The validity period of EMD is 120 days from the date of online bid opening.
In case Holiday is declared on the opening date tender will be opened at 3.30 P.M. on next working day.

The firm to quote on the tender downloaded from web site shall strictly follow the following procedure:-
1. The tender shall be submitted in two envelope system.A. The Credentials for meeting the eligibility conditions shall be submitted along with the cost of the tender documents (in the shape of demand draft) and Earnest Money in first envelope. The credentials shall be self attested and certified by any BSNL Executive. If not certified by BSNL Executive then original document shall be produced at the time of tender opening after verification of the contents of this envelope and if found eligible then the second envelope containing the bid documents shall be opened.
The tenderer shall submit the downloaded original computer printout of the document from website. The photocopy shall not be accepted. If during the process of tender finalization, it is detected the tenderer has submitted tender documents after making any changes/additions/deletions in the tender documents downloaded from the web site, the offer shall be summarily rejected and the EMD deposited by tendered shall be forfeited in addition to any other action as per prevalent rules.

Tender documents consisting of plans, specifications, the schedule of quantities of the various classes of work to be done and the set of terms & conditions of the contract to be complied with by the contractor whose tender may be accepted and other necessary documents can be seen in the office of the SDE(E), HLD between 11:00hrs. & 16:00hrs, everyday except on second Saturdays, Sundays and Pubic Holidays. Tender documents, excluding standard form, will be issued from his office during the hours specified above, on payment of Rs. 150/- + GST (18%) in cash or Crossed Indian Postal Order/Demand Draft in favour of Accounts Officer (Cash), O/o GMTD, BSNL, Haldwani
6. Tenders, which should always be placed in sealed envelope, with the name of work and due date written on the envelopes, will be received by the SDE (E), HLD upto 15:00 hrs. on. 31.10.2017 and will be opened by him or his authorized representative in his office on the same day at 15:30 hrs.
7. The tender shall be accompanied by Earnest Money of Rs 944/- in form of Demand Draft/FDR/ Deposit at Call Receipt of a Scheduled Bank guaranteed by R.B.I. / issued in favour of Accounts Officer (Cash), O/o GMTD, BSNL, Haldwani. The Earnest money shall be placed in separate sealed envelope annexed with the envelope containing the Earnest Money shall be opened first. The tenders of tenderers, who do not deposit and place the Earnest Money in the prescribed form & manner, shall be summarily rejected.

8. Copies of other drawings and documents pertaining to the work will be open for inspection by the tenderers at the office of the above-mentioned officer.
10.1 Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves before submitting their tenders as to the nature of the ground and sub-soil (so far as is practicable), the form and nature of the site, the means of access to the site, the accommodation they may require and in general, shall themselves obtain all necessary information as to risks, contingencies and other circumstances which may influence or affect their tender. A tenderer shall be deemed to have full knowledge of the site whether he inspects it or not and no extra charges consequent on any misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for arranging and maintaining at his own cost all materials, tools & plants, water, electricity, access, facilities for workers and all other services required for executing the work unless. Otherwise specifically provided for in the contract documents. Submission of a tender by a tenderer implies that he has read this notice and all other contract documents and has made himself aware of the scope and specifications of the work to be done and of conditions and rates at which stores, tools and plant, etc. will be issued to him by the Government and local conditions and other factors having a bearing on the execution of the work.
11 The competent authority on behalf of the B.S.N.L. does not bind himself to accept the lowest or any other tender, and reserves to himself the authority to reject any or all of the tenders received without the assignment of any reason. All tenders in which

Page No.-8any of the prescribed conditions is not fulfilled or any condition including that of conditional rebate is put forth by the tenderer, shall be summarily rejected.
12 Canvassing, whether directly or indirectly, in connection with the tenders, is strictly prohibited and the tenders, submitted by the contractors, who resort to canvassing, will be liable to rejection.
13 The competent authority ob behalf of B.S.N.L. reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted.
14 The contractor shall not be permitted to tender for works in the B.S.N.L. zone(responsible for award and execution of contract) in which his near relative is posted as J.A.O./A.A.O./A.O./ Sr. A.O./C.A.O. or as an officer in any capacity between the grades of Chief Engineer and Junior Engineer(both inclusive). He shall also intimate the names of persons who are working with him in any capacity or are subsequently employed by him and who are near relatives to any Gazetted officer in the Dept. of Telecom or in the Ministry of communications. Any breach of this condition by the contractor would render him liable to be removed from the approved list of contractors of this Department.
15 No Engineer of Gazetted rank or other Gazetted officer employed in Engineering or Administrative duties in an Engineering Department of the Government of India is allowed to work as a contractor for a period of two years after the date of his retirement from Government service, without previous permission of the Government of India in writing. The contract is liable to be cancelled if either the contractor or any of his employee is found any time to be such a person who had not obtained the permission of the Government of India as aforesaid before submission of the tender or engagement in the contractor’s service.
16 The tender for the work shall remain open for acceptance for a period of 1 Month from the date of opening of the tenders. If any tenderer withdraws his tender before the said period or makes any modifications in the terms and conditions of the tender which are not acceptable to the department, then the Government shall, without prejudice to any other right or remedy, be at liberty to forfeit 50% of the earnest money as aforesaid.
17 The successful tenderer shall be required to execute an agreement with the Engineer-In-Charge in the Performa annexed to the tender document, within One Month of issue of letter of acceptance by the B.S.N.L. In the event of failure on part of the successful tenderer to Sign the Agreement, the Earnest Money will be forfeited and the tender cancelled.
18 This Notice Inviting Tender (B.S.N.L. W.-6) shall form a part of the contract document. The contract shall be deemed to have come into effect on issue of communication of acceptance of the tender in favour of the successful tenderer/contractor. On such communication of acceptance, the successful tenderer/contractor shall, within 7 days from such date, formally sign the agreement consisting of:-
a) The notice inviting tender, all the documents including additional conditions, specifications and drawings, if any forming the tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto.
b) Standard B.S.N.L. W.-8.
c) Agreement signed on non-judicial paper as per Performa annexed to the tender document.

Page No.-12GENERAL RULES AND DIRECTIONS
1. All works proposed for execution by contractor will be notified in a form of invitation to tender displayed on Notice Board in select BSNL offices and signed by the officer inviting tender or by publication in News papers/internet (designated web page) as the case may be.
2. This form will state the work to be carried out, as well as the date of submitting and opening tenders and the time allowed for carrying out the work; also the amount of earnest money to be deposited with the tender, and the amount of performance guarantee to be deposited by the successful tenderer(s). Copies of the specifications, designs and drawings and any other documents required in connection with the work signed for the purpose of identification by the Officer inviting tender shall also be open for inspection by the contractor at the office of Officer inviting tender during office hours.
3. In the event of the tender being submitted by a firm it must be signed by the authorized signatory.
4. Receipts for payments made on account of work when executed by a firm, must also be signed by authorised signatory.
5. Any person who submits a tender shall fill up the usual printed form stating at what rate he is willing to undertake each item of the work. Tenders, which propose any alteration in the work specified in the said form of invitation to tender, or in the time allowed for carrying out the work, or which contain any other condition of any sort, including conditional rebates will be summarily rejected. However, tenders with unconditional rebate will be acceptable. No single tender shall include more than one work, but contractors who wish to tender for two or more works shall submit separate tender for each. Tenders shall have the name and number of the works to which they refer written on the envelopes. The rates(s) must be quoted in decimal coinage. Amounts must be quoted in full rupees by ignoring fifty paise and considering more than fifty paise as rupee one.
6. The Officer inviting tender or his duly authorised assistant will open tenders in the presence of any intending contractors who may be present at the time, and will enter the amounts of the several tenders in a Comparative Statement in a suitable form. In the event of a tender being accepted a receipt for the earnest money forwarded therewith shall thereupon be given to the contractor who shall thereupon for the purpose of identification sign copies of the specifications and other documents mentioned in Rule 1.
In the event of a tender being rejected, the earnest money forwarded with such unaccepted tender shall thereupon be returned to the contractor remitting the same without any interest.
7. The officer inviting tenders shall have the right of rejecting all or any of the tenders, and, will not be bound to accept the lowest or any other tender.
8. The receipt of an accountant or clerk for any money paid by the contractor will not be considered as any acknowledgement of payment to the Officer inviting tender and the contractors shall be responsible for seeing that he procures a receipt signed by the concerned Accounts Officer.
9. The memorandum of work tendered for and the schedule of materials to be supplied by BSNL shall be filled and completed in the office of the Officer inviting tender before the

Page No.-13tender form is issued. If a form is issued to an intending tenderer without having been so filled in and incomplete, he shall request the officer to have this done before he completes and delivers his tender.
10. The tenderer shall sign a declaration under the officials Secret Act, 1923 for maintaining secrecy of the tender documents drawings or other records connected with the work given to them. The unsuccessful tenderers shall return all the drawings given to them.
11. Rates quoted by the Contractor in the tender both in figures and words shall be accurately filled-in so that there is no discrepancy in the rates written in figures & words. However, if a discrepancy is found the rates which correspond with the amount worked out by the contractor shall unless otherwise proved be taken as correct. If the amount of an item is not worked out by the contractor or it does not correspond with the rates written in either in figures or words then the rates quoted by the contractor in words shall be taken as correct. Where the rates quoted by the contractor in figures and in words tally but the amount is not worked out correctly, the rates quoted by the contractor will unless otherwise proved be taken as correct and not the amount.
12. Performance Guarantee: The contractor is required to furnish performance guarantee for an amount equal to 5% of the contract value in the form of bank guarantee / CDR/FDR/DD (of a nationalized / Scheduled Bank in a standard format) within two weeks from the date of issue of award letter. The validity period of the performance security in the form of performance bank guarantee shall be one year from the date of actual completion of work.
Security deposit: In addition to performance guarantee stated above, a sum @ 10% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum be deducted with the sum already deposited as earnest money, will amount to security deposit of 5% of the Tendered value of the work.
13. All rates shall be quoted on the tender form. The amount for each item should be worked out and requisite totals given. Special care should be taken to write the rates in figures as well as in words and the amount in figures only, in such a way that interpolation is not possible. The total amount should be written both in figures and words. In case of figures, the word ‘Rs.’ Should be written before the figure of rupees and word ‘P’ after the decimal figures, e.g. ‘Rs.2.15 P’ and in case of words, the word, ‘ Rupees’ should precede and the word ‘Paise’ should be written at the end. Unless the rate is in whole rupees and followed by the word ‘only’ it should invariably be upto two decimal places. While quoting the rate in schedule of quantities, the word’ ‘only’ should be written closely following the amount and it should not be written in the next line.
Rates, Taxes and Duties 14A. The bidder shall give the total composite price inclusive of all levies and
taxes(but exclusive of GST as applicable) i/c packing, forwarding, freight and insurance charges as per existing BSNL policies. The evaluation and comparison of respective bids shall be done on the basis of Net Cost to BSNL on the prices of the goods offered inclusive of taxes and duties (but excluding GST), packing, forwarding, freight and insurance charges as per existing BSNL policies.

Page No.-14The applicable GST (Less Input Tax Credit on the part of the vendor) shall be
reimbursed on production of valid GST invoice by the vendor and proof of payment of GST, as applicable under GST Laws.
14B. The total composite price shall comprise of unit price and all other components of price need to be individually indicated quoted against the goods/material/service, it proposes to supply under the contract in the following manner:-
i) The Basic Unit Price of the goods /services/ materials, Freight, Forwarding, Packing, insurance and any other levies /charges already paid or payable by the contractor/ supplier (excluding GST) shall be quoted separately.
ii) The liability to pay all taxes, levies, etc shall be of contractor and BSNL will not entertain any
claim whatsoever in this respect. The applicable GST (Less Input Tax Credit on the part of the vendor) shall be reimbursed on production of valid GST invoice by the vendor and proof of payment of GST, as applicable under GST Laws.
14C. No concessional form shall be provided by BSNL.
The evaluation and comparison of respective bids shall be done on the basis of net cost to BSNL on the prices of the goods offered inclusive of duties and taxes (but excluding GST), packing, forwarding, freight and insurance charges as per existing BSNL policies.
14D. GST :-In view of the GST implementation w.e.f 01.07.2017, following points may be observed.
(i) The firm shall furnish correct HSN/SAC codes in GST challans / invoices for availing input tax credit by BSNL.
(ii) In case where the input tax credit is not offered by the vendor, and subsequently at any stage it is found that input tax credit is admissible as per GST Act 2017, then the vendors will be liable to refund the said amount if already paid to them.
(iii) Invoices should clearly indicate name address and GSTIN of the supplier, date, name address and GSTIN of the recipient, place of supply along with name of state, HSN code of goods or service accounting code (SAC).
15A. However, pursuant to the constitution (forty-sixth amendment) act, 1982, if any further tax or levy is imposed by statute, after the last date of receipt of tenders, and the contractors thereupon necessarily and properly pays such taxes/ levies, the contractor shall be reimbursed the amount so paid, provided such payment, if any, is not in the opinion of Superintending engineer (whose decision shall be final and binding) be attributable to delay in execution of work within the control of contractor.
15B. In case of statutory variation in regard to excise duty, only in respect of package AC units, EA set and Lifts. Within the stipulated date of completion of individual agreement, the same shall be paid or recovered as per the actual against documentary proof.

Page No.-15However, beyond this period BSNL will take advantage of any duty reduction but will not pay extra on account of duty increase. Price adjustment provision on account of change in excise duty shall not apply in respect of equipment/components of equipment/materials, other than package AC units, EA set and lifts.

15C.The contractor shall, keep necessary books of account and other documents for the purpose of this condition as may be necessary and shall allow inspection of the same by a duly authorised representative of BSNL and further shall furnish such other information/ document as engineer-in-charge may require.
16. The Contractor shall, within a period of 30 days of imposition of any further tax or levy in pursuant to the constitution of (forty sixth amendment) act 1982 give a written notice thereof to the Engineer-in-charge that the same is given pursuant to this condition, together with all necessary information relating thereto.
17. BSNL shall deduct income tax and other statutory deductions from payments due to the firm as per rules of the State/Central Government. The Accounts Officer of the concerned Division shall issue certificates for such deductions to the firm.
18. The tender for the work shall not be witnessed by a contractor or contractors who himself/ themselves has/have tendered or who may and has/have tendered for the same work. Failure to observe this condition would render, tenders of the contractors tendering, as well as witnessing the tender, liable to summary rejection.
19. Other agencies will also simultaneously execute the works like horticulture, external services, installation of telephone exchange equipment and other building works for the same project along with this work in particular. The contractor shall afford necessary facilities for the same. No claim in the matter shall be entertained.
20. Some restrictions may be imposed by the security staff etc. On the working and/or movement of labour, material etc., The contractor shall be bound to follow all such restrictions /instructions and nothing extra shall be payable on this account.
21. The contractor shall comply with the provisions of the Apprentices Act 1961, and the rules and orders issued thereunder from time to time. If he fails to do so, his failure will be a breach of the contract and the Engineer-in-charge may in his discretion without prejudice to any other right or remedy available in law cancel the contract. The contractor shall also be liable for any pecuniary liability arising on account of any violation by him of the provisions of the said Act.
22. No engineer of gazetted rank or executive of BSNL employed in engineering or administrative duties in an engineering department of the government of India/BSNL is allowed to work as a contractor for a period of two years of his retirement from government service without the previous permission of government of India / BSNL. This contract is liable to be cancelled if either the contractor or any of his employee is found at any time to be such a person who had not obtained the permission of the government of India as aforesaid, before submission of the tender or engagement in the contractor’s service as the case may be.

All near relatives of BSNL Employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL., The detailed guidelines in this regard are given in the following paragraphs :-
I) The near relatives for this purpose are defined as:a) Members of a Hindu Undivided family.b) They are Husband and wife.c) The one is related to the other in the manner as father, mother, son(s) & son’s wife
(daughter-in-law). Daughter (s) & daughter’s husband (son-in-law). Brother (s) & brother’s wife sister (s) & sister’s husband (brother-in-law).
II) As per Government of India’s CCS Conduct rule 4, no Government servant shall in the discharge of his official duties deal with any matter or sanction any contract to any company or for any other person if any member of his family is employed in that company or firm or under that person or if he or any member of his family is interested in such matter or contact to his official superior. This clause is applicable to all BSNL employees and in view to this as soon as any BSNL employee becomes aware of the above aspect, he must intimate this to the prescribed authority. For non executive employees this authority is SSA Head/Circle Head/Chief Engineer Chief Archt./ Corporate office under whom he is posted. For executive employees (at present some of them are called as Gazetted officers) the prescribed authority for this purpose is Circle Head/Chief Engineer/Chief Archt. Corporate office under whom he is posted.
III) (a) The company or firm or any other person is not permitted to tender for works in BSNL Units in which his near relative(s) is (are) posted. The unit is defined as SSA/Circle/Chief Engineer /Chief Archt. /Corporate office for non executive employees and all SSA in a circle including circle office /Chief Engineer /Chief Architect /Corporate office for executive employees (those called as Gazatted officers at present). Therefore, it has been decided by the competent authority that a clause must be added in the tender and other related documents that the tenderer should give a certificate that none of his /her such near relative is working in the units as defined above where he is going to apply for tender/work. In case of proprietorship firm certificate will be given by all the partners and in case of limited company by all the Directors of the company. Any breach of these conditions by the company or firm or any other person, the tender/work will be cancelled and earnest money/security deposit will be forfeited at any stage whenever it is so noticed. The department will not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.(b) In respect of case where the tender notice /work related orders have been issued and are waiting for submission the concerned unit should issue corrigendum for inclusion of above clause. However, where tender/work related documents have been opened and are waiting for finalization the certificate may be taken from the company or firm or any other concerned person giving details of the relatives employed in the jurisdiction of the tender. The company or firm or the person concerned will not be debarred in this case but his work will be kept under proper watch to avoid any further complaint. Further, the relative will not be involved in the decision making and execution of the work.
(c) Where the tenders or the work are already in operation (or awarded ) the tenderer may be requested to give details of relatives employed in the jurisdiction of the tender in such cases the tenderer will be allowed to continue the work but special watch may have to be
kept about his performance to avoid any complaint. The concerned relative will not be involved in execution and settlement of claims of the contractor.

SPECIFICATIONS FOR E.I. & FANS1. The works shall be done as per current CPWD specifications for Electrical works as
amended from time to time & Indian Electricity Rules as amended up to date.
2. The work shall be supervised by a qualified overseer.
3. The layout of the work will be given by the Engineer – in – charge or his duly authorized representative at site of work.
4. The following wiring shall be done as separate circuits.(a) Power Plug wiring(b) Light & Fan point wiring.(c) Emergency light point wiring to be fed from battery.(d) Telephone wiring.
5. The earthing sets shall be provided in the presence of the Engineer-in-charge or authorized representative.
6. The tenderer should submit the sealed samples of materials to be used on work alongwith the tender. The samples of the successful tenderer will be retained by the Engineer-in-charge while the sample of materials of others will be returned after the tender is decided un-approved materials, if used on work shall have to be removed immediately at the cost & risk of the contractors.
7. The contractors will have to submit the completion plan to the scale in triplicate when the bill is finally paid ,failing which necessary amount will be recovered from his bill as per clause 6(b)
8. The contractors shall have to give the following tests at his cost & intimated test before final bills are paid, nothing extra will be paid to him out his account.(a) Earth Test.(b) Polarity Test.(c) Insulation Test.(d) Earth continuity test of the recessed conduit pipes.
9. Any damages done to the B’ldg. by the contractors during the execution of works shall have to be made good at his cost & risk. If he does not do it himself within a reasonable time determined by the Executive Engineer (E), then the same will be got done at his cost departmentally after giving notice to him.
10. At the time of laying conduit pipes in the slab & increase the contractors will keep fish wire of 14 SWG wire throughout conduit pipe end will have take special care so that the conduits do not pass through Air-Conditioning ducts Grill column beams etc if any such necessity is forseen, special written permission of Assistant Engineer (E) will be obtained before such work is carried out. In case of failure the contractors will not beyond on this account. The successful tender should recess the conduit in the walls before the plastered & in collaboration with B’ldg. progress of work. Any damages thus done will give to be made good at the cost of the contractors. The conduit pipes should be mechanically & Electrically continuous.
11. The runs of various circuits wiring at various places shall be kept minimum by taking the runs of walls where crossing of columns is not necessary. This has to be decided before the casting slab so that un-necessary lengths of conduit are not laid there in.
12. All the I.C. Distribution board sub-main board & main board & there complete fittings shall be sign where clearly indicating the number of distribution board, the type of load it is serving & the number of circuits contained in the distribution box details of the nut in a tabular fan on the reverse of the cover of the distribution box.
13. I Underground cables both of 1.1 KV & 11 KV grade should be subjected to pressure insulation tests before & after laying the same in the ducts, & in case of un-satisfactory test

Page No.-26the cost of all repairs & replacements & all etc work of removal & re-laying will have to be made good by the contractors at his own cost & risk.
14. The contractors will have to use meal clad switches & metal clad distribution board of specified categories as given in the schedule of work.
15. Termination of all connections of main board, & slab main board Sub-Distribution boards, will be done by erupting & nothing extra will be payable on this account.
16. Interconnections between bus bar & switches i/c & above 100 Amps. Sub-Main board will be done with solid copper conductor with PVC sheathing.
17. For the conduit already laid recovery shall be effected on the basis of DSR-2013 rates & abatement of this tender on linear basis.
