    What pleasant weatherwe are having this February.It is difficult to believe that itis actually February and notApril or May. With this pleas-ant weather we still have toremember that it will con-

    tinue to get chilly when thesun goes down. Since mosthot water tanks are outsidein the cold we have somehints for helping with yourNatural Gas usage.

    It is well known that our hot wa-ter heaters use a great deal ofenergy. This occurs when we arenot actually using hot water. Thehot water heater stores hot water

    and keeps it at temperature.Here are some tips on lowering

    our gas usage:

    1. Lower the temperature ofthe thermostat on the hot watertank.

    2. Purchase a insulatingblanket for the hot water tank.

    3. Flush the hot water tankonce every three months. (This willremove the sediment at the bot-tom of your tank that act as an in-sulator preventing the flame fromeffectively heating the tank).

    Annual Lot Inspections are go-

    ing to commence very shortly.We will be reinspecting those resi-dents that still may have openitems from the inspections inSeptember. Please check aroundand get ahead of our inspec-tions.

    Speeding. Too much of it.When you see a speeder, pleasenote the make/model/color andthe license plate number and re-port it to the park office.

    If you discover unknown indi-viduals on your space, please no-tify the Hayward Police Depart-ment.

    Guillermo continues to repairstreet lights. If you see a light out,please inform the office.

    Car wash hoses: Guillermo hasnoticed over the past months thatsomeone is purposely damagingthe hoses provided by manage-ment for your use. Please report adamaged hose and anyone you

    see abusing these benefits.Graffiti: Guillermo continues to

    be on top of the graffiti but needsyour assistance. Please report tothe park office AND the policewhen you see someone involvedin tagging.

    Meter ReaderSpanish Ranch I utility meters

    are read during the middle ofeach month. The meter readeris employed by an outside com-pany that is responsible only formonthly meter readings and hasno responsibility for the amount ofyour utility bills.

    Our meter reader, Ron, is justdoing his job. You can help himdo that by keeping meters clearof obstructions and by treatinghim with respect and courtesy.

    Contractor fraudThe Contractors State License

    Board (CSLB) has advised usthat unscrupulous and unlicensed

    contractors continue to targetmobilehome parks throughoutCalifornia. Many mobilehomepark residents have launchedcomplaints against dishon-est contractors who have takenadvantage of them. Such scamsinvolve home re-piping, heating,air conditioning, jack repairs, padchanges, and re-leveling.

    Travelers, or clans of illegalcontractors move from town to

    town soliciting elderly mobile-home owners to sign contracts forwork. Many times these unsus-pecting residents are talked intorepairs that are unnecessary andwhen the work is performed, it isgenerally substandard or incom-plete. The elderly are targetedbecause they tend to be moretrusting or can be intimidatedand feel they must agree to thepitch. Also, because of a lifetime

    of saving, seniors generally havemore cash available or equityin their homes. Unfortunately,when they become the victims of

    scams, many elderly are reluc-tant to file a complaint as theyfeel it might reflect upon theirability to handle life situations.

    In order to combat thesescams, the CSLB created aStatewide Investigative FraudTeam (SWIFT) which has beensuccessful in various undercov-

    er sting operations throughoutthe state. Bands of unscrupulousand illegal contractors have been

    cited and misdemeanor notic-es have been issued for courtappearances.

    Beware the free inspectionIf anyone offers you a free

    inspection, please take heed!Check their contractors licensenumber with the CSLB and verifythat the license number, busi-ness name and business addressmatch with information given by

    the contractor.

    Anyone performing contract-ing work in excess of $500.00MUST be licensed by the CSLB.In order to become licensed,contractors must have worked atleast four years in their selectedfield, pass a two-part examina-tion, post a license bond, andprovide workers compensationinsurance for their employees.

    The Contractors State LicenseBoard operates under the umbrel-la of the California Departmentof Consumer Affairs. The CSLBlicenses and regulates Californias

    278,000 contractors. It is inter-esting to note that the CSLBinvestigates 25,000 complaintsagainst contractors annually. Ifyou wish to launch a complaintagainst a contractor, or suspectcontractor fraud, please call 1(800) 321-2752 or go to www.cslb.ca.gov.

