Effective Training Techniques•Engage the trainees and limit the training if possible to 15-30 minutes
•Use “hands on” type training aids (avoid PowerPoint’s and other lecture types)
•Focus on the key issues i.e. Heat Procedures, IIPP, lack of drinking enough water…
•Conduct a few demos i.e. emergency aid, laying out tarp for shade….
•Question the group and have them attempt to answer first
CAL/OSHA FINDINGS•Lack of written heat procedures and or IIPP – not properly implementing
•Workers not properly trained (or they don’t remember = ineffective training)

Being in the right place is one secret to success, knowing when it’s the right time is a little trickier. While ‘breaking up’ is hard to do, for a JV it’s also fatal. An eager bidder has to put the ‘brakes’ on his ambitious plans ‘post’ haste! … Q: We are purchasing a construction company that has employees and we have applied for a new license for the new company. We plan to transfer the employees to the new company once the sale is final. With regards to Worker’s Comp, can we file an Exemption now since we don’t employ anyone yet? Or are we required to add the new company to our policy since we plan to transfer all of the employees once the sale is complete? A: You can file the Exemption now with the intention to provide the CSLB with proof of Worker’s Comp as soon as the employees are officially transferred to the new entity. When employees are hired Worker’s Comp must be provided, to protect both you and your workers. Q: We need to change our business name on our Joint Venture license. Are we required to have “Joint Venture” at the end of our name or can we change it to just our two business names? Secondly, The Joint Venture used to be made up of three entities and we need to remove one of them. How do we go about doing that? A: To answer your first question, Joint Ventures are required to have either “Joint Venture” or “JV” at the end of their business name. Also, Joint Ventures are considered a Partnership and you cannot make any changes to a Partnership license. I recommend ‘terminating’ the existing license and then you would be required to apply for a new license with the two entities that currently make up the JV.
Q: Our corporation is currently licensed as a General Building Contractor. We have formed a new LLC and our license application is in process. I spoke with someone at the CSLB and they told me that our application is accepted when it is posted. Does that mean our LLC can operate now that the application is posted? A: You cannot perform any contracting work until the actual license is issued. “Posted” means that the application is acceptable but doesn’t necessarily mean that the process is complete. Many times there are more items that are required after the application is posted, such as bonds, proof of insurance, or fingerprinting. Q: We would like to add two ‘doing business as’ or dba names to our contractor’s license. We are doing a lot of general contracting work at this point and a few of our customers have been hesitant with the work because of our name as Roofing and Waterproofing. Can you help with this? A: You can add one dba to your license but you cannot have two dba’s on one license. If you want a second dba, you can apply for a separate license for the same entity with a different dba. Changes to expect:
For plan years beginning on and after January 1, 2014, employers should carefully evaluate arrangements under which they reimburse employees for premiums, or are otherwise involved in the purchase of individual health insurance policies that provide non-excepted medical coverage (i.e., coverage that is subject to health care reform’s mandates) for employees. These arrangements create significant compliance concerns under health care reform. Furthermore, these individual policies should not be paid for or reimbursed on a pre-tax basis under an employer's cafeteria plan. As described in more detail (left).
Caution for Individual Policy Reimbursement
The IRS uses a FAQ on Employer Health Care Arrangements to highlight
the potential liability for employers that, rather than establishing a group
health plan, merely reimburse employees for the cost of their individual
health plan premium.
Q1. What are the consequences to the employer if the employer does
not establish a health insurance plan for its own employees, but
reimburses those employees for premiums they pay for health
insurance (either through a qualified health plan in the Marketplace
or outside the Marketplace)?
The IRS makes it clear that the consequence is that the employer may face a
penalty.
Specifically, as explained in Notice 2013-54, employer reimbursement plans
are considered to be group health plans and therefore subject to the market
reforms, including the prohibition on annual limits for essential health
benefits and the requirement to provide certain preventive care without cost
sharing. Notice 2013-54 clarifies, however, that employer reimbursement
plans cannot be integrated with individual policies to satisfy the market
reforms.
Consequently, the employer may be subject to a $100/day excise tax per
applicable employee (which is $36,500 per year, per employee) under Code
Sec. 4980 D.

Safety Tip of the WeekHEAT STROKE, HEAT EXHAUSTION & HEAT CRAMPS
Summer is almost here so it's time to start thinking about the three kinds of heat related illness. Heat cramps, heat exhaustion and heat strokes are all possible during hot weather. All heat related injuries need prompt medical attention.
Heat cramps are muscle cramps. Usually these cramps occur in the arms or legs but may be in the abdominal or chest muscles as well. These cramps are caused by excessive body fluid loss through sweating. First aid includes moving the victim to a cool place, resting the cramping muscle and giving the person cool water.
Heat exhaustion signs include heavy sweating, weakness, fast pulse, normal body temperature, headache and dizziness, nausea and vomiting. First aid for heat exhaustion requires the worker to be moved to a cool place. Keep them lying down with their legs straight and elevated 8 to 12 inches. Apply cold packs, wet towels, or just wet their clothing to cool them. Give the victim cold water only if he or she is conscious. If the victim loses consciousness or if no improvement is noted within 30 minutes, seek professional medical attention.
Heat stroke is a true emergency! Signs and symptoms include high body temperature, unconsciousness, hot skin, rapid pulse and breathing, weakness, dizziness or headache. Immediate first aid is required. Move the victim to a cool place and immediately cool the worker by any available means (use ice and water from a jobsite cooler for example). Keep the head and shoulders slightly elevated. Monitor the airway, check to be sure the victim is breathing. Call for professional help or rush the heat stroke victim to a hospital immediately.
Prevention of heat illness is very important. Gradual adaptation to working in hot weather is a start. As the weather heats up, take a few short breaks during the day; and, if possible, schedule heavy work so that it does not have to be accomplished during the hottest part of the day. Dress sensibly and drink plenty of water. Keep a sharp eye out for potential heat injuries in co-workers. Try to practice prevention - it's the name of the game - and it will keep you from becoming a victim of a heat related illness.
Heat stroke is a serious medical emergency. Call for professional help immediately!
