The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

As suggested at the end of this column, knowledge or knowing is power, especially when you keep it under your hat! From our ‘fencing’ lesson we ‘brush’ up on some “C-33” rules for a consumer and then ‘identify’ an issue for Arizona license applicants to consider before heading south…

Q: I have a question that I think you’ll know off the top of your head. A “C-13” license is a specialty license for fencing, but can a contractor that holds a “B” license classification contract to just build a fence?

A: A contractor who holds the “B” General Building license cannot take a job (with the exception of framing and carpentry projects) that involves only one building trade. “B” contractors are required to be performing at least two unrelated building trades on a project unless that contractor holds the appropriate specialty license. While the contractor cannot do the work himself, he can take the contract to build the fence if he subcontracts out to a properly licensed “C-13” fencing contractor.

Q: I need the inside of my house re-painted and I plan to hire a C33 painting contractor to do the work. However, I also have some holes in the drywall that I was planning to have the painting contractor repair, but I am

now being told that I need to hire a drywall contractor to do that work prior to the painter coming in. That seems like a bit of a waste. Is there a limit to what a painter can repair?

A: Thank you for contacting Capitol Services. While there is certainly a limit as to what a painting contractor can repair, he/she can repair holes in the drywall in order to prepare the wall for painting. Generally the rule is that if the work is incidental and supplemental to the main trade being performed then it’s allowed. If the main goal were painting the wall repairing the holes would be considered incidental/supplemental to completing the project properly.

Q: We are currently applying for an Arizona Contractor License and one of the requirements is that all individuals listed on the license application complete a background check. When one of our Officers went to complete the form as required, he noticed that by completing the form it authorizes access to bank and credit records and even college records. This appears to be very intrusive and above what a standard background check would include. Is this standard operating procedure for AZ? Is there any way around it?

A: Yes, the background check is the new standard for everyone listed on a contractor’s

license application. We have heard several complaints about this particular aspect of the background check. We have contacted the Registrar Of Contractors (ROC) to inquire about this and they have indicated that they will not be accessing bank records or college records, and that the background check is strictly for them to review each individual’s potential criminal background.

There is no way around this requirement. We are hoping that the ROC will get enough complaints from applicants to remove the authorization to check bank and college records, especially if they have no intention of accessing that information.

The day I long for every year is upon us! Although the official recess date is not until tomorrow, the Legislature is doing everything in its power to “head out of Dodge” tonight. There are literally dozens of bills that they are trying to rush through so they can meet their own self-set recess date. While I’ll be reporting in more detail about the “good and bad” bills over the coming weeks (and also in my final year-end report which will be sent out by late October), I am a happy to report that one of our sponsored bills, SB 399 (Wright) is on the governor’s desk. Amazingly however, his staff is recommending a veto DESPITE the fact that it passed unanimously out of both houses of the legislature!!!!

Why you ask? Because the governor and his staff have “consumed the kool aid” given to them by the Department of General Services (DGS)! In other words, DGS acknowledges that they had problems paying one of our contractors, John Malloy, but they have corrected the problem and thus the bill is not needed. To which I have replied to both DGS and the governor’s staff that the bill has no effect unless they don’t pay on emergency contracts within 45 days!?

Let me again give you the background on the need for the bill and provide you with a draft letter you can put on your letterhead to send to the governor urging him to pull his “head out of his &*$%!” Following is the fact sheet about the bill:

IN BRIEF: Existing law does not allow the Department of General Services or other agencies to promptly pay for emergency

services rendered to the state THE ISSUE/PROBLEM:John Malloy, an engineering contractor, was

called by the LA Office of the Department of General Services to perform an emergency sewer repair job at the State Building in LA back in the beginning of October, 2012. The sewer problem was so bad that they had to close the building because of the unsanitary conditions!

It turned out that the lateral sewer line that traverses between the street and the building was broken. Fortunately, Mr. Malloy was able to replace the broken pipe after several days of work and sent the state a bill when it was completed in early October.

Unfortunately, despite having enough urgency to have Mr. Malloy come out immediately to repair the sewer problem, DGS totally ignored both his invoice and his phone calls inquiring about the money owed to him!! In early January (over two months later) the executive office of DGS in West Sacramento was contacted in desperation, hoping that this would help “shake loose” the $138,000 that was owed to him. It should be noted, that Mr. Malloy was fast approaching insolvency due to his inability to “float” the owed money much longer!

While the efforts of DGS’ executive office are appreciated, particularly since their small business advocate became directly involved, it still took an additional six weeks (mid-February) before Mr. Malloy was finally paid!

Why? Even though this was an emergency

situation due to the health and safety problems and the fact that workers had to be sent home, the contract (after the fact) STILL had to go through legal review, Mr. Malloy was required to produce a payment and performance bond, proof of general liability insurance and workers’ compensation among other things. Again, why?

During the time that the executive office was involved, it was also discovered that DGS’ staff erred in the use of the wrong contract (which DGS claims will never happen again through future training of their staff); however, even with the use of the correct contract, existing law does not differentiate between regular work and emergency work in terms of the turnaround time to make payments to contractors.

The Solution:The existing California Prompt Payment Act

subjects a state agency that acquires property or services pursuant to a contract with a business to a late penalty payment, if it fails to make payment to the person or business on the date required by the contract.

This measure specifies that emergency work is now subject to the California Prompt Payment Act

Existing law provides a penalty payment of 10% above the United States Prime Rate on June 30 of the prior fiscal year to a certified small business, a nonprofit organization, a nonprofit public benefit corporation, or a small business or nonprofit organization that provides services or equipment under the Medi-Cal program.

This measure includes a contractor performing emergency work or remedial measures related to the accidental or unplanned release of toxic substances within the list of entities entitled to the late payment penalty

No Penalties If Bills Paid On Time:It is absolutely critical to realize the fact that if DGS and other state

agencies pay their bills on time as expected, the provisions of this bill ARE NOT triggered!

In other words, “no fish, no Fowl,” as the expression goes! Pay your bills on time and there are no extra costs to the state, period! It should also be noted that while the penalties help businesses who are owed money, it is also hoped that AnY penalties paid will serve as a bright light to state officials and the Legislature to ask why the penalties were paid in the first place and hopefully correct the problems that caused the delay!

Other Payment Problems:As this bill awaits the action of Governor Brown, it has been learned

through staff at DGS, that Mr. Malloy’s problem is not isolated! It was reported by staff that there have been past problems with the Department of Fish and Game and the Department of Water Resources on promptly paying for emergency work on levees in the Delta as well as other projects.

Dear Governor Brown:

On behalf of my small construction company, I respectfully request YOUR SIGNATURE ON SB 399 (Wright).

It is hard to believe that the existing prompt pay provisions within the State Contract Act do not cover contractors who in good faith provide emergency work to the State of California! I strongly believe that ALL emergency work performed by a contractor MUST be covered under the prompt pay provisions. Furthermore, I strongly support the provision in this measure which states that failure to make these payments to any contractor (who has provided all required documentation) be paid the interest rate of 10 percent above the United States Prime Rate starting on the 46th day of completion of the job.

Please remember, IF a state agency makes the payments within the 45-day window, the interest penalties DO NOT apply! Therefore, if agencies do their job, this measure will not have AnY negative effects.

For these reasons, I strongly urge you to sign this important measure.

Our company is a professional organization that has been providing all types of excavation services in the San Fran-

cisco Bay Area for over 15 years. We specialize in shoring, drilling, grading and site preparation needs. Our projects are wide and varied from excavating large hillsides and creating

lakes to digging swimming pools.

We are seeking an Estimator for our growing company. Estimator must be proficient in estimating public work for excavation, demolition, shoring and pipe work.

• Interpret architectural and structural drawings, specifica-tions, and bid documents

• Perform take offs and write RFPs, and RFIs• Review Job site conditions to determine scope, costs and

project timeline• Compile detailed scope of work inclusions, exclusions, &

clarifications for estimates• Attention to detail, strong organizational and time man-

agement skills

Job Requirements

• Previous experience with computer estimating using Dodge Pro and similar sites a plus

• Project Manager experience is a plus but Estimating is the priority

• Experience in Earthwork is also a plus• Work independently as well as part of a team and accept

feedback constructively• Ability to communicate efficiently with the owner, follow

directions and have own transportation• Local references are a prerequisite of the position
