Notice of default • A firstindicator that a homeowner isin trouble comes when themortgage’s lien holder sendsout a notice of default, which isan initial, nonjudicial documentsignaling that the homeowneris at least 90 days behind onmortgage payments and thatforeclosure has begun.
Trustee sale • If the lender andthe homeowner cannot cometo terms, the lender sends out anotice of trustee sale, advertis-ing the legal description of theproperty being foreclosed onand setting the date, time andplace for the pending sale.
Real-estate owned • If a buyerfor the foreclosed homecannot be found at the trusteesale, the lender takes owner-ship, often designating a loanservicing company to maintainthe property until it sells.
