Moonee Valley Racecourse Redevelopment Advisory Committee
I am writing to you because you live, or own property, near the Moonee Valley Racecourse.
The Minister for Planning has appointed an independent Advisory Committee to provideadvice on the proposed racecourse redevelopment. You are invited to have your say onmatters relating to the redevelopment as discussed below.
Moonee Valley Racing Club has prepared the Moonee Valley Racecourse Master Plan, July2013 for the redevelopment of the racecourse. The master plan proposes to upgradeexisting racing facilities and provide opportunities for residential and mixed usedevelopment. A draft planning scheme amendment which seeks to implement the masterplan has been prepared.
In addition, Moonee Valley City Council has prepared a heritage assessment for the
racecourse. A draft planning scheme amendment which seeks to apply a Heritage Overlay tothe racecourse has been prepared.
Submissions are now sought by the Advisory Committee regarding the following: the proposed Moonee Valley Racecourse Master Plan, July 2013 draft planning scheme amendment documentation which seeks to implement the master
plan (Amendment C120 to the Moonee Valley Planning Scheme)
draft planning scheme amendment documentation which seeks to apply a HeritageOverlay to the racecourse (Amendment C124 to the Moonee Valley Planning Scheme).
The Advisory Committee
The minister appointed the independent Advisory Committee under section 151 of thePlanning and Environment Act 1987. It will provide advice to the minister and the council onthe proposed redevelopment of the racecourse, including the master plan, heritage mattersand the draft planning scheme amendments.
A copy of the Terms of Reference for the Advisory Committee is attached.
The Advisory Committee members comprise Kathy Mitchell (Chair), Gordon Anderson,Stephen Hancock, Jim Holdsworth and Lucinda Peterson.

Making a submission
You can make a written submission if you have any particular views on the master plan,heritage matters or the draft planning scheme amendments.
All submissions: must be made by Friday 6 September 2013; must be accompanied by a completed Submission Coversheet(enclosed) should include a completed Request to be Heard Form (enclosed) if you wish to present
to the Advisory Committee.
Please note that all submissions received and all information provided to the AdvisoryCommittee at the hearing will be treated as public documents. Please note the PrivacyCollection Noticeon page 2 of the Submission Coversheet.
The hearing process
The Advisory Committee will conduct a public hearing to give submitters an opportunity tobe heard in an independent forum in an informal, non-judicial manner. An AdvisoryCommittee is not a court of law.
The hearing process has two stages: the Directions Hearing and the Public Hearing.

The purpose of the Directions Hearing is to: introduce the Advisory Committee consider any preliminary matters give directions about the conduct of the hearing give directions about exchange of information and witness reports prior to the hearing answer any questions people may have about the nature of the hearing deal with any other procedural or relevant matters consider timetable issues make arrangements for the hearing, including the hearing venue and site inspections.Attendance at the Directions Hearing is not mandatory. The Directions Hearing will befollowed by a Public Hearing.
The Public Hearing will commence the week of Monday 30 September 2013 and isexpected to run for two to three weeks.
If you wish to present to the Advisory Committee at the Public Hearing, please complete theRequest to be Heard Form and include it with your submission. If you do not wish to beheard but would like a copy of the timetable and any directions, please complete theRequest to be Heard Form and tick the appropriate box.
The Advisory Committee may limit the amount of time for submissions and encouragessubmitters to make joint presentations where similar issues are covered.

The Advisory Committee will prepare its timetable for the Public Hearing based on theinformation you provide on the Request to be Heard Form. A timetable will be sent tosubmitters who return this form. The hearing is open to the public and all submitters are
welcome to sit in on any part of it.
The general order of the Public Hearing is likely to be: Moonee Valley Racing Club Moonee Valley City Council government departments and agencies community groups individual submitters.Expert witness reports
Expert witness reports will need to be circulated by 12 pm (midday) Monday 23September 2013. Parties will need to be aware of this and nominate on their Request tobe Heard Form the evidence (if any) they will be calling at the Public Hearing.

