• Driven by concerns about the sustainability of environment and the security of energy supply, interest in renewable energy is growing all over the world. Indonesia as a country that is highly dependent on fossil fuels to meet its energy needs, has forced to seek for other energy resources to maintain national security of energy supply.

• Geothermal has became a priority energy to ensure national energy security, reducing Indonesia's dependence on fossil fuel and also provide added value in energy diversification.

• Based on latest survey, Indonesia has 28.8 GWe geothermal potential which distributed in 299 locations along the country, yet its utilization has not been optimized. Up to now total installed capacity of geothermal power plant is only reached 1,341 MW.

• The Government of Indonesia (GoI) is concerned in energy development based on green energy, mainly geothermal. Presidential Decree No. 5 / 2006 on National Energy Policy (KEN) has targeted in 2025 electricity from geothermal energy will reach 9500 MW or contribute 5% of national energy consumption

GEOTHERMAL POLICIES1. Improvement and harmonization of regulations in Geothermal Business.

1). Revising the law No. 27/2003 on Geothermal. The main purpose of this revision are:

- Geothermal activities can be carried out in conservation forest area.

- To accomadate “Participating Interest “ issue which demanded by local goverment.

- To amend GWA’s tender mechanism.

2). Revising GR No. 59/2007 on Geothermal Business Activities, mainly to revise GWA’s tender mechanism. Based on proposed regulation, the winner of GWA’s tender is determined by work programs and exploration commitments.

3). Preparing Technical Guidelines as the implementation of the MR no 22/2012.

2. The government provides fiscal incentives for geothermal development (based on Government Regulation No. 62/2008 jo No. 1/2007; MR of MoF No. 177/PMK.011/2007; and MR of MoF No. 22/PMK.011/2011)

• 30% of corporate income tax;• 10% of added-value tax paid by the GoI;• Custom duties exemption for geothermal developer;• 25% per year depreciation for 8 years with double declining balance method; and• Investment tax credit 5% per year for 6 years

3. Related to Forestry Issues, currently MEMR and Ministry of Forest have signed the MoU regarding the acceleration of geothermal utilization permit within production forest, protected forest, and conservation forest

4. Feed-in Tariff MechanismGovernment sets the price of electricity from geothermal power plant which is final and can not be negotiated by PT. PLN. This mechanism is expected to reduce the main obstacle in geothermal development related to price uncertainty that usually requires a long time for negotiation.

5. Financial support and Government guaranteeGovernment guarantee on the feasibility of PT. PLN; “Geothermal Fund" for geothermal exploration; Green Banking Program, etc

• In order to encourage the utilization of geothermal in national electricity supply, GoI have

made some efforts to increase investment by creating competitive and attractive business

climate, including simplifying GWA tender process and improve geothermal energy price

structure through Feed In Tariff (FIT) Mechanism.

• In FIT mechanism, the Government set the price of electricity from geothermal power plant

which is final and can’t be negotiated by PT. PLN. The FIT mechanism is determined with

consideration of:

1. Energy resources avaibility;

2. Environment capacity;

3. Economics.

• Feed-in Tariff is applied for new GWA and for extensions or capacity additions.

• This mechanism is expected to reduce the main obstacle in geothermal development related

to price uncertainty that usually requires a long time for negotiation.

• The tariff is applied based on location and available transmission of a certain area.

The Feed-in Tariffs mechanism will be applied to :

a. geothermal license holders (IUP holder) after the issuance of MinisterRegulation No. 22/2012;

b. mining right holders, license holder or concession holder that existed beforethe enactment of Law No. 27 Year 2003 on Geothermal who already havePower Purchase Agreement (PPA), which will increase power plant capacityon the existing agreement (PPA);

c. mining right holders, license holder or concession holder that existed beforethe enactment of Law No. 27 Year 2003 on Geothermal who will extendtheir expired PPA;

d. mining right holders, license holder or concession holder that existed before the enactment of Law No. 27 Year 2003 on Geothermal who already have PPA, for both who have produced or not yet produced electricity or steam, as long as all parties involved agree upon the amendment on sales price of electricity or steam; or

e. IUP holder who will undertake PPA, as long as agreed by the partiesinvolved and allowed by PPA to be agreed by the parties.
