Fourth Global Conference of the Co-Chairs’ Circle, Legitimacy in and of Arbitration

I. Foreword Co-Chairs' Circle ("CCC") is an informal platform to foster exchanges between young arbitration practitioner groups. In recent years, more and more groups have been founded throughout the world by young lawyers practicing in international arbitration, seeking to connect, learn and effectively shape the future of international arbitration. Most of these groups operate under the auspices of an arbitral institution, an arbitration association, or an institute. Given the continued proliferation of young arbitration practitioner groups, it was time to create an informal platform for Co-Chairs across the organizations to meet and exchange ideas about topics they consider relevant, to jointly reflect on current trends and to team up in order to have a stronger impact as the young voice of the international community. Currently, around 30 young arbitration practitioners' groups participate in the Co-Chairs' Circle:

This bi-annual conference is organised and hosted by one of the member organisations of the CCC, with the support of the other organisations. It is open to all lawyers, academics and in-house counsels practicing or having an interest in International Arbitration.

ABOUT CEPANI40 CEPANI40 is the under 40 group of the Belgian Center for Arbitration and Mediation (CEPANI).

It was founded in 2004, under the auspices of CEPANI. The organisation is specifically aimed at young professionals with an interest in arbitration. With CEPANI40, we wish to offer a forum for young practitioners interested in arbitration, where they can exchange views, ideas and experiences about arbitration in a friendly and informal manner.

To this end, CEPANI40 organises regular meetings, conferences and networking events where practice-oriented issues are addressed by arbitration experts. This way, we work to create opportunities for young professionals to debate all aspects of the practice of arbitration and to enable them to further engage in their area of interest.

CEPANI40 CO-CHAIRS

Sophie Goldman, Tossens Goldman Gonne, Partner (Brussels) Sophie Goldman focuses on complex civil and commercial litigation, both in national and international settings, relating to, among others, partnership agreements, service contracts, distribution, directors’ liability and post-acquisition disputes in various sectors such as distribution of industrial products, energy, aeronautics, insurance, and construction. A major part of her practice consists in arbitration. She regularly acts as arbitrator or as counsel, mainly in ICC and CEPANI proceedings. She is ranked as “up and coming” in International Arbitration by Chambers and as “Global Leader” by Who’s Who Legal. She is also “highly recommended” by Leaders League as arbitrator as well as in commercial litigation. She is the author of various publications and regularly speaks at conferences, in Belgium and abroad. Sophie is very active within the CEPANI, the Belgian Centre for Arbitration and Mediation. She is the Co-Chair of CEPANI40 since 2017 and she is part of the CEPANI Delegation at the at the United Nations Commission on International Trade Law. She also co-chairs the CEPANI working group on Diversity and Inclusion created in 2021. .

Sigrid Van Rompaey, Matray Matray & Hallet, Partner (Brussels) Sigrid Van Rompaey was admitted to the Brussels Bar in 2009, she joined the Antwerp Bar in 2014. Sigrid was a case-manager at the Belgian Centre for Arbitration and Mediation (CEPANI) from 2011 to 2014 and is currently a CEPANI40 Co-chair. Her preferred areas of practice are domestic and international arbitration in the field of commercial litigation and contracts. She also acts as counsel for the state of Belgium before domestic and international courts. Sigrid regularly sits as an arbitrator in institutional (CEPANI, ICC), as well as ad hoc arbitration proceedings. She also acts as counsel in arbitration as well as related state court proceedings.

She is ranked in Who's Who Legal as a Future Leader in arbitration and in The Legal 500 Arbitration Powerlist - Benelux Region. Sigrid has written a number of publications in the field of national and international arbitration. She is fluent in Dutch, English, and French and proficient in German.

KEYNOTE SPEAKER

Bernard Hanotiau, Hanotiau & van den Berg, Partner (Brussels) Bernard Hanotiau is a member of the Brussels and Paris Bars. Since 1978, Bernard Hanotiau has been actively involved in more than 500 international arbitration cases as party-appointed arbitrator, chairman, sole arbitrator, counsel and expert in all parts of the world. Mr. Hanotiau is professor emeritus of the law school of Louvain University (Belgium) and visiting professor at NUS University (Singapore). He is a member of the ICCA Advisory Board and of the Council of the ICC Institute and a member of the ICC International Arbitration Commission. He is also a former vice-president of the Institute of Transnational Arbitration (Dallas), of the LCIA Court and of the DIAC Board (Dubai). He is a member of the Court of Arbitration of SIAC (Singapore), of the Advisory Board of the Seoul IDRC and of HKIAC (Hong Kong). He is the author of Complex Arbitrations: Multiparty, Multicontract, Multi-issue (Kluwer, second edition 2020) and of more than 120 articles, most of them relating to international commercial law and arbitration. In March 2011, Mr. Hanotiau received the GAR “Arbitrator of the Year” award. In April 2016, he also received the Who’s Who Legal “Lawyer of the Year” for Arbitration award.

Laura Alakija, Primera Africa Legal, Managing Partner (Lagos) Laura Alakija is the Managing Partner and head of Primera Africa Legal’s Commercial Dispute (Arbitration and ADR) and Commercial Transactions. Laura has over 15 years of experience in hospitality, energy and natural resources, project finance, transport, real estate & infrastructure and information & communications technology. Laura is a Fellow of the Chartered Institute of Arbitrators, United Kingdom, an Accredited Mediator of the Lagos Multi-Door Courthouse and a certified Online Dispute Resolution expert. She is a member of the Panel of Neutrals for the Lagos Court of Arbitration; Chartered Institute of Arbitrators; Shanghai Arbitrators Commission; Regional Centre for International Commercial Arbitration. She is an active member of the international arbitration community serving as Member, ICC Africa Commission; Member, Advisory Board of the Lagos Court of Arbitration Young Arbitrators’ Network (LCA YAN) among other positions and memberships. She served as the ICC YAF Representative for Africa, the Middle East and Turkey from 2019 to 2021.

Saadia Batthy, Gide Loyrette Nouel, Counsel (London) Saadia Bhatty is an attorney admitted to the New York bar and an Avocat au Barreau de Paris. She is Counsel in the International Dispute Resolution (IDR) team of Gide’s London office and advises and represents States and private entities on a wide range of contentious and non-contentious international dispute resolution law matters, in particular in international commercial and investment arbitrations and other public international law matters (including drafting and negotiating international treaties for States). She has acted as counsel in investment and commercial arbitration proceedings conducted under the rules of various institutions (including those of the ICC, ICSID, LCIA, SCC, the Organization for the Harmonization of Business Law in Africa (OHADA), HKIAC and CAS) as well as ad hoc arbitrations (UNCITRAL), dealing with the laws of both civil and common-law jurisdictions. She has specific experience in the energy, oil & gas and construction sectors, especially in Asia, Africa and the Middle East. Prior to working for Gide in London, Saadia worked for Gide in Paris and global law firms' international arbitration and public international law practices in London and New York. Saadia sits on the Board and is part of the Executive Committee of a number of professional organisations, including the Y-ADR CPR Steering Committee, the African

Academy for International Law Practice (AAILP) the European Federation for Investment Law and Arbitration (EFILA), the Pakistan Centre for Law and Society (PCLS), the Center for International Investment and Commercial Arbitration in Pakistan (CIICA), and of the ArbitralWomen group. She is also co-President of the Harvard Women in Defense, Diplomacy and Development in London (Harvard W3D London Chapter). A graduate from Harvard Law School, the Paris I Panthéon-Sorbonne University in Paris, and the Ecole Normale Supérieure, Saadia regularly writes articles on law, lectures in top universities, trains private practitioners and government officials, and speaks at conferences in international arbitration across the world.

