Good Morning

Thank you for the opportunity to speak once again, to this matter.

Rob and Renata recognize the mandate of, and support the important work, the TRCA does in preserving our natural resources.

They appreciate this committee’s choice at the last meeting to request a staff report to illuminate the various factors that you needed to consider before making a final decision today.

As they stated in their letter to you of April 27th

, 2012 their desire is to secure a greater level of security of their home for their children and themselves.

They have reviewed the staff report prepared for today’s meeting which includes comments from staff at the City of Toronto.

One item to correct in Toronto report is this property is at the rear of the building, as the front faces south toward the river. Rob and Renata are, as could be expected, disappointed with the conclusions reached in that report and not all decisions are agreeable to all parties in all cases.

Please consider that Toronto City Staff have indicated this is passive park land, too small and isolated from the rest of the park area to be used effectively for any recreational purpose.

They are hopeful that you, the members of this committee, will consider this aspect and respectfully request that the TRCA consider, and agree to the sale of this land

PROPERTY LOCATION AND AREA DESCRIPTION The property is located on the southeast corner of William Carson Crescent and Yonge Street in the City of Toronto and has a width of 25 metres (82 feet), a depth of 92.5 metres (303 feet) and a total lot area of 0.31 ha (0.77 acres ). The property is situated at the toe of slope of the West Don River Valley Corridor and entirely within a TRCA Regulated Area. The valley corridor in this area consists of a heavily vegetated upper slope which is interrupted by existing development along the Yonge Street corridor. Located to the east of the Yonge Street corridor is a lower valley slope and valley bottom lands including the floodplain associated with the West Don River. A location map of the subject property can be found in Attachment 1.

The front 48 metres (157 feet) of the site is developed with a commercial parking lot built prior to the adoption of Ontario Regulation 166/06 (Development, Interference with Wetlands and Alterations to Shoreline and Watercourse Regulation). The rear half (45 metres or 148 feet) of the property contains a forested 2.5:1 slope at the steepest portion. The easterly edge of the asphalt parking lot is generally coincident with the toe the valley slope in this area. The vegetated slope at the rear of the property is part of an extensive vegetated valley landform system known as the West Don River valley that continues for many kilometres to the southeast and northwest of the subject site. An aerial photograph of the site can be found in Attachment 1.

TRCA JURISDICTIONPursuant to Ontario Regulation 166/06, a permit is required from TRCA prior to any development, if in the opinion of TRCA, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development.

Development is defined as:i) the construction, reconstruction, erection or placing of a building or structure of any

kind,ii) any change to a building or structure that would have the effect of altering the use or

potential use of the building or structure, increasing the size of the building or structure or increasing the number of dwelling units in the building or structure,

iii) site grading,iv) the temporary or permanent placing, dumping or removal of any material, originating on

the site or elsewhere.

An Ontario Regulation 166/06 permit must be applied for and obtained before a municipal building permit can be issued. Based on the proposed development plan TRCA staff concludes that the conservation of land will be affected and therefore does not meet the test of the Regulation. Before refusing the permit, TRCA must hold a Hearing to which the applicant is a party (Conservation Authorities Act, R.S.O. 1990 c. C27-28). In accordance with the Conservation Authorities Act, the applicant must be afforded the opportunity to require a hearing before the Executive Committee (sitting as a Hearing Board) when staff is recommending refusal of an application.

It should be noted that TRCA staff review all permitting requirements in concert with TRCA's Valley and Stream Corridor Management Program (VSCMP, 1994) policies.

THE PROPOSALThe proposal is to excavate and remove the lower half or 33 metres (108 feet) of the existing forested slope (valley landform) to accommodate a new 12-storey residential condominium and five levels of underground parking structure.

Under this proposal, 12.5 metres (41 feet) of vegetated valley slope would remain along the easterly edge the site and the uppermost 21 metres (69 feet) of slope would remain on the adjacent property to the east.

The east basement wall of the building will be designed as a retaining wall to support the remaining upper half of the slope. The difference in elevation between the existing parking lot and where the slope will be cut to accommodate the building is approximately 10 metres (33 feet). The area within the site that contains natural vegetation is 0.159 ha (0.39 acres) which is just over half of the site area. The proposed development would result in the removal of over 46% of the total natural vegetation on the site.

