NEWSLETTER INLA UPDATE – NO. 3 (6) – WINTER, 2016 INLA New Delhi Congress As you know, the 2016 Nuclear Inter Jura Congress was held in New Delhi, India, between 7-11 November at The Imperial hotel. This was the first time the bi-annual series was held in South Asia, and the congress was hosted by the Nuclear Law Association, India (NLA). The overarching theme of the 22nd Nuclear Inter Jura Congress was “The Future of Nuclear Law: Addressing Societal, Environmental and Business Expectations” to exchange views on the convergence of these three key areas – society, environment, and business – the interlinkages of which will redefine the future of nuclearenergy. Hence, “new topics” such as climate change policies and their impact on the nuclear energy sector were duly incorporated in the program; and will only gain in relevance as we enter this new year, 2017. The tone of the conference was set during the Inaugural Session, where insightful reflections were shared by the Chairman, Atomic Energy Regulatory Board (AERB); the Additional Solicitor General of India; the Homi Bhabha Chair, Department Atomic Energy; the Legal Advisor and Director, IAEA Office of Legal Affairs; and the Chairman, US Nuclear Regulatory Commission. The 5-day conference counted 17 sessions, with about 70 Speakers from over 30 countries, including law professors, PhD students, researchers, corporate lawyers, public interest litigators, representatives from operators, regulatory boards, research institutes, diplomats, government officials, insurance companies, as well as the IAEA, Nuclear Energy Agency (OECD), the ITER Organisation and the European Commission, leading to stimulating and thought-provoking discussions throughout the event. INLA New Delhi Congress

As you know, the 2016 Nuclear Inter Jura Congress was held in New Delhi, India, between 7-11 November at The Imperial hotel. This was the first time the bi-annual series was held in South Asia, and the congress was hosted by the Nuclear Law Association, India (NLA). The overarching theme of the 22nd Nuclear Inter Jura Congress was “The Future of Nuclear Law: Addressing Societal, Environmental and Business Expectations” to exchange views on the convergence of these three key areas – society, environment, and business – the interlinkages of which will redefine the future of nuclearenergy. Hence, “new topics” such as climate change policies and their impact on the nuclear energy sector were duly incorporated in the program; and will only gain in relevance as we enter this new year, 2017.

The 5-day conference counted 17 sessions, with about 70 Speakers from over 30 countries, including law professors, PhD students, researchers, corporate lawyers, public interest litigators, representatives from operators, regulatory boards, research institutes, diplomats, government officials, insurance companies, as well as the IAEA, Nuclear Energy Agency (OECD), the ITER Organisation and the European Commission, leading to stimulating and thought-provoking discussions throughout the event.

INLA New Delhi Congress

The NLA, India, was most excited about issuing the following 5 Awards:

1. NLA President’s SN Bose Prize:

Awardee: Ms. Peri Lynne Johnson, Legal Adviser and Director, IAEA Office of Legal Affairs.

2. NLA, India Prize for Best Paper:

Awardee: Kimberly S. Nick, Lawyer, Office of Legal Counsel, NEA: for her paper on “Employee Protection and Regulations: Strengthening nuclear safety culture through the legal system”.

3. NLA, India’s Global South Award:

Awardees: Aakanksha Joshi, Partner, Economics Law Practice (ELP), and Pooja Chatterjee, Associate Manager, ELP, for their paper on: “Wading Through the Pool: Will the India Nuclear Insurance Pool be an Effective Risk Transfer and Management Mechanism?”.

4. Mukesh Arora Memorial NLA Prize for Best Presenter:

Awardee: Karoly Tamas Olajos, Legal Officer, ITER, for his presentation on: International Regulation of Nuclear Fusion.

5. NLA Young Scholar Award (with special thanks to Oxford University Press):

Awardee: Anne Wilson, Director, Comline Wilson Attorneys, South Africa for her paper on “The future of Nuclear Energy in Africa with an Overview on South Africa and its Nuclear Energy Expansion Programme: the Expectations of Society, the Environment and Business”.

Season’s Greetings

When I think of the unique INLA family that we are, with its increasing geographical diversity and global presence, the beautiful poem “Human Family” by Maya Angelou comes to mind, which I would like to share with all of you, dear friends:

I note the obvious differences in the human family. Some of us are serious, some thrive on comedy. Some declare their lives are lived as true profundity, and others claim they really live the real reality. The variety of our skin tones can confuse, bemuse, delight, brown and pink and beige and purple, tan and blue and white. I've sailed upon the seven seas and stopped in every land, I've seen the wonders of the world not yet one common man. I know ten thousand women called Jane and Mary Jane, but I've not seen any two who really were the same.

