Newsletter 2016-1 January 8, 2016 MAKE PLANS NOW TO ATTEND TRANSPORTATION DAY - JANUARY 18, 2016; FUNDING CAMPAIGN TO BE UNVEILED West Virginians for Better Transportation (WVBT) will be hosting “Transportation Day at the State Capitol” on Monday, January 18. Plan to join with others interested in the future of West Virginia’s transportation system and show support for a long-term solution for the state’s roads, bridges and highways. Members are urged to gather at the state Capitol and meet with legislators to help educate lawmakers about the challenges facing transportation across the state. “We are expecting another great day…with a large number of organizations and companies participating in the 2016 event,” said Carol Fulks, WVBT’s Chairman. This is the fifth year that WVBT has organized this gathering. “We’ve invited Gov. Tomblin, Senate President Bill Cole, House Speaker Tim Armstead and the Transportation Committee chairs in both houses to speak to our group. I know that I am looking forward to hearing their plans for funding roads and bridges,” the chairwoman said. “We also will be unveiling the new “Fix Our Roads” campaign that will kick off January 18. The campaign will talk about the needs to maintain our roads and bridges.” NEW SECURITY AT STATE CAPITOL CAWV members are asked to arrive by 9:00 a.m. New security procedures are in place and visitors will have to go through a metal detector. Only two entrances are open to the public. One is the East Wing Entrance on California Avenue at the door closest to Washington Street. The second is the West Wing Entrance at the door directly across from the Culture Center. The program will begin at 10 a.m. The good news is that January 18 is a state and federal holiday so there may be less people trying to enter the Capitol that day. After the presentations, members are asked to visit their legislators to talk about the impact the lack of highway funding is having on their companies and their employees. Since it is a holiday, WVBT will be the main attraction at the Capitol. Companies and organizations wishing to exhibit will have prime space. There is no cost to exhibit, but pre- registration is required (these are available on a first-come, first reserve basis). A registration form is attached to this week’s Newsletter for those interested in attending or exhibiting. For additional information, call the CAWV at (304) 342-1166. RESIGNATIONS DOT THE LEGISLATIVE LANDSCAPE New legislators will be named before the start of next week’s legislative session as a number of veteran lawmakers recently announced their resignations. Senator Daniel Hall made news in 2014 when he switched his party registration from Democrat to Republican to give Republicans an 18-16 majority and control of the West Virginia Senate. He announced that he is leaving the Senate to accept a position with the National Rifle Association. A number of pundits and lawyers have weighed in on whether the position should be filled by a Democrat since Sen. Hall was a Democrat at the time of the election or whether a Republican should be appointed since we was a

Republican when he resigned. Many think no matter what party the governor appoints to fill the position a challenge will be made to the West Virginia Supreme Court. Amanda Pasdon, R-Monongalia, cited health reasons for her decision to give up her House of Delegates seat and chair of the House Education Committee. Delegate Paul Espinoza, R-Jefferson, who previously announced he would run for Senate in the 16th District will now run for reelection in the House after being appointed Education Committee chair by Speaker Tim Armstead. Linda Good Phillips, D-Wyoming, is resigning, as is Harry Keith White, D-Mingo, former House Finance Committee Chairman and House Majority Leader. Senator David Nohe, R-Wood, resigned earlier and has been replaced by Del. Bob Ashley, R-Roane. Del. Larry Williams, D-Preston, resigned and was replaced by Steven Shaffer. The 2017 Legislature will see newcomers as four senators have already announced they will not seek reelection, including Senate President Bill Cole and Senate Minority Leader Jeff Kessler who are running for governor. Twelve delegates are either retiring at the end of this year or are giving up their seats in order to run for other offices, including Senate, Auditor and Secretary of State. Senator Kent Leonhardt is running for Agriculture Commissioner but he is in the middle of his four year term. If he is not successful in his campaign, he will continue to serve his term in the Senate. In related issues, Booth Goodwin announced his resignation as U.S. Attorney for the Southern District of West Virginia to run in the Democratic primary for Governor. He joins Senate President Jeff Kessler and Greenbrier Hotel owner Jim Justice in a three-way race. Secretary of Administration Jason Pizatella chaired his last meeting Wednesday of the West Virginia Infrastructure Council. He has announced his is retiring to run for the position of State Auditor. CAWV LEGISLATIVE BULLETINS AND ALERTS TO BEGIN JANUARY 18 Starting Monday, January 18, members will receive, via e-mail, the CAWV Legislative Bulletin. It will contain up-to-the-minute information on issues affecting the contracting industry and association members. The Legislative Bulletin will not be included with the weekly Newsletter. The 2016 legislative session kicks off Wednesday, January 13. In addition to the Monday morning Legislative Bulletins, the CAWV will be sending out Legislative Alerts throughout the coming weeks to members via email. Members will also find requests to send letters through the CAWV’s Legislative Action Center, powered by BIPAC. When necessary, the CAWV will provide members with a letter template, and with just a few clicks, a personalized letter or email can be sent. BIPAC also provides a “Find Your Legislator” feature, election information and a refresher on government. Members will be encouraged to contact their senators and delegates on key legislative issues, and instructions on how to do so through BIPAC will be included in Legislative Alerts. CAWV WELCOMES RENA MOLES The CAWV is pleased to announce that Rena Moles has joined the staff as Staff Assistant to both the CAWV and the West Virginia Construction and Design EXPO. Her knowledge and experience of the construction industry will be beneficial to the association, as she has worked with CAWV firms Rudd Equipment Company and Walker Machinery Company for nearly 20 years. “We are pleased that Rena has joined the CAWV family,” said CAWV Executive Director Mike Clowser. “She brings attributes to our staff that will be of great benefit to our members and our organization.” Members are encouraged to call Rena at 304-342-1166 and welcome her to the Association.

CHANGES NOTED ON SCHEDULE OF EVENTS PAGE Members will note a few changes in this week’s Schedule of Events page. The Bid Date, Project Name and Contact information on each project remains the same. Added is “Document Location” which will show where plans and documents can be obtained. The “Bulletin” section will show the date and specific bulletin in which the original notification was published. This section will also note which bin in the CAWV Plan Room the plans are located. The Schedule of Events will also note if plans are available in paper, disc or digital form. The CAWV will no longer be putting an iSqFt tracking number on a project (the number on the far right such as 2547729). The changes stem from a new arrangement with iSqFt, the internet plan room services company that the CAWV has partnered with since 2005. CAWV members who subscribe to iSqFt will continue to get project information directly through iSqFt as they have in the past. The CAWV will continue to operate our project information and plan room, just as we have for over five decades. Rena Moles will be assisting CAWV Plan Room Administrator Cheryl Clark in working with owners, architects and engineers in obtaining bidding information on building, heavy/highway and utility construction projects. Architects and engineers will continue to send plans and specs for inclusion in the CAWV Plan Room. Architects and engineers will continue to schedule prebid meetings by contacting Cheryl at 304-342-1166 or [email protected] Members are welcome to review plans in the CAWV Plan Room. Members can use the computer and monitor in the Plan Room if documents are only available in disc or digital format. For new members of the CAWV, the Plan Room is accessible to members 24 hours a day, seven days a week, via a combination lock on the Plan Room door. Anyone needing the combination in order to view plans and specs when the CAWV office is closed, please call Cheryl Clark or Rena Moles. WEST VIRGINIA INCREASES MINIMUM WAGE FOR SECOND YEAR IN A ROW Starting January 1, 2016, West Virginia’s lowest-earning workers received a pay raise, as the state’s minimum wage increased from $8 to $8.75 an hour. The last increase was included in a 2014 law, which raised the wage in January 2015 from $7.25 to $8 an hour. Prior to the 2015 change, West Virginia hadn’t seen an increase in the wage since 2008. The Mountain State was one of 14 states to see the minimum wage raise on New Year’s Day. Seven Common Accident Causes Consider this statistic: 80 out of every 100 accidents are the fault of the person involved in the incident. Unsafe acts cause four times as many accidents and injuries as unsafe conditions. Accidents occur for many reasons. In most industries, people tend to look for "things" to blame when an accident happens, because it's easier than looking for "root causes," such as those listed below. Consider the underlying accident causes described. Have you been guilty of any of these attitudes or behaviors? If so, you may have not been injured…but next time you may not be so lucky. 1. Taking Shortcuts: Every day we make decisions we hope will make the job faster and more

efficient. But do time savers ever risk your own safety, or that of other crew members? Short cuts that reduce your safety on the job are not shortcuts but an increased chance for injury.

2. Being Over-Confident: Confidence is a good thing. Overconfidence is too much of a good thing.

"It'll never happen to me" is an attitude that can lead to improper procedures, tools, or methods in your work. Any of these can lead to an injury.

3. Starting a Task with Incomplete Instructions: To do the job safely and right the first time you

need complete information. Have you ever seen a worker sent to do a job, having been given only a part of the job's instructions? Don't be shy about asking for explanations about work procedures and safety precautions. It isn't dumb to ask questions; it's dumb not to.

4. Poor Housekeeping: When clients, managers or safety professionals walk through your work

site, housekeeping is an accurate indicator of everyone's attitude about quality, production and safety. Poor housekeeping creates hazards of all types. A well maintained area sets a standard for others to follow. Good housekeeping involves both pride and safety.

5. Ignoring Safety Procedures: Purposely failing to observe safety procedures can endanger you

and your co-workers. You are being paid to follow the company safety policies-not to make your own rules. Being "casual" about safety can lead to a casualty!

6. Mental Distractions from Work: Having a bad day at home and worrying about it at work is a

hazardous combination. Dropping your 'mental' guard can pull your focus away from safe work procedures. You can also be distracted when you're busy working and a friend comes by to talk while you are trying to work. Don't become a statistic because you took your eyes off the machine "just for a minute."

7. Failure to Pre-Plan the Work: There is a lot of talk today about Job Safety Analysis. JSA's are

an effective way to figure out the smartest ways to work safely and effectively. Being hasty in starting a task, or not thinking through the process can put you in harms way. Instead, Plan Your Work and then Work Your Plan.

FEEDBACK REQUESTED: 811 NEEDS CONTRACTOR INPUT AGC of America is conducting a survey on behalf of the Common Ground Alliance (CGA), the national association representing the underground utility industry and the 811 Number. If you have ever called before digging, we ask that you take one minute to provide feedback that will directly impact the evolution of the 811 Call Before You Dig effort. The 811 “Call Before You Dig” campaign reminds homeowners and professional contractors of the steps required to mark underground utilities before any digging begins. Currently, the campaign stresses that one call, to the national 811 telephone number, is all it takes to start the process. However the use of mobile, online and other platforms to access 811 services, the “Call Before You Dig” message may need to be evolved. In 2016, CGA will debut a new tagline that better represents current and future practices. FIRST SIX MONTHS OF HIGHWAY REVENUES LAG LAST YEAR’S NUMBERS Total revenues for the State Road Fund revenues for the first six months of the fiscal year are slightly ahead of estimates but are running below actual collections for the same period last year. Through December 31, 2015, the State Road Fund collected $359.6 million, or 5.3% above the governor’s $341.5 million estimate. However, actual 2015 collections for six months were $375 million which is $15.3 million more than this year. Gas tax collections from July to December totaled $215.3 million, down $11.3 million from the same time frame the previous year. Registration fees collections are $37.7 million, $7.2 million down from last year’s figure. The Privilege Tax generated $106.6 million, $2.8 million above last year. Gas tax revenue is expected to be down since the gas tax on the wholesale price of gas dropped 1.4 cents per gallon, effective January 1. The wholesale gas tax dropped 1.1 cents per gallon in 2015 due to the reduction in the price of gas. The 1.1 cents represented about a $15 million loss of gas tax revenue in 2015 and this year’s 1.4 cents drop equals about $23 million. This represents a nearly $40 million loss of gas tax revenue over the past two years. Other states whose gas tax is based on the price of gas have also seen a drop in their road revenues. We want to, again, remind contractors that they need a new Digital ID in order to bid on WVDOH projects in 2016. Expedite is out! Bidders now need to download Project Bids software and register for a new Digital ID. The DOH will NOT be deferring any jobs due to a bidder claiming he was not aware of the changeover in bidding software. In fact, the WVDOH and InfoTech are reportedly contacting former Expedite users to advise them of the new requirement. To date, about 30 percent of former Expedite users have secured a new Project Bids Digital ID. A current Prequalification is required to complete the registration process. HIGHWAY NEWS IN OTHER STATES The state of Pennsylvania awarded in 2015 highway and bridge contracts worth more than $2.5 billion, almost double what was done two years ago prior to the Pennsylvania General Assembly increasing funding for PennDOT’s program. New Kentucky Governor Matt Bevin this week ordered a $112.5 million reduction in the Kentucky Transportation Cabinet’s budget for this fiscal year to offset an estimated shortfall in road fund revenues. The bulk of the cuts – nearly $62 million – are budget-balancing measures required by law and affect a revenue-sharing program that doles out money to counties and cities for smaller road projects. An additional $22.8 million will be slashed from the cabinet’s highway budget. Transportation Cabinet spokesman Ryan White told reporters that the state hasn’t yet determined how it will enact the cuts to its highways budget. He suggested some projects in the design and utility relocation phases could be slowed. WVDOH / FHWA ENCOURAGE CONTRACTOR PARTICIPATION IN BIKE SUMMIT On January 24th & 25th, 2016 the non-profit organization West Virginia Connecting Communities

is hosting a first of its kind Bicycle Summit in Charleston. West Virginia Connecting Communities is a non-profit organization working through education, outreach and advocacy to support the use of transportation alternatives in West Virginia. The mission of the organization is to “…support pedestrian and bicycle safety, transit, high volume occupancy automobile use, and development of complete streets leading to the improved overall well-being of residents.” The purpose of this conference is to improve communication and cooperation between cyclists and policy offices, increase awareness of cycling safety, and discuss how to make West Virginia a more cycling friendly state. It is anticipated that cyclists, highway engineers, planners, bike shop owners, cycling clubs, the wellness community, local business leaders, wellness coordinators, tourism & economic development officials, mayors, members of city councils, county commissions, legislators, and consulting engineers will all be represented at the meeting. The FHWA Division Office, with assistance from the Office of the Secretary and FHWA HQ, is actively participating in the planning for this event.
