A commission of professionals, set up earlier this year by minister of cul- ture and communication Catherine Trautmann to advise and make pro- posals to the ministry in the music field, is poised to recommend an exten- sion of the existing quota regulations. The quota law requires stations to play 40 percent French -language music; 50 percent of this must be from new acts. Trautmann's commission believes sta- tions are not respecting the "new tal- ent" part of the quotas- to meet the regulations, stations have usually increased rotations on a small number of French -language titles. As a result, the commission suggests, the quotas have not succeeded in expanding the variety of artists played on French radio. The commission-which met French radio regulator the CSA at the end of Catherine Trautmann April to discuss the sit- uation-is reportedly proposing to effectively put a ceiling on the number of rotations deployed by individual stations by not count- ing plays of a record beyond a certain num- ber of rotations as part of the station's francophone content. PARIS - The prospect of a strengthen-ing of domestic French -language radioquota laws-including a limit on rota-tions-has been greeted with dismay byFrance's radio community.
A commission of professionals, setup earlier this year by minister of cul-ture and communication CatherineTrautmann to advise and make pro-posals to the ministry in the musicfield, is poised to recommend an exten-sion of the existing quota regulations.

LONDON - For the first time, a seniorU.K record company executive has pub-licly acknowledged the impact of trans-shipments on the U.K music industry.
In his keynote speech to the RadioAcademy Music Radio conference inLondon on April 23, PolyGram U.K.chairman/CEO John Kennedywarned that the flow of trans -ship-ments from other EU countries intothe U.K. "by the bucket -load" couldresult in job losses for the U.K. indus-try and limit labels' capacity to sup-port local repertoire.
Trans -shipments of records withinEU borders became legal in 1993. Foryears, the system had worked to thebenefit of the U.K, which traditionallytook advantage of the usually low
value of the poundcompared to otherEuropean currencies toexport U.K.-manufac-tured recorded musicto the rest of Europe.Now, with a strongpound, trans -ship-ments to the U.K aregrowing, to the dismayof the local industry.
"Believe me," said Kennedy, "it isimpossible to sustain investment inartists, recording costs, video costs,tour support, TV campaigns, printcampaigns and indeed radio cam-paigns if the effect of all this is thateven when you are successful, therecord sold is not one of yours, but animported copy at a much lower pricewhich is not passed on to the consumer,
so that the low dealer price isn'teven used to drive extra sales."
Peter Scaping, general manag-er of labels' organisation theBritish Phonographic Industry,suggests that the volume ofimport sales in the U.K "repre-sent about 5 percent of the albummarket." Based on last year's fig-ures, parallel imports wouldaccount for £75 million ($125m) of

Frisian rock band De Kast(CNR) picked up the bestDutch artist/group award, oneof two new prizes voted for by
the general public which were inaugu-rated at the Edisons this year. Theother category voted for by the publicwas single of the year, which went toWereld Zonder Ja (Polydor), MarcoBorsato's duet with Trijntje Oosterhuis.
Other domestic winners were VanDik Hout (Columbia, best group),The Sun Club (Fiesta/Epic, bestdance/R&B) and Boudewijn De Groot(Mercury, lifetime achievement). Theinternational lifetime achievementaward was presented to SirCliff Richard.
Nostalgie staff want buy-outby Remi Bouton
PARIS - Several Nostalgie staff haveasked the French government if theycan buy a stake in the AC/gold net-work, recently sold to NRJ as part ofthe privatisation of the RMC Group.
"We want between 25 percent and49 percent [of Nostalgie]," says a staffsource at the network. "We don't haveanything against NRJ, but we consid-er that it is normal for employees to beable to participate in a privatisation.
"Earlier this year, the governmenttold us that Nostalgie would not besold alone, but with RMC and RadioMontmartre. Today we can see that isnot really the case, so we are repeatingour request [to the government] andwe hope that [French radio regulator]
the CSA will hear us."Both the CSA and the Principality
of Monaco have yet to formallyapprove the RMC deal (M&M, March28) but the chances of either rejectingit are thought to be slim. "On a polit-ical level, I think the governmentdecision is firm and the CSA will notchange anything," predicts an NRJsource. "Moreover, to undertake amanagement buy-out you need tohave a profitable company; that isnot the case with Nostalgie, whoseturnover is down over the past threeyears-the employees won't findfinancial backers willing to take therisk. And how can the same execu-tives who have managed the radiostation for the past couple of yearspossibly give it a new start?"

Q: What's the rationale behindyour expansion plans?A: When you look at the U.S. charts,you'll find spaces each week that aretaken up by non-U.S. artists. Up tonow, we've had little opportunity to fillthese spaces; Famous has had no"name" in Europe our catalogue hasalways been administered by otherpublishers in Europe, first by WarnerChappell then, since October 1995, byBMG. Our aim is to increase Famous'visibility in the European marketplaceby adding our own infrastructure andacquiring local repertoire.
Q: Why are you focusing onEuropean territories?A: Famous Music already has a strongpresence in North America. The Asianmarkets are emerging slowly when itcomes to copyright protection andenforcement. Therefore, Europe is ourfirst choice for expansion.
Q: What are your plans for Famous'European operations?A: Our aim is to establish a network ofcreative cells in key territories. Thelaunch of our London office, headed bymanaging director Susan Collins, is thefirst step. We hope to establish officesin Germany, France, Italy and Hollandby the end of the year. Staffing thoselocal offices will begin in early 1999.
Q: How will this work in practice?A: We believe we will have to culti-vate artists in their respective domes-tic markets first. Once these artistshave reached a certain level of successat home, we can look at ways of bring-ing them into the U.S. market. Butlocal groundwork is most certainlythe base for further exploitation. Wehave initiated contact with topEuropean producers, like HughPadgham in the U.K., to aid us indeveloping new talent.
Q: Will BMG continue to adminis-ter Famous' catalogue in Europe?A: We feel BMG is doing a tremendousjob in administering and marketingour catalogue, and we will continuewith our relationship. Adding our owninfrastructure in Europe is entirely dri-ven by the desire to acquire repertoire.We plan to hire creative people to focuson local A&R. Tasks like royaltiesadministration will continue to lie inthe hands of BMG.

Italy emerges from five-year slumpby Mark Dezzani
MILAN - For the first time in fiveyears, Italy's music market has regis-tered significant growth.
The positive news comes via statis-tics for the whole of 1997 published byItaly's IFPI-recognised music indus-try federation FIMI. For the firsttime, the market figures for 1997include music sales in non-traditionalretail outlets such as news kiosks,plus multi -media music sales.
Discounting these new areas so thatdirect comparison can be made with
1996, total unit shipments (includingsingles) increased by 12 percent to 48.7million, with values rising 6.6 percentto L669.8 billion ($372.1 million). Aftertaking Italy's 1997 inflation rate of 1.82percent into account, "real" values roseby 4.78 percent.
"The fact that units increased morethan the value of shipments indicatesmore competitive pricing," says FIMIpresident Gerolamo CacciaDominioni. "The results for 1997 arepositive, but we have yet to see if thiscan be sustained. Sales for the firstquarter of 1998 are significantly down
compared to last year, and with themarket's performance relying moreand more on strong new releases, it's alot more volatile than in the past."
Singles registered a significantgrowth on the back of a commitment toestablish the CD single format in Italy,with shipments up 52 percent in unitsand 64 percent in value compared to1996. Domestic music sales remaineddominant over international reper-toire, accounting for 40 percent ofunits and 44.5 percent of value, withinternational sales taking 34 percent(units) and 40 percent (value).
`Schlager boycott' by Radio 2?by Robbert Tilli

Purveyors of theDutch equivalent ofGerman schlager musicare claiming that thecountry's public broad-casters -s pecifi c a 11 ynational MOR/talk sta-tion Radio 2-are turn-ing their backs on thegenre, despite its recentsurge in popularity thanks to thelikes of Jantje Smit, Frans Bauer andMarianne Weber.

