RECOMMENDATIONS

1. Approve and forward this report with transmittals, to the Mayor's Office with the request that the Board of Public Works (Board) be authorized to execute Amendment No. 1 to the Bureau of Street Services (BSS) Contract C-124654 with USA Waste of California, Inc. dba Waste Management (Waste Management), and execute Amendment No. 1 to the BSS Contract C-124652 with American Reclamation. The amendments will add construction and demolition material to the existing contracts which are for the recycling and/or disposal of Inert Materials, Mixed Inert Materials, Mixed Debris, Waste Debris, and Bulky Items.

2. Upon approval, the President or two members of the Board will execute the contract amendments, and;

3. Return the executed contract amendments to the Bureau of Sanitation (LASAN) for further processing. For pick up, contact Christine Courtois at 213-485-3592.

DISCUSSION

Background

The Bureau of Sanitation (LASAN) provides solid waste collection services to other City Departments for projects which require the collection and recycling of various solid waste materials. LASAN recognizes the value and suitability of delivering recyclable materials to contractors that are able to the extent feasible, reuse and recycle these materials.

A total of three bids were received by BSS on July 22,2014 from American Reclamation, Inc. , Recycled Aggregate Materials Company, Inc. (RAMCO), and USA Waste of California, Inc. dba Waste Management in response to the Request For Bids for the recycling and/or disposal of inert materials, mixed inert materials, mixed debris, waste debris, and bulky items generated by BSS citywide operations.

On September 24, 2014, the Board approved the BSS Contracts with American Reclamation, Inc. (C-124652),RAMCO (C-124653), and Waste Management (C-124654) for the recycling and/or disposal of inert materials, mixed inert materials, mixed debris, waste debris, and bulky items generated by BSS citywide operations (Transmittal No.1). On February 11 , 2015, the Board authorized LASAN to utilize these BSS agreements (Transmittal No.2).

In addition to the recycling and/or disposal of the materials that were provided in the BSS contracts, LASAN also collects construction and demolition (C&D) material that results directly from construction, remodeling, repair, demolition or deconstruction of buildings and other structures. C&D material includes, but is not limited to, asphalt, concrete, Portland cement, brick, lumber, wallboard, roofing material, ceramic tile, pipe, glass, carpet or associated packing. C&D material does not contain hazardous waste. Therefore, LASAN needs to amend BSS contracts with American Reclamation, Inc. (C-124652) and Waste Management (C-124654) to include the recycling and/or disposal of C&D material. (Transmittal Nos. 3 and 4).

Waste Management and American Reclamation are capable of accepting and processing C&D material, and have provided LASAN price quotes for these additional services (Transmittal Nos. 5 and 6). On March 12, 2015, RAMCO responded that they are not able to accept these types of material at their facility (Transmittal No.7).

Scope of Services The scope of services for these amendments to the BSS contracts with American Reclamation, Inc., (C-124652) and Waste Management (C-124654) will add the recycling and/or disposal of C&D material and C&D material with contamination. The new schedule of prices for C&D material disposal will also be included in the BSS contract amendments.

• Accept, recycle, and/or dispose of the materials that were provided in the BSS contracts C-124652 and C-124654.

• Accept, recycle, and/or process Construction and Demolition (C&D) materials that results directly from construction, remodeling, repair, demolition or deconstruction of buildings and other structures, and does not contain hazardous waste. C&D material includes, but is not limited to, asphalt, concrete, Portland cement, brick, lumber, wallboard, roofing material, ceramic tile, pipe, glass, carpet or associated packing.

• Accept, recycle, and/or process Construction and Demolition (C&D) materials with contamination that results directly from construction, remodeling, repair, demolition or deconstruction of buildings and other structures, and does not contain hazardous waste. C&D material with contamination includes, but is not limited to, asphalt, concrete, Portland cement, brick, lumber, wallboard, roofing material, ceramic tile, pipe, glass, carpet or associated packing. Such loads contain more than 50% contamination. These loads will be processed to remove the contamination, and the contamination will be disposed of at a proper landfill.

