The City of Mill Valley is pleased to announce a street maintenance and sewer rehabilitation project that will take place this summer on East Blithedale Avenue. The project will involve improvements to the road surface to promote a smooth and quiet ride, new traffic markings, sewer pipe repair, and new manholes. While the project will cause short-term delays and traffic congestion over a period of two months, the benefits of this project will be significant, including the repair of sewer infrastructure and improved pavement conditions.

Construction on East Blithedale from Elm/Alta Vista Avenue to Camino Alto will take place from June 24th through August 23rd, while schools are not in session, Monday through Friday, from 8:00 am to 5:00 pm. While East Blithedale will not be entirely closed to through traffic at any point, traffic will often be limited to one lane, and therefore delays and traffic congestion can be expected.

If possible, we encourage you to plan alternate routes to avoid travel on East Blithedale. If you must drive on East Blithedale, add time to your travel estimates and anticipate delays.

Drain Improvement Project

This work consists of the rehabilitation of an existing storm drain pipe that extends approximately 250 feet from a manhole at the intersection of Vendola Drive and La Pasada Way to the outfall into Las Gallinas Creek. The existing 48 inch inside diameter (ID) corrugated metal pipe (CMP) will be slip-lined with a 30 inch outside diameter (OD) smooth walled HDPE liner pipe. Working underwater in tidally influenced Las Gallinas Creek, in zero visibility conditions, sediment from in and around the discharge end of the outfall of the 48 inch ID host pipe will be removed to insert a plug. The remainder of the pipe will be cleared of up to 100 cubic yards of internal sediment. The 30 inch OD HDPE liner pipe will be inserted and pulled through the 48 inch ID CMP host pipe. The voids or annulus between the host pipe and liner pipe will be filled with grout. The liner pipe will extend at least 12 feet beyond the existing host pipe to reach the deepest portion of the channel. The end of the existing pipe and extended sextion will be held down by 8 helical anchors. Pipeline markers will be attached to the anchors and an additional anchor with marker will be placed beyond the end of the new liner. A rubber tide valve will be clamped on the discharge end of the liner pipe. The Engineer’s estimate for this project is $325,425.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Becoming a Qualifier has certain ‘qualifications’ in whatever form is chosen. Understanding the differences between RME/RMO may take an expert and an example of what can go wrong. A licensed corporate construction company can be ‘removed’ to create a new firm, but they will discover some thing’s can’t be ‘transferred’…

Q: My Company’s Responsible Managing Employee (RME) has resigned and I have been asked to be the Responsible Managing Officer (RMO) for the corporation’s license. However, I have my own personal license that I need to keep active for small jobs that I do on the side.

I understand that I need to have at least 20% ownership in the company in order to keep both licenses active, which isn’t a problem. My concern is that if something goes wrong on a job that my company contracts for and there is a complaint filed, is that going to affect my Sole Owner license? And will I be held responsible for judgments/claims against the other license?

A: While it depends on the circumstance, as the Responsible Managing Officer you do hold some liability for claims, judgments, and complaints against the license. If the company license has an unsatisfied judgment that results in the suspension of the license while you are the RMO, it is likely that the CSLB will also suspend your Sole Owner license until the judg-ment has been satisfied.

In fact, to give you an example of a case where problems with a company license trickled down to an individual license, in a recent case the CEO of a corporation entered in to a contract with a homeowner, took a down payment, and then never did any of the work. This of course resulted in the homeowner filing a complaint. The RMO of the company claimed to know nothing about the project and further claimed that he wasn’t involved in the business operations. The company was cited with several violations that resulted in the license being revoked. A separate order was signed which provided for the revocation to be stayed on the RMO’s individual license provided that he comply with all terms and conditions including a 2-year probation, $15,000 disciplinary bond, and restitution to be paid within 90 days in the amount of the down payment that the homeowner paid.

