I would like to draw your kind attention to thecondition of Pensioners drawing pensions from PostOffices in North Bengal after DEMONETIZATION.

The aged pensioners both males & females,are going to the post office counters every monthrequesting payment of their due pensions. But,none of them is getting any amount at the firstapproach. That, on 2nd or 3rd approach, either theyare paid a meager amount of Rs.2000/- to 3000/-or issued a cheque of a limited amount. Then, thepensioner is required to rush to the Bank wherehe/she has Accounts and deposit the cheque. But,no payment is made on the date of deposit on plea

CONDOLENCE MESSAGE

Bharat Pensioners Samaj expresses its deep grief on the untimely demise of its veteran VicePresident late Shri M Somasekhara Rao in the late hours of 26th February, 2017.

 Late Shri M Somasekhara Rao  was associated with BPS for the last over one and a half decades.Besides being Vice President (South Zone) of BPS, he was holding charge of Central Govt. Pensioners’Forum, Hyderabad. He was a great orator and talented organiser and versatile leader of Pensionersat the zonal and National Level. His passing away at this juncture is a great loss to the PensionersFraternity. Though late Shri Somasekhara Rao has left for his heavenly abode, Bharat PensionersSamaj and Central Govt. Pensioners Forum, Hyderabad including their associates & affiliates willalways remember his meritorious services rendered to pensioners with nostalgia. Even when he wasin service, he was fully committed to the service and welfare of his fellow railwaymen with his dedicatedwork. He was a prominent Trade Union Leader particularly in the whole of South India. Despite oldage problems, he had been very actively moving around and remaining in constant touch with affiliates/associates of CGPF Hyderabad and putting his best foot forward to resolve issues of the pensioners.In his death, Bharat Pensioners Samaj in particular and Pensioners Fraternity at large have lost agem of the gems. He has left behind him imprint with indelible ink and will always live in our hearts.He attended the last AGM of Bharat Pensioners Samaj on November 13th, 2016 at Mavlankar Hall,Constitution Club, New Delhi preceded by the meeting of BPS Managing Committee on November12th, 2016 and gave valuable suggestions on issues relating to pensioners. BPS assures that itwould do its best to get these resolved.

Bharat Pensioner Samaj conveys its sympathies to Mrs M Somasekhara Rao, all other membersof the family and kith & kin and prays to Almighty to grant strength to all of them to bear the brunt ofthis irreparable loss. May the departed soul Rest in Peace.

Details of Managing committeemembers of Bharat Pensioners Samaj :-

for Representing Pensioner’s Grievances-Casual approach by administrativeOfficers especially those in Railways

The following forums are provided forredressing Pensioners grievances. It is observedby Bharat Pensioners Samaj that not a single forumis helpful in getting positive results as per directiveslaid down for the respective forum:

1.) The CPENGRAMS provided on Pensioner’sportal for Pension Related matters : The verypurpose of quick redress & efficient monitoring ofpensioners grievances is getting defeated becauseof up-loading of incorrect reply. The genuine,tenable & legitimate grievances of aggrievedpensioners are being unilaterally closedwithout giving opportunity to contest same byaggrieved Pensioner with reference to extent rules.Moreover, the attachments to the reply seldomopen. Further action taken on feedback is neverintimated to the aggrieved pensioner.

2.) The Provision of Redressing Pensioners’Grievances through SCOVA: There is hardly anyscope  due to  the exclusion of All India Federationslike Bharat Pensioners Samaj New Delhi & AIFPAChennai with  membership of several lac fromdifferent disciplines of C.G pensioners andinclusion of small local associations without anybasic infrastructure & membership of few hundredof local pensioners and SCOVA losing its represen-tative character. Agenda items suiting the administ-ration only are included and it meets only for about2 hrs twice a year. There is no machinery to monitorimplementation of decisions taken therein by theconcerned Ministry or otherwise. In this connection,Bharat Pensioners Samaj would like to draw yourkind attention to the decision of SCOVA taken onthe feedback of Railway Ministry against itemNo.6.13 (ii) of minutes circulated vide OM.No.42/1/2013-P & PW(G) dated 06.02.2013 which till-datehas not been implemented. More so, Ministry ofrailways has not even circulated it to the ZonalRailways.

3.) The conducting of Pension Adalats onDivisional/Zonal Railways: The Pension Adalatsconducted on Divisional/Zonal Railways are notfunctioning as per policy guidelines circulated videOM.No.44013/2/2010-coord dt. 25.02.2011 nor in

Sub: Deplorable condition of Medical Services

in N. F. Railway.

Undersigned is pained to draw your kindattention to the prevailing deplorable condition ofMedical Services in N.F. Railway causing a greatfrustration and grave concern among the Railwaypensioners availing Railway Medical facilities underRELHS.

4.) The Recently Introduced “NivaranPortal” by Railway Minister for RedressingRailway Pensioners Grievances: This is a newlyintroduced portal for online redressal of RailwayPensioners grievances by the Hon. Minister ofRailway vide their letter No.2016/ED/ ERP/Nivaran/II dated 20.05.2016 & 10.06.2016. Followingproblems are being encountered.

i). There is a compulsory field to record AddharNo. But in North east states of NF Rly, in theState of Chattisgarh and J&K Aadhar cardshave not been issued till now;

ii). When Aadhar No is recorded it gives error as‘value must be an integer number’;

iii). Text of Grievances is being forwarded toconcerned authorities for redressal  without theinclusion of details of the aggrievedcomplainant recorded in the format providedon the portal resulting in the closure of thegrievance for want of information about theaggrieved;

iv. Arpan http://arpan.railnet.gov.in/Arpan home.html) For registration on this Portal either PPONo or PF No is required. It does not accept oldNos such as CR/10306/117105 and the oldpensioners have not been issued New PPONos/PF Nos. Thus old pensioners are unableto register and use the Portal for their benefit.This is defeating the very purpose for whichportal Árpan’ has been launched.

BPS shall be grateful if you could consider rectification of the above issues at the earliest.

1. Existing Railway Hospitals:

(a) Except the Maligaon Central Hospital, allother hospitals viz at DBRT, LMG, BPB, NBQ, NJP,KIR & NTSK need immediate StructuralRenovation of both Outdoor and Indoor ofOperation Theatres, Maternity wards, Cabins,Kitchens, Toilets, Watering and Sanitary system;

(b) Doctors and Medical staff : These Hospitalsare to serve a large number of patients, bothserving and retired railwaymen and their familymembers. But, everywhere there is acute shortageof general physicians and specialists as well astrained medical staff;

(c) Dilapidated COTs with worn out and dirtybeddings, blankets etc. are every day experience.

Hence, Bharat Pensioners Samaj demand that:

(i) All the above Railway Hospitals be thoroughlyRENOVATED. Damaged wash basins, latrinepans, commodes be replaced and kept cleanregularly;

(ii) Operation theatre, ICU, Eye clinics etc. to beprovided with modern type of equipment;

(iii) BOS be updated, hospitals be provided withsufficient number of Regular Doctors andspecialists (viz. concerning Diabetics,Orthopedics, ENT, Eye etc.);

(iv) All the Contractual Doctors be absorbed inRailway as permanent ones and given equalstatus as that of their regular Counterparts; and

(v) Bedsheets, blankets to be of good quality andusable.

2. Independent Health Units- (At MXN, MAL,

COB, KGN, KNE etc.):- Most of the said HealthUnits isolately situated at long distances apart fromRailway Hospitals are suffering from shortage ofDoctors, Medical staff, Medicines and eveninadequate Imprest Money.

Bharat Pensioners Samaj ( Federation ofPensioners Associations), therefore, demand that:-

(i) All the said Health Units be upgraded to havepermanent physicians, housed nearest to thesame.

