The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.
If you are reading this now and are unlicensed, a resolution to become a licensed contractor is a good choice in 2013. While most of us have been working to make (and keep!) New Year’s resolutions, the CSLB has been hard at work implementing new laws and regulations for contractors…
First, contractors should be aware that employee-reporting laws have been strengthened by the passage of Assembly Bill 1794. The new law, which took effect January 1, 2013, authorizes the Employment Development Department (EDD) to share new-hire employee information with agencies in the state’s Joint Enforcement Strike Force on the Underground Economy (of which the CSLB is a member) and the State Compensation Insurance Fund. This new practice of information sharing among state offices will ensure that employers are accurately reporting their employee payroll to their insurance carrier for establishing their Worker’s Compensation premium.
Contractors are currently required to carry adequate Worker’s Comp insurance for employees or submit an exemption or Certificate of Self-Insurance. However, a CSLB study revealed that nearly half of licensed contractors either claim an exemption based on having no employees or maintain a minimum policy under which no employees are reported to their insurance carrier.
“This landmark legislation benefits consumers, contractors, and employ-ees,” said CSLB Registrar Steve Sands. “When employers properly report and insure employees, consumers are protected by Workers’ Compensation insurance coverage if an accident occurs on their property, businesses pay less in insurance premiums, and employees are eligible for unemployment insurance when they’re properly listed on the payroll.”
next up, Assembly Bill 2237, sponsored by the CSLB, more clearly defines the term “consultant” as it relates to building and construction work. The new law states that anyone who provides or oversees bids for construction, arranges for subcontractor work and schedules, and/or has oversight for a project is, in fact, acting in the capacity of a contractor and must be state-licensed. In California, a state contractor license is required for any project that is $500 or more in combined labor and material costs.
Another CSLB-sponsored bill strengthens enforcement authority over contractors who violate state contracting laws. AB 2554 amends Business and Professions Code sections 7011.4 and 7106.5 to enable the CSLB En-forcement division and its representatives to issue notices to appear in court related to disciplinary actions against a license.
Several other laws affecting consumers, contractors, and the construction
industry took effect as the new calendar arrived:
AB 2219 indefinitely extends the requirement that all C-39 Roofing contractors obtain workers’ compensation insurance coverage, even if they certify that they have no employees. The bill also extends, indefinitely, the requirement that insurers conduct annual audits, and requires that these audits be conducted in person to verify the accuracy of the reported number of employees.
AB 2114 enacts new construction permit requirements for swimming pools, spas, or public wading pools.
AB 2339 requires state regulators and those involved in the heat pump and geothermal heating and cooling industries to evaluate policies and develop infrastructure for wider use of these technologies.
SB 1576 allows the CSLB to take administrative action if a licensee files a false complaint again another licensee.

The California State Legislature returned this past Monday to commence the 2013-2014 legislative session. As we all know, this is going to be a very interesting year! As Sacramento Bee Columnist Dan Walters writes:
“Democrats now control all the strings in the state Capitol.
They can, at least on paper, do anything they wish without giving Republicans anything more than cursory attention.
However, sole ownership also means sole responsibility. No more pointing the finger at recalcitrant Republicans. No more excuses for failing to balance the state budget – especially since voters also provided billions of dollars in new tax money. No more ducking education reform and myriad other issues that have festered year after year.”
Obviously, there are a tremendous amount of potential pitfalls that could affect business in California IF the Democrats over-react to their new-found powers. While there will, no doubt, be some things that will indeed hurt business in California, I strongly believe that between the moderate Democrats in both houses, coupled with a governor who won’t allow the more liberal wing of the party to overstep their new-found power, I think California business won’t ultimately “fall into the sea!” One issue that has already begun to shape up as being a true positive for business this session is CEQA reform. Following is an article from the San Diego Tribune that lays out the issue quite well.

OverviewThe California Environmental Quality Act is generally recognized as the strongest state environmental law in the nation. Signed by then Gov. Reagan in 1970, CEQA initially applied only to public
agencies. The California Supreme Court later extended its reach to private development.
Under CEQA, agencies such as a cities and counties must identify the environmental effects, if any, of most major project proposals. The agencies also determine whether a full-blown environmental impact report is required to offset the harm. Public review is mandatory.
A project must identify impacts and offer mitigation in such diverse categories as air quality, water, traffic, noise, wildlife and aesthetics, among others. Developers can address the impacts in many ways, such as adding traffic lanes, providing open space, contributing to a sewer plant expansion, or downsizing the project.
SACRAMEnTO — Signed by Republican Gov. Ronald Reagan and strengthened by a series of court rulings and legislation, California’s bedrock environmental law in recent years has been slowly chiseled in response to the bleak economy and flurries of litigation that have compounded costs for developers and public agencies.
But this could be a watershed moment for the California Environmental Quality Act as powerful Democrats and their staunch allies return to the Capitol in January to explore legislation that could remove some of the law’s formidable legal barriers to projects while still making sure environmental safeguards do not crumble.
The debate — a continuation of a frantic late campaign last summer to make the law more business friendly — is also being fueled by an early December court order rejecting a $200 billion, 40-year regional transportation plan adopted by the San Diego Association of Governments.
The SAnDAG plan improperly permits greenhouse gas emissions linked to global warming to increase from 2020 through 2050, a judge ruled, siding with critics of the plan. But it does comply with reduction standards in state law through 2020 and was given the

green light by the state Air Resources Board, SAnDAG maintains.
The San Diego case illustrates what’s wrong with the law, according to Sen. Michael Rubio, a Bakersfield Democrat and leader in the drive to make it more difficult to use what is commonly known as CEQA to challenge projects in court.“It highlights the point that you can meet or exceed the law and still get sued and stopped,” Rubio said.
Jack Shu, president of the Cleveland national Forest Foundation board that filed the suit, said the court victory “exemplifies exactly why we need CEQA.” Shu pointed out that without the litigation SAnDAG would be free to pursue its plan and spend billions of dollars even though it would adversely affect the environment, among other shortcomings.
Rubio has been in negotiations with Senate President Pro Tempore Darrell Steinberg, D-Sacramento to craft a compromise bill.

negotiations center on a handful of core proposals:• A legal challenge could not be filed against a project for
failing to adequately address an impact as long as the developer has complied with umbrella state or federal laws that specifically cover the impact, such as the Endangered Species Act, the Clean Air Act and the Clean Water Act.
• A project could not be challenged in court if it complies with an approved city or county general plan, if those plans have an approved environmental impact report (EIR) and the project is consistent with the Sustainable Communities Strategy launched by Senate Bill 375 authored by Steinberg. That law established a path to lower greenhouse gas emissions linked to global warming through “smart growth” building policies that also encourage more alternative transit, from buses to bicycle paths.
• Those filing lawsuits must reveal their financial interests and who is paying the legal costs. There is also debate on whether to extend those transparency requirements to the local planning process as well so decision-makers know whether a protest is being lodged out of genuine concern for the environment or if there is a profit motive.
“The challenging thing about a law like this is everybody knows it needs fixes,” Steinberg said. ”The question is, what are the fixes that preserve the strength of the law and at the same time (address abuses)? That’s what we will grapple with.”
Last summer, Rubio made a late push for an overhaul that
Steinberg intercepted, sending the bill to the sidelines before it was formally introduced.
CEQA is “a great law, but a law that needs work,” Steinberg said at the time. “We’re going to take it on and we’re going to take it on in a big way.”
Gov. Jerry Brown, who as attorney general threatened local governments with litigation if they didn’t address greenhouse gas emissions in their planning documents, has signaled an interest in reigning in CEQA lawsuits on a number of occasions.
“The theology of CEQA and its endless analyses — that’s something that can be improved,” he said in September 2011. And last July he said: “I have never seen any CEQA exemptions I didn’t like.”
Their challenge will be convincing fellow Democrats, especially if environmentalists keep up their stiff resistance.
Kathryn Phillips, director of Sierra Club California, is critical of Rubio’s centerpiece provision to block lawsuits if the project meets some umbrella general plan or provisions in law.
Phillips said that strategy ignores the fact that some plans are too old and weak, unable to keep pace with the impacts of growth that has already occurred.“CEQA makes sure you take into account the world as it is, not the world as it was,” she said.
Phillips contends that just a tiny minority of projects that undertake full-blown environmental impact reports wind up in court. “The rhetoric we hear about the lawsuit element is exaggerated,” she said.
But critics of the current process say even the threat of lawsuits can be leveraged to extract costly mitigation concessions or force developers and public agencies to protect themselves by agreeing to an extensive EIR that takes time and money.
Assemblyman Brian Jones, R-Santee, said environmentalists and unions have used CEQA to block projects until developers concede to demands that can range from costly changes to union wages.
“It’s not being used to protect the environment. It’s being used to further their agendas,” he said.
Jones also criticized lawmakers for handing out exemptions to major projects pushed by those with connections, such as a recent

favorable deal for a football stadium in Los Angeles.
Assemblyman Rocky Chavez, R-Oceanside, said he saw the delays and costs add up as a councilman. “It puts a chill on development,” he said. “I don’t know if the costs are in line with the value received.”
Democrats may be open to changes, but they have been pretty selective in changing CEQA, even as GOP pressure intensified during the Great Recession. Republicans have long believed that CEQA’s regulatory hurdles have hurt California’s economic climate.
Senate Republican Leader Bob Huff of Diamond Bar said CEQA is often used as a “blunt instrument to crush” development.However, polls and elections suggest it may be difficult for Rubio to win in the court of public opinion.For example, in 2010 Californians rejected a bid to toss out the costly and controversial law known as Assembly Bill 32 to reduce greenhouse gas emissions.
Sen. Fran Pavley, an Agoura Hills Democrat who as an assemblywoman wrote that law, says she is willing to look at what develops but is wary.“We have already made it easier with amendments in the last couple of years for projects to use existing plans, but we have to be careful that we make sure these plans actually analyze and mitigate the effects of the project,’ she said in a statement. Pavley added she is “open to the discussion on how to minimize unnecessary project delays due to any abuses of the primary intent of CEQA.”Sen. Anthony Canella, R-Ceres, who supports Rubio’s effort, said one of his major concerns unrelated to the SAnDAG case are instances where there may be hidden ulterior motives. That’s why the transparency provisions regarding who is financially behind protests are necessary, he said.”I don’t want the environmental bar lowered,” Canella said. “I just want those people who use it for personal gain or extortion to be driven out.”

Flagging Safety 101As a very important part of the construction crew, flaggers ensure that other workers can get the job done by diverting traffic away from the job site. They are required on construction sites where barricades and signs cannot successfully divert traffic. This position can be extremely dangerous in high speed areas or in the presence of aggressive drivers. There are several safety tips that will ensure a safe working environment on the roadside. Flagger Dos:
1. Attend safety training on directing traffic, understanding work zone layouts and responding to emergency vehicles.
2. Ask your supervisor how to handle situations with particularly aggressive drivers.
3. Wear a vest, shirt or jacket with highly visible colors: fluorescent orange, yellow or green.
a. In the evening, wear reflective clothing so drivers can see you from 1,000 feet away.
b. Wear a hard hat, long-sleeved shirt and long pants to protect against flying debris.
4. Stay alert to your surroundings at all times.
5. Stand on the shoulder visible to oncoming traffic – do not stand in the traffic lane.
6. Establish a communication system with other flaggers and the rest of the crew to use in an emergency.
7. Be courteous to motorists as you encounter them. Do not respond to angry drivers; instead call law enforcement if necessary.
Flagger Don’ts:
1. Avoid standing in areas where you may be crushed.
2. Avoid standing in the shade, around a curve or over the crest of a hill, as drivers may not see you.
3. Wait for a co-worker to relieve you before leaving your post.
4. Avoid distracting activities such as reading, day dreaming or talking with co-workers.
5. Do not listen to music.
6. Never turn your back to oncoming traffic.
7. Stay a safe distance away from construction equipment.
Flaggers are the barrier between a construction site and traffic. Stay alert and keep your guard up!

Señalización de seguridad 101Como una parte muy importante de la cuadrilla de construcción, los señalizadores aseguran que los trabajadores puedan realizar el trabajo desviando el tránsito del lugar de trabajo. Se requieren en los lugares en construcción donde las barreras y las señales no pueden desviar el tránsito con éxito. Esta posición puede ser extremadamente peligrosa en las zonas de alta velocidad o en la presencia de conductores agresivos. Existen varios consejos de seguridad que asegurarán un ambiente de trabajo seguro al lado del camino. Lo que deben hacer los señalizadores:
