    OVERVIEW

    In the year 2000 Coca-Cola Company set up a bottling plant in

    Plachimada, Palakkad district , Kerala

    The Company occupied an area of around 34 acres of land for

    the bottling plant

    The land was classified arable by Govt.

    About Palakkad district:

    80% of population depends upon agriculture for their

    livelihood

    Lies in rain shadow area of the Western Ghats and is a

    drought-prone area

    Depends heavily on canal irrigation and groundwater

    Hence, it is most likely that, the location of an industrial

    plant itself can be seen as the beginning of the problem

    PROBLEMS FACED

    People of Plachimada started to suffer adversities within six

    months

    Salinity and hardness of the water had risen

    Water from some open wells and shallow bore wells nearby

    allegedly had strong bitter taste

    The people complained of a variety of illnesses such as a

    burning sensation in the skin of the face; greasy, sticky hair;

    stomach disorders and skin deformities

    Also reported that a few wells in the nearby area had becomedry due to the over extraction of groundwater

    The insufficiency of water had also resulted in the decline of

    agricultural production

    Local economy and life in the area was ruined

    This was due to over extraction of groundwater both in quality

    and quantity by the Company

    It involved the question of right to life, the right to livelihood

    and the emerging jurisprudence of environmental law Due to this hue and cry the Perumatty Grama Panchayat

    passed a resolution on 7 April 2003 refusing to renew the

    license given to the Company

    The matter came before the High Court of Kerala on twooccasions and is now pending before the Supreme Court of

    India

    THE LEGAL BATTLE

    Single Bench Decision

    The Court rejected allegations of the Panchayat on the ground

    that: the Panchayat is not competent to go into the quality of

    the beverages produced.

    Strongly relied upon the public trust doctrine

    It was decided that:

    The Company should be restrained from excessive extraction

    of groundwater from its land

    Should be permitted to extract the groundwater, which must be

    equivalent to the water normally used for irrigating the cropsin 34 acres of plot

    Panchayat was given the power to monitor and inspect the

    groundwater consumption of the Company

    DIVISION BENCH DECISION

    Disapproved the reasoning of the single bench based on publictrust doctrine

    Discredited the powers of the Panchayat under the Kerala

    Panchayat Raj Act

    Recognized groundwater as a private water resource andaccepted the proposition of law that the landowner has

    proprietary right over it.

    Rejected the Joint Parliamentary Committee (JPC) report on

    the purity of the cola on the ground that the JPC report had not

    referred to any samples collected from the factory in

    Plachimada

    Not satisfied with the Division Bench Decision,the village folk of

    Plachimada complained to state authorities which forced them

    to pass a legislation in favour of the village folk.

    FINAL JUDGMENT

    The State Legislature of Kerala passed a legislation that theCompany should give compensation of Rs.216 cr.to theaffected individuals

    This decision was passed by a tribunal(3-member body)formed by the State Legislature

    The Committee came to the conclusion that the Company isresponsible for these damages and it is obligatory that they paythe compensation to the affected people for the agriculturallosses, health problems, loss of wages, loss of educationalopportunities, and the pollution caused to the water resources

    Coca-Colas bottling plant in Plachimada has been shutdown since March 2004

    The case is currently pending in the Supreme Court ofIndia

    After this problem, the Kerala State Legislature passed a

    Ground-Water Act 2002

    Ground Water Act:

    The Act focuses on the conservation, regulation and control of

    PETROLEUM OIL SPILL

    An oil spill is a release of a liquid petroleum hydrocarbon intothe environment due to human activity, and is a form of

    pollution.

    The term oil spill often refers to marine oil spills, where oil is

    released into the ocean or coastal waters.

    Oil spills include releases of crude oil from- Oil Tankers

    - Offshore platforms/pipelines

    - Drilling rigs and wells

    Cost of the RIG was US$560 million.

    Built by Hyundai Heavy Industries, Completed on 2001.

    Commissioned by R&B Falcon.

    Length -> 112 m , Height 97.4 m.

    In 2002,the RIG was upgraded with e-drill (A drillmonitoring system whereby Received real-time drilling datafrom the RIG and transmitted maintenance andTroubleshooting information).

    On 20-Apr-10, 23:00 EST the Deepwater Horizon oil rig of

    British Petroleum (BP), located in the Mississippi Canyon

    about 52 miles off the Louisiana coast, suffered a catastrophicexplosion, 11 crew members were killed of the total 126

    workers aboard the rig at the time of the blast.

    On29-Apr-10

    the U.S. government revealed that

    approximately 5,000 barrels of oil per day (210,000 gallons)

    was being leaked into the ocean.

    On 01-May-10, the oil spill cleanup efforts are underway.

    On 27-May-10, USGS had revised the estimate of the leak

    from 5,000 barrels a day to 12,000-19,000 barrels a day.

    On 20-June-10, the leak was almost 100,000 barrels a day

    As of30-June-10, Deepwater Horizon has spilled 73 million

    to 126 million gallons of oil into sea.

    On 15-July-10, BP said the leak had been stopped by capping

    the gushing oil wellhead.

    Impact on Marine Community

    Oil+Water=Mousse (sticky substance). Damage the airways of Birds and Animals.

    Chemicals that are inhaled may damage liver, immune

    systems, brain function lead to death.

    Fish larvae, turtle eggs also damage. Sea grass and coral also affect.

    Oil or Dispersants on the sea can cause skin irritation,

    chemical burns and infections.

    IMPACTON ENVIRONMENT

    Oil on the water surface can catch fire and pollute the air.

    Oil can react with oxygen in the air to form acids that are carried by wind

    and eventually fall back to the ground as acid rain.

    Oil washes up on beaches and marshes resulting in life threatening habitatsfor wildlife species.

    Public expectations about the President's image-

    based actions conflicted with the practicalities of

    understanding and responding to an unprecedented and

    intellectually incomprehensible disaster

    This spill has badly affected President Obama's decision to

    open up new regions to offshore drilling.

    Lawmakers called for an enquiry into safety regulations.

    collected.

    Birds like pelicans,herons and Sea

    turtle rehabilitation centers wereopened.

    Economic

    Between Apr-20 and Jul-15,2010, almost 5-million barrels of oilwere released into the gulf.

    From that, 800000-barrels captured.

    Fisheries and Tourism were affected directly.

    As per NOAA, 20% of U.S Oyster production, 75% of U.SShrimp production depends the Gulf coast which was affected

    State and Federal Agencies of US have accused BP for

    violating Clean Water Act and Natural Resource Damage Act

    BP is accused by Justice Dept. of United States for criminal

    activity and civil liability and has to pay respective fines