As always, we recommend that you contact a construction attorney to dis-cuss the legal liabilities associated with acting as a Responsible Managing Officer.

Q: We are going to close our current corporation down and start a new one. Since the current corporation will no longer need the contractor’s license number, is it possible to transfer the number to the new corporation?

A: License numbers cannot be transferred from one corporation to another. When a new entity is formed you are required to obtain a new contractors license number for that entity.

Q: We currently have a General “A” license and we have an employee with an inactive “B” license. Can we add that employee as the “B” Qualifier on our license, or do we need to use the same Qualifier that currently holds the “A”?

A: You can add your employee as the “B” qualifier on your license and you are not required to use the same Qualifying individual who currently holds the “A” classification. You can have a different Qualifier for each separate classification on your license.

Will California lawmakers have to work this weekend? We’ll find out by the end of business today: The deadline for passing a budget beckons, so if legislators don’t ratify the latest budget accord today, they will have to do so Saturday before midnight. If they don’t succeed by tomorrow night, they will NOT receive ANY pay until the budget is passed!

This is due to an initiative that was approved by the voters several years ago that requires the budget to be sent to the governor by Midnight on June 15th. What will help them achieve their goal is the fact that a majority is only required to pass the budget in both houses, rather than the two thirds super majority that used to be the requirement. Time will tell! Stay tuned!

Update on Excavation

I reported two weeks ago that a hearing was scheduled in the Capitol early last week to determine if there needs to be further legislative or regulatory actions taken to combat excavators who do not call to have their excavation sites marked before they dig. Attached is the background paper that was handed out at the committee hearing which provides an excellent overview of the issue.

So, what was the outcome of the hearing? Virtually everyone (including myself) testified that no further actions should be taken until an accurate data collection process is developed which pinpoints if there is a problem and if so, how it should be addressed.

The bottom line as to the real reason for the hearing is simply, Senator Jerry Hill, who is chair of this committee and whose legislative district is in San Bruno where PG&E’s gas line explosion occurred, needed the political headlines to show his constituency that “he’s” on top of the situation!

Thankfully, AB 811 (Assembly member Bonnie Lowenthal) which “cutely” has the same number as the phone number you call to contact Dig Alert, has been gutted by my colleagues and I to accomplish the

data collection that is necessary. And, the data collection provisions were placed in the bill well before Senator Hill EVER thought about grandstanding with a hearing (and note that he’s a co-author on AB 811 as well, so why the hearing??)! Following is the current language in the bill.Cheers!

Excavations: regional notification center system: contractor certification.Existing law generally requires any person planning to conduct an excavation to contact a regional notification center prior to excavation, and, if practical, to delineate the areas to be excavated. Existing law authorizes the Attorney General, a district attorney, or the state or a local agency that issued a permit to excavate to bring an action for the enforcement of a civil penalty against an operator or excavator who negligently or knowingly and willfully violates the requirements of these and related provisions.The bill would require statewide information, as defined, provided by operators and excavators regarding facility events, as defined, to be compiled and made available in an annual report by regional notification centers and posted on the Internet Web sites of those regional notification centers.Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no.

The people of the State of California do enact as follows:

1 SECTIOn 1. Section 4216.6 of the Government Code is2 amended to read:3 4216.6. (a) (1) Any operator or excavator who negligently4 violates this article is subject to a civil penalty in an amount not5 to exceed ten thousand dollars ($10,000).6 (2) Any operator or excavator who knowingly and willfully7 violates any of the provisions of this article is subject to a civil8 penalty in an amount not to exceed fifty thousand dollars ($50,000).9 (3) Except as otherwise specifically provided in this article, this10 section is not intended to affect any civil remedies otherwise11 provided by law for personal injury or for property damage,12 including any damage to subsurface installations, nor is this section13 intended to create any new civil remedies for those injuries or that14 damage.15 (4) This article shall not be construed to limit any other provision16 of law granting governmental immunity to state or local agencies17 or to impose any liability or duty of care not otherwise imposed18 by law upon any state or local agency.19 (b) An action may be brought by the Attorney General, the20 district attorney, or the local or state agency which issued the21 permit to excavate, for the enforcement of the civil penalty pursuant22 to this section. If penalties are collected as a result of a civil suit23 brought by a state or local agency for collection of those civil24 penalties, the penalties imposed shall be paid to the general fund25 of the agency. If more than one agency is involved in enforcement,26 the penalties imposed shall be apportioned among them by the