Within this partially developed area of the West Don River Valley Corridor, TRCA staff consistently requests that new developments include a 10 metre vegetated buffer zone between the proposed development limit and established limit of the natural feature or natural hazard located on the property. In this case TRCA staff has requested that the building be setback a minimum of 10 metres from the staked toe or bottom of the slope. The proposed development provides no buffer to the toe of valley slope and requires the removal of half of the valley landform. BACKGROUND AND STATEMENT OF ISSUESThis TRCA permit application was submitted prior to the applicant obtaining the necessary municipal planning approvals. In most cases planning approvals are received by the applicant before a TRCA permit is approved so that the form of development is established prior to the detailed construction permit application. To date the applicant has not resolved their planning issues with the City of Toronto. The building height and rear development limit remain unresolved. A report outlining TRCA staff involvement in the planning application related to the property is outlined in a separate report that was provided to the Executive Committee at its meeting held on March 2, 2012. A copy of the previous report is attached for the Hearing Board's reference. (Attachment 1)

Since November 2011, TRCA staff has attended numerous meetings with the applicant and City of Toronto staff in order to find a resolution to the applicant's planning issues. In March of 2012, TRCA and City staff presented an alternative rear development limit to the applicant. The applicant subsequently rejected the alternative rear development limit and has decided to pursue their original development proposal before TRCA's Hearing Board in the absence of City Council Official Plan and Zoning amendment approvals.

For TRCA, the challenge has been to establish the appropriate building footprint when the site is seriously constrained by the subway easement on the streetside and the steep, wooded slopes of the valley corridor on the east side of the property. The balancing of the land use, building height, footprint and technical requirements for access into underground parking and the protection of sensitive valley slopes are a key challenge.

STAFF REVIEW OF THE PERMIT APPLICATION

Conservation of LandThe submission impacts the conservation of land as it negatively impacts a portion of the valley corridor and further affects the habitat function of the valley system. The submission does not comply with the principles, objectives and polices of the VSCMP. Further to the direction set out in Section 4.1.1 (New Urban Development) of the VSCMP, the proposal is not consistent with Policy 4.2 (Existing Development) as follows:

"The Program recognizes that where development has occurred within valley and stream corridors increased flexibility for valleyland management is required. To this end, the Authority's policies and criteria for existing development within these areas permit higher levels of risk associated with flooding, erosion and slope instability, and recognize that environmental rehabilitation is more limited. Inherent in these policies is the objective to minimize, reduce or eliminate these risks and also achieve environmental protection and rehabilitation to the fullest extent possible. The application of these policies will also have regard to the characteristics of the adjacent corridor reach; therefore, opportunities for development and redevelopment of any site will be consistent with, and dependant upon the extent and nature of existing development on the subject site and with development patterns within the corridor reach as a whole"

The proposed development limit will extend significantly beyond the existing limit of development on the site (easterly edge of asphalt parking) and well beyond the limit of development (office tower) that exists on the adjacent property to the south. The proposal does not achieve the objectives set out for "Existing Development" of the VSCMP.

The applicant has indicated that they are prepared to provide for on site or off site compensation for the loss of trees that would occur. The loss of the trees within the valley is not the only issue. The significant issue with this permit is the loss of a portion of the valley slope and natural landform in this area. Natural valley landforms cannot be recreated as such and therefore compensation of the same is impossible. The partial removal of the slope on the subject property represents a permanent loss of a natural landform known as the West Don River Valley Corridor.

CUMULATIVE IMPACTS AND THE PRECEDENT The submission is also not supported because it contributes to the impact created by cumulative loss and degradation of natural areas and associated biodiversity within the West Don River valley system. Permitting this intrusion could be argued by future applicants to have established a precedent which will lead to similar proposals within the TRCA jurisdiction, given the constant pressure for more land use intensification. It should be noted that to the north of the subject property along the east side of William Carson Crescent, there has been in the past significant alteration of the natural valley slope through the construction of retaining walls. The modifications of the valley slope on William Carson Crescent occurred prior to May 2006 when TRCA's Regulation 166/06 was adopted and TRCA first began to regulate development in this part of the Don Valley corridor.

If this application is approved, staff will have difficulty in opposing other applications or structures and/or fill within this part of the West Don River Valley Corridor, which will result in additional negative impacts to the watershed.

CONCLUSIONS AND RECOMMENDATIONIn summary, staff recommends that the application be denied for the following reasons:

1. The submission will affect the conservation of land as it:results in negative impacts to a portion of the West Don River Valley Corridor for the

purpose of creating a new multi-storey residential building within the undeveloped valley portion of the property;results in the removal of half of the upper valley slope and over 46% of the natural

vegetation on the site therefore expanding the urban edge within the valley and resulting in a loss to overall habitat value; and has a detrimental impact due to the cumulative loss of natural cover within the City

of Toronto.

2. The submission does not comply with the overall principles, objectives and policies of TRCA's Valley and Stream Corridor Management Program. Specifically, it does not conform with Sections 2.2.2 B) (Program Objectives), 4.1 (New Development) and 4.2 (Existing Development).

3. The submission could be argued by future applicants to have created a precedent that will:

result in future consideration of similar proposals within this portion of the West Don

River valley and other urbanized areas of the TRCA's jurisdiction;undermine TRCA's policies; and

reduce TRCA's ability to defend such policies at the Mining and Lands Commission.

The subject property known as 4155 Yonge Street is located south of Highway 401 and on the southeast corner of William Carson Crescent and Yonge Street in the City of Toronto. The property is situated below the top of bank of the West Don River Valley Corridor and entirely within a Toronto and Region Conservation Authority (TRCA) Regulated Area. A key map identifying the general location of the property is Attachment 1. The property is irregular in shape having a depth of approximately 92.5 metres (303 feet) and a width of approximately 25 metres (82 feet). The front 48 metres (157 feet) of the property is developed with a commercial parking lot. The rear half (approximately 45 metres or 148 feet) of the property contains a vegetated valley slope. The easterly edge of the asphalt parking lot is generally coincident with the toe or bottom of the valley slope in this area.

Planning Application HistoryIn 1989, the current property owner (Ire-Yonge Developers Inc.) received a site specific zoning approval from the former City of North York to permit the front 73 metres (240 feet) including the lower 21 metres (69 feet) of the vegetated slope to be removed and developed as a six to seven storey office building. The portion of the property intended for re-development was given a commercial "C1" zoning designation. The rear (easterly) portion of the slope (having a depth of approximately 23 metres or 75 feet) was zoned "G" or "Greenbelt" and was intended for environmental protection. A copy of schedule "B" to By-Law #30952 passed on September 6, 1989 is Attachment 2. No records were found of TRCA's involvement with the 1989 Zoning Amendment Application.

In April 2011, the same property owner applied for an Official Plan and Zoning Amendment Application with the City of Toronto in order to re-develop a larger portion of the site with a 12 storey residential condominium with ground floor retail uses and five levels of underground parking. The City of Toronto's Official Plan land use map #16 adopted by City Council in 2002 designates the front half of the property as "mixed use" and the rear half of the property as "natural areas". The City's policy associated with the natural areas designation requires that natural areas be maintained primarily in a natural state. In addition to the specific land use designation, the subject property is identified on Map #9, "Natural Heritage System" of the City of Toronto's Official Plan. Development is generally not permitted in the natural heritage system. The natural heritage system is comprised of areas where the protection, restoration and enhancement of the natural features and functions should have high priority in city- building decisions.

In TRCA's review of the application, TRCA staff staked the toe (bottom) of valley slope and drip line of vegetation associated with the valley slope. The TRCA staked lines including toe of valley slope and drip line of vegetation are identified on the aerial photo of the site in Attachment 3. The proposed development limit as well as the existing development limit is also outlined in Attachment 3. The proposed development limit will result in further loss of the slope and protected natural area of the property than was previously approved for the office building in 1989. The difference in elevation between the existing parking lot and the new development limit is approximately 10 metres (33' feet). The proposed east basement wall of the 12 storey condominium building will be designed as a retaining wall to support the remaining part of the slope.

TRCA Comments to the City of TorontoUpon completing the review of the planning application TRCA staff responded to the City in correspondence dated November 30, 2011 indicating that we could not support the application as submitted. TRCA staff advised the City that based on the policies of the Valley and Stream Corridor Management Program (VSCMP), a vegetated buffer of 10 metres is required westward from the toe of slope. To date the owner has advised TRCA staff that they cannot provide a buffer to the toe of slope nor can they protect the natural feature in its current state. The lower 33 metres (108 feet) of vegetated slope (half of the entire slope) would be permanently removed from the natural heritage system based on the current development proposal.

In addition to TRCA's role as a commenting agency on the current Planning Applications, it should be noted that the owner will be required to apply for and receive a TRCA permit prior to any development occurring on the subject property.

This request was circulated to City of Toronto staff and TRCA staff for review and comment. The following comments have been received:

City of Toronto Staff CommentsThe parcel in question is approximately 250 m² in area and located at the side of 223 Edenbridge Drive, and in front of the Edenbridge Centre a former Metro Parks Yard that is now utilized for recreation programming; the back portion still has equipment storage for Parks operation. The Edenbridge Centre is on lands owned by the TRCA and covered by the Management Agreement. While the lands are in front of the Centre, the space is a passive park space, and is not under any particular use. There are a couple of trees on the subject lands.

The subject lands are zoned R1, which permits single family dwelling, among other similar uses. The land is designated Parks and Open Space (POS) in the Official Plan. POS lands are subject to Policy 4.3.8 (page 4-8 of the O.P.) which states in part, "the sale or disposal of publicly owned lands in Parks...is discouraged and no City owned lands in Parks...will be sold or disposed of..." The TRCA is discouraged rather than prohibited from selling POS designated lands.

While the sale of these lands by the TRCA is discouraged, the TRCA may wish to consider the short term lease of these lands to the abutting land owner. The letter from the owner cites two reasons for the proposed acquisition. The improvement of safety and the addition of secure children's play space can be achieved through a short term lease of the specified property.

In summary, the lands abutting 223 Edenbridge and in front of the Edenbridge Centre is passive park space and provides a front yard for the Edenbridge Centre, These lands are designated POS in the Official Plan of the City of Toronto which discourages the land owner (TRCA) from selling these lands. But City Staff would not object to the TRCA making these lands available for a short term lease.

TRCA Staff CommentsThe subject property is located entirely below the top of the bank of the Humber River valley, as are many of the residential lots which were developed prior to the implementation of TRCA’s Valley and Stream Corridor Management Program (VSCMP) policies. The subject property is located on the valley floor, but is not within the regulatory floodplain or an erosion hazard limit associated with the Humber River. Nor is the site identified in TRCA’s Terrestrial Natural Heritage System mapping. TRCA Ecology staff advise that the subject property includes manicured lawn and three mature non-native trees and, while not ecologically significant in isolation, does provide open space functions such as enhanced air quality and a reduction in urban heat island effects. In addition, the property could be ecologically enhanced along with surrounding valleylands to create a more robust and higher quality natural heritage system in time.

TRCA understands that the subject property was acquired through the development process in 1966. While unusual in 1966, this form of acquisition through the development process has been standard practice for some time and is consistently applied by TRCA Planning and Development staff. The Greenlands Acquisition Strategy 2011 – 2016 continues to identify valleyland and lands that provide a buffer to other areas such as floodplains and the natural heritage system as targets for acquisition. Planning and Development staff implement the Strategy through the development review process.

TRCA has consistently recognized that the valleylands within its watersheds are important natural resources and that they should be managed as open space rather than for private development or amenity areas. The valleylands are the backbone of the Natural Heritage System, are natural water collection systems for the watersheds within the TRCA jurisdiction and are valued landscape units contributing to environmental quality, the prevention of natural hazards and the provision of open space.

Valleylands make up the majority of the limited greenspace available in the City of Toronto, and therefore it is important to retain and enhance the land base that remains. The retention of valleylands as open, natural landforms provides continuous greenspace corridors that serve as regional linkages to local greenspace resources, habitat areas and built communities. Their retention, along with the transfer of valleylands into public ownership, helps to enhance the quality of life of the City of Toronto and TRCA’s jurisdiction.

TRCA Planning and Development staff is consistently pressured to accept the use of valleylands for new and intensified development, filling and dumping, and has therefore been consistent in rejecting these uses as inappropriate. Policies of the VSCMP limit such uses from extending into valley and stream corridors and encourage setting aside valley and stream corridors which form part of new development proposals into public ownership. TRCA acquisition provides stronger and more permanent protection and control of land as greenspace and allows for public access for enjoyment, recreation and education. This greenspace will be at a premium in the future as we move into an age of increasing urban intensification.

Given the direction embedded in the VSCMP policies and the Greenlands Acquisition Strategy, the sale of the lands adjacent to 223 Edenbridge Drive or other valleylands to a private entity is not supported by TRCA Planning and Development staff.

A plan illustrating the location of the subject lands is outlined in Attachment 1. After Executive Committee Meeting #3/12, held on May 4, 2012, additional correspondence was received from citizens in regard to this matter. A summary is outlined in Attachment 2.

CONCLUSIONSince the Official Plan of the City of Toronto discourages the disposal of POS lands, the subject parcel functions as passive park space which provides a front yard for the Edenbridge Centre, and would be contrary to TRCA's VSCMP policies as well as TRCA's mandate to conserve valley corridors, staff is recommending that the subject parcel be retained for conservation purposes.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the Regional Municipality of Durham to convey certain lands for the proposed expansion of the existing parking lot and continued maintenance of plantings and landscaping at the Ajax Water Supply Plant, on the south side of Lake Driveway, east of Harwood Avenue South, on the Lake Ontario Shoreline in the Town of Ajax;

AND WHEREAS it is in the opinion of TRCA that it is in the best interest of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with the Regional Municipality of Durham in this instance;

THEREFORE LET IT BE RESOLVED THAT a parcel of TRCA-owned land containing 0.235 hectares (0.5807 acres), more or less, required for the proposed parking lot expansion project and maintenance of plantings and landscaping, said land being Part Lot 8 Range 2 Concession BFC being Part of PIN 26469-0597(LT), Town of Ajax, Regional Municipality of Durham, designated as Part 1 on Plan 40R-27068, be conveyed to the Regional Municipality of Durham;

THAT consideration be the nominal sum of $2.00, plus all legal, survey and other costs to be paid by the Regional Municipality of Durham;

THAT all TRCA lands disturbed by the construction of the proposed expansion of the existing parking lot of the Ajax Water Supply Plant, if applicable, be revegetated/rehabilitated to the satisfaction of TRCA staff;

THAT an archaeological investigation be completed, with any mitigative measures being carried out to the satisfaction of TRCA staff, at the expense of the Regional Municipality of Durham;

THAT the Regional Municipality of Durham is to fully indemnify TRCA from any and all claims from injuries, damages or costs of any nature resulting in any way, either directly or indirectly, from this sale or the carrying out of construction;

THAT said conveyance be subject to approval of the Minister of Natural Resources, if required, in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27, as amended;

CARRIEDBACKGROUNDThe subject lands form part of a larger acreage described as Parts 1 and 2 on registered Plan WR-385, acquired by TRCA from the Town of Ajax on July 22, 1975 for nominal consideration of $2.00. The subject lands are also under management agreement with the Town of Ajax.

The Regional Municipality of Durham has conveyed lands to TRCA over the years for nominal consideration of $2.00 and has requested that the subject TRCA-owned lands abutting the Ajax Water Supply Plant be conveyed for the nominal consideration of $2.00.

The southern portion of the subject property is requested by Durham Region for a proposed parking lot expansion for the Ajax Water Supply Plant. The project is presently being reviewed by the Town of Ajax through the site plan control process and TRCA planning staff has provided comments ensuring that the project complies with TRCA requirements. The project is designed to include an extra paved parking area to accommodate approximately 16 parking spaces with artificial lighting and a snow storage area as well as a naturalized buffer area with bioswale to the east and south of the proposed paved area.

The northern portion of the subject property is requested for continued maintenance of a landscaped and vegetated area which is between the water supply plant and a recreational trail and green space to the east. Staff of the Town of Ajax advises that Durham Region currently maintains the landscaped and vegetated area.

Staff of the Town of Ajax concurs with the land transfer of the subject lands.

A plan illustrating the fee simple conveyance location is attached.

Plantings:The proposed project area around the parking lot will be planted with native trees and shrubs.

FINANCIAL DETAILSThe Regional Municipality of Durham has agreed to assume all legal, survey and other costs involved in completing this transaction.

RATIONALEGiven the growth in size and complexity of TRCA business transactions requiring a single "Authorized Signing Officer" signature, staff recommend the addition of a third designate. This will enable staff to expedite approvals as sometimes having only two signatories limits availability.

The internal control process for review of contracts, agreements and other legal documents has several parts:

preparation by the section/staff requiring the document;

review by Finance and Business Services staff for form and legal clarity;

Staff has been advised by TRCA's legal advisers that authorized signing officer protocol is valid. However, the existing regulation governing TRCA procedures needs to be clarified to make it consistent with the practice of TRCA. Staff is investigating how to do this and will make the necessary applications to the Minister of Natural Resources.

CARRIEDBACKGROUNDDistrict energy (DE) is an old concept going back as far as the Roman empire but has only been present in the Province of Ontario for the past 100 years. In fact there are several good systems in the GTA including the EnWave Deep Lake Cooling System and Markham District Energy. However, DE is by no means pervasive across the Province.

DE refers to systems that generate and distribute thermal energy (heating and/or cooling) at a community scale. The infrastructure includes a localized centre where energy is generated, and a network of buried insulated pipes (the thermal grid) that distribute that energy to buildings within a defined geographic area. The medium for transmitting the thermal energy along the thermal grid is either steam (for legacy DE systems) or water for modern DE systems.

A variety of input fuels can be used to create the thermal energy transmitted in the DE grid, including biomass, biogas and other forms of renewable energy, natural gas and cool water from adjacent water sources (e.g. Enwave's cold water from deep in Lake Ontario). Natural gas is the most commonly used fuel source to generate hot water or steam in Canadian DE systems.

Due to their community-scale, DE systems are more adaptable over time than traditional energy delivery systems, as alternative fuels can be substituted to generate the thermal energy. DE systems can also integrate the output of distributed generation plants, as the pipeline grid can be used as a "thermal collection system" for the output of plants along the DE system. Examples of heat sources that could provide heat along the DE system include solar thermal, industrial or commercial waste heat and electricity plants. In this way DE infrastructure increases efficiency and effectiveness by allowing the integration of distributed renewable sources of energy, and managing surplus heat across applications and sectors and converting "waste heat" to usable energy.

DE systems are akin to other linear municipal infrastructure, such as water, roads and sidewalks. Ideally they are factored into community land use plans and designs at the initial phases of development. Currently, one of the core challenges associated with DE is that, as a non-conventional approach to community energy delivery systems, it requires both education of key stakeholders and high levels of cooperation among developers, utilities and municipalities. Absent of any legislative imperative or enabling framework for DE systems to be considered in community planning, developments tend to revert to conventional system approaches, thus eliminating the opportunity to realize the benefits of building DE infrastructure for decades to come. Further, like other essential infrastructure, DE thermal grid investment is capital intensive with up-front capital expenditures yielding benefits over time as communities grow and thermal energy demand yields returns on investment.

For the past nearly two years TRCA staff has been working with the Canadian District Energy Association to help raise awareness of the benefits of DE and to gain an understanding of the issues preventing DE from becoming a more common part of municipal infrastructure in urban centres. The results of those consultations indicated that many municipalities in the GTA and beyond are interested in DE or are looking for mechanisms to help them implement DE systems.

In February 2012 TRCA staff accompanied the CDEA to a meeting with the Minister of Municipal Affairs and Housing (MMAH). In that meeting the Minister expressed interest in DE and asked how MMAH could assist. Both TRCA and CDEA suggested that MMAH could provide additional policy support through the Provincial Policy Statement, to municipalities wishing to develop DE systems. The Minister invited TRCA and CDEA to provide her with an example of what this policy support would look like.

In order to respond to the Minister's request, TRCA and CDEA, in collaboration with CaGBC GTA Chapter and QUEST Ontario, retained a consultant and undertook a process of consultation to develop input to the Provincial Policy Statement in support of district energy. The consultation included a wide variety of municipalities and industry experts. The consultant developed background materials in consultation with the project team and facilitated two working sessions, an in person half-day workshop and a two hour web meeting. Participants in these sessions provided a combination of verbal and written feedback, which the consultant used to craft a report and set of recommendations. The specific recommendations are outlined in Attachment 1 and printed copies of the full submission will be available at the meeting.

RATIONALEThe Province has taken significant steps to secure a more sustainable and reliable energy future for Ontarians. However, our consultant's analysis of provincial policies and regulations revealed that efforts to date have been largely focused on matters related to electricity, and silent on matters related to thermal energy policy. Considering that thermal energy accounts for over 70% of community energy needs, this emerges as a significant gap in provincial policy. More specifically, district/community/thermal energy has the potential to play a significant role in meeting the thermal energy needs of urban communities in a more efficient way, and the Provincial Policy Statement should reinforce that potential.

Several Ontario municipalities are already working to identify planning mechanisms to ensure that thermal grids with small combined heat and power (CHP), will be built to meet community growth requirements in the most cost and time efficient manner. While some municipalities have already succeeded in building District Energy systems (e.g. Hamilton and Markham) and are now looking to expand the use of this infrastructure, many more are in the initial stages of exploring this infrastructure strategy. Putting community-based thermal energy networks clearly on the development radar through PPS policies will reinforce the validity of local efforts to improve energy efficiency through official plan policies and sustainable guidelines, and help support the efficient and coordinated provision of cleaner energy in suitable communities across Ontario.

Attachment 1Proposed New Policies & Definitions

The purpose of these proposed new policies is to enable municipalities to pursue the implementation of District Energy, and to ensure that this infrastructure strategy is considered throughout the planning process. We recommend these policies be incorporated within Section 1.6 Infrastructure and Public Service Facilities.

1.6.9 District Energy

1.6.9.1. A land use pattern, density and mix of uses should be promoted that maximize the long-term security and flexibility of the energy supply and support the development of viable choices and plans for community-based District Energy.

1.6.9.2. Planning authorities shall establish policies to ensure new development is compatible with thermal energy networks, where the use of such networks is feasible.

1.6.9.3. The consideration of community-based thermal energy strategies shall be integrated at all stages of the planning process.

We recommend these definitions be incorporated within Section XXXX. The purpose of these new definitions is to ensure that District Energy and cogeneration are clearly understood, and that the profile of these infrastructure strategies is elevated throughout the planning process.

District Energy: means systems that generate and distribute thermal energy (heating and/or cooling) at a community scale. The infrastructure includes a localized centre where the thermal energy is generated, and a network of buried insulated pipes (the thermal grid) that distribute that energy to buildings within a defined geographic area. The medium for transmitting the thermal energy along the thermal grid is either steam (for legacy systems), or water (for modern systems). The thermal grid enables the application of heat recovery strategies (such as combined heat and power, waste heat capture), community-scale thermal storage, and the use of alternative and renewable fuel sources.

Combined heat and power (CHP or cogeneration): means a process that simultaneously produces electricity and useful heat. This process works by recovering waste heat from electricity generation, and distributing that heat through the thermal grid.

1.7 LONG-TERM ECONOMIC PROSPERITY

1.7.1 (h) providing opportunities for increased energy generation, supply and conservation, including alternative energy systems, and renewable energy systems, and District Energy systems.

1.8 ENERGY AND AIR QUALITY

1.8.1 e) promote infrastructure, design and orientation which maximize the use of alternative or renewable energy, such as solar, and wind and district energy, and the mitigating effects of vegetation.

1.8.2 Increased energy supply should be promoted by providing opportunities for energy generation facilities to accommodate current and projected needs, and the use of renewable energy systems, and alternative energy systems, and District Energy systems, where feasible.

1.8.3 Alternative energy systems, and renewable energy systems, and District Energy systems shall be permitted in settlement areas, rural areas and prime agricultural areas in accordance with provincial and federal requirements. In rural areas and prime agricultural areas, these systems should be designed and constructed to minimize impacts on agricultural operations.

Definitions

The purpose of these proposed amendments to Section 6.0 of the PPS is to ensure that references to “energy” specify both thermal and electric energy, and to ensure that District Energy is recognized as an alternative energy system and as infrastructure.

Alternative energy systems: means sources of energy, or energy conversion processes, energy recovery strategies, or energy distribution networks that significantly reduce the amount of harmful emissions to the environment (air, earth and water) when compared to conventional energy systems. Alternative energy systems include, but are not limited to, District Energy and combined heat and power (also known as cogeneration).

Infrastructure: means physical structures (facilities and corridors) that form the foundation for development. Infrastructure includes: sewage and water systems,; septage [sic] treatment systems,; waste management systems,; electrical and thermal energy power generation, and transmission, and distribution; communications/telecommunications,; transit and transportation facilities,; oil and gas pipelines gaseous and liquid fuel distribution; and associated facilities.

Renewable energy systems: means the production of electrical or thermal energy power from an energy source that is renewed by natural processes including, but not limited to, wind, water, a biomass resource or product, or solar and geothermal energy.

CARRIEDBACKGROUNDConstructed in 1962, the Albion Hills Field Centre (AHFC) is an existing one and half storey residential environmental education field centre located at Albion Hills Conservation Area, north of the Village of Bolton. Set deep into the rolling topography of the Oak Ridges Moraine, the cedar and granite chalet-style building is equipped with bedrooms, washrooms, classrooms, offices, cafeteria, lounge, dining hall and commercial kitchen facilities.

As part of the Region of Peel's Climate Change Mitigation Program, TRCA engaged Montgomery Sisam Architects Ltd. to undertake a facility assessment and conceptual redesign of the AHFC. The purpose of the assessment and redesign program was to provide a framework for major renovations and system retrofits to improve the environmental performance of the building while supporting climate change and sustainability learning programs for visiting students. In February of 2008, Montgomery Sisam began the detailed architectural work for the complete retrofit and renovation of AHFC. In order to minimize disruption to student use throughout the school year, renovation and construction activities at AHFC are limited to mid-June through late-September. As such, the complete retrofit of the field centre is being phased over a number of years with entire segments of the building being completed in each phase.

