Buying a brand-new home or condo o� ers an opportunity to get exactly what you really want. It can be a dream come true and an investment for the future, but don’t forget, it’s also a legal transaction.
The term “get it in writing” has never been more important in the case of the new-home or condo purchase since it outlines everything your new home will have in it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms between you and your developer and/or builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon.
Since building a home is much more complicated than a resale transaction where the home already exists, there is
no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so new-home contracts can vary from one builder to another and from provinceto province.
Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what’s in it. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document, so seeking the services of an experienced lawyer is an important step toward ensuring that your dream home becomes a reality.
I can still remember the fi rst time I took a ride on the SkyTrain. It was around the time of Expo ’86, the cars were shiny and new, and my grandma and I got on at the Granville Station and took the ride all the way out to Surrey and back. The distinctive sound that the Bombardier cars make when pulling out of the station always reminds me of that fi rst trip, which we thought was as exciting as any theme park ride.
It’s hard to believe that there was a contentious political battle fought over what has become an integral part of our region’s growth and urban planning. Certainly Surrey, New West, Burnaby and now Coquitlam would be very di� erent places altogether if there was no fast, (mostly) reliable way to get to and from the city core. Now we are again making an important decision for
the city’s future. Take part in the Metro Vancouver Transportation & Transit Referendum, from March 16 - May 29, 2015, and have your say in the future of Metro Vancouver.
An average household would pay $125 a year for the increase to the province’s existing 7-per-cent provincial sales tax, according to Vancouver City Hall staff. The new levy would raise $250-million a year for the capital and operating costs of the new transit projects, leaving regional mayors to seek about $3-billion from the federal government and province.
With more than one million new residents in the Lower Mainland over the next 30 years, this is one of the most pressing issues for the continued livability of our beautiful city.

THE SUN’S SHINING, spring’s in the air, and since it’s been at least a month since I last visited The Shore in North Vancouver, I figure it’s a perfect day to hop on my bike and head over the Lions Gate Bridge. As an extra incentive, Eric Andreasen, Adera’s vice president of marketing and sales, tells me the community’s highly anticipated West Coast piazza is almost complete.
“The Shore’s success is undeniable,” Eric notes. “Since our grand reopening in September, The Shore’s second building is over 70 per cent sold and we anticipate starting to sell our third building months earlier than anticipated. Plus our first homeowners have moved into building one, so there’s a very lively, tangible sense of neighbourhood evolving. The Shore is now so much more than a collection of presale

Outdoor SociableAs I cross the bridge over Mosquito Creek at The Shore’s entry, I once again experience the distinct sense of leaving the hustle and bustle behind and entering a quiet retreat secluded in the heart of the city. No wonder Eric likes to refer to this community as a North Shore Shangri-La.
I pause to admire the bubbling water feature that I remember vividly from earlier visits. Even though Adera is well-known for incorporating innovative public art into each of their developments, the abstract sculpture
of a tree that’s the focal point of this “bubbler” is one that still intrigues me — somehow capturing the sheer majesty of the North Shore forests while honouring contemporary minimalist sensibilities.
Then I look ahead and finally understand why Eric says The Shore’s West Coast piazza is destined to become a social gathering space for the entire community. Inviting benches are conveniently scattered beneath shade trees or beside planter boxes.
In the center, there’s another even larger water feature that, on closer inspection, has one sloped edge that reminds me of a beach. I’m betting that once the hot weather hits, plenty of kids of all ages will be found dipping their toes in here. But what’s most amazing is the public art piece located in the middle of the fountain —three, layered

metal sheets each a cutout of the entryway’s “pine tree.” Intriguing and eye catching, it’s also one of the coolest “no waste” art projects I’ve ever seen.
“Not only is the piazza an incredible outdoor amenity, it also creates exceptional privacy for homeowners,” Eric says. “It’s so easy to think the best homes are ones with a view of the mountains or Mosquito Creek, but visualize sitting on your balcony and looking out over this,” Eric says gesturing across the lavish landscaping. “You’ve got the animation of the water bubblers and people walking past, plus there’s a huge sense of space between you and the building next door. Recently, my bosses, the board of directors of the Greater Vancouver Home Builders’
Association (GVHBA) publicly expressed their support for the proposed 0.5 per cent Metro Vancouver Congestion Improvement Tax, joining over 100 other organizations on the Better Transit and Transportation Coalition.
It wasn’t an easy decision for a number of reasons, particularly the reality that the new tax actually increases the costs of doing business for our members. Our staff and board have scrutinized the 30-year strategy and vision reflected in the plan put forth by the Mayors’ Council, and on balance, determined that the initiative is too
important for the community – and our industry – to allow it to fail.
So why say ‘yes?’In short, notwithstanding some real reservations about TransLink, everyone wins with this plan. Any urban land economist worth their salt will tell you this — worldwide, there is a tight correlation between proximity to transit and prosperity.
An effective transit system means fewer cars, needing fewer parking spots, freeing up space for a more vibrant, livable city. The benefits, in a competitive market like Metro Vancouver, get passed along to homebuyers leading to improved
housing affordability and choice.The benefits of transit are also
realized by businesses – especially small businesses. When people get out of their cars, foot traffic increases, generating more business for retailers located near transit. Thriving business centres create healthy communities, not to mention easier commute times for employees!
Bottom lineA strong land use plan requires an efficient transportation plan, and the one we’re being offered, although not perfect, fits the immediate needs of our community, so this spring, I hope you’ll join me in voting “Yes!” to improved transit and transportation in Metro Vancouver!

Okay, full disclosure. I visit a lot of presentation centres, and it’s not often I find myself at a loss
for words when I see a new one. Today, however, I’m in the just opened RiverSky presentation centre and discover my pen simply isn’t doing much writing.
Sure, I’d expected this New Westminster waterfront condominium from Bosa Properties would be different — but this is breathtakingly so. Hint: a massive, abstract wave in silver floats above the scale model. It’s also packed with people whose enthusiasm is creating a dynamic, engaging vibe. As we begin to prepare for an additional one million people predicted to migrate into Metro
Vancouver over the next 30 years, the Mayors’ Council has developed an ambitious Transportation and Transit Plan called Regional Transportation Investments. Recognizing that our current system will not be able to keep up with the anticipated growth, this plan enables smart expansion through an economically sustainable model.
The Transportation and Transit Plan is a $75 billion dollar plan that will include increasing bus services, building new infrastructure and maintaining existing infrastructure. The aim of the plan is to create less congestion and cleaner air for the Metro Vancouver area. If the plan is approved, two new rapid transit systems will be added. One will connect Surrey Centre with Guildford, Newton and Langley with a later expansion to Langley Centre. The other will be an underground extension of the Millennium Line along Broadway connecting VCC-Clark to Arbutus Street. A third notable part of the Transportation and Transit Plan is to rebuild the Pattullo Bridge to make a safer four lane structure.
In order to implement the Transportation and Transit Plan, a new Metro Vancouver Congestion Improvement Tax — a 0.5% Government Sales Tax harmonized into the Provincial Sales Tax — has been proposed. By introducing an additional 0.5% tax it is estimated to generate $250 million per year over the next ten years. The remainder of the amount will
be subsidized by the provincial and federal governments. The mayors’ council estimates by implementing the new tax it will cost each household approximately $0.35 per day.
When considering the number of people coming into the city and the huge benefits that all community members will reap, $0.35 seems like a small sacrifice to continue to make this region of the best places in the world to live.
It’s up to you to have your sayThe Transportation and Transit Referendum is our opportunity to have a say in the future of our communities. Ballots will be sent by mail and will arrive in households by March 16. Voting will start when ballots are received and will come to an end on May 29, 2015. By voting “Yes” to the transit referendum voters will help keep Metro Vancouver livable, affordable and green, by helping minimize congestion
across Metro Vancouver and maximizing the efficiency of new and existing infrastructure and transit systems.
A “No” vote will cause an interruption in infrastructure and transit growth for Metro Vancouver. This means more time and money will be wasted as transit passenger wait times increase and commute times rise as the region’s population grows over the next 30 years.

FOR MANY WHO LIVE in the Greater Vancouver Area, the only way to own property is to move to the suburbs. Increasingly, however, certain neighbourhoods in the Lower Mainland are redefining what is thought of as suburban.
The Township of Langley certainly qualifies as one such place. Although suburbs are typically populated as a city sprawls out, Langley was one of the first locations in BC settled by Europeans. As such, it has a rich cultural heritage reflected in the variety of architectural styles that save it from being monotonous.
Ambling down Murray’s Crescent in Murrayville, for example, is like taking a walk through British Columbia’s colonial past: beautiful colonial-style buildings line the street, and a little parkette at the centre is the perfect spot for neighbours to gather. What’s more, the story of how Murrayville got its name is a source of pride for locals: in 1884 young Alexander Murray died in a heroic attempt to save a friend from drowning.
Fort Langley is known as “The Birthplace of British Columbia,” and traders for the Hudson’s Bay Company were the first non-indigenous people to populate the area, beginning in
1827. When gold was discovered in the Fraser River in 1858, Fort Langley became an important supply station on the way up the river in search of gold. After the gold rush, Vancouver and New Westminster continued to grow into larger cities, while Langley remained a largely rural landscape.
Although much of Langley maintains this rural feeling, consisting of farming territory and ALR land, recent development and increased population density in certain key areas have been catalysts for some change in the Township of Langley.

for example, which is being touted as Langley’s first truly walkable community, has plenty on hand for all, including delish sushi at Noma, a great cup of joe at Mattu’s Coffee & Tea, a health club, a liquor store, a grocery store, a drug store, and a nail salon. The family feel of this neighbourhood is a further selling point. Sanveer Shokar of Sunmark Homes explains, “On a Saturday, all you’ll see are joggers, people on bikes, and kids playing in parks.”
Qualico’s Kensington is right on site here, and, as such, is a no-brainer for those who like to have everything right at their doorstep. It is

Meanwhile, Hayer recently saw their 20 designer single-family home development, Radius, sell out in Murrayville, and are now offering Exchange, a collection of 98 elegant townhomes whose interiors don’t sacrifice any modern beauty or convenience. Although it’s exciting to see the Township of Langley moving into the twenty-fi rst century with these walkable communities, it’s also reassuring to know that it won’t lose it’s charm as a quiet place to live in the process: farms still abound here, and the volume of ALR land in the vicinity ensures that this community will always be surrounded by plenty of greenspace and fresh air.

Luxury homes see double-digit increase in sales
Luxury homes are selling like hotcakes in Canada’s major markets, according to Sotheby’s International
Realty Canada’s latest Top-Tier Real Estate Report. That upward trend is expected to continue well into 2015, with historically low mortgage lending rates, a solid Canadian economy and an ongoing flow of immigration, migration and foreign investment into Vancouver, Calgary, the Greater Toronto Area and Montreal.
The report examined properties sold in the $1-million-plus range between Jan. 1 and Dec. 31, 2014, analyzing sales volume, the number of days on market, and the percentage of homes that sold over asking price.
Canada’s big four all saw double-digit gains in the sale of luxury homes.
The GTA led the pack with a 38-per-cent increase over 2013 – head and shoulders above Canada’s priciest market of Vancouver, which saw gains of 25 per cent, and Montreal’s 21 per cent. Calgary’s more modest increase of 16 per cent is attributed to fluctuations in the oil market, which introduced uncertainty to the luxury market.
With demand up and inventory down, luxury homes favored sellers in 2014, showing a drop in days on market and a rise in the number of homes sold over asking price in the GTA and Vancouver. The steady rise in the benchmark price of a typical, detached single-family home (now well beyond the $1 million mark in what are considered “conventional” neighbourhoods) has
propelled the price of luxury homes upward in these cities as well.
According to Sotheby’s International Realty Canada president and CEO Ross McCredie, “2014 was another benchmark year for high-end real estate in Canada, as demand continued to be fueled by historically low lending rates, a strong economy and steady immigration and migration into Canada’s major cities. We expect the market to remain strong in the GTA and Vancouver well into 2015, and for demand to outweigh available inventory, especially when it comes to detached single-family homes. The outlook for Montreal and Calgary is positive, but more conservative – both cities are heading into the year positioned to maintain balance.”

