Proposal:

The Owner is requesting permission to construct a one-storey multi-unit building with the following variances:

Official Plan:

The subject lands are designated “Employment Area General” by in-effect OPA #450 (Employment Area Plan). The subject lands are also designated “General Employment” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

The Applicant is requesting permission to construct a one-storey multi-unit building with an increase in the permitted floor area for accessory retail sales in Unit #1 to 49%. The proposed use of Unit #1 is for the warehousing and sales of sporting goods and equipment. The Development Planning Department has no objections to the increase in accessory retail area, as the proposed retail portion of the unit is directly associated with the employment/warehousing use. In addition, the majority of the unit (i.e. 51%) is being maintained for employment purposes. The Building Standards Department has indicated that the current proposal does not require additional parking. However, as a result of the increase in floor area for retail purposes, the aggregate amount of parking for the entirety of the subject lands has increased to 193 spaces, whereas 185 spaces are proposed. The Development Planning Department has no objections to this variance, as the reduction in parking represents a deficiency of 4%. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A103/13.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
