The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

A ‘general’ question starts out this Q&A, and for anyone who employs subcontractors a valuable lesson comes with the answer. We discover a ‘major’ glitch in the ambitions of another contractor and a handyman with a ‘minor’ problem…

Q: I am a General Contractor and the supplier on one of my jobs from last summer recently contacted me regarding payment. I paid retention to my sub, but it turns out he did not pay his material supplier, and at this point has no ability to do so. The supplier claims that they filed a preliminary notice, so my question is, as the GC am I responsible to pay the 2nd tier sub’s supplier?

A: I reached out to a former CSLB employee, Michael Brown, who now serves as a contractor licensing expert witness for attorneys. He stated that as a General Contractor, you are not responsible for payments to anyone with whom you don’t have a direct contract. The license law does not provide for discipline in such cases, but a sub like the one described can certainly mess up a project. One solution would be for the General to require joint checks and/or lien releases from the sub and the sub’s material suppliers in order to avoid this type of problem.

Q: My question is about getting a General Building license. I’ve been working for a few years with a contractor doing a little bit of everything (mainly plumbing, painting, drywall, finish carpentry). I have also done some handyman work on the side such as fencing, and plumbing repair Do you think I’ll be able get my license with this background?

A: Thank you for your email. In order to qualify for a General Building (“B”) contractor’s license you must be able to show 4 or more years full time experience within the past ten years. The CSLB will require that someone verify your background in two or more unrelated trades -- plus rough framing. The Board will

look for work in what they consider the “major” building trades (plumbing, concrete, electrical, roofing and HVAC). Unless you have this work background – especially framing – it is unlikely the Board will accept your application for a “B” license.

Q: I have been doing ‘minor’ repair work for the last several years, but I don’t have a contractor’s license. I would like to know what services a Handyman cannot perform or advertise for. I plan to get my license once I have the four years of experience under my belt, but until then I want to make sure that I’m not doing anything incorrectly.

A: There are no specific trades/services that I am aware of that a Handyman cannot perform and advertise for, as long as the total cost of the project does not go over $500, including materials and labor. Also, when advertising, individuals who are unlicensed are required to indicate in their ad that they do not have a State Contractor’s license.

Also In This Update• CSLB Stings Unlicensed Contractors

Cal OSHA held a Heat Illness Advisory task force meeting on July 8th to seek input from all interested parties on whether there is a need to further tighten the heat illness regulations. Obviously the outcome of these proceedings has a tremendous impact on the construction industry, so on your behalf I have joined an employer coalition that is urging Cal OSHA nOT to mess with the existing regulations. As Cal OSHA proceeds with their deliberations, we have joined forces with virtually every employer group in the state that is affected by these regulations to combat any further restrictions.

Following is a letter that was sent to Cal OSHA last week which expresses the coalition’s sentiments:

On July 1, 2013, a coalition of employer associations wrote to DOSH to request that the Heat Illness Prevention Advisory meeting held on July 8, 2013, open with a presentation focusing on the necessity and rationale for amending the Heat Illness Prevention Standard. The text of that letter follows these comments. Throughout the meeting various stakeholders also requested that DOSH provide data regarding the need for any change to the regulation. To date, all requests for data have been declined. The discussion at the advisory meeting

consisted primarily of anecdotal speculation on what changes to the standard may or may not be useful without regard to the effectiveness of or compliance with the existing regulation. California has close to 8 years of experience with its heat illness prevention regulation and has gathered significant amount of data about its impact on the incidence of heat related illness and fatalities, as well as the increase in compliance over the years. We do not understand why, given this wealth of data, a presentation and analysis of these data was not the starting point for the discussion on the need for possible changes in the provisions of the standard.We must reiterate the need to take a holistic approach and consider regulatory change last rather than first. California employers understand the regulation and have now demonstrated a high level of compliance with the nation’s only heat illness prevention standard. It would be unwise to change the rules in a manner that would create new requirements and liabilities for employers without first considering more practical and effective approaches. Cal/OSHA has many tools to achieve employer compliance that enhances employee safety, all should be considered prior to rulemaking, such as consultation, partnering with employer associations, training, outreach, education and effective enforcement focusing on the worst actors who jeopardize not only employee safety but the viability of legitimate businesses that attempt in good faith to comply with all of the laws and regulations already enacted.The signatories to this comment letter agree with the coalition letter of July 1, 2013 as well as the additional comments provided here. We remain committed to a process that clearly states justification and rationale based on data and facts for any needed change to the regulation.