Michelle Bock, Squire Patton Boggs, Partner (Brussels) Michelle Glassman Bock is a Partner in the Brussels and Washington offices of Squire Patton Boggs. Michelle is a US-qualified lawyer who has practiced international commercial arbitration and litigation in the US and in Europe for over 15 years. Her practice focuses on high stakes arbitrations governed by both civil and common laws, sited in both civil law and common law jurisdictions in the U.S., Europe, and Asia. She has acted for clients in arbitration proceedings conducted under the auspices of the major arbitral institutions, as well as in ad hoc proceedings. Michelle’s representations cover a wide range of industries, with a particular focus on energy-related disputes, including those involving the pricing and shipping of natural gas and LNG. She has also represented companies and individuals before US courts at the trial and appellate levels. Michelle teaches international commercial arbitration and the taking of evidence at the Université Libre de Bruxelles and regularly speaks and lectures on international arbitration at universities throughout Europe. Who’s Who Legal recognizes her as a Global Leader in Arbitration.

Victor Bonnin Reynes, VBArbitration, Principal (Madrid) Victor is the Secretary General of the Spanish Club of Arbitration and has an extensive experience in international commercial arbitration, investment arbitration and sports arbitration (he is an arbitrator in the CAS). He has acted in many cases as arbitrator, counsel or as secretary of arbitral tribunals. Nowadays he focuses on his activity as arbitrator. In such role, he has acted in more than 35 arbitrations administered under many institutions such as ICC, LCIA, HKIAC, Swiss Chambers, Madrid Court of Arbitration, Amcham Peru, Spanish Court of Arbitration, among others. As arbitrator in cases conducted in Spanish, English, French and Portuguese, and he also speaks German.

Victor has been listed in the Who's Who 2017 to 2021 Under 45 Future Arbitration Leaders lists. In 2020, 2021 and 2022 he has also been ranked in Chambers: Most in Demand Arbitrators and in the list of Leaders League: Spain's Best Arbitrators.

Guillaume Croisant, Linklaters, Managing Associate (Brussels) Guillaume is an all-round litigator specialising in international arbitration and related state court proceedings. He has been appointed as an arbitrator and as a tribunal secretary under the ICC, LCIA, CEPANI and NAI rules. He is a member of the ICC Commission on Arbitration and ADR and of various arbitration associations (including the Steering Committee of CEPANI40). Guillaume lectures on private international law and advocacy in international arbitration at the Université libre de Bruxelles (ULB). He is the co-editor in chief of Belgium’s leading business law journal (Revue de Droit commercial belge / Tijdschrift voor Belgisch Handelsrecht) and the author of numerous contributions in treaties and legal journals.

Vanessa Foncke, Jones Day, Partner (Brussels) Vanessa Foncke represents Belgian and foreign clients in a broad range of contractual and commercial disputes and negotiations in all stages of court and administrative proceedings. She also conducts internal compliance investigations on behalf of clients. Vanessa has extensive experience in domestic and international commercial arbitration both as counsel and arbitrator. She is a member of the board of administration and of the executive committee of CEPANI. In that capacity she also participates in the bi-annual meetings of the United Nations Commission on International Trade Law (UNCITRAL) Working Group II (Arbitration and Conciliation/Dispute Settlement). Vanessa has experience across a broad spectrum of industries, including construction, distribution, heavy industry, telecommunications, energy, and real estate. She is ranked in Chambers Global and Chambers Europe, Who's Who Legal: Arbitration, and The Legal 500 EMEA. Vanessa is fluent in Dutch, English, and French and is proficient in German.

Clément Fouchard, Reed Smith LLP, Partner (Paris) Clément specialises in international commercial and investment arbitration. Clément has fifteen years’ experience advising on major litigation and arbitration proceedings. He has regularly acted for French and international clients in arbitrations seated across the globe and has particular experience in complex disputes in the construction, energy and infrastructure, mining, defence and distribution sector, as well as considerable experience with joint ventures and post-acquisition disputes. In addition to his experience as counsel, Clément also acts as an arbitrator in domestic and international arbitrations (ICC). Clément is a member of the Paris Arbitration Week Organizing Committee, a member of the Board of the Comité Français de l’Arbitrage (CFA) and a founding member of AfricArb. Clément lectures on international arbitration at Science Po Law School (LL.M. in Transnational Arbitration and Dispute Settlement), and at Paris II Panthéon-Assas University (LL.M. AWArDS - Assas World Arbitration and Disputes Settlement). He regularly publishes articles in law journals (including the Revue de l’arbitrage) and speaks at international conferences on matters of arbitration law.