What will the Advisory Committee do?
After considering relevant information, including allsubmissions, the Advisory Committee will provide awritten report to the Minister for Planning and councilproviding, among other things:
an assessment of the submissions made to it
an assessment of the master plan, heritagematters and the draft planning scheme
amendments a recommendation as to whether the proposal
should proceed and if so, in what form
a recommendation on the appropriate planningcontrols that would best implement the masterplan and provide clear guidance for future useand development of the land.

The Advisory Committee will consider all writtensubmissions received.
Do I have to make a submission toattend the public hearing?
You are welcome to attend any part of the hearingprocess even if you do not make a submission.However, if you would like to make a presentation atthe Public Hearing you must make a writtensubmission (and return a Request to be Heard

Terms of Reference
Moonee Valley Racecourse Redevelopment Advisory Committee
Advisory Committee appointed pursuant to Part 7, Section 151 of the Planning and Environment
Act1987 to report on the redevelopment of the Moonee Valley Racecourse.

Name
1. The Advisory Committee is to be known as the Moonee Valley Racecourse RedevelopmentAdvisory Committee (the Advisory Committee).
2. The Advisory Committee is to have members with the following skills: Strategic planning; Transport; Community facilities, including open space and sport and recreational planning; Social Planning; Environmental Sustainability; Geotechnical and hydrological; Heritage; and Design and built form.
3. The Advisory Committee may also seek specialist advice about the horse racing and track industryas appropriate.
Purpose
4. The purpose of the Advisory Committee is to provide advice to the Moonee Valley City Council andthe Minister for Planning on all relevant matters associated with the proposed redevelopment of
Moonee Valley Racecourse including:
The proposed Master Plan for Moonee Valley Racecourse, October 2011 (or as amended andprepared by the Moonee Valley Racing Club);
The draft Planning Scheme Amendment documentation (to be prepared by Moonee ValleyRacing Club ); and
The draft heritage Planning Scheme Amendment documentation (prepared by Moonee ValleyCity Council).
Background
5. The Hon. Matthew Guy, MLC Minister for Planning has appointed an Advisory Committee pursuantto Section 151 of the Planning and Environment Act 1987 to review all matters related to theproposed Moonee Valley Racecourse Master Plan, associated draft Planning Scheme Amendment

documentation (including heritage controls proposed by Council); and submissions lodged in
relation to these documents.
6. Moonee Valley Racing Club has prepared a master plan for the redevelopment of the racecourse.The proposed master plan was submitted to Moonee Valley City Council on 25 October 2011.
7. The Moonee Valley Racecourse is within the Moonee Ponds Activity Centre boundary and iscurrently zoned Special Use Zone 2 (SUZ2). The site is not affected by any overlays.
8. The proposed Moonee Valley Racecourse Master Plan was placed on informal public consultationby the Moonee Valley Racing Club in June 2011. Moonee Valley City Council informed the
community during November and December 2011 about the process of the Master Plan approval
and provided a response to the master plan and the Clubs rezoning request on 2 February 2012,
and requested further information on the development proposal.
9. Moonee Valley City Council commissioned a Heritage Assessment prepared by David HelmsHeritage Planning and Management on 13 September 2011. The assessment identifies numerous
structures and buildings it states are worthy of retention and protection.
10.Moonee Valley City Council subsequently requested interim heritage controls on 10 April 2012 forstructures and buildings on the Moonee Valley Racecourse site from the Minister for Planning in
conjunction with a request for authorisation to prepare a Planning Scheme Amendment for
permanent controls.
11.The Moonee Valley Planning Scheme at Clause 21.07-1 states that ...building on existing driverssuch as Moonee Valley Racing Club presents a unique opportunity for the municipality. The site is
not identified for any other purpose or future use within the Moonee Valley Planning Scheme.
Method
12.The overall purpose of this Advisory Committee is to provide advice to the Moonee Valley CityCouncil and the Minister for Planning on the most appropriate outcome for the site. The Advisory
Committee should undertake this in the form of four clear stages.
Stage 1: Review and Consultation
13.The Advisory Committee must meet with the Moonee Valley City Council, the Moonee ValleyRacing Club and the Department of Planning and Community Development (DPCD) to initiate
consideration of this matter.
14.The Advisory Committee will meet with the following: Public Transport Victoria, Department of Transport, Vic Roads, Department of
Early Education and Childhood Development and any other relevant agencies

15.The Advisory Committee must review and provide written comments on the proposed MooneeValley Racecourse Master Plan (including any revisions), and associated draft Planning Scheme
Amendment documentation to be prepared by the Moonee Valley Racing Club taking into account
Councils request for further information and community submissions to the Moonee Valley
Racecourse from consultation in June 2011 and any feedback and information provided by the
relevant agencies.
16.The Advisory Committee must review and provide written comments (including any revisions) onthe draft heritage Planning Scheme Amendment documentation prepared by Moonee Valley City
Council.