Jante Smit Schreijenberg, man-aging director ofArnhem -based TipTop Records, is plan-ning to protestagainst both Radio 2and the Dutch gov-ernment at an open-air "national reper-toire manifestation"at the Malieveld fair-ground in The Haguethis August. It isplanned for a petitionsigned by an estimat-
ed 300,000 fans to be presented to thegovernment at the event.
"It's a crying shame that Radio 2does not play what the public wants,"says Schreijenberg. "Don't five millionalbums sold by Bauer so far count for
anything? Bauer is on top of thealbum chart for the second week. He'sat No.1, but not on Radio 2!"
However, following a relativelyrecent decision to drop schlager musicfrom its playlists, Radio 2 has seen itsmarket share increase from 5 to 10percent. Explains Radio 2 spokesper-son Luppo Huizinga: "Followingrestructuring [in 1992 and 1997], pro-gramming on Radio 2 has been for-matted more clearly. The station haschosen a music policy that cuts outthe extremes, such as the populist[Dutch schlager] genre and country,and this has paid off with increasedmarket share. We're not boycottingFrans Bauer. He can still be heard onshows like 'De Gouden Uren' [TheGolden Hours']. We won't be changingour format again."
Court decision meanssafe landing for Sputnikby Ed Meza
BERLIN - A state court in Saxony hasrejected demands by commercial broad-casters to take public CHR stationSputnik off the air in the city of Halle.
The MDR youth sta-tion has been under con-stant fire from the com-mercial sector since itstarted broadcasting ter-restrially on 104.4 FM inHalle last year. Sputnikwas originally conceivedas a cable and satellite -only network.
The court case wasan appeal against a decision made inOctober by an administrative court inLeipzig which permitted Sputnik tocontinue broadcasting terrestrially inHalle, where the station is based.
The protesting commercial broad-casters-which include AntenneThuringen, Energy Saxony,Radioropa, Radio. PSR and RadioSAW-argue that Sputnik is broad-casting on a regional, not a local, fre-
quency and as a result can be heardfar beyond the Halle region and evennear the Czech border.
"Sputnik can be heard as far away asZwickau," claims Gerhard Potzsch, gen-eral manager of Energy Saxony. "That's
not a local radio fre-quency; it's regional."
The Saxony govern-ment has also joinedthe dispute, arguingthat by putting Sputnikon FM, MDR is violat-ing the broadcastingcontracts it agreed withthe states of Saxony,Saxony-Anhalt and
Thuringia. Sputnik, it says, does nothave the right to broadcast terrestrial-ly in one state without the contractualconsent of the other states.
Officials at MDR, however, insistthat Sputnik has a local frequency andits limited -range local broadcastinglicence does not violate the tri-state con-tract. But despite the latest court ver-dict, it is thought that legal actions arelikely to continue against the station.
Emma Shapplin recently rec-eived a gold disc for Frenchsales in excess of 100,000 unitsof her EMI debut albumCarmine Meo. The classical -inspired album is currently onrelease in more than 30 coun-tries, according to EMI Franceinternational exploitation ma-nager Wende Cook.

ON THE BEATMADRID NEXT FOR LICENCE HAND-OUTMADRID - The regional government in Madrid hasannounced it will shortly advertise 25 new FM licences aspart of the Spanish government's overall share -out of 350new FM licences. The region currently has 32 stations broad-casting on the FM dial. A spokesperson for the Madridregion's ruling Popular Party says the 25 licences will beawarded according to seven criteria. Those are: promotion ofthe region's historical culture; the percentage of locally -pro-duced programming; economic viability; service quality guar-antee; news plurality; technical viability; and net job creation.Meanwhile, following recent controversial licence awards inGalicia (M&M, March 21), socialist and nationalist groupshave alleged that the COPE radio group knew in advancethat it had won several licences. "Within 24 hours of the pro-visional announcement [of the awards], COPE was transmit-ting on four of the wavelengths it had been given," says social-ist spokesman Miguel Cortizo.

`RADIO TO READ' DEBUTS IN BERLINBERLIN - Commercial AC/gold station Berliner Rundfunk91.4 and German Telekom have jointly produced the coun-try's first "Radio to Read" receiver. The Walkman -sized FMunit comes with a graphic display offering scrolled -text infor-mation on news, finance, sport, traffic and weather. A pilotproject was undertaken in the Berlin -Brandenburg region,and the radio will hit the national market in August at theCeBIT Home Electronics Fair in Berlin. Similar radio textreceivers are already on the market in the U.S. and U.K,and in France a model is to be introduced in conjunction withthi§ summer's World Cup football announcement.
CARBONE TO KEEP THE FAITH AT STATION ONEMILAN - Stefano Carbone has been appointed music direc-tor at national syndicated network Station One. He recentlyleft the equivalent position at CUR network Radio 101,where he had been for 10 years. Carbone has pledged to con-tinue Station One's radical, taste -making music policy. "Mystrategy," he says, "is to playlist new music with a cuttingedge sound." In the Audiradio survey for the first quarter of1998, Station One recorded an increase in audience for thefirst time since its new -music -only format was introducedlast summer.

Recovery continues inFrench music market
PARIS - The overallhealth of the Frencheconomy is reflected innew figures which showsignificant rises inrecord sales in the firstquarter of 1998.
According to the fig-ures from French recordcompany organisationSNEP, record sales enjoyed a4.8 percent increase in valueand a 7.9 percent growth inunit shipments during the firstquarter of 1998. Between Janu-ary and March, sales toppedFfr1.7 billion ($275 million),says SNEP. The singles marketcontinued to boom, with a 42percent increase in value atFfr221.1m and a 30 percentincrease in units to 10.1m. Sin-gles now represent 28 percentof all records sold in France,compared with 13.8 percent inthe first quarter of 1995.
However, thestatistics alsoshow album salesare continuing todrop slightly bothin units (down0.75 percent) andvalue (down 1.3percent). The dropin album sales
accounted for Ffr2lm in lostsales compared with the samequarter in 1997.
The SNEP fig-ures also reveal amassive concen-tration of saleson very fewtitles. During thefirst quarter, fivealbums account-ed for 15 percentof all sales-these were the Titanic sound-track and releases from PascalObispo, Era and Jean -Jacques
Goldman (two albums).For the first time since the
1996 introduction of lawsenforcing a 40 percent Frenchlanguage airplay quota onFrench radio, internationalrepertoire accounted for more ofthe country's total music sales(46.4 percent) than domesticproductions (44.3 percent). "Wehave to analyse this phenome-non over the long term to see
whether or not it's a serioustrend," says SNEP generalmanager Herve Rony.
Releases by CelineDion, Andrea Bocelli,Aqua and Janet Jacksonhelped internationalrepertoire account for 51.2percent of singles sales-the first time since theearly 1990s that the share
of local repertoire in the sin-gles market has fallen belowthe 50 percent mark.

