    The City of Mill Valley is pleased to announce a street maintenance and sewer rehabilitation project that will take place this summer on East Blithedale Avenue. The project will involve improvements to the road surface to promote a smooth and quiet ride, new traffic markings, sewer pipe repair, and new manholes. While the project will cause short-term delays and traffic congestion over a period of two months, the benefits of this project will be significant, including the repair of sewer infrastructure and improved pavement conditions.

    Construction on East Blithedale from Elm/Alta Vista Avenue to Camino Alto will take place from June 24th through August 23rd, while schools are not in session, Monday through Friday, from 8:00 am to 5:00 pm. While East Blithedale will not be entirely closed to through traffic at any point, traffic will often be limited to one lane, and therefore delays and traffic congestion can be expected.

    If possible, we encourage you to plan alternate routes to avoid travel on East Blithedale. If you must drive on East Blithedale, add time to your travel estimates and anticipate delays.

    VARIOUS ROADS IN MARIN COUNTY

    2013 ROAD SEALANT PROJECT

    will be received by the Clerk of the Board of Supervisors, Room 329, Marin County Civic Center,

    San Rafael, CA 94903, until

    This project involves pavement restoration by applying slurry or chip seal to various roadways throughout the County that show

    signs of weathering and pavement cracking. This project consists of sealing the 79 road segments indicated on the attached list, totaling 43 centerline miles. Construction will take place during

    the daytime hours with traffic control measures. Work will include application of micro surfacing or chip seal to various roadways throughout the county. Department of Public Works Road Crew

    will perform the traffic striping and pavement markings.

    The Engineers estimate for this project is $1,450,000.

    The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

    A little fresh air helps blow away concerns about electrical installer certifications for our first contractor, while reminding others of this

    requirement. Another contractor with interest in federal work discov-ers that you may not technically need a license to build, but a bid may

    require it

    Q: We are a C-20 control systems contractor. We supply and install low

    voltage control systems for large HVAC systems. This primarily involves

    low voltage sensors and communication cables. When we first started we

    held a C-20 license to do our work. Some years ago we added a C-10

    because some bid specifications required both classifications. My question

    is since our work is covered by my primary C-20 license are my installer

    employees required to be certified electricians because of the C-10?

    A: Thank you for your question. Existing law requires that persons (other

    than the licensed Qualifier) performing work as an electrician under a

    C-10 license, be certified pursuant to standards established by the Divi-sion of Labor Standards Enforcement. Electrician is defined as a person

    who engages in the connection of electrical devices for aC-10contractor.

    Since this is the only license classification required to have certified electri-cians, HVAC (C-20) contractors do not fall within these Labor Standard

    Enforcement regulations. This would include the low voltage work youve

    described.

    note, since you also hold the C-10 class, your employees might fall

    within the Division guidelines if your company takes a non-HVAC project

    for which a C-10 is the primary classification and the work is over 100

    volt-amperes. For a more detailed response, I suggest you visit the State

    Q: Can a Home Improvement Salesperson work for more than one con-tractor? Are there any construction experience requirements?

    A: Yes, a Home Improvement Salesperson (HIS) can work for multiple

    contractors, however you must register separately for each contractor.

    There are no experience or educational requirements, but you must be at

    least 18 years old to qualify.

    Q: We are an out-of-State contractor and there is a project coming up in

    CA that wed like to bid on. We dont have a CA Contractors License but

    the project is on an Army base. I was told that work done on federal prop-erty does not require a contractors license, however the project owner is

    requesting that we have a license in place in order to bid. Is this allowed?

    If we do need a license, how long will it take to obtain one?

    A: If the entire project is on Federal property then a contractors license is

    not required, however its ultimately up to the awarding authority whether

    they want the work performed by a licensed contractor.

    The time it takes to obtain a license varies depending on several factors

    (exams, fingerprinting, etc). Please give me a call and we can further dis-cuss your particular situation.

    BILLS FACE DEADLInE TO PASS OUT

    OF HOUSE OF ORIGIn

    Friday, May 31 (today or tomorrow

    depending upon when you read this) is the

    deadline for all bills to pass out of their house

    of origin or they become two-year bills. Im

    happy to report that our sponsored bill, SB 399

    (Wright), passed off of the Senate yesterday

    (Wednesday) and will be ready to face the

    Assembly policy committee (likely Assembly

    Business and Professions Committee) within a

    few weeks. As you may recall from last weeks

    update, this bill as it currently reads would

    require the state to pay contractors 10% above

    prime in interest for all emergency contracts

    that are not paid within 45 days. I fully intend

    to fatten up this bill in the Assembly, so stay

    tuned. I will also report next week on the other

    good and bad bills that we will be dealing

    with in their respective opposite houses next

    week.