    Did you know that a permit is required formost physical changes to your home?

    The State Department of Housing & CommunityDevelopment (HCD) requires a permit for exterior

    changes, such as: awning extensions

    room additions

    air conditioner installations

    storage shed construction

    porches

    decks

    Park managers are required by HCD to signoff on a permit application for exterior items.

    You might be surprised to learn thatHCD requires permits for changing your homesinterior as well, but management does not get

    involved in this area.The management office has plot plan forms

    required for the permit application.

    In addition to the ongoing Food Drive for theAlameda County Food Bank food barrels, resi-dents will be asked to contribute to other worthycauses throughout the year.

    February-April: Animal shelter. Spring is a busytime for the shelter with an influx of puppies andkittens. Gift cards from grocery or pet supplystores, dry or canned dog and cat food, and vari-ous other items are needed by the Hayward animalshelter. See specific list on page 6.

    Coming up May-July: school supplies to benefitHaywards Tools for Schools.

    SR1 Assn Board Meeting 1/27/11Present were Judy Allen-Rogers,

    Patty Little, Kathi Calvert, and DawnPlaskon.

    Revisions to the bylaws were dis-cussed with a meeting of the revisioncommittee set for Sunday, Jan. 30 at4pm.

    Proposed changes from tonights

    meeting include:Consider whether the current lan-

    guage allows for a person to serve asboth VP/Secretary or VP/Treasurer orSecretary/Treasurer. Article IV Section1 states that the elected officers ofthe Association shall be the President,Vice President, Secretary, andTreasurer. The text does not specifythat these offices must be held by 4individual parties.

    Modify Article IV Section 6. Reducethe required number of board mem-bers from 6-8 to 4-6 in addition to theofficers.

    Modify Article IV Section 7 to requirethat the board provide a detailedmonthly accounting of income andexpenses for publication in the El Toro.Perhaps include a statement that resi-dents seeking to question or contestboard expenditures should come tothe monthly board meeting?

    Modify Article VIII Section 1 to statethat the board will meet monthly andits recommendations published in theEl Toro through the minutes. Datesof upcoming board meeting to be

    posted at the clubhouse and on thewebsite as well as in the El Toro. Notethat meeting dates would need to beconfirmed 2 months out to be usefulin the El Toro

    Modify Article VIII Section 2 to thata general meeting will be held onthe first Thursday of April to elect offi-

    cers and board for the coming yearand other meetings will be called asdeemed necessary.

    Modify Article VIII Section 3 toremove the seemingly superfluous ref-erence to the right to call meetingsand MRL

    Modify the Article IX Section 1 toreference proposed changes beingbrought to the monthly board meet-ing, and that amendments will bevoted on at an association meeting(that being one of the deemed nec-essary instances).

    We also discussed the possibility ofholding brief association meetings atthe start of any association-sponsoredevent like a spaghetti feed or wienieroast.

    Those of us at the meeting hopedto have the draft ready for presenta-tion at the coming association meet-ing on Feb. 3. This would let us voteon them at the start of the April meet-ing just before elections.

    Kathi has agreed to serve as nomi-nations chair for the coming elec-tions.

    We chose April 16 for the Home

    Fair, and will submit a reservationrequest. We proposed $20/table pluspublicizing the event to all mobilehome communities in Hayward.

    Reported Crime:

    Mail Stolen

    Mail was stolen from a homeon Miranda. The resident saw theperson taking her outgoing billpayment mail and gave chaseand called the police. The policewere given a description of thecar, make and model and also apartial plate number. So be safeand take your mail to the USPS

    blue box at the main clubhouse.The car was a silver 1990s model

    Pontiac Grand Am (had severalbig dents on the vehicle) withpartial California license plate #5vp753. The driver of this vehiclewas a black man 25-35 years ofage with a round, chubby face.