(ii) Each Health Unit to have at least 2 beds forEmergency treatment.

the Head Quarters and the said Books issued toall the RELHS Card Holders of entire N. F. Railway.

6. Tie-up with Private Hospitals in case of

Emergency:- As most of the existing RailwayHospitals do not have sufficient infrastructuralfacilities, specialist and Doctors have to face manyproblems in Emergent situations. To overcomethis,TIE-UP with some nearby Private Hospitalsof Repute may be done and this process becontinued with minimum period of “Break”.

To keep off Monopolization and misuse ofcondition of Contract, “Tie-Up” should be made withmore than one of such Private Hospitals.

7.Cashless Treatment Scheme In

Emergency (CTSE): The Railway Board, vide theirLetter No. 2014/H/28/1/Smart Card/Part’A’Dated:14-07-2016, have circulated the said“Scheme” for Phase wise implementation.

It is claimed that, “the underlying Philosophythat the scheme is to give social security to theelderly group of people who had served Railwaysin their youth.” That the scheme will “WorksSeamlessly on pan India basis” as “Additional”,without curtailing the existing facilities eligible forRELHS beneficiaries.

All these are very good gestures. But, tocharge Additional FEES of Rs.50,000/-, 25,000/-or 10,000/- according to entitlement and Rs.10,000/-, 5000/- or 2000/- as instantaneous DEPOSIT tothe empanelled Hospital at the time of conditionalAdmission, as well as, to pay a sum of Rs.200/-per members for CTSE Card, will not at all makethe scheme attractive for RELHS Card- holders,who have already paid their one month’semoluments or double of last basic Pension forthe same.

Cashless to be cash free:

It is also most unfortunate that before circulationof the scheme, none of the Railway Pensioners’Associations including “BHARAT PENSIONERSSAMAJ” was consulted.

Bharat Pensioners Samaj, demand that the ex-parte decision on CTSE be reviewed and finalizedafter holding a thorough discussion with BharatPensioners’ Samaj and other sister organizations.

(iii) Regular supply of Medicines to be ensured andImprest Money to be increased judicially,keeping pace with the Market Ratesofmedicines.

(iv) Every Health unit should have one Ambulance.

3. Supply of Medicines, Imprest Money and

Local purchase:- The process of procurement ofMedicines by the Central office and subsequentsupply of the same, as per requisition, to thedifferent Hospitals seems to be cumbersome andlengthy. Right medicines are not available at theright times. On the other hand it appear that handsof CMS are tied up with stringent restrictions.

Bharat Pensioners Samaj (Federation ofPensioners Associations) therefore , demand that:-

(a) There should be continuous flow of supply ofMedicines from the Central Hospitals to theother Hospitals as per Requisition within theshortest period of time; and

(b) Power of local purchase to be relaxed. Amountof Imprest Money to be increased rationally tocope up with the local needs.

4. A full-fledged Hospital at Agartala:- Weare happy to observe that the N. F. Railway hasbeen extended to Agartala and then to Udaypur inthe State of Tripura.

It is also known to all that hundreds ofRailwaymen, after their retirement, have settled indifferent part the State. But, Railway Administrationhas not yet considered to provide MedicalAssistance even to the serving Employees in theseparts.

Bharat Pensioners Samaj , therefore, demandsetting up of a full fledged Hospital at Agartala andHealth Unit at Dharma Nagar.

5. Health Books to RELHS Card Holders:The CMS/NJP, vide his Notification dated 15-12-2016 asked the,“Retired Railway Beneficiaries” tofurnish copies of some “Documents” such as PPO,RELHS Card, Pension Payment Slip from Bank,etc. with a view to issue separate “Health Books”to each eligible member. Similar Health Books arebeing issued in Eastern Railway and seemed tobe very much helpful. Bharat Pensioners Samaj,request that, the above practices be regulated from

The old pensioners desirous of joining CGHSnow, on opening of a new center at the place oftheir residences or their shifting to a place whereCGHS facility is available for some familycompulsions, may not find it financially viable tosubscribe at the new rates especially shelling outsubscription for ten years to become whole lifemember effective from February 1, 2017. Para5(v) of memo dated January 9, 2107, underreference, reads, “Any pensioner / familypensioner who is entitled to avail CGHS facilityhas not so far got his/ her pensioner CGHS cardmade, the rate of contributions in such cases willbe with reference to the level of pay that he/shewould have drawn in the post  held by him /her (atthe time of his/her retirement /death) had he/shecontinued to be in service now but for his / herretirement / death.Sir, a middle level pensionerretired in February, 1994 from the pay scale ofRs. 3000-4500/- (level 11) has till now got anincrease in his pension to the tune of 9.24 timesagainst which his subscription to CGHS now atthe new rates contained in memo of January 9,2017  is hiked by 108.33 times i.e. Rs. 78,000/-now against Rs. 720/- subscribed in 1994.  Anillustration, in support of this with full calculations,is attached as an annexure and may kindly beglanced through.

4.  Bharat Pensioners Samaj requests you tocome to the rescue of old pensioners and advisethe Ministry of Health& Family Welfare to reviewthe new rates prescribed keeping in view thefinancial viability vis-a-vis rising cost of living andnot depriving old pensioners of availing the facilityat a stage when it is made available to them bythe GOI. OPTION – I FOR PRE-2016 PENSIONERSREJECTED: In the meeting held on 30-06-2016, withGroup of Ministers by JCM staff side, the FinanceMinister had also clarified that Government has takenthe decision to implement the recommendation of7th CPC to bring about parity between past andpresent pensioners (Vide NJCA Statement issuedon 06-07-2016). Finance Minister categoricallyassured the NJCA leaders on 30-06-2016 that theGovernment has accepted the recommendation intoto and Pension department has only been askedto sort out the difficulties in implementation of Option-I, if any. NJCA wrote to Finance Minister on 16-07-2016, as follows:

“The issue of acceptance of Option-I and II wasdiscussed with your goodself at the residence ofHon’ble Home Minister (Govt. of India) whereinHon’ble Minister for Railways and Hon’ble MoSRailways were present. You had categorically agreedour demand that no dilution would be made in theoptions given to the Pensioners by the 7th CPC. It isunfortunate that a rider “subject to feasibility” has beenimposed on Option-I. Sir, this is very unfair and wewill appreciate, if you kindly get the sentence “subjectto feasibility” removed from that order, to keep yourpromise also”. But, Finance Minister had gone backfrom his assurance to JCM Staff side leaders and he

refused to withdraw the condition “subject tofeasibility”.

In the letter dated 17-10-2016, addressed toChairman of the “Pension Option-I Committee”, theSecretary, JCM staff side requested as follows:

“The attempt therefore must be to explore theways and means of implementing the saidrecommendation which is beneficial to a large numberof pensioners, especially those retired prior to 1996.In view of this, the staff side is of the firm view thatthe Government issue orders for implementation ofOption-I as there is no room for stating that therecommendation is impossible to be implementedfor those who are benefitted by the said option”.

Finally NJCA wrote a letter to Hon’ble HomeMinister Shri. Rajnath Singh on 17-01-2017,requesting intervention. The letter reads as follows:

“The Central Government Pensioners numberingpresently more than the working employees areaggrieved of the fact that the one and the onlyrecommendation of the 7th CPC which was in theirfavour ie; Option-I have been recommended to berejected by the Pension Department to theGovernment”.

Inspite of all these, the proposal is submitted tocabinet to reject Option-I. This underlines the factthat unless NJCA revive its deferred indefinite strike,the Government will not allow Option-I to pensioners,as assured by Finance Minister.

Deductions under Section 80C

Section 80C of the Income Tax Act providesvarious provisions under which an individual canget deduction benefits up to Rs. 1.5 lakh.Employees’ Provident Fund (EPF), PublicProvident Fund (PPF), Sukanya SamriddhiAccount, National Savings Certificate and tax-saving fixed deposits are some of the investmentoptions that offer benefits under Section 80C. New Income Tax Rates And DeductionsApplicable From April 1, 2017

There are many exemptions available in theIncome Tax Act, which can substantially reduceyour tax liability. Rebate of up to Rs. 2,500 availablefor taxable salary up to Rs. 3.5 lakh for AY 2018-19.

Here are the new income tax slabs fortaxpayers:

Section 80C. An individual in 30 per cent taxbracket can save up to Rs. 15,450 of tax byinvesting Rs. 50,000 in NPS.

Deduction under Section 80D

One can claim deduction of Rs. 30,000 if he isabove 60 years of age, towards medical insurancepremium paid for self, spouse and children.

Deduction under Section 80DD

If a tax payer has dependent parents, spouse,children or siblings who are differently-abled, thenhe can claim deductions up to Rs. 75,000 forexpenses on their maintenance and medicaltreatment under this section. This deduction canincrease to Rs. 1.25 lakh in case of severedisability.

Deduction under Section 80DDB

Under this section, one can claim deductionfor treatment of certain diseases for self anddependents. The deduction can go up to Rs.60,000 if the tax payer is above 60 years of age

Is pension income taxed as salary income?

Yes. However, pension received from the UnitedNations Organisation is exempt.

Is Family pension taxed as salary income?

No, it is taxable as income from other sources.

If I receive my pension through a bank who willissue Form-16 or pension statement to me- thebank or my former employer?

The bank.

Are arrears of salary taxable?

Yes. However, the benefit of spread over of incometo the years to which it relates to can be availed forlower incidence of tax. This is called as relief u/s89 of the Income-tax Act.

Can my employer consider relief u/s 89 for thepurposes of calculating the TDS from salary?

Yes, if you are a Government employee or anemployee of a PSU or company or co-operativesociety or local authority or university or institutionor association or body. In such a case you need tofurnish Form No. 10E to your employer.

Is leave encashment taxable as salary?

Leave encashment received at the time ofretirement is exempt in the hands of theGovernment employee.

Are receipts from life insurance policies onmaturity along with bonus taxable?

As per section 10(10D), any amount received undera life insurance policy, including bonus is exemptfrom tax. However, following receipts would besubject to tax:

Any sum received under sub-section (3) of section80DD; or

Any sum received under Keyman insurance policy;or

Any sum received in respect of policies issued onor after April 1st, 2003, in respect of which theamount of premium paid on such policy in anyfinancial year exceeds 20% (10% in respect ofpolicy taken on or after 1st April, 2012) of the actualcapital sum assured; or

Any sum received for insurance on life of *specifiedperson (issued on or after April 1st 2013) in respectof which the amount of premium exceeds 15% ofthe actual capital sum assured.

* Any person who is –

i) A person with disability or severe disabilityspecified under section 80U ; or

ii) Suffering from disease or ailment as specifiedin the rule made under section 80DDB.

Following points should be noted in this regard:Exemption is available only in respect of amountreceived from life insurance policy.

Exemption under section 10(10D) is uncondition-ally available in respect of sum received for a policywhich is issued on or before March 31, 2003.

Amount received on the death of the person willcontinue to be exempt without any condition.

Operation Clean Money: everybody needs

to check their e-filing account

You need to respond within 10 days of gettingthis message from the I-T department. Even if youdid not deposit much money in your account, docheck your e-filing account. If you had deposited alarge stash of cash post-demonetization, chancesare that you have already got a message from theincome tax department. You need to respond within10 days of getting the message. But even if youhave not received any message and did not depositmuch money, do check your e-filing account to seeif there is bad news ahead for you. 

You could get a compliance notice if your high-value transactions are not in line with your incomeprofile. You could also get a notice because oftechnical errors, where a cash deposit was wronglyattributed to your Permanent Account Number(PAN). This means that every taxpayer needs tologin and check if there is any message from thetax department.

Deduction under Section 80E

According to the provisions of Section 80E, ataxpayer can claim deduction for interest paid oneducation loan for him, spouse or children. Thereis no upper limit on the amount of deduction.However, the loan must have been taken from afinancial institutional or approved charitableinstitution and for full-time higher education.

What should you do

Login into your e-filing account on the incometax department website https://incometaxindiae

filing.gov.in. Your username is your PAN number,and keep your password handy. Click the “CashTransactions, 2016” option from the drop down listunder “Compliance” section. If there is no cashdeposit-related compliance against your profile, itwill show the message: “Presently, you are notrequired to submit any response. You may checkagain later. Please ensure that your email andmobile is updated in the profile.” However, if youdid make deposits that are out of tune with yourpast returns, it will reflect the details of transactionsrelated to cash deposits between 9 November and30 December 2016. In such a case, you will befurther required to submit responses, which canbe done online.

How to submit responses

The response can be submitted in two steps.The first step is to acknowledge whether thetransaction information belongs to you or not. Foreach transaction, you can choose: “The accountrelates to this PAN” or “The account does not relateto this PAN”.

“There are possibilities that cash deposittransactions were wrongly credited against yourPAN,” said Sudhir Kaushik, co-founder and chieffinancial officer, Taxspanner.com, an e-filing andtax services portal. “In the past there have beeninstances where tax deducted at source (TDS) waswrongly credited against another PAN; suchmistakes could happen in these cases too. Butprobability is very low,” he added. So, if thetransaction information does not belong to you, youcan select the option: “The Account does not relateto this PAN.” Upon doing so, the message will read:“Your feedback will be sent to the informationsource for confirmation”. But if the transactioninformation belongs to you, you should select theoption: “The account relates to this PAN.” After thatyou will be directed to the next step where you canrespond about the details of the transaction.

First, you need to confirm that the amountmentioned in the transaction or deposit is correct.If there is a mismatch in what you deposited andthe amount against which the department is

seeking your response, you can mention thecorrect amount you had deposited in the bankaccount.

Explanation of deposit

Once you confirm the amount of moneydeposited by you in the bank account, the next stepis to give details about the deposited amount. “Onemust take utmost care while responding about thesource of deposited money,” said AmitMaheshwari, partner, Ashok Maheshwary &Associates LLP. Based on the information providedby the individual, the department will take furthernecessary action. If the deposited amount in thebank is from more than one categories (or out ofcash in hand), the details of each source andamount from it needs to be mentioned. If you claimthat the deposited cash was out of earlier incomeor savings, you may need to provide additionalinformation, which will be matched with yourincome tax returns filed earlier. If this is not in linewith the taxpayer’s profile or other availableinformation, the case may be selected forverification based on the risk criteria.

If cash is claimed to be out of receipts exemptfrom tax, such as agricultural income, gift, anddonation, further details need to be provided suchas name and PAN of the person who gifted ordonated. In the other three options you can mentionthat the cash deposited is received from anotherperson. Here you have to give a break-up of the:“Cash received from identifiable persons (withPAN)”, “Cash received from identifiable persons(without PAN)”, and “Cash received from un-identifiable persons”. But if someone mentions thesource of the cash as received from anotherperson—whether identifiable or not—it may attracttrouble. This is because the income tax departmenthas warned people against depositing others’money in their own account. “It may attractimplications of the benami property Act,” saidMaheshwari. “Under the Act, both penalty andprosecution can be initiated against such persons,”he added. While filing the responses, rememberthat the sum of all sources of cash deposits shouldmatch the total cash deposited amount. Besidesthat, you can also mention that the depositedmoney is disclosed or is to be disclosed underPradhan Mantri Garib Kalyan Yojana.

The noose tightens: How taxmen plan to

investigate suspicious cash deposits -

HIGHLIGHTS

The Central Board of Direct Taxes has crackeddown on 18 lakh people who made suspiciousdeposits of over Rs 5 lakh during the 50-daydemonetisation period, as part of its OperationClean Money. Here’s how taxmen are expected tofurther investigate these possible cases of blackmoney and tax evasion.

Individuals

1. Individuals are exempt from verification fordeposits of up to Rs 2.5 lakh (other than minors).No verification required for deposits of Rs 5 lakhfor those over the age of 70 years.

2. In case of cash receipts from exempt incomesuch as agriculture, officials will verify these againstearlier returns. They may also seek information onland holdings, etc.

3. IT may seek bank statements to cross-checkindividuals’ bank withdrawals.

4. Those claiming cash receipts from third partyas ‘gifts’, may be asked to pay tax.

5. No need for additional information for those inbusiness if cash holdings are lower than level atthe end of March 2016.

Businesses

1. Assessing officer will verify if cash transactionsare in line with normal practice by seeking data onmonthly sales, stock register entries, bankstatements.

2. Investigators will look at abnormal jump in cashsales during November-December 2016 and tallyit with sales history.

3. More than one deposit of scrapped Rs 500 and

Rs 1,000 notes closer to Dec 30 deadline maytrigger attention.

4. Non-availability of stock or attempts to inflatestocks by introducing fictitious purchases will alsoattract scrutiny.

5. Transfer of cash deposits to another entity oraccount which is not in line with earlier history mayinvite queries.

The undersigned is directed to refer to abovementioned DoP&PW OM and to state regardingits applicability to IDA Pensioners that Pensionrevision of IDA pensioners/ family pensioners (pre-2007) was done pursuant to wage revision basedon 2nd PRC recommendations w.e.f 01.01.2007as per DoT OM No. 40-17/2008-Pen(T)-Vol.IIIdated 15.03.2011. Para 4.2 of this OM specifiesthat the revised pension in no case shall be lower

than 50% of the minimum of the pay in the pay

scale corresponding to the pre-revised pay scale

from which BSNL pensioner had retired and thereis no mention of pro-rata reduction of minimumpension so arrived at on the basis of pensionershaving qualifying service of less than 33 years atthe time of retirement. Annexure-I of the OM alsomentions the minimum revised pensioncorresponding to each pre-revised pay scale.

2. Thus, it is hereby clarified that pro-ratareduction of the minimum revised pension (50%of the minimum of the pay in the pay scalecorresponding to the pre-revised pay scale fromwhich BSNL pensioner had retired) was notincluded in the pension revision order in respectof IDA pensioners vide DoT OM No. 40-17/2008-Pen(T)-Vol. III dated 15.03.2011. DoP&PW OM No.38/37/08-P&PW(A) dated 06.04.2016 bears no

relevance to IDA pensioners as it has been issuedin partial modification of DoP&PW OM No. 38/37/08- P&PW(A) dated 28.01.2013 applicable to CDApensioners.

3. It may be ensured that pension revision ofall pre-2007 IDA pensioners w.e.f 01.01.2007,carried out on the basis of DoT OM No. 40-17/2008-Pen(T)-Vol.III dated 15.03.2011, has beendone strictly according to the provisions containedin the said OM. In case of pensioners in respect ofwhom the revised pension has been fixed inaccordance with the para 4.2 of the said DoT OMat 50% of the minimum of the pay in the pay scalecorresponding to the pre-revised pay scale fromwhich BSNL pensioners had retired, no pro- ratareduction is to be applied even if they had qualifyingservice of less than 33 years at the time ofretirement.

Sub: Checking of tickets during Night Time inReserved Coaches.

Please refer to this office letter of even No.dated 25.08.2010 (Commercial Circular No. 78 of2010) on the subject quoted above. The matterhas been reviewed and the modified instructionson this account are as under:-

I. Checking staff should be suitably instructedthat tickets in reserved coaches should normallybe checked between 0600 hours and 2200 hours.

II. In case of reserved passengers ticketsshould be checked initially after passengers boardthe trains to begin their journey.

III. Bonafide reserved passengers whosetickets have already been examined and verifiedshould not be disturbed between 2200 hours and0600 hours without a valid reason. However, sincethe overall responsibility of not permitting anyunauthorised passenger in the coach lies with theticket checking staff, if any unauthorised passengeris found in the coach, this provision cannot be takenas a plea for the same.

IV. Checks can also be made between 2200hours and 0600 hours in the followingcircumstances:-

a) In case where train departs from originatingstation on or after 2200 hours; .

b) the passengers who .have to perform theirjourney between 2200 hours and 0600 hours;

c) where tickets have not been checked afterboarding.

However, care should be taken by the ticketchecking staff that the passengers are not undulydisturbed during the night time.

V. Reserved coaches can also be checkedbetween 2200 hours and 0600 hours in caseVigilance Department have any doubt/havesourced information about some suspiciousactivity/unauthorized carrying of passengers. Itmay, however, be ensured that it should be donewith the least inconvenience to the passengers.

2. It is also clarified that in the year 2010 thelast circular No. issued was 66 and the No. 78 tothe Circular referred to above was giveninadvertently and was not uploaded on the website.However, this circular has been uploaded on thewebsite with the remarks that no circular between67 and 77 were issued in 2010.

The undersigned is directed to say that it has beendecided that Anomaly Committees should be setup, consisting of representatives of the OfficialsSide and the Staff Side to settle the anomaliesarising out of the implementation of the 7th PayCommission’s recommendations, subject to thefollowing conditions, namely:

(1) Definition of Anomaly

Anomaly will include the following cases:

(a) where the Official Side and the Staff Side areof the opinion that any recommendation is incontravention of the principle or the policyenunciated by the Seventh Central PayCommission itself without the Commissionassigning any reason; and

(3)The Departmental Anomaly Committee may bechaired by the Additional Secretary (Admn.) or theJoint Secretary (Admn.), if there is no post ofAdditional Secretary (Admn.). Financial Adviser ofthe Ministry / Department shall be one of theMember of the Departmental Anomaly Committee.

(4)The National Anomaly Committee will deal withanomalies common to two or more Departmentsand in respect of common categories of

employees. The Departmental AnomalyCommittee will deal with anomalies pertainingexclusively to the Department concerned andhaving no repercussions on the employees ofanother Ministry / Department in the opinion of theFinancial Adviser.

(5) The Anomaly Committee shall receiveanomalies through Secretary, Staff Side ofrespective Council upto six months from the dateof its constitution and it will finally dispose of allthe anomalies within a period of one year from thedate of its constitution. Any recommendations ofthe Anomaly Committee to resolve the anomalyshall be subject to the approval of the Government.

(6) Cases where there is a dispute about thedefinition of “anomaly” and those where there is adisagreement between the Staff Side and theOfficial Side on the anomaly will be referred to and“Arbitrator” to be appointed out of a panel of namesproposed by the two sides. However, this arbitrationwill not be a part of the JCM Scheme.

(7) The Arbitrator so appointed shall consider thedisputed cases arising in the Anomaly Committeesat the National as well as Department level.

(8)Orders regarding appointment of the Arbitratorand constitution of Anomaly Committee at NationalLevel will be issued separately. All Ministries /Departments are accordingly requested to takeurgent action to set up the Anomaly Committeesfor settlement of anomalies arising out ofimplementation of the 7th Pay Commission’srecommendations, as stipulated above.

2. Taking into consideration the grievancesreported by Pensioners’ Associations andPensioners, CPAO had issued instructions toHeads of CPPCs and Government BusinessDivisions vide OM No. CPAO/Tech/BanksPerformance/2015-16/60 dated-14.06.2016 forstrict compliance of above guidelines for providingdetailed breakup of pension payments.

3. It has again been reported by Pensioners’Associations and Pensioners that “arrears of arrearof Revision of Pension, Fixed Medical Allowance,Additional Pension, Life Time Arrear etc. areclubbed with monthly payment of pension for whichit becomes difficult for pensioner/family pensioner

to understand if pension and arrears are disbursedcorrectly. Even recovery of overpayment or wrongpayment is not shown separately”.

4. Therefore, banks are instructed to follow theprovisions of CPPC guidelines and instructionsissued vide OM dated-14.06.2016 and provide fullbreakup of pension payment dearly to thepensioners. A compliance report in this regard maybe sent to CPAO latest by 31.01.2017 positively.

How to apply for granting family pension on thedeath of Government servant/ pensioner/ familypensioner.

What should a family member (eligible forthe grant of family pension) do to get the familyPension?

Normally, family pension to spouse issanctioned and authorized at the time pension isauthorized in favour of retiring government servantand indicated in the pension payment order and isto be drawn after the death of the pensioner.However, in cases where Govt. servant expiredwhile in service, the widow or widower has to applyin Form 14 (of CCS Pension Rules) to the Head ofOffice concerned who will sanction and authorizethe family pension through its Pay & AccountsOfficer. Where the deceased Govt. servant issurvived only by a child or children, the guardian(in case of minor child/children) or such child orchildren may submit a claim in Form 14 to the Headof 0ffice for sanction and authorization of familypension. For getting family pension, the deceasedpensioner’s family should apply in Form no.14along with a copy of the death certificate of thedeceased Pensioner to:

(I) The pension disbursing authority if, theamount of family pension is already indicated inthe Pension Payment 0rder.

(II) The Head of Office for sanction of familypension in all other cases.

SCOVA MINUTES

Minutes*

The 29th meeting of Standing Committee ofVoluntary Agencies (SCOVA) was held under thechairmanship of Hon’ble MOS(PP) on 12.01.2017.

The list of the participants is at Annexure-I(notpublished)

At the outset, Secretary (P&PW) welcomed therepresentatives of Pensioners Associations andthe participating officers from various Ministries/Departments.

2. Secretary (P&PW) said that some issues ofthe last SCOV A meeting have been resolved. Tworeview meetings were held with DefencePensioners Associations, SCOVA and Ministry ofDefence on 27.09.2016 and 20.12.2016 to resolveissues relating to Defence pensioners pending inSCOV A for a long time.

3. He said that this Department hasimplemented Government’s decision on therecommendations of the 7th CPC for revision ofpre-2016 pensioners/family pensioners etc. Thereis no change in the pension fixation formula forthose retired/retiring on or after 01.01.2016. Theminimum pension has been increased to Rs. 9000/-per month against the existing Rs. 3500/- permonth. The ceiling of gratuity has been increasedfrom existing Rs.10 lakhs to 20 lakhs per month.The rates of ex-gratia lump sum compensationbeing paid to the families of employees who die inperformance of duty has been increased fromexisting Rs.10-15 lakh to Rs.25-35 lakh, dependingupon the circumstances in which the death occurs.He further stated that approximately 85% percentgrievances have been disposed of by thisDepartment.

4. Thereafter, the Action Taken Report on thedecisions of the 28th SCOVA meeting and FreshAgenda Items of the 29th SCOVA meeting weretaken up for discussion.

5. Discussion on ATR of 28th SCOV A

meeting:-

(i) Revision of PPOs of pre-2006 pensioners.

CPAO intimated that the issue of revision ofthe remaining 3200 PPOs for pre-2006 pensionershas been reviewed with banks. The main reasonfor pendency is non-availability of records. CPAO

would prepare fresh list of live pending cases onthe basis on e-scrolls which would be provided tothe concerned Ministries/Departments to review thependency. The Ministries/Departments have beenasked to give certificates of non-availability ofrecords. The banks have also been asked to doKYC when the pensioners visit them for lifecertificate. CPAO also informed that they have notreceived any grievances in respect of non-revisionof these particular PPOs. Since CPAO hasexpressed reservation about the pending cases, itwas decided that CPAO would examine thesecases under Audit and treat the pendency as NIL,subject to outcome of Audit.

Ministry of Defence intimated that 2368 (2470)PPOs of Air Force pensioners have been revised.Some discrepancies have been noted which willbe resolved within a week. CGDA was requestedthat the list of cases be shared with the Directorateof Air Veterans (DAV) and with the Air ForceAssociation,New Delhi. DAV would tally the list withtheir records and revert back with the list of pendingcases. On the issue of PPOs of Ordnance Factory,Ambarnath, CGDA committed that the pendencywill be disposed of by first week of February, 2017.It was decided that DoPPW will hold a tripartitemeeting with Department of Ex-servicemenWelfare, Directorate of Air Veterans and DefencePensioners Associations of SCOVA.

Department of Telecom reported that one ofthe reasons for pendency of 203 cases was thatthe Maharashtra Circle did not have relevantrecords. The Department was asked to dispose ofthe pendency within a week. It was said that theactual revision of pension had been carried out forall cases, the review was only with reference toissue of revision authorities. The revisionauthorities would be pending only for thosepensioners/family pensioners who are nottraceable. Therefore, the matter was decided tobe closed. The Ministries/Departments wouldcontinue their efforts to attend to specificgrievances to trace old records and issue revisionauthorities at the earliest.

(ii) Health Insurance Scheme for pensioners

including those residing in Non- CGHS area.

Ministry of Health informed that the final EFCMemo is under submission to the Secretary. Theproposal covers Central Government civilemployees and pensioners only and that too forindoor treatment. OPD and appliances would notbe covered under the proposed scheme. DisabledWar Veterans (India) raised the issue of coveringprosthesis under this scheme and stated that thiswill facilitate rehabilitation. The Hon’ble MOS(PP)observed that the prosthesis of good quality arenow available. It was decided that Secretary(P&PW) will have a meeting with the Departmentof Empowerment of Persons with Disabilities andMinistry of Health and Family Welfare to discussthe question of covering prosthesis for CivilGovernment employees/pensioners under CGHS/Medical Insurance.

(iii) Special “Higher” Family Pension for

widows of the war disabled invalided out of

service.

Ministry of Defence has stated that thecomments of Service Headquarters on the issuehave been sought vide MOD ID Note dated10.10.2016 which are still awaited.

The Disabled War. Veterans (India)Association, stated that the cases would coverArmy personnel mostly and not Navy and Air Forcepersonnel. Department of Ex- servicemen Welfarewas requested to arrange a meeting of theconcerned Joint Secretary with the Disabled WarVeterans (India) to discuss and finalise the issuewithin a month.

It was decided that Secretary(P&PW) will writeto Secretary(ESW) to finalise the issueexpeditiously .

(iv) Extension of CGHS facilities of P&T

pensioners.

(ix) Conversion of Postal Dispensary at

Cantt. Road Cuttack to CGHS Wellness Centre

The Ministry of Health and Family Welfareinformed that the recommendation of 7th CPC in

this regard is under consideration of the“Allowances Committee” set up after 7th CPC.Department of Expenditure was requested to checkand confirm whether the issue is actually underthe purview of the “Allowances Committee”.DoPPW will independently seek clarification fromthe Implementation Cell, Department ofExpenditure

(v) Anomaly in fixation of pension of DoT

employees absorbed in BSNL retired between

01.10.2000 and 31.07.2001.

Department of Telecom informed that, asdesired by the Department of Expenditure, financialimplications on the formula suggested by DoPPWwas being worked out in consultation with BSNL.Meanwhile, CAT Principal Bench has allowed apetition filed by the BSNL absorbee pensioners forfixing their pension only on the basis of IDA paydrawn after absorption in BSNL. Department ofTelecom was requested to examine the judgementof CAT.

(vi) Merger of78.2% IDA with basic pension

benefit to absorbed BSNL pensioners.

Department of Telecom informed thatconsequent on approval of the Cabinet, thenecessary instructions were issued to theconcerned CCAs vide OM dated 18.07.2016.Therefore, the matter was closed.

(vii) Extension of benefit of upgraded Grade

Pay to pre-2006 retirees of S-12 grade (issue of

grant of grade pay of Rs. 4600/- instead of Rs.

4200/-)

Department of Expenditure has observed thatthe upgraded Grade Pay of Rs. 4600/- was givensubsequently outside the recommendation of the6th CPC. Since this up- gradation is post 6th CPCdecision, it is not applicable to those who areholding the pre-revised scale of Rs. 6500-10,500/- and retired before 01.01.2006. Department ofTelecom informed that the benefit of Grade pay ofRs. 4600/- to pre-2006 pensioners in pre-revisedpay scale of Rs. 6500-10,500/- is sub-judice.

(viii) Issues relating to CGHS Wellness

Centre, Dehradun- Merger of Survey of India

Dispensary in CGHS on the same lines as P&T.

Ministry of Health and Family Welfare informedthat the O/o Surveyor General of India hasconveyed that Survey of India dispensaries wereestablished as per the obligations under FactoriesAct. Therefore, their merger with CGHS on thesame lines as in the case of P&T dispensaries isnot possible. Ministry of Health and Family Welfarewas requested to examine as to how the provisionsof the Act come in the way of merger of thesedispensaries with CGHS, particularly when thedoctors in these dispensaries are also providedby Ministry of Health under CGHS. Ministry ofHealth and Family Welfare has stated that theyhave taken a decision to post 2 more contractualdoctors in the CGHS Wellness Centre, Dehradun.Ministry of Health and Family Welfare wasrequested to post doctors expeditiously.

(x) Stoppage of Recovery of wrongful/

excess payments from Railways Pensioners.

Ministry of Railways informed that the matter.regarding waiver of recovery and withdrawal of thepetition filed in the Court was submitted for theapproval of Railway Board and a decision was likelyto be taken in 3-4 days. The item was closed.

(xi) Delay in commencement of family

pension to spouse on death of pensioners .

CPAO intimated that the relevant instructionshave been issued on 02.06.2016. 12 Banks havereported timely commencement of family pension.However, CPAO will revert to the banks based onthe reports of the e-scrolls, Also internal audit ofthe banks at CPPCs are conducted to check thedelay. Secretary (P&PW) directed to circulate thecopies of instruction issued by CPAO. CPAO willsend a report on the delayed cases within a monthand DoPPW will take up the issue with theDepartment of Financial Services.

(xii) Payment of (i) Restoration of

commutation amount and (ii) Additional

Pension on attaining the age of 80 years should

be streamlined by the Banks.

CPAO intimated that the relevant instructionshave been issued on 02.06.2016. Secretary(P&PW) directed to circulate the copies ofinstruction issued by CPAO. CPAO will send adetailed report on the delayed cases within a monthand DoPPW will take up the issue with theDepartment of Financial Services based on thereport received from CPAO.

6. Discussion on Fresh Agenda Items

(29.1) Item wise details of payment made to

be shown in Pass Books of Pensioners.

CPAO intimated that instructions are in placeto indicate the break-up of various payments tothe pensioners at the time of payment of pension.All heads of CPPCs and Government AccountsDepartments of the banks have been instructed tostreamline their internal system to enforce theexisting guidelines. A “Web responsive PensionersService” (WRPS) was launched by CPAO whichenables the pensioners/family pensioners to seedetails of pension like monthly pension, DR,Medical Allowance, DA arrears, Commission/Otherarrears, recoveries etc. Secretary (P&PW) directedto send copies of relevant CPAO instructions tothe various Pensioners Associations and also totake up the matter with Department of FinancialServices.

(29.2) Amendment/Revision in notification

of Life Certificate.

It was clarified that Digital Life Certificate is anadditional facility. CPAO stated that there are 3options for submission of Life Certificate.-

(i) By presenting himself/herself to the authorisedbank officer to record the life certificate

(ii) By producing a Life Certificate in the prescribedProforma signed by any of the person specifiedin para 15.2 of the Scheme for payment ofpensions to Central Government CivilPensioners by authorised Banks.

Ministry of Health stated that there are 9empanelled hospitals in Ambernath/Dombivli. The14 enlisted hospitals in the fresh agenda do notsatisfy the criteria of minimum 40 beds forempanelment. The pensioners associationrequested if the above condition may be relaxedfor the empanelment of these hospitals.

7. In view of the large number of unresolvedissues relating to CGHS, it was decided that aspecial review meeting on Health issues will bechaired by Secretary (P&PW). The concernedAssociations would also be invited to participate.

8. Concluding the session, Hon’ble MOS(PP)

said that it had been a very meaningful andstimulating interaction, which is indicative of theefforts being made by the Department of Pension& Pensioners’ Welfare. Since the population ofretired people is steadily increasing, there is a needto put in place an institutional mechanism to makegood use of the knowledge, experience and effortsof the retired employees. He also stated that thepensioners are a healthy and productive workforceand we need to streamline and channelize theirenergies, thereby making pensioners a part ofnation building process. He expressed satisfactionthat approximately 88% of the pension accountshave been linked with the Aadhaar numbers andthat pensioners will now be able to benefit fromthe ‘Jeevan Pramaan’ initiative of the Government.

Relief to lakhs of Patients

The selling price of stents has been slashedby up to 85%. Prices of life-saving coronary stents-- a spring-like metal device used to prop openblocked arteries -- have been capped at Rs 30,000,which is a cost drop of about 85% from what iscommercially available.

The National Pharmaceutical Pricing Authority(NPPA) — the country’s top body that fixes pricesfor drugs - on Monday fixed the rates of bare metalstents and drug-eluting stents at Rs 7,260 and29,600 respectively. The move comes as a relieffor lakhs of patients who are forced to payinordinately high amounts for the device. Thereare massive margins charged at each step in thedistribution and supply of stents, and by the timethe patient gets it, the increase from the originalcost of the stent is often in the range of 1,000-2,000%. There has been a lot of criticism abouthospitals making huge profits on stents, which insome cases was as high as 650%.

“Hospitals now under legal obligation to billcardiac stents separately from ‘procedure’ or‘packages’,” tweeted NPPA india. Whilecardiologists largely welcomed the step, there isalso a fear about quality getting compromised inthe long run.

Ageing population

These are common stories among the growingcohort of elderly Indians, even more so among thedestitute population. While India still has ademographic distribution that is still relativelyskewed toward the youth, compared to developedcountries, its population is ageing fast. By someestimates approximately 20% of Indians will beelderly by 2050, defined as aged 60 years andabove, marking a dramatic jump from the 6% levelthat the figure is at now. Combined with the factthat we already have the second largest elderlypopulation in the world, such projections beg thequestion of how the country’s nascent infrastructureand traditional social values will cope with theenormous stress that is likely to come from theneed to provide for our senior citizens’ welfare. Ina sense our attitudes toward the elderly, which inmany cases deny them a life of dignity in theirtwilight years, pose as much a challenge as theeconomic conundrums of ensuring they receivequality healthcare and accommodation. Those whomove from the world of active work to a retired life,often with dependencies upon family members,face numerous uncertainties and sometimes aharsh reality of deprivation. Among them, seniorcitizens fortunate enough to have worked in theorganised sector receive pension and otherretirement benefits after retiring at between 60 and65 years of age, yet for the others the only succouris the nominal old-age pension coverage providedby the Government of India and StateGovernments.

We doubted ifshe would survive then,” said Uma Maheshwari, asupervisor at the home. During the first four monthsafter Govindammal moved in, her daughter-in-lawvisited once a month to collect her old age pensionof Rs. 1,000. But soon, when her pensions stoppedcoming in, so too did those purposeful visits.

“At least she came, the son never visited once,”says Ms.Maheshwari. In another corner of thehome, 80-year-old Velu Chettiar was busywrapping home-made semiya in small packets. Hewould go out and sell them door-to-door, makingRs.2 for every packet that he sold for Rs.10. The

the poorer sections amongst the elderly is theMinistry of Rural Development’s Indira Gandhi OldAge Pension Scheme. This ensures for belowpoverty line households, a monthly pension ofRs.200 is given for each person in the age groupof 60-79 years and Rs. 500 for those above 80years and above. Various other Government ofIndia ministries offer concessions and similarschemes that promote access to resources by theelderly, including the Ministries of Health andFamily Welfare, Finance, and Departments ofRevenue, Railways, and Civil Aviation. While mostof these initiatives look good on paper, reality cansometimes be less encouraging. In the Krishnagirihome around 11 of the 13 women and men in NewLife home were rescued from within a 3 kilometerradius of the main town, yet there is not onegovernment run home in the district. Genderdifferences can also cut both ways among theelderly in India. At the New Life Home Malliga, avolunteer, says that in many families the youngergeneration seems inclined to keep elderly mothersat home to take care of the grandchildren or dohousehold chores; yet they are less inclined to keepfathers. Paradoxically, women sometimes end upworse off because in many of the patriarchal-patrilineal families especially in rural areas, theresponsibility for care and nurture falls to thewomen of the family, which in turn has cast womenboth as victims and perpetrators of abandonment.As long as women’s leisure-less labour freed menof any such responsibility towards aged membersof the household, men’s workplaces and thegovernment establishment could afford to plod onin the same patriarchal modes. Yet as women’sroles have in recent years expanded outside ofhome-making there has not been an accompanyingrecognition that men would now have to play alarger role in caring for the aged than they used to,and that men’s workplaces and the governmentsubsidy systems would have to do more to supportthis.

Changing attitudes

Looking beyond these structural factors, anattitudinal shift may be necessary to mitigate theneglect, abuse and violence faced by the elderlyin India. These usually stem from the perceptionof senior citizens as not deserving of respect anddignity, as vulnerable targets for predation for

“The State sees them as destitutes, beggarsand not as senior citizens who were abandonedand in need of care.” says Revathi Mohan, thetrustee of Narendra Nambikkai Natchathiram, anintegrated home for children and destitute oldwomen in Hosur, about 57 kilometers fromKrishnagiri. Hence, these government-supportedhomes are not encouraged to rescue the pooramong the elderly, who inevitably get pushed tobeggary on the streets.

ORDER

The short issue to be decided in this OA iswheteher the applicant who was not a Member ofCGHS Scheme, can be given CGHS Pensionerscard for himselef and his wife. The applicant retiredas a Postman from Faridabad Postal Division on31.12.2011 after serving the department of postsfor 35 years. His application with all the documentsand demands draft was rejected by the repondent-2 stating that being a Postal pensioner who didnot have CGHS card while in service was notentitled for issue of CGHS pension card. Learnedcounsel for the applicant submitted that this issuehas already been decided by this Tribunal in acatena of judgments which have been upheld byHigh Courts. In this connection, he placed relianceon OA no.1198/2015, OA 372/2011,OA 2834/2015,OA 1020/2014, and OA 1512/2014.The learnedcousel further submitted that the respondents havepassed speaking order on 16.11.2015 stating thatthe applicant will be provided CGHS facilities alongwith his dependant family members on yearly basistill the administrative order is issued against thedisposed SLPs at Hon’ble Supreme Court by thecompetent authority. The applicant had been askedto submit his Pension Payment Order, last paycertificate, address proof etc. According to thelearned counsel this was against the spirit of theorders passed by various Tribunals and Hon’bleCourts. It has already been settled at the level ofHon’ble Supreme Court that the Postal employeesare entitled for CGHS coverage post retirementeven if they were not Members of CGHS while inservice.

2. The learned counsel for the respondentssubmitted that admittedly, there are various judicialorders directing the respondents to issue CHSpensioner card and the matter has been decidedby the Hon’ble Supreme Court also while disposingof many SLPs. However, administrative order inthis regard has not yet been issued. Therespondents No.3, therefore, is not in a position toissue CGHS pensioner card to the applicant onregular basis at present. As a via media theauthority has decided that the applicant will beissued CGHS card on yearly basis till such timethe requisite administrative order is issued.

JUDGEMENTS

3. I have considered the submissions madeby the learned counsel for the parties and perusedthe record.

4. From the judgments cited by the learnedcounsel for the applicant, it is clear that SLPsagainst the orders of the Tribunal/High Court havebeen disposed of by the Hon’ble Supreme Court.The Administrative Order following the disposal ofSLPs has not yet been issued by the respondents.The retired employee cannot be kept waitingindefinitely for the issue of administrative order. Atthe same time, learned counsel for the applicanthas not placed on record the outcome of thedisposed of SLPs by the Hon’ble SupremeCourt.Therefore, this Tribunal cannot issue anydirection at this stage for issue of a permanentCGHS pensioner card to applicant. Therespondents have already taken a decision to issueCGHS card on yearly basis vide order dated16.11.2015 till such time the administrative ordersare issued.

5. OA is, therefore, disposed of with directionto the respondents to issue temporary CGHSpensioner card for which the applicant has alreadybeen asked to submit necessary papers, within aperiod of one month from the date of this order.Further, the respondents cannot sit over thejudgment of Hon’ble Supreme Court indefinitelywithout issuing the requisite administrative order,and make that as ruse to circumvent the judgment.The respondents are further directed to issue theenabling orders to implement the judgment withinthree month from the date of receipt of a copy ofthis order. At the time of issuing permanent CGHScard to the applicant in pursance of the order ofthe Hon’ble Supreme Court, the fee charged forthe issue of yearly basis CGHS card, if any, will beadjusted against the fee liable to be paid by theapplicant for permanent CGHS card.

6. In view of the above order passed in OA,MA No.4037/2015 is disposed of as having becomeinfructuous.

Learned cousel for the applicant pressed hiscase with regard to issuance of permanent CGHSPensioners card to the applicant, who is a retiredsub Postmaster, NH-3, Faridabadand his wife, toenable them to get much needed medical treatmentin their old age. Applicant appeared before theAdditional Director (HQ), respondent No.2 to extendthe benefit of CGHS card, but was handed over acopy of Memo dated 01.08.1996 denying thebenefits of CGHS facilities.

2. The applicant is seeking quashing of theaforesaid Memo dated 01.08.1996 in view of theorder passed in OA No. 2834/2015, dated20.07.2016, which was disposed of with the followingdirections:-

“10. Accordingly, this OA is disposed of with thedirection to the respondents that they will issueappropriate orders in respect of applicant and hisdependent family members for issue of a permanentCGHS card as per decision in the aforesaid SLPwithin a period of three months and issue on yearlybasis CGHS card ad per their own order dated30.11.2015 to the applicant, if not already issuedwithin a period of one month. No costs.”

Similarly, on 22.12.2016, the following orderwas passed by the Tribunal:- “It is also pointed outthat in similar 50 cases, similar orders have beenpassed and he requested the case may be disposedof by directing the respondents to consider and passorders in the same vein. I also take note of theargument of the learned cousel for the applicant thatin case a full-fledged proceeding is initiated and thegamuts are followed, it will mean harassment to hisclient, in view of the order already passed.”

4. In view of the order passed in OA No. 2834/2015 quoted above, it is clear that the applicant andhis dependent family members are entitled for issueof a permanent CGHS card. Accordingly, the

settlement of her late husband. Rule 11 of RailwayServicePension Rules, 1993 is reproduced in thejudgment which deals with the eligibility of personsto whom gratutity is payable. In view of thisstand,Railways requested for dismissal of the case.

xxxxx The Tribunal called for the service Book ofthe deceased employee and also the familydeclaration form submitted by the late employeefrom time to time from the date of joining the service. The Tribunal also fined an amount of Rs. 10,000for submission of the records belatedly byRailways. Railway Respondents in addition to theabove details also filed DoP&T circular, dated27.11.2012 along with Railway Board Circular,dated 14.1.2013. The said circulars relate toeligibility of childeren from a void or voidablemarriage of family pension. The said OfficeMemorandum is reproduced for clarity: “Thus thechilderen from two legally void marriage of the lateemployee--One with the Applicant and the otherwith R-5 if their mothers are declared the guardian,the benefits according to the illegitimate childrenas per Railway Board’s Circular No. 1/16/1996-P&PW(E) (Vol.II), dated 27.11.2012 read withabove-quoted DoP&T will be dispensed throughlegally appointed guardian, whosoever they maybe inculding the Applicant/and or RespondentsNo.5.” Though the action was taken but not tological conclusion as the Applicant approachedlocal District Authority, Cachar, Silchar on26.08.2010 and hence the case is under litigation.Note, dated the 28th of May,2010 in the file throwsthe light on the issue and the reasons of delay inthe matterxxxx. The first page of the Service Bookshows that the deceased employee has signed hisService Book on 30th April, 1984. Hence, anydocument after that date acquires dubious nature.

It is clear as on 14.03.2016, the Railwayrecognized Smt.Chabi Rani Dey, R-4 herein as thewife and is to be provided the DCRG benefitsprotecting along with the interest of their legitimatechilderen. The relevent note of the office in the fileis reproduced for clarity. To that effect, the letteraddressed to R-5 is reproduced.

HELD : “ In view of the above details, it is clearthat the deceased employee has entered intomultiple marriage/conjugal relations and has leftbehind childeren from the first marriage as well as

The marriage of the Applicant herein, the thirdwife of the deceased, Shri Babul Chanda Dey,an ex-Railway employees is a void one but herchilderen are entitled to DCRG benefitsinculding family pension as per rule. In casethe Applicant does not comr out with theguardianship of her childeren then R-4, the firstwedded wife of the deceased employee and herchilderen should not suffer to get the benefit.

Facts: The applicant herein is the third wife of thedeceased employee of the Railways. Even thoughthe Applicant managed to get a legal heir certificateannexured, the form of declaration of the familymade by her deceased husband and the insuredamount under LIC policy, the Railways did not granther family pension and the DCRG benefits. TheRespondents took the stand that the Applicant isnot entitled for family pension and DCRG as sheis the third wife of the deceased. Smt.Chabi RaniDey is the first wife and Smt. Archana Dey is thesecond wife and the Applicant is the third wife. TheRailways stated that the first wife had a son, thesecond wife had a son and a daughter and thethird wife, the Applicant herein, had threedaughthers and also given the names of thewidowed mother and dependent brother of thedeceased. The main contention of the Railways isthat, the Applicant, being the third illegal wife ofthe ex-employee, she cannot get the family pensionand DCRG of the deceased employee. Hence theApplicant filed this OA to direct the Respondentsto release her share of DCRG, accumulation ofPF, etc., as per law. TheRespondents as statedearlier to pay her the requested share in the final

respodents are directed to issue a permanentCGHS card in respect of applicant and his wife, asper their own order dated 30.11.2015 immediatelyas applicant is a pensioner. They shall do so, withina period of 6 weeks to the presenting of the copy ofthis order to them, along with the representationpreferred by the applicant.

5.The OA is hereby allowed. No costs.

ORDER (ORAL) 

2. The applicants, all retired from service priorto 01.01.2006 in S-24 scale of pay filed the O.Aseeking the following reliefs :-

(i) Call for the records of the case;

(ii) Direct the Respondent to apply the ratio of All

India S-30 Pensioners Association Vs. UOI inOA No. 937 of 2010 with OA No. 2101 of 2010delivered on 20.11.2014 and in the RA/10/2015in OA No. 937 of 2010 dated 24.09.2015;

(iii) Direct the Respondents to fix the pension ofeach of the Applicants at Rs.37850/- thusextending the benefits of Full parity as has beengranted in the case of S-30 Association by CAT(PB), New Delhi; and/or;

(iv) Direct the Respondents to grant higher NFU inSAG to the Applicants as permissible andrevise their pension accordingly;

(v) Direct the Respondents to grant NotionalPromotion to the post of DDG in the Grade Payof Rs.10000/- with retrospective effect and fixtheir pension accordingly;

(vi) Grant Notional promotion after 13 years ofGroup “A” service and notional incrementsthereafter till retirement and to arrive at thenotional pay with those increments w.e.f.01.01.2006, and to fix consequent pension andpensionary benefits accordingly. Grant anyother relief which the Hon’ble Tribunal maydeem appropriate for the benefit of theApplicants.”

3. When this matter is taken up for hearingtoday, it is noticed that the applicants have notmade any specific representation either individuallyor through any Association ventilating their exactgrievances to the respondents before filing the O.A.

In the circumstances, the O.A is disposed ofwithout going into the merits of the case bypermitting the applicants to make a proper andspecific representation ventilating their grievances,by enclosing the copy of the judgment in All IndiaS-30 Pensioners Association Vs. Union of India inO.A No. 937 of 2010 with O.A. No. 2101 of 2010dated 20.11.2014, on which they are placingreliance for claiming parity, to the respondents,within a period of six weeks from the date of receiptof a copy of this order and on receipt of such 12O.A 3807/2015 representations from theapplicants, the respondents shall consider thesame and pass an appropriate speaking andreasoned order thereon, in accordance with lawwithin a period of 90 days therefrom. No costs.

xxxx The OA is thus devoid of merit. RailwayRespondents are directed to disburse the DCRGbenefits inculding the family pension to Smt. ChabiRani Dey, R-4 and the childeren born to Chabi RaniDey as well as Archana Dey and Joya Rani Dey. Itis possible that the guardianship of Smt. ArchanaDey and Joya Rani Dey. i.e. the Applicant and R-5may not be easily and timely forth coming and thematter may get further deleayed. TheRailwayauthorities are directed that beacuse of non-cooperation of the Applicant and R-5, the legallymarried wife, Smt.Chabi Rani Dey (R-4) and herchilderen should not suffer any more. The shareof the DCRG benefits be disbursed to them at theearliest but in no case not later than three monthsfrom the date of receipt of this order. The Railwayauthorities may simultaneously pursue with theApplicant as well as R-5 with regards to theguardianship of the childeren borne out of theirrelationship/illegal marriage under the HinduMarriage Act and father by the deceased employee

The OA is thus disposed of. No costs.

Sangam ,--- celeberated Pongal festival on 16-01-2017 in which over 70 members participated &chaired by AIRPS's prez N Kalivaradan. Afterprayer recitation by T S Balasubramanian, DRathinasamy Pillai welcoming audience elaboratedthe importance of Pongal in which all communitiesof TN irrespective of caste and creed participate.Prez lauding the large gathering explained that thefunction involves worshipping Sun God seekingblessings for rich harvests.Celeberations endedwith distribution of Sarkarai Pongal and Vadas toall followed by thanks by C S Balakrishnan. In themonthly meeting held on 07-02-2017 chaired bythe prez, after prayer, two minutes silence wasobserved in memory of K Ravisunder. TreasurerA R Badrinarayanan presented accounts & sameapproved. D Rathinasamy addressed on generalproblems of pensioners and exhorted members tocooperate with the prez and persuade the dissidentmembers to rejoin AIRPS.
