots of which the closedroad forms part .The lands edged brown on Plan No. 2 shall vest

in the Council and the Council may sell or dealwith such lands in such manner and upon suchterms and conditions as it shall deem fit . TheCouncil may use such lands or any parts thereofto complete . the several new lots affected by theclosed roads. In the event of adjoining land being

31. The Council may enter into arrangementswith the Metropolitan Water Supply, Sewerage andDrainage Department for the extension of watermains and pipes to the subdivisional area and makesuch payments to the Department for that pur-pose as it considers reasonable .

32. Powers and Authorities of Council .-Incarrying out the provisions of this Scheme theCouncil shall have the following powers and auth-orities :-

(a) To enter and inspect any land within theArea .

(b) To enter into agreements with the ownersor occupiers of any land within the Area .

(c) To enter into agreements with purchasersor prospective purchasers or prospectiveoccupiers of land within the Area .

(d) To extend the time within which anyoffer of replacement lots may be accepted .

(e) To extend the time within which the pay-ments referred to in clause 6 (a) (i) shallbe made .

(f) To acquire by purchase or otherwise anyland within the Area .

(g) Resume land for roads .(h) Carry out any road construction, drain-

age, improvements or other works withinthe Area .

(i) Dispose of any land not required for thepurposes of the Scheme.

(j) Enter into any agreements or arrange-ments with the Crown for the purposesof the Scheme .

(k) If any owner of land within the Unde-veloped Area does not proceed with thesubdivision and development of his landin accordance with the terms of thisScheme and his failure to do so in theopinion of the Council will unduly delaythe completion of the Scheme the Councilmay resume the land of such owner andproceed with the subdivision and develop-ment of the said land in accordance withthe provisions of this Scheme .

(1) In the event of the Council exercising itspowers under clause (k) it shall have allthe powers of an owner in the subdivisiondevelopment and disposal of the said landbut before selling the land so subdividedand developed it shall offer the new lotsto the original owner upon his paying tothe Council all costs and expenses conse-quent upon the resumption subdivision anddevelopment of the said land and allmoneys which would have been payableby him if he had carried out such sub-division and upon his releasing the Coun-cil from all claims for compensation inrespect of such resumption . The saidoffer shall be made in writing and if notaccepted within one calendar month ofthe service thereof the Council may pro-ceed with the sale of the subdivided lots .All moneys received by it from such saleshall be applied firstly in payment of allcosts and expenses consequent upon suchdevelopment subdivision and sale andsecondly in payment of all compensationin respect of the resumption of the saidland. 33. Arbitration.-Any dispute or difference be-tween the owners as to their respective rights underthis Scheme or as to the valuation of land underclause 22 hereof may be referred to the arbitrationof a single arbitrator in manner provided by theArbitration Act, 1895, or any statutory modifica-tion thereof for the time being in force and if theparties fail to agree upon any one single arbitratorhe may be nominated by the Council .

34. Costs of Scheme.-The Council may pay allcosts and expenses of this Scheme and the costsof any works carried out by it within the Areafrom moneys received by it in pursuance with theterms of the Scheme . If the moneys received bythe Council are insufficient to meet the said costsand expenses the Council shall be responsible forthe payment of the balance . The Council may re-tain any moneys coming to it by reason of theScheme which are in excess of the amount re-quired for the costs of the Scheme and the saidworks.

35. Compensation .-Claims for compensation byreason of the operation of this Scheme shall bemade within six months of this Scheme coming intooperation and claims for compensation on resump-tion of any land shall be made within six monthsfrom the issue of a notice of resumption or thedate of recission under clause 11 whichever is thelater .