BERLIN - North Rhine-West-phalia's annual EMA ratings,which focus on local andregional broadcasters, showthat public broadcaster WDRcontinues to almost totallydominate listening in the state.
According to the ratings sur-vey, conducted in the autumnof 1997 and in February thisyear, full -service station WDR4 enjoys a market -leadingreach of 25.5 percent, whileWDR 2 (AC) has a 15.8 percentreach and CHR broadcasterWDR Eins Live 17.3 percent.Local commercial stations haveseen a slight 0.2 percent drop
in their reach to 6.0 percent.WDR has a virtual monopoly
on state-wide frequencies inNorth Rhine-Westphalia. Of the46 commercial stations in thestate, 45 are local. The only state-wide commercial broadcaster isAC outlet Radio NRW, whichitself is partly owned by WDR.
Wolfgang Halm-Cremer,chairman of state radio regula-tor LfR's local radio committee,admitted that big competitionprizes, phone-in shows and for-mat changes have not succeededin helping the state's commer-cial stations win back listenersfrom the public broadcaster.
Critics of WDR's state-widedomination have recently
been calling for a youth -orient-ed state-wide commercial sta-tion. While there are no defi-nite plans for such at present,a source at the LfR tells M&Mthat a new FM commercialnetwork "might be made avail-able in the near future."
The EMA ratings provide amore detailed look at the per-formance of the smaller localstations in the state than thenational Medien Analyse rat-ings, which were published lastmonth (M&M, April 18). The23,000 -listener survey was car-ried out by GfK MedienResearch on behalf of the Asso-ciation of Local Radio, the LfRand WDR's sales house, WWF.

THE M&M INTERVEW D!BMG has recently restructured its European organisation and made a clear commit-ment to an "A&R focus" for the company. At his headquarters in New York, BMGEntertainment International president/CEO Rudi Gassner talks to Music & Media editor -
in -chief Emmanuel Legrand about the rationale behind these changes, and how hesees the evolution of BMG and the European market.
Q: Your European structurechanged in January, from three totwo regional divisions. Why?A: When we started [BMG Inter-national] eleven years ago, threeregions was absolutely the rightchoice, because we had a very separat-ed U.K. industry. Also, from a reper-toire point of view, we had a verystrong German company, and we hadCentral Europe to develop and build.And don't forget that, for example, wedidn't have companies in Scandinaviaat that time. So we had different tasks.Those tasks are now being fulfilled.
With that in mind, we looked againat the markets and how we couldincrease our efficiency, our organisa-tional skills, our market share. Thegood thing is that we work in a com-pany such as Bertelsmann, where theexecutive talents of ArnoldBahlmann, who has helped us enor-mously building Central Europe,could move on to the next challengewithin the company. When that movehappened, it allowed me to restruc-ture Europe.
By bringing in Richard Griffiths, Isent a clear message that A&R, repre-sented by him and Thomas Stein, isthe future of the two European units.As an organisational structure, weare now where we aim to be-verylean and efficient. We need to contin-ue to increase our market share, tocontinue to develop our domesticrepertoire. The Griffiths/Stein combi-nation will do exactly that.
Q: The real novelty is that youhave divided Europe in two, andintegrated the U.K. with the restof continental Europe. BMG is theonly major to have done that.A: I've heard a couple of comments-including from my competitors-thatwe are going in a very positive direc-tion. It makes me nervous when com-petitors praise you [smiles]. Apart fromthat, we have to give up the notion ofisolating the U.K. company.Integration is going to be a fact, and wesimply may be a little ahead of ourtime. Griffiths is certainly able to makethat step because of his American expe-rience, and the fact that he is not limit-ed by historical considerations.
Q: Are you going to invest more inpan-European marketing?A: Yes, absolutely. There's no doubtthat in Europe-because we are soclose to each other- our marketingefforts will not stop because there is aborder somewhere. A border which, infact, is going to be removed anyhow.There is a European market place,with European marketing priorities.
Q: When you launched BMGInternational 11 years ago, you
said local repertoire would be thekey to the company's growth. Youseem to have been proved right...A: I've always predicted that therewould be a tendency, especially withthe globalisation of the markets, tocome back and embrace domesticartists, almost as a cultural counterattack. German kids understandwhat Tic Tac Toe are singing, and itmakes all the difference.
What domestic repertoire did nothave 10 years ago was the quality ofproduction, of presentation. But 10years on, there is no doubt that pro-duction quality in Europe has

However, there is still enoughroom left for global stars, with globalmessages, who can work globally andsell enormous amounts of records.That will not change.
Q: What has changed, perhaps, isthat even the success of those glob-al stars cannot be taken for grant-ed any more?A: The time is gone when you couldtake a Top 40 U.S. hit and almostautomatically translate it into a suc-cess in any other country.
It changed because the American
market is basically divided into threemusic categories: urban, non -popR&B, which does not travel well;country, also difficult to export; andthat leaves one third of the market,pop/rock. With country and R&B, youcan achieve some success provided ithas some sort of a pop hook to it, as inthe case of Puff Daddy, or with anycountry artist who comes out with agreat song. Songs will always sellregardless of where they come from.
Q: What's your view on the evolu-tion of the European market?A: I don't think we are going to have aEuropean consumer with a"European" taste. But in terms of themacro economic situation, the singlecurrency and the lifting of borders willslowly create a European market. Ican see things changing, but notovernight. I tend to advocate goingnaturally with the flow of the market.
Q: What about the effects of thesingle currency?A: One single currency used all overEurope will have implications for dis-tribution-that's a fact. But I don'tthink it will have many structuralimplications. We'll have a Europeanprice sometime, because consumerswon't accept that prices in Stockholmare higher than in Italy.
We are not the only manufacturersplaced in that situation. We'll end upwith very close European pricing, andwe have to make sure it also meansthat we get the highest possible price.
Q: What about the media situa-tion? The localisation of MTVproves your point about theEuropean consumer. But if therearen't pan-European media, thereare pan-European media compa-nies-CLT-UFA, NRJ, EMAP.A: There is such a huge fragmenta-

tion of languages, cultures andlifestyles that I don't think there willbe serious changes. Radio is obviouslya more fragmented medium, andthere will always be magazines in thedifferent languages.
There might be an evolutiontowards a greater connection betweenregions-Germany, for example, withAustria and the Czech Republic;Scandinavia getting closer toBenelux. It will happen as a naturalevolution, but like MTV, I don't thinkwe'll have Europe -wide broadcasterseverybody listens to, and everybodyspends their advertising budgets on.But if [the broadcasting companies]are clever, they'll probably createsome umbrellas and have local win-dows, as in America.
Q: Based on your U.S. experience,what elements from the marketthere should inspire Europe?A: Number one, get a system likeSoundscan. Get that in every country,without any limitation on the partici-pation of retailers and the industry.Then you will know what really sells,and Europe will reach another oper-ating level.
Q: And vice versa, what couldEurope export to the U.S.?A: The Europeans are certainly tak-ing risks at very early stages withnew styles, new products, much morethan in the States. The argument
would be that it's easier in Europebecause the market is less formatted.Yet it doesn't mean it cannot be done.
Q: Is the new digital technology athreat to the music industry?A: In our business, threats are oppor-tunities; I don't see a threat, butanother way of doing business.
I could go further and say that,from a marketing point of view, I'drather have direct access to a con-sumer, knowing what that specificconsumer wants, and target himdirectly. Today, I have to go via whole-salers and retailers to reach that oneconsumer who is going to buy my onerecord. It is quite an expensive way. IfI have a more direct way, it's a greatopportunity for the record company.
Q: How would you describe yourmanagement style?A: [Laughs] Ask other people, not me.Let's put it this way: I think I knowwhat I'm doing.
Q: Has Bertelsmann beenoffered EMI?A: Well, nobody can "offer" EMIbecause it is the shareholders whomake the decisions. All one could do issay, "I am ready to pay X per share.Who wants to sell me their shares?"
Q: And why haven't you done that?A: Because we would have to go pub-lic immediately.

Q: You have just renewed yourown contract with BMG. You'vebuilt the company into a world-wide global player. What's yourlong-term vision for BMG?A: The past 10 years were about build-ing the company and making quanti-tative achievements and quantitativeleaps. The next 10 years will be drivenby us being qualitatively better thanour competitors in all areas. It's a
completely different task and it's achallenge. That's why I'm looking for-ward to it, because it needs to bethought through and implemented.
My belief is that if your are quali-tatively No.1, you will improve yourbusiness. Our competitors are verystrong, too. They are not sleeping,and are not waiting for us to take overtheir business. That's where the funis-it's like a soccer match.

France, radio and all that jazzWith more festivals, labels,organisations and export-able jazz artists than anyother European territory, aswell as domestic sales ofsome 3 million jazz albumsin 1997, France is Europe'smost active market for jazz.Terry Berne examines therole of radio in boosting thispre-eminence.
Despite a plethora of pro-grammes on local and region-al stations, as well as an aver-age of three and a half hoursa day on Radio France's vari-
ous franchises (Fip, France Musique,France Culture and France Inter), thesituation of jazz on French radio ishighly fragmented at best.
The majority of programmes clockin at under 2 hours in length, and arebroadcast at what most would consid-er to be unreasonable hours of thenight. Many of them have a decidedlyhistorical focus, which does little topromote interest in contemporaryartists. Seventeen years after deregu-lation, Paris still lacks a 24 -hour jazzstation comparable to JazzFM/London or Jazz Radio101.9/Berlin, a situation in theFrench capital which has beendescribed as "practically scandalous."
Change will comeChange may be on the horizon, how-ever. The last two years have seen thelaunch of two commercial stations inFrance dedicated exclusively to jazz:Frequence Jazz in Lyon, a 24 houroutlet linked with that city's three -station PNV group; and Paris Jazz,which currently shares a frequencywith French rap station Generation.
Paris Jazz FM began broadcastingin October 1996. It airs daily from14.00-19.00 and from 23.00-07.00.The latest Mediametrie figures puttheir audience at 40,000 daily listen-ers. Music content is limited to mod-ern jazz, starting about the time be-bop emerged after World War II.Programmes are built around 40 per-cent recent recordings, including 20
percent devoted tocontemporary Frenchartists.
Sequencing jazz'sbroad range of stylesis always a jazz pro-grammer's principalchallenge. The twomain options are:dedicating blocks oftime to particularstyles such as swing,fusion, blues, bop,and latin; or tossingthem all together inas rational a manneras possible.
Paris Jazz opts forthe second policy, but,according to commer-cial director SylvainMoser, sticks to onekey rule: "We neverplay more than two instru-mental tracks in a row. Allinstrumental pieces arefollowed by one or twotracks featuring vocals."Programme directorFrederic Charbaut feelsthat vocal tracks are moreaccessible to non -spe-cialised audiences. Thereare plans for a number of specialityshows in the future, however-although free jazz is entirely excludedas "too difficult" for the general lis-tener.

Building revenuesAdvertising at the moment is jazz -related (concerts, clubs and labels),though Moser is quick to point outthat they are just beginning.
EMI has just struck a deal for two-week long campaigns monthly for thecurrent year, featuring new and cata-logue releases. "There's little money inthe jazz world for advertising," notesMoser, "though more and more bigcompanies are becoming aware of thegrowing importance of the station."
At Frequence Jazz/Lyon, advertis-ing revenues are ahead of projections,according to programme managerJacques Dorland. Launched in Jan-uary of 1996, the station can claim a2.2 percent share in its market, with30,000 daily listeners drawn from apotential 1.5 million people in Lyonand its environs. As France's sole 24 -hour jazz station, Frequence Jazzboasts both local and national clients,and hopes to break even within sixmonths, a year and a half before thefour-year goal.
Programming strategiesProgramming policy at the stationshares some similarities with ParisJazz-there are no "single style" blocks.
Says Dorland: "Block program-ming by style cannot work. A listenerwho doesn't like a particular type ofmusic, be it swing or blues or whathave you, will simply tune out. So it'salways better to present a mix."
The contents of that mix are wherethe two stations differ. "On FrequenceJazz you get the whole history of jazzevery hour and a half," Dorland adds."That means that a listener who does-n't like be -bop knows that in threeminutes he'll get Sidney Bechet, and
among the public. We'relooking for our own fre-quency, and once we arebroadcasting 24 hours aday we may expand intoother cities. We'realready heard 24 hourson cable and satellitevia Canal Satellite."

The two stations do share a populistphilosophy. "We want to present jazz tothe largest possible audience. Ever-yone's heard jazz, yet it remainsunknown to a wide public. Lots of ourlisteners are non -specialists, preciselybecause our programming is accessible."
For the moment, there are only twoshows with presenters: a music andnews programme from 07.00-09.30;and an afternoon showfrom 17.30-19.00. Bothnational and local artists,drawn from Lyon's livelyjazz scene, are featured onthe playlist.
The station also broadcasts livefrom France's most important sum-mer festival, Jazz a Vienne. Night-time programmes feature more "diffi-cult" music, ranging from hard -bop toECM artists, as well as longer (8-10minute) tracks.
Frequence Jazz belongs to localgroup PNV, which also includes RadioEspace and Radio Classic 2. It has anownership link with Paris Jazz, withwhom it shares its distinctive logo. Sodoes this portend a future jazz net-work? "It took three years for the pro-ject to be accepted by the radioauthority," says Dorland, "and ParisJazz only has half a frequency. Butthere's definitely a place for jazz sta-tions in the big cities, so expansion isa possibility."