27 court in a manner that will fairly offset the relative costs incurred28 by the state or local agencies, or both, in collecting these fees.29 (c) Statewide information provided by operators and excavators30 regarding violations of the requirements of this article and damages31 resulting from those violations facility events shall be compiled32 and made available in an annual report by regional notificationcenters and posted on the Internet Web sites of the regional2 notification centers.3 (d) For purposes of subdivision (c), the following terms have4 the following meanings:5 (1) “Facility event” means the occurrence of excavator6 downtime, damages, near misses, and violations.7 (2) “Statewide information” means information submitted by8 operators and excavators using the California Regional Common9 Ground Alliance’s Virtual Private Damage Information Reporting10 Tool. Supplied data shall comply with the Damage Information11 Reporting Tool’s minimum essential information as listed in the12 Common Ground Alliance’s most recent Best Practices Handbook.

Avoid Heat Illness When it is hot outside, your body temperature can rise to dangerous levels. Normally, your body cools itself through sweating. However, in hot and humid weather, sweating is not enough and the result can be a heat illness. Staying Cool Follow the suggestions below to stay cool when working in hot weather: • Wear loose, light-colored clothing and

some type of hat. • Adapt to working in hot conditions

gradually, especially if performing strenuous tasks.

• Take breaks in the shade when possible, and remove any outer protective gear you may be wearing.

• Avoid overexerting yourself during peak temperature periods (midday).

• Drink liquids frequently, even if you don’t feel thirsty - at least eight ounces every 20 to 30 minutes. Choose water, fruit juice or sports drinks and stay away from liquids containing caffeine, which can dehydrate you.

Recognizing the Symptoms There are three forms of heat illness, each with its own distinct symptoms: • Heat Cramps – severe muscle spasms

in the back, stomach, arms and legs, which are attributed to the loss of body salt and water during periods of heavy perspiration

• Heat Exhaustion – heavy sweating, cool or pale skin, nausea, headache, weakness, vomiting and fast pulse

• Heat Stroke – high body temperature, sweating stops, red and often dry skin, rapid breathing and pulse, headache, nausea, vomiting, diarrhea, seizures, confusion or unconsciousness

Providing Treatment It is essential to treat heat illness as soon as possible. If you are feeling any of the above symptoms, inform a co-worker and ask for help. If you suspect that a fellow worker has any of these conditions, follow the first-aid suggestions below: • Heat Cramps – Move the victim to a

cooler area and allow them to drink approximately six ounces of water every 15 minutes. Follow up with a medical examination.

• Heat Exhaustion – Move the victim to a cooler area and keep them lying down with their legs slightly elevated. Cool their body by fanning and applying cool, wet towels. If conscious, allow the victim to drink approximately six ounces of water every 15 minutes. Follow up with a medical examination.

• Heat Stroke – You or a bystander should immediately call an ambulance. Meanwhile, move the victim to a cooler area, remove their outer clothing, immerse them in cool water or apply cool, wet towels or cloths to the body. Do NOT give them liquids. If medical help is delayed, call the hospital for further instructions while waiting. Heat stroke is life-threatening, so it’s important to move quickly!

Safety Reminder The risk of heat illness increases with age, poor diet, being overweight, insufficient liquid intake, poor physical condition and/or when taking medication. Never take salt tablets without your doctor’s approval. Be aware of weather conditions when you will be working outside so that you can be prepared with appropriate clothing and beverages. If you are working outside and start to feel any adverse symptoms, inform your supervisor and take a break.

Heat illness can be a serious threat. Your best defense is to learn how to stay cool when the weather heats up.

Evite la enfermedad por calor Cuando hace calor afuera, la temperatura de su cuerpo puede aumentar a niveles peligrosos. Generalmente, su cuerpo se refresca solo mediante la transpiración. Sin embargo, en un clima caluroso y húmedo, la transpiración no es suficiente y el resultado puede ser una enfermedad por calor. Mantenerse fresco Siga las sugerencias a continuación para mantenerse fresco cuando trabaje en un clima caluroso: • Use ropa floja, de colores claros y algún

tipo de sombrero. • Adáptese a trabajar en condiciones

calurosas gradualmente, en especial si realiza tareas agotadoras.

• Tome descansos en la sombra siempre que sea posible y quítese todo equipo de protección externo que pueda estar usando.

• Evite fatigarse en exceso durante los períodos de temperatura pico (mediodía).

• Tome líquidos con frecuencia, incluso si no tiene sed, al menos 8 onzas cada 20 ó 30 minutos. Elija agua, jugos de fruta y bebidas deportivas y manténgase alejado de los líquidos que contengan cafeína, lo cuales lo pueden deshidratar.

Reconocimiento de los síntomas Existen tres formas de enfermedad por calor, cada una con sus propios síntomas distinguibles: • Calambres por calor: calambres musculares

Suministro de tratamiento Es esencial tratar la enfermedad por calor lo antes posible. Si siente algunos de los síntomas anteriores, infórmele a un compañero de trabajo y pídale ayuda. Si sospecha que un compañero de trabajo tiene alguna de estas condiciones siga las recomendaciones de primeros auxilios que presentamos a continuación: • Espasmos por calor: mueva a la víctima a

un área más fresca y dele de beber aproximadamente 6 onzas de agua cada 15 minutos. Prosiga con un examen médico.

• Agotamiento por calor: mueva a la víctima a un área más fresca y manténgala recostada con las piernas levemente elevadas. Enfríe su cuerpo abanicándolo y aplicando toallas húmedas frías. Si está consciente, dele a la víctima de beber aproximadamente 6 onzas de agua cada 15 minutos. Prosiga con un examen médico.

• Golpe de calor: usted o alguien que esté en el lugar debe llamar de inmediato a una ambulancia. Mientras tanto, mueva a la víctima a un área más fresca, quítele la ropa de abrigo, sumérjala en agua fresca o aplíquele toallas o paños húmedos fríos en el cuerpo. NO le de líquidos. Si la ayuda médica se demora llame al hospital para que le brinden más instrucciones mientras espera. Los golpes de calor ponen en riesgo la vida, por eso es importante moverse rápidamente.

Recordatorio de seguridad El riesgo de enfermedad por calor aumenta con la edad, la mala alimentación, el sobrepeso, la ingesta insuficiente de líquidos, la mala condición física y/o la medicación. Nunca tome píldoras de sal sin la aprobación de su médico. Esté atento a las condiciones climáticas cuando trabaje al aire libre para poder estar preparado con la ropa y bebidas adecuadas. Si se encuentra trabajando al aire libre y comienza a sentir algún síntoma negativo, infórmele a su supervisor y tome un descanso.

La enfermedad por calor puede ser una amenaza seria. Su mejor defensa es aprender a mantenerse fresco cuando el clima se pone caluroso.

Cal-West Rentals is in search of a technician to work within our service department at our yard in Petaluma. They will be responsi-ble for repairing and maintaining all types of equipment including small engines, heavy construction equipment, and delivery trucks.

The work is mostly in the shop, but also includes field service calls and deliveries of equipment. It is a full-time position, M-F, with full benefits. This person will be reporting to our service manager. Must possess knowledge and experience in the mechanical and construction field.

Minimum Qualifications:
