Statutory Duties under the OSHO, Chapter 509

I. Employer

Under section 6 of the Ordinance, every employer must, so far as reasonably practicable, ensure the safety and health at work of all his/her employees.

II. Employee

Under section 8 of the Ordinance, an employee while at work

(i) must, so far as reasonably practicable, take care for the safety and health of persons (including himself/herself) who are at the workplace; and

(ii) co-operate with the employer or other person so far as may be necessary to enable the statutory requirement to be complied with.

HA OSH Committee

Terms of Reference

1. Provide comments and guidance on the direction of OSH across HA in line with the

provisions and requirements of the OSH Ordinance, subordinate legislation and

regulations.

2. Advise the Human Resources Committee through the minutes of the meetings and

by other reports when appropriate, on OSH issues.

3. Receive reports from members or subject officers on Cluster and HO OSH issues.

4. Monitor Injury on Duty, Incident and Near Miss trends across HA and recommend

necessary action on the findings.

5. Ensure that safety and accident prevention are an integral part of operations and

HA activities.

6. Discuss existing and emerging OSH issues and their resolution.

7. Provide a forum for the exchange of ideas on how OSH issues can be managed.

8. Promote OSH awareness and safe working practices across HA.

9. Provide guidance on OSH programs, including training in relation to their need,

suitability and relevance.

Terms of Reference

1. To review current practices in hospitals and enhance corporate policy, guidelines and

manuals in relation to prevention, management and legal prosecution of workplace

violence.

2. To advise and make recommendations on the workplace violence training needs,

awareness promotion strategies, and measures for continual improvement.

3. To review workplace violence training curriculum and develop e-Learning platform if

required.

4. To provide a platform for communication, sharing of OSH best practices on prevention

and managing workplace violence across HA and aligning practices where appropriate.

5. To review the structure and reporting mechanism of workplace violence incidents and

accidents.

6. To advise workplace violence legal prosecution with the support from HO Legal Service

Section.

7. To coordinate the implementation of initiatives and priorities on prevention and

management of workplace violence and report to the HA OSH Committee.