It’s no secret: transit has become a big word in housing. More specifically, proximity to transit, especially high-speed
transit like SkyTrain. Proximity to transit is now acknowledged as a significant driver in the decision to purchase process as well as an early indicator of areas with solid potential for rising values.
This issue, New Condo Guide chats with Ben Taylor, director of sales at Wesgroup, about why he believes transit-oriented living is the way of the future and a solid investment.
As a developer, Wesgroup has always embraced the concept of transit-oriented communities. Why are you such enthusiastic supporters?Over the last five to 10 years there’s been a huge cultural shift in the way
people view transit. The days when riding the bus was considered a taboo subject because it wasn’t cool are long gone. In many ways, transit is like the new waterfront — everyone wants to be close to it and on it.
And that’s true of all generations. Look around and you’ll see more and more young people who aren’t buying a car or even getting their driver’s license, because the cost of owning a vehicle is one they aren’t willing to take on. For the older generation, it’s often just easier to get around by transit — in
fact, the over-50s are some of the biggest adopters of this lifestyle. If you make transit reliable, frequent and cost-effective, people use it because it makes sense. When I need to get from Wesgroup’s downtown office to our Brewery District project in New Westminster, it takes me 27 minutes by SkyTrain. I can get to Metrotown in just over a quarter of an hour or Richmond in 20 minutes. Why would I drive?
For homebuyers, is there a magic number that defines “proximity” to transit?In practical terms, think about carrying groceries or a couple of bottles of wine home after a long day at work. For most people, 800 metres is still relatively comfortable — but more than half a kilometre and it doesn’t really feel like you’re that close.
What about price? Does this “new waterfront” cost more?It depends on the area, but yes, most properties located directly on a transit node command a slightly higher price and often appreciate more rapidly than the surrounding neighbourhoods — which can be great as an investment. For example, in Burquitlam, prices rose once construction of the Evergreen Line was actually underway. The same thing happened along the Cambie Corridor. TransLink also predicts that of the 1.2 million people who will move to Metro Vancouver in the next 30 years, 60 per cent of them will live within 800 metres of a rapid transit station.
That tells me demand for homes around transit is going to
continue increasing which will keep that upward
pressure on prices consistent over time — so again, that’s good for people who buy early.

I’ve seen one-bedroom apartments rent for as much as $200 less than a similar product located just down the street but adjacent to a SkyTrain Station. So while you may pay a bit more for a property located directly on transit initially, you’re also getting a lot more long term value.
Many developments are now integrating a SkyTrain station directly into the building — much the way the Sapperton Station flows directly into the plaza at Brewery District. Is this a trend you see continuing?Yes. I believe it just makes sense for developers to work in collaboration with TransLink and the municipalities. Designing with integrated transit in mind is no different than designing communities with dedicated outdoor areas, integrated retail and coffee shops, or adequate bike parking. It’s design on a human scale that creates a more diverse, more vibrant living environment. And that means better communities for everyone.

home. They lived in north Simcoe and we are in Richmond Hill. They loved their home; unfortunately they can no longer maintain it on their own. A | The Baby Boomer generation may have to put condo living on
hold for several years. Many boomers have the financial responsibility of not just university kids but aging parents too. Our generation (the “Sandwich Generation”) is blessed with having the people most close to us at home – our children and parents.
Unfortunately, neither Ottawa nor Ontario provide a deduction for your financial assistance. However, they do provide a “caregiver” tax credit. You may qualify to claim a $4,223 federal tax credit and a similar provincial amount. This will reduce your federal and provincial income taxes by $633 and $210 respectively.
You should note, parents must be at least 65 years old and mentally or physically dependant on their adult child.

Q | My kids attend pre-school and elementary private institutions.
The cost is astronomical but my wife and I believe it is best for our kids. How much of the tuition may I deduct and how? Alan, Markham
A | Generally, private school tuition is not tax deductible. An attempt
was made several years past to deduct private school tuition; however it was politically unpopular and was reversed the following year.
Fees to education institutions may be deductible as childcare and claimed by the lower income spouse. A receipt must be provided by the school for the portion of the fees that are considered “childcare.” Additionally, depending if there is some religious affiliation, part of the fees may be allocated as a charitable donation. Again, the institution must provide receipts and qualify for charitable status.
Q | I recently sold a real estate investment property. How
much income tax will I pay? I calculated I made approximately $80,000. Karim, Mississauga
A | Real estate that is sold for more than its cost may result
in a capital gain for the individual. Fifty per cent of the gain must be included in your income tax return in the year of sale.
Using your figures and assuming you have other income, such as from employment, we can use a 40-per-cent tax rate. Therefore, the $80,000 capital gain is reported. Forty thousand (50 per cent of the gain) must be included in income. This is taxed at 40 per cent. Your tax obligation on the gain is $16,000 (40,000 x 40 per cent) to Canada Revenue Agency.
Consult your accountant/tax advisor before committing to pay any income taxes.

Living in a small space means maximizing storage and ridding yourself of unneeded items. It’s
sometimes tempting to take everything with you for those “just in case” moments. But starting fresh has its advantages when it comes to making the most of storage options to max out their usefulness.
No matter if you are moving into a new house or condo, no one ever says they have enough closet space, so making the most of what you have is critical. Investing
in closet organizers in the bedroom that provide shelves, both short and long, hanging as well as drawers and shoe storage will be invaluable. You will be happy you took the time to do this as you move in and create a new life and new routines. Leaving a closet undone will simply waste space in the end.
Another area to make sure you maximize space is in the front hall closet. Being Canadian means we have a lot of different seasonal coats and footwear and this needs to go somewhere!
Think about adding shelves, drawers and hooks to this closet as well. Make sure the doors to the closet are swing doors if possible and not sliders, as sliders can make closet access difficult.
Another place to create useful organization is the linen closet. Be sure to update this space with lots of shelving prior to using it. A tip that will help maximize your storage within your linen closet is to tightly fold each sheet set and then place them inside the corresponding pillowcase. This will

help you stay organized, allow you to see all of the linen sets and will keep everything together.
Store unused items in bins that fit under a bed, or purchase a new bed with built-in drawers that tuck under the mattress. This is a big area, so make sure it is efficiently used – particularly in a condo! This is a good place to store out-of-season items, as they will be out of sight and mind until they are needed.
If you have the height and budget, build upward! Create a wall unit that goes to the ceiling so you not only elevate the visual height, you take advantage of this extra storage space. In the area, you can store items such as CDs, DVDs, books and photo albums. These items can take up lots of space
if not stored efficiently, so make sure to buy storage solutions specifically created for these items.
If your home is being built brand new, request additional outlets in easy-to-access places to cut down on the clutter of power cords. Consider adding extra receptacles under the cabinets in kitchens to maximize counter space, and a few extra in the bed and bathroom, so that you have enough space for chargers, your hair dryer and shaver.
And never forget, there are great accessories that can be added within kitchen cabinets and under sinks for better organization and easier access.
Good organization may take a little more time and money in the beginning, but it will definitely be worth the effort in the end.
