We shine the light of knowing into the dark corners of myth, miscon-ception and mistaken ideas about solar that will be good news for pool contractors. Another dispute can be settled by the word, ‘if’, which draws a line in the ‘sand’ for plaster and drywall work… Q: You helped me get my “C-53” swimming pool license a few years back and I have a question for you. A few of my customers have asked me to install solar heating for their residential pools that I have serviced, but I have been told by other contractors that I specifically need either a “B” (General Building) or a “C-46” (Solar) license to do these installations. Is that correct? A: nice to hear from you again! Since solar contracting is an ever-expanding part of construction these days, there is a lot of talk and also a lot of confusion over the proper license that a contractor needs in order to perform this work. A “C-53” Swimming Pool contractor is authorized to include the installation of solar heating in swimming pools projects, so you will not need to obtain any additional classifications. There are also several other classifications that allow contractors to perform solar installation/repair jobs: “A” (General Engineering); “B” (General Building); “C-4” (Boiler) contractors are authorized to perform solar heat-ing specifically associated with boilers, hot-water heating and steam fitting; “C-10” Electrical contractors can perform solar projects that involve elec-trical energy; “C-36” Plumbing contractors can perform solar to heat water or fluids; and of course “C-46” Solar Contractors can perform all types of solar installations. Q: Hello, I am a regular reader of your Q&A column in our local Contrac-tor’s Association newsletter. Thank you for your engaging reading. My question may be a good candidate to share as I have not read anything of the sort in the 4 years I have been following you. I am licensed as a “C-9” (Drywall) and a “C-35” (Lathe and Plaster) contractor. I am losing drywall business to a local large plastering contractor and decided to check his license status. It turns out he does not have a “C-9” license. Where is the line drawn between a lathe and plaster contractor and a drywall contractor? Can a “C-35” contractor take on regular drywall services? A: Thank you for reading the column. We appreciate you contacting us it’s why we are here to help. The “C-9” and the “C-35” are two distinct classifications. A “C-35” contractor cannot do a project that is exclu-sively drywall, and likewise, a “C-9” contractor cannot do a project that is exclusively lathe and plaster. The two classifications are similar though, so a C-35 can do some of the work that falls under a “C-9” classification, if

the work is supplemental and incidental to the lathe and plaster job. This is the same for a “C-9” contractor with regards to lathe and plaster; he/she can perform some “C-35” work, if it is incidental and supplemental to the drywall job. • Moody’s New Pension Rules Would Bankrupt Six Cal Counties

CSLB Starts Enforcing Workers’ Comp ExemptionIf you were a “fly on the wall” and listened to some of my “sermons on the mount” testimonies before committees in the California State Legislature through the years (Gulp! This is the start of my 40th year “in the building”), you would have heard me use the phrase (frequently) that we must level the playing field for legitimate contractors! Indeed, much of my work on your behalf is focused on “going after the bad guys” and to make sure everyone “plays by the rules.”

Obviously, we’ve got lots of work still left to do, but we keep “carving away” at the list, slowly but surely! One issue that has bugged me for a long time deals with the workers’ compensation exemption form. As you may recall, when you apply for a contractor’s license, there is a form that you are required to sign which gives you one of two choices. You either are starting off as a contractor with employees and as such produce a workers’ compensation policy that you submit to the board, or you file the workers’ compensation exemption form because you don’t have any employees to start off with.

The problem was, once you filed the exemption form, there was no provision in the law that required you to produce proof of workers’ comp insurance once your business grew and you hired employees! Obviously then, many contractors simply never bothered to get workers’ comp, because no one pushed them to get it.

Well, this was a long-standing “pet peeve” of mine and as such, I got AB 397 introduced (and signed into law – Chapter 546 of the 2011 Statues) which requires all contractors to now re-sign

a workers’ compensation exemption form upon renewal of their license every two years, or provide the board with a copy of your workers’ comp policy (your insurance broker knows what is required to be provided to the CSLB). So, you say, the “dirt bags” will simply sign the exemption form and move on with their lives of crime? Well, the form now says “under penalty of perjury” meaning that if you get caught (and the CSLB is stepping up their enforcement, big time!), you will be “nailed” for perjury if you are caught.

This IS a big deal!!! So, all contractors whose licenses are up for renewal starting in the end of March of this year will be receiving a renewal notice with the new language contained in it. To meet new public pension financing rules, six counties in California would have to dedicate all of their existing property taxes to pay for pensions or pursue municipal bankruptcy through the courts. That is the conclusion of an independent pension analyst of the new pension rules established last year by Moody’s municipal credit rating agency. The only alternatives would be to get voters to approve immense property tax increases or undergo deep cutbacks to essential public services.

The six counties listed below affected by Moody’s new pension financing rules all have independent pension plans that are outside the California Public Employees Retirement System (Cal-PERS):

Back on July 2, 2012, Moody’s announced proposed adjustments on how it evaluates public sector pension data. Independent public sector pension analyst John Dickerson in Mendocino County recently released his analysis of Moody’s proposed pension fund rating changes for the above six counties. Dickerson has a website –-YourPublicMoney.com –- for public oversight into public pension plan solvency in 21 California counties. The California Public Policy Center website recently posted a summary of Dickerson’s full 10,000 word analysis of Moody’s pension fund changes.

Moody’s proposed changes in evaluating pension funds are:The assumed rate of return on pension fund investments will be lowered from 7.75 percent to 5.5 percent. The lower the interest rate on pension fund investments, the larger the cash contribution required by employees or counties. Public pension funds have assumed unrealistically high investment return rates based on inflation during the Mortgage Bubble.Municipalities will be required to catch up on its unfunded pension liabilities in 17-years, not the 20 to 30 year period now used.

Full payment of borrowed principal and interest – called full amortization — will be required in making pension payments. This means that level payments will be required, not graduated payments that start low and rise over time.

Pensions Would Consume All Property Taxes

Dickerson calculated the affects the above changes will have on the above-listed six counties. Pension payments will have to double according to Dickerson.Catch-up pension payments will have to increase in the six counties by 192 percent. And existing aggregate pension bond payments will have to be increased by a total of $177 million total in the six affected counties to avoid insolvency. As Dickerson states, this will result in consuming 98 percent of all the property taxes in the six counties for pensions only as shown in the table below.

The percentage that each county depends on property taxes for

their operating budget is shown in the table below. Alameda County –- with a seaport related economy — relies on property taxes for a low 12 percent of its General Fund. Agricultural-based Sonoma County has 43.6 percent of its General Fund dependent on property taxes. Contra Costa County relies on property taxes for 21.9 percent of its operating costs; Marin County 25 percent; Mendocino County 14.4 percent; and San Mateo County 22 percent.

Doubling the amount of property taxes dedicated to pensions wouldn’t be enough to meet increased pension payments in two of the counties. Mendocino County would have to raise property taxes by 9 percent and Contra Costa County by 54 percent to meet their pension payments. This would require voter approval unless other funding sources –- such as the county share of sales taxes or income taxes –- could be shifted away from essential services such as police, fire protection, road maintenance, social services and medical care.

Failure for each county to double pension fund payments could result in: a) bad credit ratings; b) much higher interest rates on municipal bond borrowings that would crowd out pension payments in county budgets; or c) even failure of bond investors to buy county bonds for public works projects or for refinancing of existing pension bonds.

Large property tax increases to cover the unmet portion of public pensions is not much of an option in an economic recession.

That is because real estate markets will adjust property values downward resulting in lower property values and, thus, a lower property tax base.Cal-PERS and Cal-STRS: not Too Big to Fail

As the editor of the website UnionWatch.org sums up the situation:“The arithmetic, fact-based reality is this: We are on track to spend more money each year to pay public sector pensions than we will spend on social security for five times as many citizens. The average government employee retires with benefits that are five times more

lucrative than the average social security recipient… the counties he (Dickerson) evaluated, Alameda, Contra Costa, Marin, Mendocino, San Mateo, and Sonoma, are not unique…“And what they (the six counties) are going to face is unlikely to differ significantly from any of California’s other local government pension funds, or CalPERS or Cal-STRS for that matter.”

The bond markets, not the courts, are starting to push counties into fully funding their pensions that could make many cities and counties in California fall into municipal bankruptcy. Gov. Jerry Brown, the Democratic supermajority in the State legislature, Cal-PERS, and public sector unions are hoping for a favorable court ruling in the pending municipal bankruptcy case of the City of San Bernardino. But the bond market is beginning to overrule whatever decision comes out of the courts.

Fearing an uncontrollable statewide wave of municipal bankruptcies, the California legislature passed a municipal bankruptcy reform law in 2011 –- Assembly Bill 506 – requiring cities and counties to first obtain a neutral bankruptcy analysis except in the case of a financial emergency. But it is difficult to be neutral between unsustainable pensions and essential protective public services when the governor has released criminals back into communities under prison realignment.

Workers’ Compensation Changes for 2013

On Sept. 18, 2012, Governor Jerry Brown signed into law significant changes to the California workers’ compensation system, which will take effect on Jan. 1, 2013.

The legislation was supported by both Democrats and Republicans and is intended to benefit employers and employees in California by reducing costs, increasing benefits and improving the system overall.