Mirror twins are different although their features jibe, and lovers think quite different thoughts while lying side by side. We love and lose in China, we weep on England's moors, and laugh and moan in Guinea, and thrive on Spanish shores. We seek success in Finland, are born and die in Maine. In minor ways we differ, in major we're the same. I note the obvious differences between each sort and type, but we are more alike, my friends, than we are unalike. Congratulations, Jacques Lavoie!

Importantly, the INLA General Assembly held during the New Delhi Congress, elected a new INLA President, Mr. Jacques Lavoie, General Counsel, Emirates Nuclear Energy Corporation (ENEC), UAE; and the next 2018 INLA Congress will be held in Abu Dhabi. Here’s first and foremost congratulating Jacques on his election as the next INLA President! I’m truly happy to hand over the baton as INLA President to such a seasoned nuclear lawyer and a truly global citizen! I wish Jacques and his colleagues all the very best with the preparations of the next INLA Congress and am convinced that the 2018 INLA Congress will be a spectacular and top-class event! For those of you who haven’t met Jacques in person yet, let me share that over the last 30 years, Jacques Lavoie spent his career with the Canadian Federal Government in the provision of legal services, management of government programs, administration of justice, regulatory affairs and national security. He was the Head of the Canadian delegation at the Nuclear Energy Agency (NEA) Nuclear Law Committee and he worked closely with the International Atomic Energy Agency (IAEA) and the US Nuclear Regulatory Commission (US NRC). He is a guest lecturer at the International School Nuclear Law, Montpellier, France. He was Senior General Counsel for the Canadian Nuclear Safety Commission (CNSC) before his appointment as General Counsel and Secretary of the Board of the Emirate Nuclear Energy Corporation (ENEC) in the united Arab Emirates. ENEC is currently building four nuclear power reactors in the Western region of Abu Dhabi in collaboration with KEPCO from South Korea. Recently, in October 2016, ENEC and KEPCO entered into a Joint Venture for this world leading nuclear peaceful project. Mr. Lavoie was directly involved in the creation of two subsidiaries, Nawah Energy Company and Barakah One Company which will be involved in the operation and financing of the nuclear power plant.The Barakah Nuclear Power Plant is scheduled for completion in 2020, with construction having started in 2012.

With this, may I once again wholeheartedly congratulate Jacques with his election as the next INLA President!

Message from Jacques Lavoie

First and foremost, I would like to kindly thank everyone who is a member of INLA and the sponsors of this most successful conference in New Delhi, India. The hospitality provided by our hosts is only a small reflection of the kindness that was extended by the people of India to all who attended the 22nd bi-annual INLA Congress which was a proud moment for the Nuclear Law Association of India. After the Congress in Argentina, our dear friend Rafael Mariano Manóvil shared these words in his message: “Looking forward, I wish my successor, Els Reynaers Kini, every success for her term and I have no doubt that all members will give her the support she will need as President of our Association. This will be the first time an INLA Congress is organized in India.” And the Congress happened and was an unequivocal success. We made new friends, we shared and laughed and were even regaled with priceless cartoons from Carlton Stoiber. As our dear President said in her message in 2014:

Message from Jacques Lavoie

“Importantly, it will be NLAI’s endeavour to live up to the old Sanskrit proverb “Atithi Devo Bhava” (an ideal person should try to “treat the Guest as God) which is culturally strongly imbibed by all people in India. It is, indeed, our aim to ensure that your experience in India will be memorable!” She achieved her goal and more. I must admit that I am truly humbled by the privilege of following in the path of great people and honoured to have been chosen to be the next President of the INLA. Along with my colleagues from the United Arab Emirates (UAE), I am delighted to invite and welcome you in this wonderful country where the hospitality of its people is legendary and a tradition. As I have been fortunate to learn, in the UAE, many of the traditions reflect the people's historical reputation for generosity, courtesy and love of community. Emirati households, for example, ensure the majlis (reception area) is kept tidy and prepared at all times to receive guests at any hour. It is also perfumed with incense of Oud to welcome guests, who are invited to sit in places of honour within the room. These kind gestures speak volumes about the hospitality of the hosts, and the genuine warmth towards visitors. Insha'Allah, God Willing, we will have the pleasure of your company at the next congress in 2018. Until then, I look forward to working with everyone to continue to promote the mission of INLA: “…the promotion and pursuit, on an international level, of studies and knowledge of legal issues related to the peaceful utilisation of nuclear energy, with a focus on protecting persons, property and the environment; the exchange of information between members of the Association; and scientific co-operation with other organisations having similar objectives”.