    HAVE YOU ExPERIEnCED 4 FOOT

    WIDE UTILITY MARkInGS?

    As you know, I have spent a considerable

    amount of time with the utilities and Regional

    notification Centers (DIG Alert) on a task

    force known as the Common Ground Alliance

    (CGA). Anything to do with excavators and

    utilities is within our purview. And, as I

    have previously reported, because of the San

    Bruno explosions as well as efforts by the

    federal Transportation Agency to push states

    to increase the penalties significantly for

    excavation violations, there have been several

    draconian bills introduced over the past two

    years that, fortunately, weve been able to

    tame thus far but watch out!

    First and foremost, I have been informed

    that several utilities that are called out to mark

    jobsites prior to excavating have been making

    four (4) foot wide markings! In other words,

    the lines are four (4) feet wide which means

    that by law contractors must pot hole and use

    hand tools within this much larger space AnD

    the safety zone extends twenty four (24) inches

    beyond the markings on each side (remember,

    if it is determined there is a high priority

    subsurface installation, the existing law

    changes to require 10 feet of clearance on each

    side). Obviously this is absolute overkill.

    Unfortunately, this is what happens when

    an issue becomes a hot political potato. I

    have already been in contact with the Regional

    notification Centers about this who also

    acknowledged that they are hearing about this

    overkill problem.

    I need your help on this matter. Have

    you experienced this problem? If so, if you

    could drop me an email ([email protected])

    identifying which utilities are doing this and

    how frequently (is it every jobsite or what?). I

    will be pursuing this matter with the Common

    Ground Alliance in one of our future meetings

    in the very near future. Indeed, even the

    Regional notification Centers have expressed

    concern!

    Also be aware that a state Senate

    Subcommittee will be conducting a special

    hearing next Tuesday, June 4th at the Capitol

    on the issue of excavation and what (or if)

    future legislative and regulatory requirements

    will be needed. You can bet that I will be

    listening closely and testifying if necessary. I

    too will report on this hearing in next weeks

    update.

    LongMile-S and Horizon diesel particulate

    filter systems to ESW CleanTech, Incorporated

    (ESW CleanTech). ESW CleanTech acquired

    the Cleaire product line on April 18, 2013,

    completed all the verification transfer

    requirements specified in the Verification

    Procedure, Warranty, and In-use Compliance

    Requirements for In-Use Strategies to Control

    Emissions from Diesel Engines, Title 13,

    California Code of Regulations, and will sell

    new systems as well as provide support for

    existing Cleaire customers. The LongMile-S

    and Horizon systems reduce emissions of

    diesel particulate matter by at least 85 percent

    and are designated as a Level 3 Plus systems.

    The systems are compatible with on-road

    vehicles using diesel fuel that contains up to

    20 percent biodiesel. Specific engine families

    and conditions for which the LongMile-S and

    Horizon systems have been approved may be

    found in the Executive Orders on the ARBs

    OAKLAnD -- The California Commission

    on Health and Safety and Workers

    Compensation (CHSWC) is pleased to

    announce Injury and Illness Prevention (IIPP)

    training and resources for general industry

    and small business. This training is part of the

    Commissions Worker Occupational Safety

    and Health Training and Education Program

    (WOSHTEP), a statewide effort aimed at

    reducing job-related injuries and illnesses

    among California workers. This program is

    administered by CHSWC through inter-agency

    agreements with the Labor Occupational

    Health Program (LOHP) at the University of

    California, Berkeley, the Western

    Center for Agricultural Health and Safety

    (WCAHS) at the University of California,

    Davis, and the Labor Occupational Safety and

    Health Program (LOSH) at the University of

    California, Los Angeles.

    The free day-long course for general

    industry and the half-day course for small

    business, Taking Action for Safety and

    Health: Implementing an Effective IIPP, was

    developed by LOHP for CHSWC. Cal/OSHA

    enforces requirements of the IIPP standard.

    This course will train participants to develop

    and implement an effective health and safety

    program at their workplace which meets the

    requirements of Cal/OSHAs IIPP standard.

    Materials include a free guidebook and easy-

    to-use model template for writing an IIPP,

    factsheets and tools to help implement an IIPP,

    and resources for technical assistance.

    CHSWC, created by the workers

    compensation reform legislation of 1993,

    is charged with examining the health and

    safety and workers compensation systems in

    California and recommending administrative

    or legislative modifications to improve their

    operation. CHSWC was established to conduct

    a continuing examination of the workers

    compensation system and of the states

    activities to prevent industrial injuries and

    occupational diseases and to examine those

    programs in other states.

    Youve heard of the fog of war. Well,

    now weve got the fog of Obamacare. The

    controversial Affordable Care Act (ACA)

    has so many moving parts that its hard to

    know how its implementation is proceeding.

    In 2014, many uninsured are supposed to get

    coverage either through insurance exchanges,

    where they can buy subsidized policies if

    their incomes are less than four times the

    federal poverty line, or through an expanded

    Medicaid. The trouble is that 20 or more

    states may reject the Medicaid expansion, and

    the exchanges arent yet finished. Much is

    unknown.

    Its not just that the ACAs plumbing is still

    under construction. Millions of Americans are

    perplexed. An April poll by the Kaiser Family

    Foundation found that one-fifth of respondents

    didnt think the ACA was still in force they

    thought it had been repealed by Congress or

    struck down by the Supreme Court. About

    half the respondents didnt know how the law

    affects them personally. President Obama

    recently called the confusion exaggerated.

    For the nearly 85 percent of Americans with

    insurance from large employers or Medicare

    and Medicaid (programs for the elderly and

    poor), there would be little change, Obama

    said.

    Thats probably true. But it still leaves a

    sizable enclave of ignorance mainly among

    workers for small and medium-size firms and

    todays uninsured. Under the ACA, companies

    with more than 50 full-time workers are

    required to provide insurance or pay a fine

    (now called a tax) of $2,000 per employee (the

    first 30 are excluded from the tax). Part-time

    workers, defined as those who work fewer

    than 30 hours a week, arent counted. And

    uninsured individuals are required to buy

    insurance or face a tax penalty that begins

    at $95 in 2014 and increases to $695 in 2016.

    How will these requirements work? Will

    smaller companies add insurance or drop it?

    Will uninsured individuals buy subsidized

    coverage in the exchanges or pay the tax?

    To get some answers, I recently talked

    with the heads of four professional employer

    organizations (PEOs) these are companies

    that act as human resources departments

    for small companies. They provide payroll

    services and advise on fringe benefits and

    government regulations. Their customers

    include construction companies, restaurants,

    small manufacturers and professional firms.

    Many of these firms are only now coming to

    grips with the ACA, because theyd assumed

    that the Supreme Court would invalidate it or

    that a Republican White House would repeal

    it.

    To encourage candor, we talked on a not-

    for-attribution basis. I left with three main

    takeaways.

    First, some companies now providing

    insurance are being hit with huge premium

    increases. Before Obamacare, said one PEO

    adviser, his clients typically received annual

    increases of 6 percent to 12 percent. This year

    were seeing 30 percent rate hikes, he said.

    The surge is blamed, rightly or wrongly, on the

    ACAs requirement for more comprehensive

    coverage and on its formula for calculating

    premiums (aka community rating). Costlier

    insurance could cause some employers to

    drop it and others not to offer it. But modest

    increases in overall health spending could

    relieve pressure on premiums.

    Second, most companies havent made final

    decisions. Those who have go both ways.

    Another adviser described a 250-worker car

    dealership with good wages but no health

    insurance; it will provide coverage and cut

    wages to help pay costs. Another example

    involved a 60-worker manufacturing firm

    with wages of $12 to $15 an hour. It offered

    bare-bones policies with steep deductibles.

    Confronting higher premiums for expanded

    coverage, the owner will drop insurance.

    He found the ACA too complex, said this

    adviser. Wages will be increased somewhat.

    With subsidies, workers might do better in the

    exchanges.

    Third, many firms are revising their

    business models to minimize insurance costs.

    One favorite idea: Hold workers below the

    30-hour weekly threshold requiring insurance.

    Many part-time employees who work more

    (say, 35 hours a week) will lose hours. One

    adviser discussed a movie-theater chain that

    will keep most staff below the threshold.

    Many restaurants and hotels may do likewise.

    Similarly, companies are striving to stay

    below the 50-employee ceiling that triggers

    the insurance mandate. Another adviser

    mentioned a client, an engineering firm with

    48 workers, that had deliberately restrained

    expansion.

    All of this clouds Obamacares promise

    of universal coverage. The Supreme Courts

    decision that states dont have to join the

    Medicaid expansion will reduce the number

    who get coverage. What matters for small

    and medium-size firms is the gap between

    providing coverage and paying the tax

    penalties. The wider it gets, the more likely it

    is that firms wont provide insurance. Some

    will also be deterred by the hassle factor of

    complying. The less private coverage, the more

    federal subsidies for exchanges will rise and

    the greater the chances that individual workers

    will forsake insurance and pay the tax penalty.

Chernus, Friday, May 10, 2013 granted the Construction Industry Force Account Councils (CIFACs) Petition for Writ of Mandate against the Ross Valley Sanitary District (RVSD) to bring them into compliance with Californias public bidding laws. The decision in favor of the CIFACs action requires that RVSD competitively bid their sewer pipe replacement projects for all projects valued at $15,000 and above. Thats the law but they ignored it, said CIFAC President Dave McCosker. The Courts decision means a minimum of 139 miles of pipeline replacement and related work will go out to bid creating scores of new job opportunities and allowing the public to see the real costs which will be much lower. We recognize this work is extremely important to prevent further spills and we are willing to be a resource to the District to get it done. Its clear from the court documents that the district engineer is not clear on construction protocols and procedures, said Cathryn Hilliard, CIFACs Executive Director and Tam Valley resident. First led astray by former General Manager Brett Richards, former members of the RVSD Board were persuaded to hire from 7 to 11 new staff to perform all the work in-house. Richards convinced the Board that they should use a method called pipe-bursting and claimed they could do it all in-house for $847,000 per mile and claimed that contractors would charge $1.4 million per mile. Marin Builders Associations Legislative Analyst Casey Mazzoni appeared at the same District Board meetings as Hilliard to argue that if RVSD put the work out to competitive bid, contractors could do it for $660,000 per mile or less and take less time to complete it. The economic downturn resulted in high construction industry unemployment and at a time when local government has less funding; it only makes sense for local agencies to look first to their local contractors, Mazzoni said. But Richards told the Board that there were no local contractors to do the job and it would cost the District $45,000 to do a study to find contractors that could do the work. Bolstered by their attorneys who originally provided no advice or wrong advice, the Board ignored warnings that pipe replacement projects, with a value of more than $15,000, must be put out to

    competitive bid as specified in the section of the California Public Contract Code that relates to Sanitary Districts. Despite the warnings from CIFAC, MBA and the public works construction industry, the Board adopted the budget as presented and approved a very large rate increase at the same meeting. Hilliard noted that every effort was made to avoid legal action but the Districts legal counsel was clearly not interested and did not reply to numerous letters or phone calls for more than a year. We had no choice but to go to the court in June of 2012, and even then District Counsel would not accept service for the Board, so CIFAC was forced to serve each Board member in public between its Finance Committee and the Board meeting. Thats something we would have liked to avoid, said CIFAC President McCosker. The General Manager, who proposed the idea of increasing staff size and training them to do the pipe-bursting work, has since disappeared and the composition of the Board has changed. In the recent past, the District has been involved in a number of other legal battles and three Grand Jury investigations. President David A. McCosker said while some of the newer Board members seemed to understand the law, a majority of the Board members at the time appeared to be far less concerned and were willing to risk legal action. Im amazed that CIFACs offers to hold off legal action if the District simply agreed to follow the law and bid the pipeline work was first ignored and then refused. It appeared that the General Manager and some members of the Board were willing to treat the ratepayers like a deep pocket to absorb the cost of all sorts of legal expenses and then they turn around and raise the rates on them to pay for their mistakes. The ruling means that Ross Valley Sanitary District must immediately bid all new public works construction projects.

    Eye Injuries Are a Serious Threat Protect your eyes on the job

    There are countless eye hazards on a construction site, including particles (wood chips, dust, cement chips, metal shavings, etc.) that have been ejected from a tool or blown by the wind. Chemical splashes and swinging objects can also be eye hazards on a worksite. However, most eye injuries are preventable if you follow simple safety precautions, and always wear your safety goggles! Use Protective Eyewear Its a proven fact that the best thing you can do to protect your vision on the job is to wear safety glasses or goggles. Even if you do have your safety glasses on, keep in mind that there are a variety of ways you can get debris in your eyes. Some accidents happen by simply taking off your safety glasses or goggles and wiping your face; particles can easily fall out of eyebrows or hair and into your eyes. Safety glasses should rest firmly on top of the nose and close to but not against the face. If they are uncomfortable, foggy or sight-restrictive, then find a different pair. Dont let excuses get in the way of protecting your eyes. They may not always be convenient to wear, but the right eyewear will ensure your eyes and vision are safe while doing your job. Find a Good Fit You can find many ways to make safety glasses or goggles work for you, such as:

    If you find safety glasses uncomfortable, experiment with different sizes or styles.

    Make sure glasses are fit well while you are also wearing your hard hat and other protective equipment.

    Wear glasses or goggles that are properly ventilated for the work you are performing. Unless you are working near splash hazards, use goggles that have plenty of side ventilation.

    If you wear prescription glasses, wear goggles designed to fit over your glasses or safety glasses made with your prescription.

    If your goggles fog up, try a model with more ventilation or coat them with an anti-fog liquid.

    Wear a sweatband or handkerchief around your head to keep sweat off your goggles.

    Always keep your safety glasses clean. Scratched and dirty glasses or goggles can reduce vision, cause glare and may contribute to accidents.

    Safety First It takes only one accident to cause partial or complete blindness. Even tasks that you dont consider dangerous may present a risk for eye injury. Take a moment to think about possible eye hazards around each job site, and then take the necessary precautions to help prevent potential accidents and injuries.