Following is the text of the letter sent to DOSH on July 1, 2013:We respectfully write to request that the Heat Illness Prevention Advisory Committee meeting held on July 8 open with a presentation focusing on the necessity and rationale for amending the Heat Illness Prevention Standard. We believe that DIR and DOSH have developed more comprehensive information related to the heat standard’s impact on employers and employees than they have ever done for any other OSH standard, investing considerable resources in this extensive effort, and the data developed as a result offer a unique opportunity to analyze the actual impact of the standard on heat illness incidence and severity in outdoor places of employment.We have always appreciated the holistic nature of Cal/OSHA’s approach to the issue of heat illness prevention. Unlike the usual practice of adopting a standard and assuming the problem has been fixed, the heat illness campaign begun in 2005 consisted of a concerted effort not only to achieve a protective standard that would help to solve the problem, but a complete approach consisting of enforcement, education, consultative assistance, and partnering with stakeholders to coordinate our efforts and maximize the effectiveness of the nation’s first comprehensive campaign to address heat illness in outdoor places of employment.This presentation should focus on the incidence of heat and work-related fatalities and illnesses each year since 2005, and it should compare those cases in which the incident occurred in a compliant workplace with those cases in which the incident occurred in a non-compliant workplace, with particular focus on how previous and proposed amendments to the standard may have had an impact on those comparisons.It should include a description and summary of DOSH’s findings for each case on: • The circumstances of the occurrence

of the heat illness, including the date, the location/region, nature of the business, and activity in which the employee was engaged at the onset of illness,• The nature of the heat illness,• How the work-relatedness of the heat illness was determined, and • The details of any violations found to have existed in each case.This information should be made available to all stakeholders, so that we can have a robust and data-driven discussion about the impact of the heat standard to date and what implications that information has, not only for the potential necessity for further rulemaking, but also for the potential necessity for Cal/OSHA to change its enforcement, consultation assistance, and educational strategies. We would be most appreciative of having as much of this information in hand as you can provide prior to the meeting.We thank you for your consideration, and we hope you will view this request in the spirit of its intent—which is that we can achieve the best results and offer employees the most effective protection by working together and arriving at any decision to make changes in the context of broad, open, and informed public discussion.Please feel free to contact any of us if you would like to discuss our request.

ENFORCEMENTCalifornia Summer BlitzThe Statewide Investigative Fraud Team (SWIFT) conducted the summer blitz on July 17 and 18. Simultaneous stings were held in- Artesia (Los Angeles County), - Fresno (Fresno County), - Long Beach (Los Angeles County),

- Oxnard (Ventura County),- Redding (Shasta County), - Sacramento (Sacramento County), and - South Lake Tahoe (El Dorado County). Investigators issued 79 notices to Appear to individuals facing various criminal charges.

Among those arrested were a convicted felon, a registered sex offender, and two suspects caught with drugs. A total of 79 individuals were given a notice to Appear (nTA) in Superior Court, and now may face misdemeanor charges of contracting without a license. Fifty-two of the individuals also may be charged with illegal advertising. Thirteen were issued Stop Orders.

Highlights included:In Artesia, 11 suspected unlicensed contractors were issued nTAs. When investigators identified themselves and told one suspect he was in a sting, the suspect said his identification was in his truck. Instead of getting it, he drove away, leaving behind his cell phone and paperwork.

In Long Beach, 15 suspected unlicensed contractors were issued nTAs. One suspect brought two employees and supplies with him, expecting to get the job and start right away. As the employees started to unload their tools, the boss received his nTA.

In Oxnard, 12 suspected unlicensed contractors were issued nTAs. One suspect was a convicted felon on parole and also in possession of drug paraphernalia. He was taken into custody. Another suspect was a registered sex offender. Oxnard Code Enforcement also issued 15 citations to suspects who didn’t have a city business license.

In Sacramento, 11 suspected unlicensed contractors were issued nTAs. Two arrested were taken to jail: One for possession of an

illegal substance; the other for possession of drug paraphernalia and having an arrest warrant.

All in all the operation was a success!

Avoid Heat Illness When it is hot outside, your body temperature can rise to dangerous levels. Normally, your body cools itself through sweating. However, in hot and humid weather, sweating is not enough and the result can be a heat illness. Staying Cool Follow the suggestions below to stay cool when working in hot weather: • Wear loose, light-colored clothing and

some type of hat. • Adapt to working in hot conditions

gradually, especially if performing strenuous tasks.

• Take breaks in the shade when possible, and remove any outer protective gear you may be wearing.

• Avoid overexerting yourself during peak temperature periods (midday).

• Drink liquids frequently, even if you don’t feel thirsty - at least eight ounces every 20 to 30 minutes. Choose water, fruit juice or sports drinks and stay away from liquids containing caffeine, which can dehydrate you.

Recognizing the Symptoms There are three forms of heat illness, each with its own distinct symptoms: • Heat Cramps – severe muscle spasms

in the back, stomach, arms and legs, which are attributed to the loss of body salt and water during periods of heavy perspiration

• Heat Exhaustion – heavy sweating, cool or pale skin, nausea, headache, weakness, vomiting and fast pulse

• Heat Stroke – high body temperature, sweating stops, red and often dry skin, rapid breathing and pulse, headache, nausea, vomiting, diarrhea, seizures, confusion or unconsciousness

Providing Treatment It is essential to treat heat illness as soon as possible. If you are feeling any of the above symptoms, inform a co-worker and ask for help. If you suspect that a fellow worker has any of these conditions, follow the first-aid suggestions below: • Heat Cramps – Move the victim to a

cooler area and allow them to drink approximately six ounces of water every 15 minutes. Follow up with a medical examination.

• Heat Exhaustion – Move the victim to a cooler area and keep them lying down with their legs slightly elevated. Cool their body by fanning and applying cool, wet towels. If conscious, allow the victim to drink approximately six ounces of water every 15 minutes. Follow up with a medical examination.

• Heat Stroke – You or a bystander should immediately call an ambulance. Meanwhile, move the victim to a cooler area, remove their outer clothing, immerse them in cool water or apply cool, wet towels or cloths to the body. Do NOT give them liquids. If medical help is delayed, call the hospital for further instructions while waiting. Heat stroke is life-threatening, so it’s important to move quickly!

Safety Reminder The risk of heat illness increases with age, poor diet, being overweight, insufficient liquid intake, poor physical condition and/or when taking medication. Never take salt tablets without your doctor’s approval. Be aware of weather conditions when you will be working outside so that you can be prepared with appropriate clothing and beverages. If you are working outside and start to feel any adverse symptoms, inform your supervisor and take a break.

Heat illness can be a serious threat. Your best defense is to learn how to stay cool when the weather heats up.

Evite la enfermedad por calor Cuando hace calor afuera, la temperatura de su cuerpo puede aumentar a niveles peligrosos. Generalmente, su cuerpo se refresca solo mediante la transpiración. Our company is a professional organization that has been providing all types of excavation services in the San Fran-

cisco Bay Area for over 15 years. We specialize in shoring, drilling, grading and site preparation needs. Our projects are wide and varied from excavating large hillsides and creating

lakes to digging swimming pools.

We are seeking an Estimator for our growing company. Estimator must be proficient in estimating public work for excavation, demolition, shoring and pipe work.

• Interpret architectural and structural drawings, specifica-tions, and bid documents

• Perform take offs and write RFPs, and RFIs• Review Job site conditions to determine scope, costs and

project timeline• Compile detailed scope of work inclusions, exclusions, &

clarifications for estimates• Attention to detail, strong organizational and time man-

agement skills

Job Requirements

• Previous experience with computer estimating using Dodge Pro and similar sites a plus

• Project Manager experience is a plus but Estimating is the priority

• Experience in Earthwork is also a plus• Work independently as well as part of a team and accept

feedback constructively• Ability to communicate efficiently with the owner, follow

directions and have own transportation• Local references are a prerequisite of the position