    Speeding Car

    A resident complained aboutcars racing down Murcia by theupper car wash at around 11:30 1 a.m. at night. Vehicle is report-

    ed to be dark gray/black suppedup sports car. If you know whois doing this or get a can get alicense plate number report it tothe police and management.

    Donation Bags Rifled

    Thieves are again going throughdonations bags out front of homes,sometimes leaving clothing strewnabout. Residents are requested toput donations out in the morningand not the night before, andif possible to keep an eye out

    during the day until the charitystruck comes through.

    The upper car wash has beenleft unlocked, if you see either ofthe car washes not locked up atnight, call the office.

    Article I Name

    The name of this organization shall be SPANISHRANCH 1 ASSOCIATION, INC. a non-profit organiza-tion. Hereafter SPANISH RANCH I ASSOCIATION shallbe referred to as the ASSOCIATION.

    Article II Purpose and Goal

    SECTION 1: It shall be the purpose of theAssociation to foster and promote a safe and harmo-nious living environment for all the residents throughthe sponsorship of cultural, education and socialactivities of general appeal so that all residents feelwelcomed to participate in the Association. It is alsoour goal to promote a friendly environment withinour community for all residents while respecting theprivacy of all individuals. We will always considerthe fact that we are a family park. Our recommen-dations and decisions will reflect the fact that weare a family park. Discrimination of any type willnot be tolerated. Lastly, t The Association shall actas the political action body whenever it becomesnecessary to defend the rights of all park residentsgranted under the Hayward Mobile home RentStabilization Ordinance, the California State Mobilehome Residency Law (California Civil Code Sections798 through 799.10), all other California state lawsand codes, United States laws and codes.

    SECTION 2: The Association will work withand listen to the concerns of residents and discuss withManagement the decisions made at the ExecutiveBoard Meetings and the monthly Association meet-ings to improve living conditions, safety and well-being of the residents of our Park. If the park residentsalong with the elected officers and the Board ofDirectors of the Association feel that the manage-ment staff is not cooperating with our requests madeconcerning the park residents amenities and livingconditions, the Association will take all steps neces-sary to resolve those unsolved issues.

    Article III Membership

    SECTION 1: All legal residents of SpanishRanch 1 Mobile Home Park are automatically mem-bers of the Association, without levy, upon establish-ment of residence. Legal residents shall be definedas those residents who are registered with the man-agement of the park and of legal voting age asdefined by the State of California.

    SECTION 2: Minors age 14 and under shallbe accompanied by a parent or guardian to alladult social events.

    Article IV Elected Officers

    SECTION 1: The elected officers of theAssociation shall be the President, Vice-President,Secretary and Treasurer. The office of President shallbe filled by one person but any two of the remainingthree offices may be held concurrently by a singleindividual.

    SECTION 2: The term of office shall be forone year based upon a fiscal year beginning May 1and ending April 30. The maximum term of service forany office shall be two consecutive terms.

    SECTION 3: The Duties of the electedOfficers shall be as follows:

    a. PRESIDENT: The President shall preside atthe Association meetings, Board of Directors meet-ings, and when the Association feels necessary, meetwith Management to represent the residents of thepark and their concerns to foster and maintain unityand cooperation within the park. The President willonly vote as a tiebreaker and will make sure that allAssociation by-laws are adhered to.

    b. VICE-PRESIDENT: The Vice-President shall assumethe duties of the president when the President isunavailable. He/She shall assist the President asrequested by the President. The Vice-President shall

    Changes to the By-Laws proposed by the By-LawsCommittee were discussed at the February 3, 2011 Residentsmeeting and will be voted on at the April 7, 2011 meeting. Allresidents are encouraged to attend.Principal changes include:

    One annual general membership meeting per year (but retain monthly Boardof Directors meetings which are open to all residents).

    Cut the board to between 7 and 10 people, 3-4 officers and 4-6 board

    Provide accountability and transparency in all matters by publishing allactions and financial transactions.

    be a de facto member of all committees and shallassist all committees as necessary.

    c. SECRETARY: The Secretary shall record andpublish the Minutes of the monthly meetings ofboth the Association and the monthly meetingsof the Board of Directors in the El Toro. Should nei-ther the President nor the Vice-President be avail-able, the Secretary shall assume the duties of thePresident of the Association. The Secretary will alsoreceive, file and send correspondence as directed

    by required (with the approval of the Association).Recommendations and reports from the Board ofDirectors monthly meeting will be included in thepublished minutes discussed at the Associationsmonthly meeting for review by the residents. All per-tinent new information will be included in Minutes ofthe monthly Association meeting.

    d. TREASURER: The Treasurer shall receive,deposit and dispense Association funds as directedby the Association members. The Treasurer will keepwritten records of all transactions and will report thestatus of the Associations funds at the AssociationsBoards monthly meetings. At any meeting whichthe If the treasurer cannot attend, an Associationmonthly meeting, a Treasurers Report will be sup-plied to the members and read by the President atthe Associations monthly meeting. The treasurer willprovide a monthly accounting for publication in theEl Toro detailing income and expenses. The treasurershall also prepare an annual budget and present itto the Association for approval May Board meet-ing for approval and then for publication in the ElToro by the deadline for the July issue by the JuneAssociation meeting. Residents seeking to questionor contest Board expenditures should attend and doso at the monthly Board meeting.

    SECTION 4: If any Officer vacates their

    position, the office will be filled by a person agreedupon by a majority of the Board Association atthe next Association monthly meeting following thevacating of the office. This position will be for the bal-ance of the fiscal year.

    SECTION 5: If any officer fails to attend anythree (3) consecutive meetings (Board or Association)without being formally excused by the presiding offi-cer or if any officer fails to fulfill the duties of theiroffice as defined in the by-laws, that officer shall beremoved from their office by a majority vote at theearliest Board or Association meeting possible.

    SECTION 6: A quorum of FIVE SIX Boardmembers of which TWO must be elected officers,shall be required to be present before any Boardbusiness can be transacted.

    SECTION 7: The Board shall present to thegeneral membership for prior approval any expendi-ture not in the annual budget in excess of 25% of thecurrent treasury.over $50.00.

    Article V Board of Directors

    SECTION 1: The members of theAssociation, at the April Association Meeting, willelect from nominated members of the Associationto serve on the Board. There will be a minimum of 6

    four and no more than 8six members of the Boardof Directors in addition to the elected officers of theAssociation.

    SECTION 2: Serving as a member of theBoard of Directors will be for a period of one year,from May 1 through April 30. To serve on the Boardthe following year, a Board member must be re-elected by the Association. The maximum number ofterms that can be served by a member of the Boardof Directors would be four (4) consecutive terms.

    SECTION 3: Any member of the Board ofDirectors who does not attend three (3) consecutivemeetings (Board or Association) without being for-mally excused by the presiding officer or who doesnot fulfill the duties of their positions may be removedfrom their office by a majority vote at the earliestBoard or Association meeting possible.

    SECTION 4: Duties of the Members of theBoard of Directors (other than Officers) shall be as fol-lows: (1) Chair or assist in appointing a Chairpersonfor the committees of the Association; (2) Investigateconcerns of residents as directed by the Board ofDirectors; (3) Facilitate communication between the

    members of the Board of Directors and the parksresidents.

    Article VI Committees

    SECTION 1: Committees for the Associationmay consist of the following: Social Activities,Welcoming, Youth, Disaster, Grievance, and any oth-ers deemed necessary by the Association members.The community positions of Spectrum, NeighborhoodWatch, HMOA Representative and the El Toro Editorare encouraged to work cooperatively with theAssociation and give regular reports at the meetings.Should a community position become vacant, theAssociation will assist in finding a replacement.

    SECTION 2: The Spanish Ranch 1Association is not associated with Los RancherosCharities (Bingo).

    Article VII Voting

    SECTION 1: Each legal resident shall haveOne (1) vote in Association matters.