17.The Advisory Committee shall identify whether there is sufficient information before it to enablethe DPCD to consult with the community in Stage 2: Exhibition, and if necessary make directions to
the Moonee Valley Racing Club and/or Moonee Valley City Council seeking further information.
Stage 2: Exhibition
18.The Advisory Committee will pre-set the Hearing dates.19.The DPCD will exhibit the draft Planning Scheme Amendments and proposed Master Plan for a
period of six weeks. Moonee Valley City Council may decide to undertake additional notification.
20.All submissions are to be collected at the office of Planning Panels Victoria and copies will be madeto the Moonee Valley City Council, Moonee Valley Racing Club and DPCD within 5 working days
from the close of exhibition period.
Stage 3: Public Hearing
21.The Advisory Committee is expected to carry out a public hearing and provide all submitters withan opportunity to be heard.22.The Advisory Committee may meet and invite others to meet with them when there is a quorum of
at least two of the Committee members.
23.The Advisory Committee may limit the time of parties who wish to appear before it at the publichearing and may regulate cross-examination
Stage 4: Outcomes
24.The Advisory Committee may inform itself in any way it sees fit, but must consider: The objectives of the Planning and Environment Act 1987and any other relevant provisions of
the Moonee Valley Planning Scheme,
All documentation and information prepared by the Moonee Valley City Council, and inparticular the further information request and supporting documentation provided to the
Moonee Valley Racing Club on 2 February 2012,
All relevant documentation prepared by or for the proponents for the redevelopment of theMoonee Valley Racecourse or otherwise provided to the Advisory Committee, and
All submissions made in regard to the proposed Master Plan for Moonee Valley Racecourseand associated draft Planning Scheme Amendment documentation.
25.The Advisory Committee must produce a written report to the Moonee Valley City Council and theMinister for Planning providing:
An assessment of the submissions made to the Advisory Committee. An assessment of all relevant matters concerning the proposed Master Plan for Moonee Valley
Racecourse and its proposed redevelopment;
An assessment of all relevant matters concerning the identification of buildings and structureson the Moonee Valley Racecourse as containing heritage significance;
A recommendation as to whether the project should proceed and in what form the projectshould proceed
A recommendation on the appropriate planning controls that would best implement themaster plan for the site and provide clear guidance for future use and development of the site;
Consideration of any other relevant matters raised in the course of the Advisory Committeehearing; and

A list of persons who made submissions and those who were heard by the AdvisoryCommittee.
Submissions are public documents
26.The Advisory Committee must retain a library of any written submissions or other supportingdocumentation provided to it directly until a decision has been made on its report or five years has
passed from the time of its appointment.
27.Any written submissions or other supporting documentation provided to the Advisory Committeemust be available for public inspection until the submission of its report, unless the Advisory
Committee specifically directs that the material is to remain in camera.
Terms of Reference
28.The Advisory Committee may apply to vary these Terms of Reference in any way it sees fit prior tosubmission of its report.
Timing
29.The Advisory Committee should complete Stage 1 within twelve weeks of being appointed.30.The DPCD is required to complete Stage 2 within eight weeks of the completion of Stage 1,
including receipt of exhibition material (draft Planning Scheme Amendments and proposed Master
Plan) from the Advisory Committee.
31.The Advisory Committee is required to commence Stage 3 (i.e the Directions Hearings) no laterthan 2 weeks from the close of exhibition period.
32.The Advisory Committee is required to submit its report in writing as soon as practicable but nolater than 8 weeks from the completion of Hearings.
Fee
33.The fee for the Advisory Committee will be set at the current rate for a Panel appointed under Part8 of the Planning and Environment Act1987.
34.The costs of the Advisory Committee will be met by the project proponent.Project Manger

