In the event of discrepancies between bid prices (in words) and (in figures) of individual items totals, the mathematically correct amount using sum bid prices (in words) shall govern in determining the TOTAL LUMP SUM BID PRICE. All work for this project shall be performed under the above Schedule of Value Items. These Bid Items shall become the basis of payment of work performed. The value of each Schedule of Value Item when added together shall equal the Total Base Bid amount. Should the Bidder have any questions regarding the specific elements of work to be included within each Item, said question shall be directed in writing sufficiently in advance of the bid date in order to allow for a proper response. The cost for other items of work included in the Contract Documents and/or on the Contract Documents and not listed in the Bid Items shall be included in the cost of the various Items bid. All items shall include all costs necessary to perform the work and the costs for all materials, equipment, tools, labor and work incidental thereto, including overhead and profit.
Variation in Estimated Quantity: If the quantity of a unit‐priced item in this Contract is an estimated quantity and the actual quantity of the unit‐priced item varies more than twenty (20) percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 120 percent or below 80 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the City within 10 days from the beginning of the delay, or within such further period as may be granted by the City. Upon the receipt of a written request for an extension, the City shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the City, is justified. Any adjustment to the Contract price or time due to a variation in estimated quantities in response to a request from the Contractor shall be the sole and exclusive remedy available to the Contractor due to such variation and payment to the Contractor for such variation shall constitute an accord and satisfaction regarding any claims related to the variation.
ACKNOWLEDGEMENT In submitting this Bid Form, the undersigned proposer acknowledges that the price(s) include all labor, materials, transportation, hauling, overhead, fees and insurances, bonds or letters of credit, profit, security, permits and licenses, and all other costs to cover the completed work called for in the ITB. Except as otherwise expressly stated in the ITB, no additional payment of any kind will be made for work accomplished under the price(s) as proposed.

1. Tack Coat: Minimum surface temperature of 50 deg F.
2. Asphalt Base Course: Minimum surface temperature of 40 deg F and rising at time of placement.

PART 2 - PRODUCTS
2.1 Products shall be in conformance with Form 816.
2.2 MIXES
A. Mixes shall be in conformance with the plans and Form 816.
PART 3 - EXECUTION
3.1 EXAMINATION
A. Verify that subgrade is dry and in suitable condition to begin paving.
B. Proof-roll subgrade below pavements with heavy pneumatic-tired equipment to identify soft pockets and areas of excess yielding. Do not proof-roll wet or saturated subgrades.
1. Completely proof-roll subgrade in one direction. Limit vehicle speed to 3 mph.
2. Proof roll with a loaded 10-wheel, tandem-axle dump truck weighing not less than 15 tons.
3. Excavate soft spots, unsatisfactory soils, and areas of excessive pumping or rutting, as determined by Engineer, and replace with compacted backfill or fill as directed.
C. Proceed with paving only after unsatisfactory conditions have been corrected.
D. Verify that utility adjustments requiring installation below the asphalt surface have been made prior to paving.
3.2 RECLAMATION
A. Cold reclaim asphalt pavement in conformance with the plans and Form 816 to a depth of 12 inches below the finished pavement. The Contractor shall grade and compact the reclaimed material as necessary to obtain the required base for geotextile and 12-inches of imported processed gravel and subbase, as specified in these Specifications. Any surplus or unutilized reclaimed or partially reclaimed material shall be removed and disposed of off-site by the Contractor.
3.3 SUBBASE PREPARATION
A. The Contractor will excavate and dispose off-site the current existing pavement and base materials to a depth of 16 inches below the proposed finished pavement grade.
B. The Contractor shall establish a firm subgrade as discussed in Division 2 Section “Earthwork.” Prior to placing separation geotextile.

3.4 BITUMINOUS CONCRETE CURBING
A. Construct bituminous concrete curbs over compacted pavement surfaces as shown on Drawings. Apply a light tack coat unless pavement surface is stilly tacky and free from dust. Spread mix at a minimum temperature of 250 deg F.
B. Place bituminous concrete curb cross section indicated by the Drawings by machine or by hand in wood or metal forms. Tamp hand placed materials and screen to smooth finish. Remove forms after bituminous concrete has cooled.
C. Protect curbing for a minimum of 24 hours and until mixture has cooled so as not to become marked.
D. Installation shall be in conformance with Form 816 Section 8.15.
3.5 FIELD QUALITY CONTROL
A. Testing Agency: Contractor shall employ a qualified testing agency to perform tests and inspections.
B. Thickness: In-place compacted thickness of hot-mix asphalt courses will be determined according to ASTM D 3549.
C. Surface Smoothness: Finished surface of each hot-mix asphalt course will be tested for compliance with smoothness tolerances.
D. In-Place Density: In conformance with Form 816.
3.6 DISPOSAL
A. Remove excavated materials from Project site and legally dispose of them off-site in an EPA-approved landfill.