France Musique offers 6 regularshows, a total of 16 hours a week,including Friday night's Jazz Club,live from any of several clubs in Paris,hosted by Claude Carriere and JeanDelmas; and Musique En Tourne,with Renaud Machart, which featuresnew releases. In addition, some 20concerts a year are produced for thestation by Xavier Prevost at the Jazz

Julien Delli Fiori presents hour-longshows on both Saturdays and Sundayson France Inter. But Jazz a Fip,beamed to France's nine largest citiesdaily from 19.30-21.00 on Fip, is, bycommon consent, the most influentialjazz programme in France. The showfeatures an album of the week chosenby a select group of programmers.
Alex Duthil is editor of JazzmanMagazine and co-producer-with threecolleagues-of Jazz Midi, a half-hourdaily programme at noon on FranceMusique. "Jazz a Fip," he says, "is veryimportant, but other stations such asFrance Inter and France Cultureshould schedule their jazz shows justbefore or just after Fip's, so that listen-ers could tune in to jazz for severalhours at a stretch. Time slots for jazzon public radio are generally poor."
Duthil also points out that, apartfrom live broadcasts, there is no cen-tral jazz policy at Radio France; eachprogramme at the various stations isindependently produced.
One advantage which public radiohas over the new commercial outlets isthat, less dependent on audience fig-ures, it can afford to be more adventur-
ous. However, domestic music quotasmay soon be extended to include instru-mental music, which would mean jazzshows would have to programme moreFrench -produced material.
The cable routeDespite what seems at first glance awide variety of programmes, an aver-age day offers only three to four hoursof jazz programming across all ofRadio France's stations.
This is doubly discourag-ing for supporters of thegenre, given France's longtradition as jazz capital ofEurope. One solution to thepaucity of jazz on public
radio is under discussion at RadioFrance: a special channel, perhaps oncable, dedicated exclusively to jazz.Andre Francis, however, describes theidea as "just a dream."
There is some consolation to befound on Monday nights at 01.00, inthe form of Jazz 6 on commercialchallenge channel M6. Now in its11th year, the one -hour show featuresperformances from Jazz a Vienne, aswell as historical concert footage"from Duke Ellington in black andwhite to Ornette Coleman in colour,"as producer Philippe Adler puts it.
Racking up some 300,000 viewersper show despite the hour (many fanstape Jazz 6 for more convenient view-ing), it is surprising to learn that jazzlabels shun the show.
When consulted, labels in the mainseem apathetic about such commer-cial initiatives as Paris Jazz,Frequence Jazz and Jazz 6. A commoncomplaint about the TV show is that itairs too late, and, despite Adler's affir-mations that he "tries to present animage of what jazz is today," labelsfind the format of little relevance tocurrent releases. The new radio sta-tions' lack of live presenters is the rea-son most cited by labels for theirapparent lack of interest.
The importance of Miles Davis tocontemporary music has never beengreater than now, seven years afterhis death. Panthalassa: The Music ofMiles Davis 1969-1974 (Columbia), is more thanjust a tribute to the complex, funky, often frustrat-ing music of the trumpeter's pioneering experi-ments with electronic soundscapes. In a musicalclimate where the fusion of emphatic rhythm withelectronic sonics no longer defines the cuttingedge, but has invaded the mainstream, the musicof Miles becomes a fundamental reference.
On a series of live and studioalbums, most prominently document-ed on such masterpieces as In A SilentWay, Bitches Brew, Live -Evil and OnThe Corner, Miles charted the frontierbetween street -smart funk, Africansyncopation and a sophisticated mix ofbaroque and minimalist electro-pop.In the remixes by Bill Laswell onPanthalassa, he shortens and mergestunes to form flowing new versionsfrom the longer originals, underliningjust how prophetic this music was, andhow contemporary it sounds today.
Columbia also continues its exem-plary multi -CD packages dedicated tovarious Davis formations and periods with TheQuintet 1965-68, featuring four musicians who helped
JCI77 Notesset the course of modern jazz: Wayne Shorter,Herbie Hancock, Ron Carter and Tony Williams.The last of these sessions sees the first incursions intothe areas captured on Panthalassa.
Jazzline continues its run of fine European jazzreleases with The Smile Of The Honeycake Horsefrom Septer Bourbon, a quartet featuring pianistMarkus Burger and
saxist Jan VonKlewitz. Burger's playing is luminous, and he's alsoan exciting composer, especially adept at ballads,
though the Monkish Bonk is an uptem-po highlight. Klewitz's supple tone capa-bly extracts the emotion from themelodies. Imaginative, highly textured
contributions from bassist Martin Gjakonovskiand drummer Uwe Ecker make this one of the bestworking quartets on the Continent.
Two very different guitarists are the focus ofengaging new releases. Bireli Lagrene's regular triois joined by extraordinary pianist Maurice Vanderon the very swinging Blue Eyes (Dreyfus Jazz), dedi-
cated to the music of Frank Sinatra.The leader's stunning solo lines andchordal phrasings burst the confines ofthe familiar melodies, creating a classicset of impeccably played jazz, and oneof Bireli's best.
From Verve comes the newestincarnation of guitar wizard JohnScofield. On A Go GO he's support-ed-no, surrounded-by a top-flightorgan trio led by John Medeski.This is a jam -and -groove outing whichupdates the soulful form. The band isrhythmically explosive, and Scofieldinjects his riffs with a decidedly mod-ern sense of harmonic invention. The
soul jazz revival of the past several years has pro-duced a host of blues -based B-3 sounds, but fewquite so funkily adventurous.

Both ver-sions are powered by an excellent funky bass line; Krilly'sFrozen Remix is the more obviously commercial version, dueto its Detroit references. A techno track capable of pleasingboth the underground and pop programmers is rare; ArcticSurvival is indeed that unusual beast.
JUNGLIZED AGAINClaiming to feature breakbeat sounds that are "musical andrefreshing", Junglized 2 (Selector-Crammed/Belgium), actu-ally lives up to its ambition to a surprising degree. An eclec-tic selection of tracks spans several drum'n'bass sub -genres.The album reflects the current state of breakbeat science anddoesn't try too hard to be "hipper than thou." Stand -outtracks include the 4 Hero remix of Nuyorican Soul's I Am TheBlack Gold Of The Sun and Tosca's Fuck Dub.
BLACK ON BLACKL.S.G.-a.k.a. Oliver Lieb-is one of Germany's foremosttechno musicians. A prolific and gifted composer with a deftmelodic touch and a clutch of alter egos including Spicelab,The Ambush, Superspy and Azid Force, Lieb has justreleased The Black Album (Black Series Recordings/Superstition), his seventh long player since 1989.
Building on previousL.S.G. releases, The BlackAlbum favours the linearexcursions and ambientsoundscapes of previousreleases, adding a harderedge. "The album wasmixed together to createthe feeling of a journey,"says Superstition spoke-sman Axel Wirtz. "It has asound which isn't typicalL.S.G. It's `phatter,' fasterand very spacious."
The Black SeriesRecordings imprint was created to mark this change of direc-tion for Lieb, who wanted to continue to release records underthe established L.S.G. banner. "The new label was developedin consultation with Oliver and for the moment is solely ded-icated to his output," says Wirtz. "We wanted to make a cleardistinction between this [Black Series] sound and futureL.S.G. projects, which will be closer stylistically to previoustracks under that name."

Ace of Base, Sweden's biggest pop phenome-non since Abba, are back after a three yearbreak with their third album Flowers (Mega).
The new set is due out on June 15-thealbum's first single Life Is A Flower sees theband back in the upper regions of Music &Media's European Airplay Top 50 and on top ofthe Border Breaker chart this week.
As opposed to the act's firsttwo multi -platinum albums-The Sign (1993) and TheBridge (1995)-which clearlyappealed to teenagers acrossthe globe, Copenhagen -basedMega Records is aiming at 15-35 year -olds with the latestAce Of Base material.
"They still have a lot of fansout there, but there's a newpotential audience for Ace OfBase," says Mega Recordsinternational manager Bir-gitte Lauridsen. She believesAce Of Base have matured toextend their fanbase to includeadult listeners. "This is musicfor grown-ups as well."
Mega Records head of production BobMorrison adds: `With Ace Of Base, we defi-nitely see a move toward a wider demograph-ic. Whereas they previously leaned towardsdance, Flowers is basically CHR pop."
European radio has embraced the "new" AceOf Base wholeheartedly. Life Is A Flower hasbeen ranked among M&M's Most Added tracksacross Europe over the last six weeks. RadioViborg programme director Kent Kordt Rudercomments: "If the rest of the album is like Life
Is A Flower, it will have good sales potential."It will be interesting," he adds, "to see if they
can get through to a new audience with this.""I think the album is actually quite differ-
ent from the single," says Jonas Berggren, thedriving force behind Ace Of Base, together withco -writer Ulf Ekberg. Berggren-who is alsothe brother of the band's female vocalists Linnand Jenny-adds "you can still recognise our`trademark' pop -reggae sound on some tracks,
but there are some Motowninfluences, some disco andsome slow songs."
Mega handles Ace OfBase in the Nordic territo-ries and licensed the newalbum to Polygram for Asiaand Europe and to Arista forthe Americas and Japan."Flowers will be released intwo versions," addsMorrison. "For the U.S.market [and in Japan], wewill include more R&B ele-ments, while the Europeanversion will have more of apop flavour."

Charles Fisher (Savage Garden), StephenHague (Pet Shop Boys) and Douglas Carr onFlowers. The mix -down was largely supervisedby Chris Lord-Alge in Los Angeles and DavidLeonard in Nashville.
"Became there are so many different labelsworking the album, we have to please them a bitand make some compromises here and there,"says Ekberg. "That's why it took a little bit longer[to complete Flowers]. A lot of chefs were involvedin making this soup."

The debut album by Melville-the first actsigned to Richard Branson's V2 label inFrance-looks about to disprove the generalconsensus that "pop is dead and raprules France."
V2 general manager Thierry Chassagneadmits that: "We got laughed at by other labelsfor putting money on a pop act. Many peoplewithin the industry argued that pop with rockleanings was a 'has-been' on a market floodedwith successful rap and hip -hop acts."
Chassagne's notion that there is a future forpop in France might yet be proven right as theParisian group is gaining airplay steadily.Melville's debut album Est-ce Que L'amourRestera (Will Love Remain) was released onFebruary 10. Paris -based rock station Oui FMpicked -up the track Qu'Importe Ce Qu'On Dit,which spread fast to CHR stations Fun Radioand NRJ and is currently receiving supportfrom music TV stations M6 and MCM.
"Pop and rock still have some space on themarket," believes Melville's front manEmmanuel Tether. "Not having the media expo-sure [of contemporary French hip -hop artists]does not mean that you are not successful allthe same."
Tellier, deputy editor of weekly music mag-azine Les Inrockuptibles, was known for hiswriting before he formed Melville in 1995together musicians Etienne Dutin (guitar),Pierre Palmieri (bass) and Luc Durand(drums) all from his former band, Chelsea.

WithTellier on vocals, the band also switched fromChelsea's English language lyrics to French.
Having collected stage experience asopener to V2 U.K.-signed act Stereophonicson their French tour last winter, Melville willembark on their own tour between May andJune, which will be sponsored by CHR net-work Fun Radio.

No-one could accuse Simply Redfrontman Mick Hucknall of beingambivalent about the state of radio iriEurope today. "They are trying toinstitutionalise music," he declares,"and they will fail. That's why thesestations have to offer cash prizes andeverything else you can imagine
apart from the music."Regarding European radio
from the vantage point of aman with a 10 -year string ofhit singles across the conti-nent, Hucknall admits: "I'vedone OK out of it, but I thinkpeople out there deserve morechoice than they're getting atthe moment.
"Radio's too busy puttingeverything into boxes and Ifind people out there don't livein boxes. I feel that radio willchange in the next few yearsand you will get some peoplesomewhere who'll start usingthe good old-fashioned DJ whoplays his favourite songs andthe sooner we get back to thatthe better."
Despite those harsh words,Hucknall knows very well thatthere is no better medium thanradio to let fans know that hehas a new album on the way-and it seems radio still lovesSimply Red. On the eve of theMay 18 release of the act's sixthalbum Blue (East West), thefirst extracted single Say YouLove Me is sitting comfortablyon top of M&M's Most Addedchart for the third week.
The Simply Red brandname and the mainstream popsound of the record have
ensured wide radio acceptance. It hasbeen playlisted by the alternative -leaning national CHR station BBCRadio One in the U.K. and is current-ly the most played internationalrecord in Italy.
"Mick is very keen on this [record]working at radio," says East Westinternational director Ian Grenfell."It's not about being No.1 in thecharts, it's about getting as much air-play as possible for Simply Red at
this stage. Historically, the slowersongs have done better commerciallyso a track like Say You Love Me defi-nitely addresses his core market."
Blue started life as a collection ofcover versions, "until it really emergedthat I wanted to do a 60/40 album oforiginals and covers and that's how itturned out," according to Hucknall.

Hucknall anticipates some antipa-thy from the media on the subject butcounters: "Most people out theredon't give two hoots. They love a songand and if the song is a great songthey don't care. I don't care. Ask Elvishow many songs he wrote. Ask FrankSinatra how many he wrote. Beingfirst and foremost a singer I lovedoing other people's songs becausethey're another vision of the world."
In the U.S., where Simply Redlaunched their career in 1986 withthe chart -topping ballad HoldingBack The Years, it's not the issue of
attracting Simply Red's existing coremarket but the possibility of attract-ing a new younger audience that isdriving Elektra's marketing plan.
There is no commercial U.S. singleat this point but radio is being ser-viced with the two versions of The AirThat I Breathe with a view to focusingattention on the album. While ACradio has the "Hollies-style original"version, Top 40 and crossover radiohave the R&B-flavoured "reprise" ver-sion, a collaboration with Puff Daddysidekick Stevie J. It is a strategywhich finds favour with Hucknall.
The Air That I Breathe will be thenext European single in July, bothversions being made available to ter-ritories on an individual choice basis."At the moment the `Hollies version'seems to be coming out strongeracross Europe outside the U.K.," saysGrenfell, "but if we have a huge hit inAmerica, it wouldn't surprise me ifthe Stevie J 'reprise' gathered steam."
Hucknall is already lookingbeyond the immediate future. "I'vegot all the material ready for the nextalbum, which is why I'm not going totour this album," he announces. "I'mgoing to go straight into recording thenext album because these will be verymuch like brother and sister albums."He confirms that there will be two orthree covers on the follow-up.
Before that, however, there'sanother major event taking placewhich is sure to divert the SimplyRed mainman's attention. The mostimportant question of them all is:does soccer fan Hucknall have ticketsfor the World Cup? "I've not asked forone actually," he confesses.
"I think I'd prefer to watch this oneon TV at home with a few mates and afew beers and a few bottles of wine. Butif England get into the semi finals I'll beover there, I've got a couple of mates inthe team so I'll be supporting them."

Two weeks ago, German band DieArzte achieved their highest ever newentry and their best ever chart posi-tion in Germany in a 15 -year career.
This week, their single MannerSind Schweine (Hot Action/MotorMusic) made the No.1 slot, racingtowoards gold status (250,000 unitssold). But fans are advised to hold onto their copy, because in August, thelabel will be histo.ry. As discussed inlast week's M&M, Die Arzte plan todissolve their label, Hot ActionRecords at the height of their success.
The single, which entered theGerman charts at number 2, is awitty pop song with a tinge of ska,featuring "easy listening" -stylestrings and a brass section. The lyricsare highly literate, yet very direct-and full of revealing detail on thequestion of why, in their words, "men
are pigs."Radio feedback has been "surprising-
ly good," says freelance radio promoterDagmar Grosser. "We delivered the sin-gle by hand to make sure that every keyradio programmer really got a copy.Quite a few stations, including NRWand Antenne Bayern who had hardlyever played Die Arzte before were veryopen and playlisted it immediately"
Andreas Schulz of Frankfurt -basedprivate dance station Planet Radiowas one of the first to play MannerSind Schweine. "We usually have aproblem when the guitars begin toweep and wail, but the new Die Arztesingle is a great pop tune, and it islikely to go on heavy rotation."
Farin Urlaub, the group's leadsinger and guitarist, confided to M&Mthat "I'm deeply impressed with thissuccess. I had severe doubts about thesingle, although I wrote it, because itwas something rather different from
what we normally do and not verydynamic, musically speaking, butdrummer Bela B and bass player RodGonzalez thought it was cool."
To control the marketing of MannerSind Schweine and the band's upcom-ing album 13-due out on May 25-Die Arzte founded the Hot Actionlabel, headed by former PhonogramMD Louis Spillmann and band man-ager Axel Schulz. According to Schulzthe founding of the label was purely amatter of quality control. "We want tosign off on every piece of artwork,every ad, every word of copy," com-ments Urlaub, "and it takes years tomake record companies accept that."
Once the campaign for 13 and fur-ther single spin-offs is set up-thenext single is Goldenes Handwerk,but no release date has been con-firmed yet-licensing partner Motorwill take over the implementation ofthe band's marketing ideas and Hot
Action will be dissolved Spillman andSchulz plan to formally announce theclosure of Hot Action at Germanmusic fair Popkomm, which will takeplace in Cologne from August 13-16.
So, will Die Arzte return after thisrather theatrical farewell? M&Mhears that plans are already drawn upto revive Hot Action in the year 2000to work on Die Arzte's 14th album...

At Bologna -based Italian nationwide dancenetwork Radio Italia: Los Cuarenta, senior programmer Michele Menegosays: "In October last year, when the original came out, we featured it onour house music chart and it had a lot of impact in the clubs. When thevocal version was released, we thought it was a massive improvement andit would be a big summer hit." Menegon adds that this type of music is"easy to programme for Radio Italia Network and it currently gets about 25plays a week between 06:00 and 10:00." Menegon concludes that "hav-ing the programmers like the song a lot doesn't hurt..."

After No.ls for Natalie Im-bruglia (Torn/RCA), Janet Jack-son (Together Again/Virgin), andMadonna (Frozen/Maverick) theSpice Girls finally outstrip allcomers with Stop (Virgin).Madonna drops down to number3, after a nine weeks reign on top,the second longest stay since thelaunch of the chart in 1990.Holder of the record for the lengthiest tenure onpole position is (Everything I Do) I Do It For Youby Bryan Adams (A&M), which managed to stickto the top for 12 weeks in 1991.
It's unlikely The Spice Girls, who are already inthe 11th week of their chart run, will stay on topfor long, because two other tracks are storming upthe charts. Ace Of Base are at number 4 with LifeIs A Flower (Mega/Polydor), just ahead of SimplyRed at 5 with Say You Love Me (East West).
The Ace Of Base track is this week's greatestchart points gainer and is the most played recordin Scandinavia and the G/S/A countries, as theMajor Market Airplay section shows. It's alsoNo.1 on the Border Breakers chart-and thatmakes Ace Of Base the most successful act everon that chart, with no fewer than six No.ls. Brodde says he used to buy the ModernTalking singles in his teens and is excited aboutthe project: "It definitely has the '90s feel over it,and on the other hand, their music sounds nowa-days like kitsch."
Brodde is also currently playing a new version(by Alex Braydon) of the 1983 Spandau Ballet hitTrue, and raves about an album track on the newLos Umbrellos album (Flex/EMI-Medley)-a coverof The Cars' 1984 hit Drive. IFPI: Europe back in second placeby Christian Lorenz
LONDON - Europe lost its position asthe world's No.1 music market lastyear as worldwide music sales droppedfour percent by value.
New figures from labels' body theInternational Federation of the Phono-graphic Industry, published on April 30show that the global value of salesdropped despite a modest two percentincrease in unit sales. They prove,according to IFPI director general NicGarnett, that "1997 undeniably was abad year for the music industry."
Addressing the media at London'sAbbey Road Studios on April 30, Gar-nett said that despite these statistics,he saw "many reasons to be optimisticabout the future of the industry."
Blaming a strong U.S. dollar for adistorted picture of real market devel-opment, IFPI calculated a local curren-cy growth rate, weighted by the size ofeach country's contribution to the globalmarket. According to the IFPI calcula-tion, total retail value of the worldmusic market grew by two percent inlocal currency terms last year asopposed to the four percent drop regis-tered in dollars.
Europe was particularly hard hit by
the appreciation of the dollar, with afive percent drop in retail value in dol-lars, compared to a local currencygrowth rate of four percent, according toIFPI. Among the world's principalmusic markets, Europe fell back to sec-ond place last year with a dollar marketshare of 33.3 percent. North Americare-established itself as the world'slargest single music market, with amarket share of 33.8 percent.
On a micro economic level, Europe'sfate looks less dark, with a couple ofcountries showing two -digit growthrates in both retail value (in local cur-rency) and units sold. In westernEurope those were Spain (14 percent byunits/19 percent by value) and Ireland(10 percent/20 percent). Hungary (23percent/18 percent) and Poland (19 per-cent/19 percent) showed the biggestgains in eastern Europe.
According to the IFPI statistics, localrepertoire fuelled above -average growthin unit sales in Europe and Latin Amer-ica, nourishing hopes for growth in theailing world music market.
"There is plenty of room for growtheven in the developed markets," SonyMusic Entertainment Europe presidentand IFPI board member Paul Russelldeclared. Russell drew attention to the
fact that "the share of local repertoire inwestern Europe grew from 34 percentto 43 percent over the past five years"and identified the key issues for themusic industry as "increasing the choicefor the consumer and creating a greaterchoice of places to buy music."
EMI Europe president/CEO and vicechairman of the IFPI European Execu-tive Board Rupert Perry said that hesees growing export potential for west-ern European artists in emerging mar-kets like Latin America, eastern Europeand Asia.
"The crossover between Spain andthe Latin American region is now50/50," observed Perry, "with theexchange flowing equally in bothdirections. Some Spanish artists arenow selling more in Latin Americathan at home."
Both Russell and Perry, describe1997 as a "bad year after a number ofvery good ones." and dismiss specula-tions about imminent shake-ups with-in the industry. The shrinking mar-kets observed in some territories lastyear will not lead to a reduction of thenumber of players in the industry,according to Perry. He says: "Futuregrowth in the music industry has noth-ing to do with consolidation."
Radio falls for dark Attackthe band from Bristol which "invent-ed trip -hop" has steadily turned Mas-sive Attack into a style icon since therelease of their debut album, BlueLines in 1991.
Now, that cult status is paying offwith impressively mainstream -stylesales for their third album Mezzanine(Virgin), this week's sales breaker (atnumber two) on M&M's EuropeanTop 100 Albums chart, thanks tomassive support in style -consciousmarkets Italy and France.
Mezzanine is a Top 3 album in sixEuropean countries this week, andthe April 27 -released single Teardropis enjoying strong airplay supportfrom a wide variety of radio stations.
In France, where the album ranksat number three in the sales charts,Teardrop is being played on rock sta-tions and full -service networks. "OuiFM did not play tracks from the twoprevious Massive Attack albums,"says Jean -Patrick Laurent, head ofmusic programming at the Paris -based rock station. This time, howev-er, Oui FM even broadcast the band'slive performance on the popularCanal+ TV show Nulle Part Ailleursthree weeks ago.
French full -service network RTLis also supporting Mezzanine, onFrancis Zegut's weekday late show."We play slow and reflective titles inthe evenings," explains RTL musicprogrammer Pascal Amiaud. "ButTeardrop is not made for the daytimeaudience, which looks for moreupbeat titles."
In Italy, Mezzanine is numberthree in the country's album chartsthis week. Virgin Music Italy TV andradio promotions director SandorMallasz reckons: "Massive Attack's
music is very close to Italian sensibil-ities-it's a very gutsy sound."
Stefano Carbone, music director atCHR network Station One, adds:"The whole trip -hop scene has beenvery popular here, from Portishead toTricky. Massive Attack's music has avery dramatic and positive vibe."
European shipments of Mezzaninealready amount to almost 80 percentof sales of its 1994 predecessor Protec-tion, says Virgin Records U.K interna-tional marketing manager Bart Cools.'e expected better sales this time,"he reveals, "but did not anticipate thatthe band's fanbase is so strong."

Says NRJ managing director AlainWeill: "If the law-or the way it isimplemented-has not improved thediversity of the music played, theanswer should be not to force eachradio to open its playlist, but to offer awider diversity of formats."
Eric Baptiste, president of radioorganisation Vive la Radio, which rep-resents all French stations, contends:"It's pointless to change the rules whenthose rules are [already] not respected."
The 1994 quota law, unanimouslyvoted for by the French parliament,came into force on January 1 1996.The legislation was backed by allsides of the music industry, frommajor companies and independentlabels to artists and performingrights societies.
But two years on, some in themusic industry believe it's time toloosen the regulations; others thinkthe CSA should be more active inenforcing the quotas. "Let the CSAenforce this law and get all the sta-tions to respect it, and only then willwe be able to review the effects of thelaw," argues Skyrock's Bouneau.
Figures from major record compa-nies' body SNEP show that sales ofdomestic products fell during thefirst quarter of 1998, which some inthe industry are attributing to a"relaxation" in radio's implementa-tion of the laws (story, page 7).
"The drop in the number of titlesplayed on radio stations is alarming,and this concerns everybody," saysSNEP's managing director HerveRony. "It is necessary to find a solu-tion with the CSA, or to add a provi-sion in the law that will force sta-tions to play a greater diversity [ofmusic], even if that means we'll haveto soften other aspects of the law."
EU hears case for hi -tech protectionBRUSSELS - The International Fed-eration of the Phonographic Industry(IFPI) technology roadshowhit the Belgian capital onApril 27-28.
The Brussels stop was partof IFPI's campaign to raisethe awareness of EU policymakers to issues of concern tothe music industry.
Legislators from the European Par-liament and policy makers from theEuropean Commission, as well as rep-resentatives from the media, were invit-ed to attend the presentation, whichdrew over 200 people over two days.
The presentation, hosted by BBCTV presenter Michael Rodd, includeddemonstrations* of different digitaltechnologies and formats-from theInternet to digital distribution and
DVD-which are, or will be, availableand are likely to change the way con-
sumers access music.In particular, thedemonstrationshowed how musiccan be downloadedfrom an Internet siteand transferred onto arecordable CD in a
matter of minutes."We wanted to illustrate with con-
crete examples how these new tech-nologies can represent both threatsand opportunities for the music indus-try," explains Adrian Strain, seniormedia affairs advisor, Europe forIFPI's Brussels -based office. "Weshowed that, with some state -of the -art gadgetry, piracy on the Internetwas easy.

"This hi -tech presentation has beenappreciated as a real watershed for anindustry to pass on its message to law-makers and regulators," continuesStrain, who makes no secret of thefact that the presentation was tailoredto reinforce the IFPI's message thatthe music industry needs proper pro-tection in the digital age. The messagewas also a time -sensitive one, as theEuropean Commission is in theprocess of approving the draft Copy-right directive.
The roadshow will be followed upby a series of meetings with MEPsand members of the Commission.Strain hopes that similar presenta-tions will be made in other Europeancountries. "Our message has to bedelivered to national governments aswell," he concludes.

London's mainstream music stations are win-ning the fight for the capital's listeners at theexpense of speech outlets and national CHR stationRadio 1, according to RAJAR ratings for the firstquarter of 1998 released at time of going to press.95.8 Capital FM is the market leader with a 15.5percent share-down slightly on the previous quar-ter-but gains were made by Virgin Radio (rock),Melody FM (MOR/AC) and Heart 106.2 (AC)which overtook Capital Gold in market share andweekly reach. Sony Music France president Paul -ReneAlbertini is believed to be about to announce areorganisation of the company's top management.Sources say he will create three horizontal decisioncentres with responsibilities over all labels:Strategic Management, with current senior VPJean-Claude Gastineau; Operations &
Marketing, headed by Columbia MD OlivierMontfort; and A&R, under SMALL MDPhilippe Desindes. The aim is to create "a quick-er and flexible decision making process."