Guide to the Public HearingPanels, Advisory Committees and Environment Assessment Inquiries
Panels, Advisory Committees and Environment Effect Inquiries tend to operate in a similar way in terms of
Hearing procedures and conduct. However, the Terms of Reference for Advisory Committees and
Environment Effect Inquiries usually provide specific advice on what is required from the Committee and
how Hearings are to be conducted.
This guide refers to Panels but this term can in most cases be interchanged with an Advisory Committee or
Environment Effects Inquiry.
Hearing Timetable
The Hearing Timetable will be prepared on the basis of information supplied by persons who complete a
Request to be Heard form.
All Hearings are open to the public. Submitters are welcome to attend the while or any part of the Hearing
and are requested to arrive at least 15 minutes before their scheduled time of commencement.
Please ensure that you complete your presentation within the time allocated. Extensions of time will not
normally be possible. However, if you run out of time, any written material not addressed will still be
considered by the Panel.
If you are unable to be present, please notify the Panel Co-ordinator at Planning Panels Victoria (PPV) on
9637 9690 as soon as possible.
Submissions at the Hearing
The Panel will already have a copy of you original submission and you do not need to bring additional
copies of it to the Hearing.
At the Hearing, please have copies of any additional written submission, material or PowerPoint you intend
to rely upon. The Panel will make directions about the number of copies you need to provide. If you have
difficulties with supplying copies please contact the relevant Municipality or PPV.
Written material presented at the Hearing should preferably be in the following form:
two-hole punched; and stapled, not bound.
Photographs or other visual material should be presented in binders in A4 or A3 format, not on large
boards. This makes the material easier to transport and file.
All submissions received and all information provided to the Panel during the Hearing will be treated as
public documents. All written material submitted at the Hearings will be available for inspection during the
course of the Hearing.
Copies of submissions (with name and contact details) and other written material provided to the Panel
may be provided to the Proponent, Council, Government Agencies and other parties to the Hearing.

Expert Witnesses Reports
Copies of expert witness reports or statements must be circulated in accordance with Directions made by
the Panel. Copies will usually be given to the Panel and the Planning/Responsible Authority and the
Proponent. Other parties may obtain electronic copies by contacting PPV.
Before the Hearing, copies of witness reports or statements will normally be available for perusal by
submitters at the offices of the Planning/Responsible Authority or PPV, Level 1, 8 Nicholson Street, East
Melbourne.

People Appearing at the Hearing
The following are the types of people likely to appear at the Hearing:
Advocates
Usually professionals who are acting on behalf of a client. Their client may be the Planning Authority, the
Proponent, or some other party. They generally run their clients case and may or may not call an expert
witness. They express their clients view about the proposal but do not provide expert evidence
themselves.
Expert witnesses
People who give expert evidence in a particular field of expertise and who are 'called' to give that evidence.
Common areas of expert evidence include planning, traffic, environmental issues, economics and the like.
Submitters
People who have an opinion about a particular proposal and who wish to express that opinion. Submittersusually represent themselves or they may have a person such as a family member or friend speak on their
behalf. Occasionally a submitter or group of submitters will engage a professional advocate.
Questions at the Hearing
Only expert witnesses can be cross-examined through questioning. No cross-examination of submitters or
their advocates (including the Proponent) will be permitted.
Questions to witnesses will only be permitted at the discretion of the Panel. The following criteria will
guide the Panel in deciding whether to allow any question:
Questions must be directed towards matters of fact or professional opinion. Questions must be relevant. Questions must be of assistance to the Panel. Questions must be genuine questions, not statements or arguments. If you disagree with a witness
or wish to comment on something he/she has said, you should present this as part of your
submission.
Only those people who have heard the whole of the expert witness's evidence will be able to askquestions of that witness.
Only the Panel may ask questions of advocates and individual submitters. However, points of clarification
may be put to a submitter or advocate through the Chair and at the Chairs discretion.

Hearing Manners
Panel Hearings are intended to be relatively informal. However, people attending the Hearing are expected
to show courtesy to others by allowing them to make their submission without being distracted by people
talking amongst themselves or by passing comments.