    SECTION 2: (a) Voting in the election ofOfficers, Board of Directors, or for any motion at anAssociation meeting will be by count of hands. A sim-ple majority shall suffice. If any resident so requests,voting will be by written ballots.(b) Voting at the Board of Directors meeting will beby a show of hands of the current Board members.

    A simple majority shall suffice. The President can onlyvote in the case of a tie.

    SECTION 3: Voting on Amendments to theBy-Laws of the Association, which have been prop-erly submitted and noticed as provided in ArticleIX, shall be by written ballots, 2/3 majority of thoseAssociation members attending shall suffice.

    SECTION 4: At the February BoardAssociation meeting, the President shall call for aVolunteer Nominating Committee from the generalmembership of the Association.

    SECTION 5: At the April Associationmeeting, recommendations from the NominatingCommittee Chairperson shall be received alongwith nominations from the floor. Elections for theAssociation Officers as well as members of the Boardof Directors will take place. The new Officers andBoard of Directors members will assume office onMay 1.

    SECTION 6: Rules of Order. The usual par-liamentary rules as laid down in Roberts Rules of

    Order shall govern all deliberation when not in con-flict with the by-laws of the Association. A copy ofthe Association By-Laws will be provided to all newregistered park residents. A copy of Roberts Rules ofOrder will be available for review at all Associationmonthly meetings.

    Article VIII Meetings

    SECTION 1: The Board of Directors shallmeet monthly prior to the Association meeting.Recommendations from this meeting will be sharedwith all Association members in attendance at theAssociation meeting and included in the minutespublished in the El Toro. This meeting will be open to

    any resident of Spanish Ranch I and the location ofthis meeting will be at the clubhouse. and tThe datewill be posted at the clubhouse and on the website.in the El Toro as part of the monthly calendar ofactivities.

    SECTION 2: The general membershipmeeting of the Association shall be held on the firstThursday of each monthApril at 7:00 p.m. in the mainclubhouse for the purposes of electing officers anda report on the state of the Association. Any perma-nent change in the Association meeting scheduleshall be given in writing and with no less than 30 daynotice. Any association event may include a briefupdate to the membership.

    SECTION 3: Special meetings of theAssociation membership may be called by thePresident or by any THREE (3) members of theBoard of Directors, or any THREE (3) members of theAssociation. The right to make calls for such a meetingand the right to petition and distribute information fora special meeting is provided to mobile home parkresidents in the California Mobile Home ResidencyLaw. This law allows park residents to assemble whennecessary to discuss park living. All residents of thepark must be notified that such a special meetingwill take place. Notice of such a special meetingshall be given by the convening parties at least one

    week prior to the date of the special meeting. Callsfor any such meeting by any other than the Presidentshall be presented to the Secretary in writing, includ-ing the business to be transacted and the signatureof those requesting the call. A notice of the specialmeeting shall be placed in the paper tube of eachresidence prior to the special meeting.

    SECTION 4: To conduct a General or spe-cial Meeting and to vote for certain proposals, asimple show of hands by the majority of Associationmembers in attendance shall suffice. All proposals forchange will be discussed with Association members

    at the Association general meeting or any SpecialMeeting called under Section 3 of Article VIII of theBy-Laws for the Spanish Ranch 1 Association.

    Article IX Amendments

    SECTION 1: Any member/resident of theSpanish Ranch 1 Association may submit a written rec-ommendation for a change in the By-Laws. This infor-mation can be brought to the Association monthlyBoard meeting for discussion. These amendments will

    be voted on by written ballots at a specially calledthe next association meeting following a 30-day writ-ten notice of the proposed Amendments to the By-Laws. Publication of the Proposed Amendments tothe By-laws will constitute the 30-Day Notice.

    The meeting was called to order at 7:00pm on2/3/2011. Pledge of Allegiance was said.

    As the El Toro for February 2011 had not yet beenreceived, it was moved and approved that accep-tance of the January meeting minutes be tabled.

    Ruth Horton presented a treasurers report. Theassociation bank account has $593 in it after reim-

    bursing Dawn Plaskon for expenses relating to thesmall claims lawsuit to recover records or funds fromthe prior board.

    HMOA

    The HMOA Representative distributed a summaryof the 2010 legislation in California that could impactmobile home owners. Most of this legislation died,but it was approved by the state of California thatmobile home park owners no longer need to distrib-ute the MRL to residents each year. Instead, theymust provide a notice about substantive changesand inform residents that they may request a copy

    from the office. Note: the current MRL is availableat the Spanish Ranch Association website at http://spanishranch1.org/resources.

    Resident Concerns

    A resident was told by management to resolvea reported gas leak and spent $139 to an externalvendor to test his lines. No leak was found. PGE wascalled and found no leak. The resident requesteda refund of the $139 from the park office and wasrefused. This issue has been escalated to Rutherfordcorporate by the resident.

    A bill to allow residents to sublet their homes has

    died; however, the current MRL allows residents whomust leave their homes for a documented medicalissue to sublet that home for up to 1 year.

    Charity Drives:

    The charity drives committee has proposed that,in addition to the ongoing food bank, quarterlydrives for several different local groups includinganimal shelters, school supplies, coats and gloves,and toiletries be promoted. The drive for Februarythrough April is for the animal shelter. Gift cards frompet supply stores, dry or canned dog and cat food,and clean towels and blankets are needed by the

    Hayward animal shelter. To make a donation as partof our drive, please call 510-274-1771 and leave amessage or email [email protected] torequest a pickup of your donation.

    Between May and July, our charity drive will befor school supplies to benefit Haywards Tools forSchools.

    Between August and January, we will collectcoats, gloves and hats for the homeless, benefittingHaywardCAN through a One Warm Coat drive. Ourcoat drive last year resulted in a donation of 31

    coats benefiting the homeless in Hayward. Duringthis period, we will also collect toiletries and hygienicsupplies to benefit the homeless and batter wom-ens shelters. Supplies to donate include womenssanitary supplies (pads, tampons), diapers and pul-lups, razors, soap, shampoo.

    Flea Market

    A flea market is scheduled for Saturday, March12. Please contact Patty Little at 510-783-1543 toreserve your space. Flyers with detailed informationhave been distributed.

    Home Improvememt Services

    A Home Improvement Services Fair is scheduledfor Saturday, April 16 from 10:00am to 2:00pm. Thisevent will allow contractors, insurers, realtors andother home services companies an opportunity totalk to you about what they can provide to you, thehomeowner. This will be an invitational event for thecontractors, so if a service provider has impressed

    you, please call 510-274-1771 and leave a messagewith details so that our committee can reach out toinvite that provider to our event. We will be charg-ing vendors $20 for the opportunity to meet withyou. The association will donate a table to the Cityof Hayward program providing repair services forseniors and low-income residents. We hope to pro-mote this event at all of the mobile home parks inHayward.

    Election of Officers

    Elections for the association board and officers arecoming up in April. Kathi Calvert has volunteered to

    chair the nominating committee. If you would liketo suggest a nominee or help with the nominatingcommittee, please call 510-274-1771 and leave amessage for Kathi.

    We hope to promote more events in the commu-nity during the coming year. These events can helpto build a sense of community among residents aswell as generate income for the association.

    By-Laws RevisionProposed revisions to the bylaws of the association

    were reviewed and approved by residents in atten-dance at the February meeting. These revisions are

    intended to adjust the operating requirements ofour association to be more flexible. The proposedrevisions are included in this months El Toro and willbe voted on at the April 2011 meeting before elec-tions are conducted. Please review the changesand plan to attend the April meeting to vote for thebylaws changes and for a new board.

    Ave, on weekdays route 22 will go to the South HaywardBART station every 30 minutes from 6:22am until 11:22pmweekdays, and hourly on weekends and holidays from6:22am until 11:22pm. From the South Hayward BART sta-tion going down Tennyson will leave every 30 minutes from6:04am until 11:04pm weekdays, and hourly on weekendsand holidays from 6:17am until 11:17pm.