News from the INLA Working Groups

o Working Group 1: Questionnaire on “political closure risk”– seeking inputs from all INLA members!

§ At the congress in Delhi a first draft of a paper on “political closure risk” developed by WG 1 members was presented. Currently there are 5 participating countries that have contributed their country analysis but WG1 is looking for others to participate. If you are interested please contact Ian Salter ([email protected]) or Łukasz Mlynarkiewicz ([email protected]).

o Working Group 2:

§ The WG2- Nuclear Liability and Insurance is going to convene one of its conference call-meeting at 10:00 am (Washington time) / 16:00 pm (Paris time) on 13 April 2017 in order to discuss the following topic areas:

v the status of nuclear liability regimes in your respective countries and

v the topics you would consider interesting for the WG2 to address in order to start preparations for the 2018 INLA Congress.

§ The meeting is open to WG2 members. If you would like to join and receive more information on the above conference call, please contact the co-chairs Mr Bill Horin ([email protected]) and Ms Ximena Vásquez-Maignan ([email protected]).

o Working Group 3:

§ Mr. Paul Bowden wished to be relieved from his position as Chair of WG 3 – New Build ; Mr. Ahab Abdel-Aziz and Mr. Jacques Lavoie have accepted to serve as new Co-Chairs of the Group and their designation was approved by the Board.

News from the INLA Working Groups  

o Update on AIDN-INLA Working Group 6 on Nuclear Security:

§ One of the most important events in the nuclear security field in 2016 is the convening of the International Conference on Nuclear Security: Commitments and Actions at the International Atomic Energy Agency in Vienna, Austria on December 5-9.

§ Among the broad range of presentations and meeting at the Conference, including by Heads of State and government officials responsible for nuclear security, AIDN-INLA Working Group 6 Chair Carlton Stoiber is participating in two sessions.

§ In the first session on “Perspectives on implementing international legal instruments” Stoiber is presenting a paper on “The Review Conference Process as a Means for Strengthening Nuclear Security”. He will also participate in a related panel discussion of several experts on “The role of international organizations and bilateral programmes in supporting national implementation of international obligations.”.

o A. Nuclear Energy Agency - International Nuclear Law Essentials (INLE): 20 – 24 February 2017:

§ The NEA is pleased to announce that the next session of the International Nuclear Law Essentials (INLE) will take place on 20 – 24 February 2017 at the OECD Conference Centre in Paris, France. The INLE programme has been designed to provide working professionals with a comprehensive and informed understanding of the various interrelated legal issues relating to the safe, efficient, secure, and environmentally friendly use of nuclear energy.

Academic Corner – training programs & publications  

§ The INLE programme addresses developments in nuclear law and provides a high-quality, intensive overview of a complex body of laws and legal regimes. The 2017 INLE programme will be conducted under the leadership of Paul Bowden, Partner at Freshfields Bruckhaus and Deringer LLP, London, United Kingdom. Renowned specialists in nuclear law from international organisations, governments and private industry will present the course content and engage the participants in examining current issues in nuclear energy law.

§ The proceedings of the 14th Regional Conference of the German Branch of INLA, held in September 2015, have now been published. The publication News From the Front Lines of Nuclear Law is edited by Christian Raetzke, Ulrike Feldman and Akos Frank; and published by the legal editing house Nomos. Price for INLA – Membership fees – Introducing PayPal

All good things come with a price! We try to keep the membership fee as nominal as possible and would encourage all INLA members to kindly settle any outstanding membership fees at the earliest.

For 2017, the INLA Board of Management has decided to fix the membership fee's amount at 90,00 EUR for ordinary members and 20,00 EUR for students.

The PayPal system has now been launched to facilitate all membership payments; or for onward disbursement by the domestic chapters of the membership fees they collected.

o D. Publication – Nuclear Non-Proliferation in International Law – Volume III – Legal Aspects of the Use of Nuclear Energy for Peaceful Purposes:

§ The third volume of the book series on Nuclear Non-Proliferation in International Law, edited by Jonathan L. Black-Branch and Dieter Fleck, has recently been published, and counts several INLA members as authors, including Sonia Drobysz who’s written a chapter on “A Framework for the Secure Development of Nuclear Energy: Obligations, Challenges and Possible Solutions”; and Dr. Norbert Pelzer on “Nuclear Accidents: Models for Reparation”. You will find the details of this publication in Annex 2 of this Update.