In the past two years, the costs of workers’ compensation insurance have risen from $14.8 billion to $19 billion, with an estimated 12.6 percent increase projected in the near future. According to a statement from Governor Brown, the workers’ compensation changes will reduce systemic inefficiencies and unnecessary expenses and are projected to save businesses $1 billion in 2013, increase payments to disabled workers by 30 percent and improve the delivery of medical treatment, retraining and other benefits.

PERMANENT DISABILITY BENEFIT CHANGES

Increased Benefits

The amended statutes enable injured employees who are permanently disabled to receive higher benefits by increasing impairment ratings by 40 percent and raising the amount of weekly benefits over a two-year period. Some estimate that these changes translate into $860 million in additional benefits for injured employees. The new law aims to finance this increase in benefits by relying on savings derived from a leaner and more predictable system, rather than increasing employer contributions.

Delayed Payment

Under the amended statutes, an employer is not obligated to provide wage replacement benefits for a worker with a permanent disability if:

An award for permanent disability has not yet been issued; and

The employer has offered the employee a position that pays at least 85 percent of his pre-injury average wages or the employee already works in a position that pays at least 100 percent of his pre-injury wages.

However, once an award for permanent disability is authorized, an injured employee is entitled to receive these benefits retrospectively from the date the last benefit for temporary disability was paid or the date the employee’s disability became permanent and stationary, whichever is earlier.

INDEPENDENT MEDICAL REVIEW (IMR)

Process Prior to 2013

Under the system in place prior to 2013, injured workers are required to receive an initial evaluation of their injury from a physician that belongs to the Medical Provider Network. The network physician also determines the extent of disability caused by the injury and proposes a medical treatment plan. The plan then goes through utilization review.

Employers and insurance carriers use the utilization review process to evaluate whether treatment plans follow authorized medical standards. The utilization review also determines how much of the treatment will be covered by the employer’s workers’ compensation insurance policy.

In theory, employers that disagree with a treatment plan can contest it through an IMR system. In practice, however, parties usually bring their medical treatment issues to the California Workers’ Compensation Appeals Board (WCAB) for hearings, using judicial appeal mechanisms as necessary.

Process for 2013 and Beyond

The amended statutes force disputing parties to resolve their disputes through the IMR process. This change is intended to help employers, injured workers and physicians avoid litigation costs and provide a faster determination on treatment for injured workers.

The IMR is limited to an examination of whether the proposed medical treatment is a medical necessity. A medical necessity is a treatment that is “reasonably required to cure or relieve the injured employee of the effects of his or her injury.” This process must be used even when considering a dispute regarding spinal surgery, a dispute process that follows an entirely different medical dispute resolution track under the pre-2013 system. The physician who conducts an IMR must be an uninterested third party. The new laws set detailed parameters to ensure that the IMR physician conducts an independent and uninterested review. A physician who has a financial interest in a particular case may not participate in the case review.

IMR physicians must use a specific hierarchy of medical authorities to render his or her evaluation. If the case is reviewed by a panel of physicians, the majority’s decision prevails.

IMR physicians must render their decisions in writing within 30 days and must use plain and simple language so a layperson may understand, as much as possible, the reasoning used for the decision. The review process can be expedited to three days if there is an imminent and serious threat to the health of the employee.

Appealing an IMR Decision

Appealing an IMR decision is difficult under the amended statutes. A party can appeal an IMR only if it can prove with clear and convincing evidence that:

The decision was made without or in excess of the reviewer’s authority;

The decision was procured by fraud;

The IMR physician was subject to a material conflict of interest;

The decision was the result of bias on the basis of race, national origin, ethnic group identification, religion, age, sex, sexual orientation, color or disability; or

The decision was the result of a plainly erroneous express or implied finding of fact (the fact must be based on ordinary knowledge, not subject to expert opinion).

Criticisms of the IMR System

Opponents of the revised IMR system argue that it does not allow for an accurate review of an injured worker’s condition, substantially decreases individual access to treatment and jeopardizes the quality of care available to injured workers. They believe that the new IMR system is a paper review process that deprives injured workers of a face-to-face medical re-evaluation and compromises constitutional due process rights.

TREATMENT RESTRICTIONS

Psychiatric, Sleep and Sexual Disorders

Under the amended statutes, treatment for psychiatric disorders, sexual dysfunctions and sleep dysfunctions will be paid for through workers’ compensation only if the disorder or dysfunction is the direct result of an industrial injury. In other words, treating physicians generally cannot increase a

disabled worker’s impairment rating to accommodate for these conditions when the conditions are not the direct result of an accident but develop because of a compensable physical injury.

However, the amended statutes do allow physicians to increase an impairment rating when psychiatric injury is the result of direct exposure to a significant violent act or a catastrophic injury. The definitions of violent act, significant violent act and catastrophic injury remain unchanged in the amended statutes.

Chiropractic Treatment

The amended statutes restrict a chiropractor’s status as a treating physician in the Medical Provider Network. As of Jan. 1, 2013, a chiropractor is a treating physician to an injured worker only during the number of visits allowed by the Medical Treatment Utilization Schedule.

Home Health Care Services

The amended statutes place additional restrictions on covered home health care services. These services can be provided as medical treatment only if they are reasonably required to cure or relieve the injured employee from the effects of his or her injury, and they are prescribed by a licensed physician.

These services do not have to be covered if they are provided more than 14 days before the employer receives the physician’s prescription.

Criticism of Treatment Restrictions

Some health care providers also oppose the treatment restrictions. They claim that standardized, prescribed procedures are not always in the best interest of injured workers and that increased Medical Provider Network oversight on the workers’ compensation system will increase treatment costs and cause delays in delivering adequate care.

MISCELLANEOUS CHANGES

Interpreters

The amended statutes give employees the right to have access to certified interpreters during administrative hearings, medical treatment appointments and other proceedings at their employer’s expense. The Division of Worker’s Compensation (DWC) determines the fees that interpreters are entitled to collect for their services.

Burial Expenses

Under the amended statutes, burial expenses increase from $5,000 to $10,000 for injuries occurring on or after Jan. 1, 2013.

SELF-INSURED EMPLOYERS

Beginning in 2013, additional restrictions will be placed on employers that self-insure workers’ compensation benefits. Certain types of employers will not be permitted to self-insure these benefits and those that do will be subject to revised deposit requirements.

Self-Insurance Restrictions

Under the amended statutes, an employer must have the Department of Industrial Relations’ (DIR) authorization to self-insure if it has previously allowed its workers’ compensation coverage to lapse.

In addition, starting on Jan. 1, 2013 certain employers will not be allowed to self-insure. These employers include:

Professional employer organizations;

Leasing employers;

Temporary service employers; and

Any employer in the business of providing employees to other employers.

Certificates of consent previously issued for these employers will be revoked by Jan. 1, 2015.

Deposit Requirement Changes

Prior to 2013, the DIR required a deposit equal to 125 percent of the employer’s estimated future liability for compensation plus 10 percent of the employer’s estimated liability relating to the administrative and legal costs associated with the payment of benefits.

The amended statutes require a deposit equal to the sum of the following figures, as they are calculated on Dec. 31 of each year:

The employer’s projected losses;

Net of specific excess insurance coverage;

Incurred but unreported liabilities (IBNR);

Allocated loss adjustment expense; and

Unallocated loss adjustment expense.

The deposit must be paid by May 1 of each year, as with the previous formula. An employer that overpays its deposit will be able to receive a refund only if it receives the consent of the Self-Insurer’s Security Fund, if there has not been an order of default or if the funds are not part of the composite deposit.

Manual Material Handling For construction workers and contractors, repetitive motions, poor lifting and unsafe handling injuries are some of the most common. Coincidently, they are also usually preventable by practicing safe lifting techniques. Use these helpful ergonomic guidelines to lift any size load without causing injury to yourself or others. Pre-Lifting Techniques

Determine whether or not you will need assistance to do the job.

Consider the size or shape of the load – bulky or odd-shaped building materials could create additional challenges.

Determine if you will have to turn or change direction while carrying the load.

Find out if the route you will take with the load is clear of obstructions and slip, trip or fall hazards.

Make sure your route is not dangerously close to vehicular traffic, especially if it is traveling at high speeds.

Make sure you have a back support belt and are wearing it properly.

Determine what kind of personal protective equipment (PPE) you will need to protect your hands and prevent slippage during lifting.

Lifting Techniques

Get as close as possible to the load and keep it close to your body.

Always bend from the knees and not the back, and lift using your legs.

Be aware of your balance. Stand on a stable, even surface,

and wear proper foot protection to prevent slips and other injuries.

Bring the load down to waist level if lifting from above, and wear a hard

hat to prevent head injuries from dropped materials.

No matter what you are carrying, always avoid reaching and lifting at the same time.

Carrying Techniques

Look ahead instead of down to make sure your path is clear.

Watch out for terrain changes, and avoid carrying up stairs if possible.

Have someone else open doors, gates or other closed entries for you.

Keep shoulders, hips and feet aligned – do not twist at the waist or change direction by moving your hips.

Set the load down on a firm surface if it becomes too heavy or unstable.

Watch for pinch or shear points on carts, dollies and hoists.

When you are finished transporting the load, set down the corner or edge of the object closest to you first, keeping your fingers out from underneath.

For construction workers and contractors, repetitive motions, poor lifting and unsafe handling are the cause of some of the most common injuries.