• Operate and maintain their facilities in compliance with all federal, state, and local permits and applicable laws.

Provided below is the cost table for C&D Materials and C&D Material with Contamination (C&DWC). These costs are to be added to the Schedule of Costs Submittal in the original contracts. Table 1. Additional Schedule of Costs for American Reclamation, Inc. (C-124652)

PROPOSED TERM OF CONTRACT The proposed contract terms of the original contracts are five (5) years, which commenced on August 1, 2014 and expires on July 31,2019.

BUSINESS INCLUSION PROGRAM Due to the nature of services provided by these contracts, there are no subcontracting opportunities available and the Mayor's Office of Economic Development waived this requirement on April 23, 2014. However, if any subcontracting opportunities arise, the City of Los Angeles, Department of Public Works will encourage the vendors to utilize Minority Business Enterprises (MBE), Women Business Enterprises (WBE), Small Business Enterprises (SBE), Emerging Business Enterprises (EBE), Disabled Veteran Business Enterprises (DVBE), and Other Business Enterprises (OBE).

OTHER CITY POLICIES AND REQUIREMENTS Waste Management and American Reclamation, Inc. shall comply with all City requirements, including:

NOTIFICATION OF INTENT TO CONTRACT The required Notification of Intent to Contract was filed on September 6, 2013 with the CAO Clearinghouse.

CHARTER SECTION 1022 A Charter 1022 determination was not required because there is no labor component to the contract.

CONTRACTOR RESPONSIBILITY ORDINANCE All contractors participating in this program are subject to compliance with the requirements specified in the City of Los Angeles's Contractor Responsibility Ordinance #173677, [Article 14, Chapter 1, Division 10, L.A. C. C.]. Failure to comply with the requirements specified in this ordinance will render the bidder's contracts subject to termination pursuant to the conditions expressed therein.

CONTRACTOR PERFORMANCE EVALUATION In accordance with Article 13, Chapter 1, Division 10 of the City of Los Angeles Administrative Code, the appropriate City personnel responsible for quality control of these personal services contracts shall submit Contractor Performance Evaluation Reports to the Bureau of Contract Administration upon completion of these contracts.

LOS ANGELES RESIDENCE INFORMATION The headquarters of Waste Management is located at 1011 Fannin, Suite 4000, Houston, Texas 77002. The contractor has 43,500 employees company-wide of which 95 reside in the City of Los Angeles.

The headquarters of American Reclamation is located at 4560 Doran Street, Los Angeles, California 90039. The contractor has a staff 70 employees, of which 45 reside in the City of Los Angeles.

APPROVED AS TO FORM The proposed contracts have been approved as to form by the Office of the City Attorney.

CONTRACT ADMINISTRATION Responsibility for the administration of these contracts will be with the Bureau of Street Services.

LOCAL BUSINESS PREFERENCE PROGRAM The City passed Ordinance No. 18190, which adopted the Local Business Preference (LBP) Program. The Program is designed to increase local employment and expenditures in the local private sector. Businesses that qualify as a Local Business Enterprise (LBE) may be granted an eight percent (8%) reduction of their Bid amount solely for the Bid evaluation process.

For this project, all bidders were awarded a contract; therefore, the LBP Program was not applicable.

STATUS OF FINANCING

There is no impact to the General Fund. The total funding for this project is not to exceed $25,000 per year for American Reclamation, Inc. (C-124652), and $70,000 per year for USA Waste of California, Inc., dba Waste Management (C-124654). Funding for Fiscal Year (FY) 2016 - 2017 is available in the Solid Waste Resources Revenue Fund, Fund 508, Appropriation Unit NO.50NX82, Object 602. However, Funds and Appropriations for future fiscal years are not yet identified and existing appropriations may change based on available cash balances. Therefore, Funds and Appropriations, once determined by the Director of Sanitation or designee, will be reviewed and certified by the Director of the Office of Accounting or designee, as to the status and availability of fu e·ff1
