THEMEDIATIONANDNEGOTIATIONTRAININGPROGRAM

TheMNLU-PACTMediationandNegotiationTrainingProgramisajointinitiativetoempowerlawstudents, lawyersandprofessionals,especially theyounggeneration, in theconceptofconsensual dispute resolution (CDR). This program will provide participants with the coremediationskillsandhands-onexperiencethroughavarietyofsimulations.

The program will enable theparticipants to understand the legalframework governing mediation, andthe role of a counsel as a pro-mediationlawyer.Thetrainingwouldbe a combination of theory androleplays. The extensive simulationsinvolvingrolesasclients,counsel,andmediators,casestudies,andanoverallfeedbackwillprovide theparticipantswith theopportunity to have real-life

applicationanddevelopmentoftheirskillsinconsensualdisputeresolution.

Intoday’senvironment,theabsenceofeffectivenegotiationisoftenthesinglelargestcontributortodisputesandthelackofsuccess.TheTrainingProgramalsofocussesoneffectivecommunicationandnegotiation,areasthatarevaluableforlawstudentsinboostingtheirprofiles,especiallyiftheyareaimingforacareerinConsensualDisputeResolution.

CATHERINE DAVIDSON is a nationally accredited mediator (NMAS) and IMICertifiedmediatorpractisinginAustraliaandinternationallyandisamemberof several national panels. Catherine has mediated over six hundredcommercial andworkplace disputes and is amember of several nationalpanels. Catherine has a legal background having practised commerciallitigation inSydneyandLondon.Catherine isaMediationTrainerandalsoconductsNegotiationandConflictManagementWorkshopsinthepublicandprivate sector. She is a Trainer for the Australian Disputes Centre’s -MediationTrainingCoursesinAustraliaandAsia.

JONATHANRODRIGUES is the co-founderof PACT.He is a certifiedmediatorlistedwiththeIndianInstituteofArbitrationandMediation(IIAM),and iscurrentlypostedastheWorldMediationOrganization’s(WMO)ContinentalAdvisorforAsia.HeisalsothedevelopmentofficerforAsiawiththeSCMA(London) and has been trained as a commercial mediator by the IndianInstitute of Corporate Affairs (IICA), under the aegis of the Ministry ofCorporateAffairs.Hehas trainedasaRestorativeFacilitator inBangalorewithReal Justice (Australia) and the International Institute of Restorative

Practices(IIRP).HeworkedbrieflyasaMediationAssociatewiththeCentreforAdvancedMediationPractice(CAMP),Bangalore.

NISSHANT Laroia is an accredited mediator from the Indian Institute ofCorporateAffairs(IICA),registeredbyMinistryofCorporateAffairs(MCA)and Indian Institute of Arbitration andMediation (IIAM). Nisshant is acertifiedmediatorbythePSMACharlesUniversityincrossborderdisputeresolution.CharlesUniversity..Hehastrainedcloseto800studentsacrossIndiaandhasworkedat theDelhiDisputeResolutionSocietyMediationCentre.NisshantisanactivecoachforstudentteamsparticipatinginADRtournaments and takes capacity building sessions at otherNational LawUniversitiesinIndia.

CHIRAGBALYANisanAssistantProfessorofLawatMaharashtraNationalLawUniversityMumbai(MNLU).HeistheCourseDirectorofNegotiationandMediationTrainingProgramandisfaculty-in-chargeoftheADRSociety.Hetrains in mediation and negotiation skills to students and professionalsacrossMumbai.Chiraghasorganizedandconductedseveralinternationalworkshops, lectures in theareaofADR.AtMNLUbesides teachinga fullfour credit clinical course on ADR, he also mentors various teamparticipatinginvariousADRtournaments.
