The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Like The Professor and Sherman from those old cartoon reruns, we fire up the ‘way back’ machine for a contractor’s question. A couple of contractors who’ve reached their ‘boiling point’ on bids need a short answer, and a long one. A General discovers they can play, but not get in the ‘pool’ alone… Q: You helped me get my license way back when and I have been the Responsible Managing Officer (RMO) for many, many years. As I get closer to retiring, I am becoming less involved in the day-to-day operations of the company. I am ready to pass the RMO torch to one of my employees and have him be the new qualifying individual. I still have ownership in the company so my question is if I remove myself as the RMO, how does that affect my interest in the company? I won’t be fully retired for another year or two. A: It’s great to hear from you again. Changing the Qualifier on the license does not affect the ownership structure of the company. You can even remain as an Officer on the license. Go ahead and pass the torch and of course contact us if you’d like help with the process! Q: My company has a “C-20” (HVAC) license and we do energy upgrades on homes. Part of this work sometimes involves replacing the boilers. Recently another contractor told me I couldn’t do the boiler work unless we held a “C-4” Boiler classification. Can you tell me if that’s correct? A: A “C-20” HVAC contractor can replace boilers as long as it’s part of a heating system. They can not do just boiler replacement alone. Q: I am a “C-35” Plastering contractor and I’m losing work to an-other contractor in the area who is a “C-9”Drywall contractor. He is bidding on and signing contracts for drywall and plaster jobs and then subbing out the plastering to another “C-35” contractor. Can a drywall contractor sign a contract for Plaster license work?

A: It all depends on the project. In some cases the CSLB has deter-mined that a specialty contractor can sign contracts involving trades outside of their specialty, and sub-contract the work to a properly licensed contractor if the work to be done is incidental and supple-mental to the work being performed within their specialty trade. In this case, if the plastering work is necessary in order to complete the drywall project then it is acceptable to take the job and then sub out the plaster part of the project. However, if the drywall and plasterwork are two distinct jobs which can be performed separately (such as drywall inside a residential home and plaster outside of the home), then the drywall contractor should not be including that work in his/her contract. Q: I have a “B” General Building license and one of my customers would like me to put a pool in their backyard. Since building a pool involves more than two unrelated trades, am I allowed to do this project for them? A: Although building a pool involves two or more unrelated trades, a General Building contractor cannot build a pool since it’s not a structure. You can however take the contract for the pool if you hire a “C-53” Swimming Pool contractor to perform the work. A General Building contractor can also build a pool if it is part of an overall building project, such as a new home or a large renovation project.

“Fun” Begins Next Week In Sacramento

next Monday, April 1, commences the true start of the 2013 legislative session. You may recall that I reported back in late February that over 2,300 bills had been introduced this 2013 session. Once introduced, all regularly introduced bills must be in print for a minimum of 30 days before any action can be taken on them. Since Spring Break Recess was this week, it means that next week will be when the bills begin being heard in earnest. This first-round of policy committee hearings will last until May 3rd for bills with fiscal implications and May 10th for non-fiscal bills. As promised, in the weeks ahead I will be reporting on the progress of our four sponsored bills as well as myriad others.

AB 1212 (Levine) – Or Equal Provisions in Public Contract Code YOUR HELP IS NEEDED! Speaking of sponsored bills, this is one of them this year. As proposed to be amended, it will simply state: no data substantiating a request for a substitution of “an equal” item shall be disclosed to other potential bidders prior to the time when bids are received.

A couple of years ago a local southern California agency published an invitation for bids/instructions to bidders that required or-equal submissions BEFORE bid day AnD provided that the only way to get approval was by issuance of an addendum to the bid package BEFORE bid day - thereby allowing every competitor of the proponent of the or-equal to take advantage of the proponent’s ingenuity by copying its proposal. needless to say, no one was willing to propose an equal on that basis, so the agency was able to sole-source the particular item without complying with the sole-sourcing requirements of Public

Contract Code section (c), which it probably could not meet anyway.What I am looking for are specific invitation to bid documents

from public agencies anywhere in California that require the or equal documents to be received BEFORE bid day so that they can be sent out as an addendum to the bid package. If anyone has seen this type of language who can scan and send it to me, it is what I need to win passage of this bill in 2013. Please send it to: [email protected]

Arrest Made in Scam Targeting CSLB Applicants, Licensees Second suspect added to CSLB’s Most Wanted list

SACRAMEnTO – The Contractors State License Board (CSLB) is announcing that one arrest has been made and another is pending after a comprehensive investigation into a scam that targeted both licensed contractors and those attempting to become licensed.

Luis Manuel Flores, 50, was arrested in February while crossing the border into the United States and remains jailed at the Rio Cosumnes

Correctional Center in Sacramento County. Flores is charged with one count of Conspiracy to Cheat/Defraud another person of property (Penal Code section 182(a)(4)).

An arrest warrant has been issued for a second suspect, Maico Merdinand Dimla, 41, who is believed to be in the Tijuana, Mexico, area. Dimla has been added to CSLB’s Most Wanted list.

The multi-faceted investigation began last summer after a number of license applicants told investigators that they were conned by people falsely representing themselves as CSLB employees. Applicants were

told they needed testing study guides, while licensees seeking an additional classification were told they needed continuing education credits or licensing exams, and needed to pay with a credit card over the telephone.

Investigators believe Flores and Dimla created a fraudulent business and website with names similar to CSLB. While in the Tijuana area, it is believed that the two contacted CSLB applicants and licensees with phone numbers that appeared to victims as originating from the 916 area code (Sacramento area). At least 50 people have been defrauded, in amounts ranging from $98 to $250 each. The number of victims could increase once people realize they’ve been conned.

“Our efforts to protect consumers go beyond those who hire contractors,” said CSLB Registrar Steve Sands. “We take very seriously any attempt to con or take advantage of our licensees or those who apply for a contractor license.”

CSLB issued an industry bulletin and a prominent alert on the CSLB website to warn contractors and applicants about people claiming to be from CSLB and asking for credit card information over the phone. They also were reminded that CSLB fees only are payable through the mail or at CSLB Headquarters in

Sacramento. The warnings dramatically cut the number of people being victimized.

Anyone with information on Maico Merdinand Dimla’s whereabouts should contact their local law enforcement agency.

State Agency to Offer Seminars on Labor, State Payroll Tax Laws

The California Division of Labor Standards Enforcement (DLSE) and Employment Development Department (EDD) are making available free seminars throughout the state discussing the state’s labor and payroll tax laws.

“Toolbox” Safety Meetings – Tips for TrainersAs a safety manager, one of your key roles is to promote a safety-minded culture while maintaining costs. By alerting employees to workplace hazards, “toolbox” safety meetings are worth your time. To get the most out of your safety meetings, it’s best if the whole crew actively participates. How? Try these tips for trainers: Select relevant meeting topics. If you

have drill presses, talk about drill press safety. If you are entering confined spaces, talk about respirators and confined space entry. If you notice that spills aren't being cleaned up promptly, discuss that. If there has been an accident or a near-accident on the job, talk about it. What happened? Where did it happen? How can it be prevented from occurring again? Lifting incorrectly can result in a variety of injuries. Back strain is a very common injury, resulting from the over-stretching of certain muscles. It can be avoided if employees are reminded to practice safe lifting techniques.

Employees are a good source for meeting ideas. Encourage your employees to suggest topics; they often know best what and where the dangers are.

Once you select a topic, research it. If you want to focus on the safe use of a specific piece of machinery, consult the manufacturer’s operations manual. For handling toxic substances, get a copy of the safety data sheet (SDS). To source ready-to-use documents on a variety of safety-related topics, conduct a keyword

search: “Safety Matters” from the Documents on Command section of your client portal from Leavitt Group.

Ask questions instead of lecturing. Introduce each new point you want to make by asking the crew a question. Wait a short time to let people think, and then call on volunteers to answer. Use the answers as a springboard for discussion.

Ask about personal experience. If you ask a question and no one has an answer, ask if someone has had any personal experience to help the group figure out the answer.

Limit the amount of time any one person can talk. If a crew member is talking too much, invite someone else to speak.

Stick to the topic. If the crew’s questions and comments move too far from the topic, tell them that their concerns can be addressed later, either in private conversation or in an upcoming safety meeting. This will also give you ideas for future meeting topics.

Assign a crew member to assist you. Involve a crew member (or members) in choosing the next topic, and take him or her with you when you do your next “walk-around” safety inspection. You might also ask the person to help lead the next meeting.

To get the most out of your safety meetings, it’s best if the whole crew participates. Use these tips to find out how.

Vale la pena que invierta tiempo en las reuniones de seguridad de “información práctica” para alertar a los empleados sobre los peligros del lugar de trabajo. Para aprovechar al máximo sus reuniones sobre seguridad, es mejor que participe todo el personal de forma activa. ¿De qué forma? Trate de seguir estos consejos para los capacitadores: Seleccione los temas de reuniones

relevantes. Si tiene prensas de perforación, hable sobre la seguridad de las mismas. Si debe entrar a espacios reducidos, hable sobre los respiradores y el ingreso a los espacios reducidos. Si observa que los derrames no se limpian de inmediato, analice este hecho. Los empleados son una buena fuente para aportar ideas para las reuniones. Aliente a los empleados a que sugieran temas; a menudo, son los que mejor conocen cuáles son los peligros y dónde están.

Una vez que seleccione el tema, investíguelo. Si desea concentrarse en el uso seguro de una pieza específica de una maquinaria, consulte el manual de operaciones del fabricante. Para manipular sustancias tóxicas, obtenga una copia de la hoja de datos de seguridad de los materiales (Material safety data sheet,

MSDS). Para crear documentos listos para usar sobre diversos temas relacionados con la seguridad, realice una búsqueda con palabras clave: “Cuestiones de seguridad” en la sección Documentos solicitados del portal del cliente en Leavitt Group.

Haga preguntas en lugar de disertar. Introduzca cada punto nuevo que desee analizar al hacer una pregunta a los participantes. Espere un breve momento para que las personas piensen y luego pida a los voluntarios que respondan. Use las respuestas como un trampolín para el debate.

Pregunte sobre la experiencia personal. Si hace una pregunta y nadie tiene la respuesta, pregunte si alguien ha tenido alguna experiencia personal para ayudar al grupo a determinar la respuesta.

Limite la cantidad de tiempo que puede hablar cada persona. Si un miembro del personal está hablando demasiado, invite a alguien más a hablar.

No se aparte del tema. Si las preguntas y comentarios de los miembros del personal se alejan demasiado del tema, dígales que sus inquietudes pueden abordarse más adelante, ya sea en una conversación privada o en una próxima reunión de seguridad. Esto también le aportará ideas para los temas de las futuras reuniones.

Asigne un miembro del personal para que lo ayude. Pídale al miembro (o miembros) del personal que elija el siguiente tema, y llévelo con usted cuando realice su siguiente inspección de seguridad. También podría pedirle a la persona que lo ayude a dirigir la próxima reunión.