Anya George, Schellenberg Wittmer, Partner (Zurich) Anya George is a trilingual and dual qualified lawyer (Switzerland and England & Wales). She represents clients in complex international commercial and investment arbitration matters, as well as in enforcement and setting-aside proceedings before the Swiss Supreme Court. Her main areas of expertise are energy infrastructure, natural resources, insurance and reinsurance contracts, and manufacturing and sales agreements. She also advises clients on business and human rights issues. Anya lectures in International Commercial Arbitration at the University of Zurich. She is a member of the ASA Marketing Committee and an immediate past co-chair of the LCIA Young International Arbitration Group (YIAG). Anya is considered as an "incredibly bright advocate" and "one of the best of her generation worldwide" (Who's Who Legal), and is praised by clients for her "excellent responsiveness" and "complete control of her practice" (Legal500).

Thomas Granier, ASAFO & CO, Of Counsel (Paris) Thomas Granier is Counsel at Asafo & Co in Paris, France. He focuses his practice on international arbitration and recognition and enforcement proceedings before French courts. He has developed strong experience in disputes relating to energy, power, infrastructure, mining, engineering, telecoms and new technologies. Thomas has acted as counsel in a number of arbitrations under the rules of various institutions such as the ICC, the LCIA, the HKIAC, ICSID and ad hoc arbitrations (including UNCITRAL and CIArb). He has repeatedly acted as arbitrator under the arbitration rules of the ICC, the DIS, Delos Dispute Resolution and in ad hoc arbitrations. Prior to joining Asafo & Co, Thomas worked at a leading US law firm and served as counsel in the case management team at the secretariat of the ICC International Court of Arbitration dealing mainly with cases from Africa, the Middle East and France and as deputy counsel for the case management team dealing mainly with cases from Germany, Switzerland and Austria. He is a co-founder of Delos Dispute Resolution. Thomas is vice-president of the BVI International Arbitration Committee, member of the Arbitration Consultative Committee of Delos Dispute Resolution and special adviser to the Casablanca International Mediation and Arbitration Centre (CIMAC). He is fluent in English, French and German.

Raphaël Kaminsky, Teynier Pic, Partner (Paris) Raphael Kaminsky is a Partner at the dispute resolution boutique Teynier Pic in Paris. He specialises in commercial litigation, international arbitration and ADR. Raphael regularly represents clients in institutional and ad hoc international arbitration procedures in a variety of sectors such as construction, aeronautics, telecoms, pharmaceutical industry. He also sits as arbitrator. In addition, Raphael represents clients in institutional and ad hoc mediations and conciliations. Prior to joining Teynier Pic, Raphael was as associate at Latham & Watkins from 2002 until 2012. He joined Lazareff Le Bars as a partner in 2012 before setting-up his own practice in 2015 and joining Teynier Pic in 2017.

Ulrich Kopetzki, Kopetzki, Arbitrator (Vienna) Ulrich Kopetzki is an independent Austrian arbitration practitioner, who acts both as counsel and arbitrator in international arbitration proceedings. Ulrich graduated from the law school of the University of Vienna (2012). Afterwards, he worked in the arbitration department of Wilmer Cutler Pickering Hale and Dorr LLP in London as an Intern and Visiting Foreign Lawyer (2013-2014) and at the Secretariat of the ICC International Court of Arbitration in Paris as a Deputy Counsel (2014-2016). He later returned to the ICC as Counsel to become head of the German speaking case management team and subsequently of the Eastern European case management team (2017-2018). During his time at the ICC, Ulrich mainly dealt with cases from Eastern Europe as well as from Austria, Switzerland, Germany and Nordic countries. He supervised over 500 arbitrations, including several investment treaty and emergency arbitrator cases. He was involved in the review of some 100 awards as part of the ICC Court's scrutiny process. Furthermore, Ulrich teaches negotiation at various universities and was a Visiting Scholar at the Kellogg School of Management at Northwestern University in Chicago (2016). He is also the co-editor of a forthcoming commentary on the ICC and the DIS Rules, which will be published this summer.

Catherine Anne Kunz, Lalive, Partner (Geneva) Catherine Anne Kunz specialises in international arbitration and disputes relating to commercial contracts. Dual-qualified in Switzerland and in England (Solicitor), she advises and represents clients in international disputes, in ad hoc and institutional arbitration proceedings under all major rules of arbitration and governed by various substantive laws, both common law and civil law. She also represents parties in arbitration-related court proceedings, especially in the setting aside of international arbitral awards before the Swiss Supreme Court. She acts as arbitrator and advises clients on other forms of dispute resolution, such as commercial mediation. Her experience spans various sectors and includes joint ventures, shareholders, sales, energy, telecommunications and engineering disputes. Catherine A. Kunz also regularly advises public international organizations on a range of issues, including immunities and privileges, internal dispute resolution mechanisms, litigation exposure, compliance and governance. Catherine Anne Kunz is a member of the editorial board of the ASA Bulletin, the Swiss Arbitration Association’s journal. She

Mélanie Riofrio Piché, CIAM, Secretary General (Madrid) Mélanie Riofrio Piché is the Secretary General of the Madrid International Arbitration Centre (MIAC) an arbitral institution recently created, in 2020. She also acts as arbitrator in international proceedings under ICSID and ICC Rules, and has acted as secretary of arbitral tribunals in complex commercial and investment arbitrations administered by ICC, PCA, ICSID, DIAC and VIAC. Gabriele Ruscalla, Liedekerke, Senior Associate (Brussels and Paris) Gabriele Ruscalla is a Senior Associate in the International Arbitration and Dispute Resolution Practice of Liedekerke. He assists on matters involving corporate clients, States and State-owned entities in both international commercial and investment arbitrations, conducted under the major arbitration rules. Before joining Liedekerke, Gabriele was Counsel of the Italian-Swiss team at the International Court of Arbitration of the ICC. DIE AFFIRMATIVE

Die Affirmative will provide a humoristic wrap-up of the Conference. Die Affirmative is a professional improvisational theatre ensemble from Mainz with six actors and one musician. They frequently take part in international improvisation competitions, often coming home with the main prize. Furthermore, Die Affirmative runs the largest improvisation school in Germany with over 120 active students, 11 weekly courses and regular workshops. In addition to their full-time work as actors and theatre pedagogues, the members of Die Affirmative are also committed to Mainz and the region – with charity performances and free courses for young people and children. Together with other Mainz improv groups, Die Affirmative runs the Improfestival Mainz e.V., which has been in existence since 2012. Last year, over a thousand enthusiastic spectators attended the festival.

VIII. Other practical information (covid restrictions, transport, accommodation)

COVID RESTRICTIONS Before travelling to Belgium, please check the latest covid restrictions here: What to do when you arrive in Belgium? | Coronavirus COVID-19 (info-coronavirus.be) At present there are no covid restrictions in place in Brussels. TRANSPORT All venues of the conference, with the exception of the dinner and brunch, are located in the heart of the city centre and within walking distance of each other. There are many taxi services available, among which

- Taxi Verts (+32 2 349 49 49),

- Taxis Autolux (+32 2 5 123 123),

- Taxi Bruxelles Service (+32 489 36 23 80), etc. Ride hailing apps such as Uber, Bolt and Heetch are available in Brussels. Brussels also has a well-developed public transport network, with buses, trams, the metro and train all available, depending on where you want to go. It is recommended to buy a ticket for the bus, tram or metro before boarding as it is not possible to buy one from the conductor since covid, and the contactless payment terminals are not available on all vehicles. Finally, for the less fainthearted, there are a range of stand-up scooters and bikes on offer, including Dott, Voi, Bolt, Lime, Bird, etc. WHERE TO STAY Brussels caters to a wide variety of tastes when it comes to accommodation. In terms of hotels, we recommend as they are within walking distance from the conference venue:
