ARIZONA Goodyear March 28, 2011 Ms. Debbie Cotton Director City of Phoenix Public Transit Department 302 North 1st Avenue, Suite 900 Phoenix, AZ 85003 Dear Ms. Cotton: The City of Goodyear (“City”) is requesting that the Phoenix Transit Department submit a request to FTA seeking approval for an incidental use at the City of Goodyear Park and Ride facility. The City has an opportunity to enter into an agreement with Clear Channel, a large national outdoor advertising company, to install and operate digital marquees on city-owned properties along Interstate 10 in Goodyear. The digital marquee would be used for commercial advertisements, public and community events, and emergency messaging. One of the sites proposed by Clear Channel for a digital marquee is the Goodyear Park and Ride property, just west of Dysart Road and north of Interstate 10. The area required for construction of the digital marquee would encompass approximately 2,400 square feet (40 feet by 60 feet). The site proposed is inconsequential to the existing and future transit facilities on the Park and Ride property. Construction and continuing operation of the digital marquee would not disrupt or impede in any way the existing Park and Ride facilities or any transit activities therein. The property proposed is not a part of the area planned for phase 2 (expansion) improvements at the Park and Ride facility. The City understands that it must adhere to FTA po1ic~ (FTA Circular 5010.1 D) regarding incidental uses on project property to remain compliant with grant terms. The City addresses each of these considerations as follows: Needed Property: ‘1 1~e Goodyear P~k and Ride will remain a transit facility indefinitely. The incidental use outlined above will not impact the continuing function of transit for the region. (for maintenance). It will be located on land that is outside the future second phase ofthe Goodyear Park and Ride.

• Continuing Control: The City will maintain complete and continuing control of thePark and Ride facility throughout the duration of the digital marquee installation andoperation.

• Non-Profit Use: The City will consider appropriate public service messages andadvertising opportunities that will serve to benefit non-profit agencies through itscontractual agreement with Clear Channel.

• Income: FTA regulations require that income from incidental uses must be applied totransit operations. The City recently lost dedicated transit funding allocated through theState of Arizona so the City expects to benefit from having a new funding source fortransit operations from the digital marquee revenue. All revenue generated by thedigital marquee will be invested in local transit. It will not be used as part of the localshare for the City’s FTA grants for the Park and Ride.

The City believes this request for incidental use is a win-win for both FTA and the City.The addition of the digital marquee will raise additional revenues for the local transitsystem at a time when the City’s operating budget is stretched to manage critical operatingneeds and it will alDo serve as a landmark to help guide motorists to the Goodyear Park andRide, thus enhancing ridership.
