10. Perusal of O.A. reveals that inter alia, applicant has
challenged on the grounds viz. :-
“II) The impugned order dated 20/02/2019 of
applicant‟s transfer is issued before completion of statutory tenure of 3 years on the said post, hence is bad & untenable in the eye of law as it has been issued by Resp. No. 1 in violation of the provisions contained in Sections 3 (1), 4 (4) (2) & 5 of the said Act.
VI) It needs to be further taken into consideration
that applicant‟s case does not fall in any of the contingencies laid down in Clause 3(i) as Jalna is not his Home district nor in Clause 3(ii) of the notification dated 16/01/2019 because he has not completed 3 years on the said post. And hence on this count also the impugned order is deserving to be quashed and set aside.

VII) It needs to be further taken into consideration that applicant‟s case does not even fall in the contingency laid down in Clause 4 of the notification dated 16/01/2019 as there were no Bye elections held at Partur in Jalna prior to 31/05/2017.”

11. The question as to whether the special reasons and
exceptional circumstances are recorded the crux of matter,
and it is a matter of record of the Government. Therefore,
this Tribunal directed the learned Presenting Officer to
produce perusal record viz. :-
(i) Copy of the proposal sent by the Divisional Commissioner, Aurangabad proposing the
transfer.
(ii) Copy of the Civil Services Board along with approved transfer.

15. It is seen that the Civil Services Board has in toto
accepted the recommendation of the office of Divisional
Commissioner, Aurangabad, in so far as transfer of the
applicant in place of Shri Pradeep Kulkarni as Sub
Divisional Officer, Nanded, is concerned.
16. The reasons recorded in column No. 7 by the Civil
Services Board are replica of contents of the text narrated
in column No. 5 of the proposal sent by the Divisional
Commissioner, Aurangabad.
17. Endorsement of the competent authority i.e. Hon’ble
Minister and Hon’ble Chief Minister does not reveal reasons
consisting of even one line, in order to comply with the
statutory requirement of existing and recording of ‘special

reasons’ and ‘exceptional circumstances’, for effecting mid-
term and mid-tenure transfer.
18. In the result, applicant has made out prima-facie
strong case for grant of interim relief by way of stay to the
impugned order dated 20.02.2019, in so far as applicant
relates and hence, ex-parte ad-interim relief by way of stay
to the impugned order is granted in favour of applicant in
terms of para 12(F) is granted, with notice to respondents
to show cause as to why the I.R. should not be made
absolute.

“ The R. No. 3 Deputy Director of Education, Aurangabad Division, Aurangabad submits that the orders and decisions cited at pages 45, 47, 53 and 54 of the present Original Application reducing pay scale of the Applicant and re-fixing the same at lower scale are withdrawn.
That the prayer clause „D‟ in the Original Application shall be complied and processed thereby granting 2nd benefit to the applicant under Assured Career Progress Scheme w.e.f. 9.11.2005 holding Applicant‟s 1st entitlement for higher pay scale w.e.f. 9.11.1993. Applicant‟s pay shall be fixed accordingly and the pension proposal be processed accordingly within three months from today. Hence, this purshis”
3. Learned Advocate for the applicant states that the
applicant is satisfied.
4. In view of the foregoing, the O.A. is disposed of in
terms of purshis quoted in foregoing paragraph No. 2.
5. There shall be no order as to costs.
