Subject :-Clarification to Rule 67 of the Jammu and Kashmir Civil Services (Leave) Rules, 1979 recast vide SR0-274 dated 30th May, 2013.
Doubts have been expressed by various Administrative Departments regarding application of SR0-274 dated 30th May, 2013 as to whether the in-service candidates/officers who are on study leave on the date of issue of the notification can be paid salary for the
remaining period of leave.
The issue has been examined in the Finance Department and it is clarified that the notification has prospective effect and as such, the Government servants who had been on study leave (without pay and allowances) on the date of issue of SR0-274 are not entitled to the leave salary for the remaining period of leave.
Accordingly, all the Administrative Departments are requested to communicate the above clarificatory instructions to all Heads of Departments to settle such cases. .

Subject :-Facility to Migrant State Government employees to draw advances out of their G. P. Fund Account and settlement of their final G. P. Fund and State Insurance claims.
In order to facilitate the State Government employees who have migrated from Valley to other parts of the country, to draw advances and make non-refundable withdrawals out of the balances standing at their credit from the offices wherefrom they have been drawing their leave salary at Jammu and other places and final payment of G. P. Fund balances on retirement and settlement of their insurance claims against the State Insurance Fund Policies, Finance Department has laid down provisional procedures for settlement of these cases way back in 1991, vide OM No. A/97(90)-946 dated 02-01-1991.
The Migrant State Government employees drawing their leave salary from the office of the Principal Resident Commissioner, New Delhi have now represented for enhancement in the ceiling of withdrawals (non-refundable advances) from existing 50% of the net credit verified, to 75% of the balance at credit as is applicable to other State Government employees in terms of Rule 8-C of the General Provident Fund Rules amended from time to time. After examination of the issue in the Finance Department, it has been decided to propose enhancement in the existing ceiling of 50% of net credit verified as laid down in sub-clause (b) of clause vi of para B of OM No. A/97(90)-946 dated 02-01-1 991 to 7 5 % of the net credit.
Consequent upon the above, the sub-clause (b) of clause vi of para B of OM cited above is recast as under:-
(b) Withdrawal (Non-refundable advances)
75% of the net credit verified.

The undersigned is directed to invite attention of the Accountant General (A&E), Sirnagar to his letter No. PN-Rev-Cell/G0-57-F/255 dated 11-3-2013. The concordance table attached to Government Order No. 57-F of 2013 dated 11-3-2013 is to facilitate the payment of revised pension/family pension, and has no bearing on pensioner's/ family pensioner's eligibility which is to be determined in terms of the provisions of Government Order in question. The provisions of Government Order No. 57-F of 2013 dated 11-3-2013 are equally applicable to pre-1-1-2006 pensioners/family pensioners of erstwhile Government Lumbering Undertaking (GLU) and Government Transport Undertaking (GTU) pensioners from the date it is applicable to other State Government pensioners. The pension/family pension of erstwhile GLU/GTU pre-1-1-2006 pensioners as revised w. e. f. 1-1-2006 in terms of SR0-94-F of 2009 and amended from time to time shall further be stepped up in terms of the provisions of the Government Order No. 5 7-F of 2013 dated 11-3-2013 read with provisions of Government Order No. 92-F of 2009 dated 24-4-2009.
The case of Shri Raj Nath Dhar which has been pending for want of concordance table may kindly be disposed of at an earliest so that compliance report is filed with NHRC.