Three phases of the retrofit have been completed and consisted of a new roof, electrical, mechanical and fire code upgrades, and a major kitchen renovation. The existing building envelope is reaching the end of its lifecycle and is the main focus for Phase 4 of the retrofit. The scope of work for Phase 4 consists of new exterior siding, the replacement of all the windows and doors, and a new interior partition between the cafeteria and lounge. To increase the R-Value (insulation value) of the building, an added spray foam layer will be applied before the new siding is installed and the new windows will be double glazed to improve the building temperature. The new interior partition has been designed as a solid structure with opaque glazing that will act as a sound barrier and still allow the transfer of light between the two rooms, thus improving the functionality of the AHFC programming. The AHFC will be shut down from June to September to accommodate the 2012 construction. This major facility upgrade and retrofit will significantly contribute to AHFC’s business sustainability and strengthen its position as an important environmental and sustainability education resource.

RATIONALERequest for Pre-Qualification (RFPQ) for general contractors was advertised on-line with biddingo.com on April 27, 2012 and closed on May 3, 2012. The work includes, but is not necessarily limited to, the supply of labour, material, supervision and equipment to perform the prescribed scope of work. The general contractor will coordinate all construction activities which will comprise of demolition; window installation; finish carpentry; drywall finisher; flooring; insulation; cladding; minor mechanical and electrical; and millwork.

General contractors interested in pre-qualifying were advised that the criteria for evaluation will include:

completeness of submission;

past experience in the renovation of older buildings of similar size;

past experience with the proposed scope of work;

ability to meet construction schedule milestones;

ability to coordinate work by others; and

experience dealing with projects with construction budgets of $500,000.00 to

$1,000,000.00.

All interested general contractors will need to be bondable and required to produce a bid bond of 10% of the contract price at the time of the tender submission. Pre-qualification information was requested by the following nine firms:

JJM McGuire General Contractors;

Martinway Contracting Limited;

Morosons Construction Limited;

The pre-qualifying documents were reviewed by the selection committee made up of TRCA staff that have extensive backgrounds in new building and retrofit construction projects. The proposals were evaluated using the following criteria being met in order to receive a tender package:

As part of the bid submission, a separate cost for the supply and delivery of the windows and doors was requested to expedite the order to avoid any potential delays due to the high volume of window material orders during the summer period. Based on an evaluation of the bids received, staff recommends that Contract PMO11-05 be awarded to Vema Corp. Constructors for the total cost not to exceed $325,000.00, plus a 20% contingency, plus HST, as they are the lowest bidder that meets TRCA specifications. In addition, staff recommends that the supply and delivery of the windows and doors for a cost of $111,200.00, plus HST, be executed by Vema Corp. Constructors prior to final approval at Authority Meeting #5/12, scheduled to be held on June 22, 2012.

CARRIEDBACKGROUNDAs a founding partner of the CaGBC, TRCA has worked closely with the CaGBC on several initiatives since the Council was first established in 2003. The Council's mission is to "lead and accelerate the transformation to high-performing, healthy green buildings, homes and communities throughout Canada." TRCA has provided ongoing support in their work towards this mission, which is well-aligned with TRCA's vision for The Living City.

The Authority first formalized this relationship by approving the establishment of a Memorandum of Understanding between TRCA and CaGBC. By entering into the MOU, TRCA agreed to work in partnership with the CaGBC on various initiatives focused on increasing the uptake of green building practices and promoting sustainable community development in the GTA. At Authority Meeting #3/10, held on April 30, 2010, Resolution #A54/10 was approved as follows:

THAT Toronto and Region Conservation Authority enter into a Memorandum of Understanding with the Canada Green Building Council.

The purpose of the MOU was to formalize the working relationship between the two organizations and to establish priorities. Among the many roles and responsibilities outlined in the MOU, was the condition for TRCA to support and advocate for local funding opportunities and to work closely with the Greater Toronto Chapter (GTC). In 2010 and 2011, TRCA and GTC developed and executed annual work plan agreements which identified key activities and initiatives to be completed in each calendar year. At Executive Meeting #7/11, held on August 5, 2011, approval was granted for TRCA to carry-out the annual work plan agreement with the GTC. Resolution #B119/11 was approved as follows:

THAT Toronto and Region Conservation Authority (TRCA) continue its existing agreement with the Greater Toronto Chapter of the Canada Green Building Council (CaGBC) to December 31, 2011;

Municipal Engagement and Knowledge Sharing 1.

a) Municipal Leaders Forum Ontario Green Policy Hub

The Municipal Leaders Forum brings together municipal leaders in the southern Ontario

region to share knowledge on green building policy and practice issues at the municipal level. With the support of TRCA and Ontario Power Authority, the Municipal Leaders Forum has created the Ontario Green Policy Hub (OGPH), an online searchable resource of the most innovative and best policy practices implemented to promote and develop sustainable built environments by Ontario municipalities. The OGPH will be hosted on the GTC website and launched in spring 2012. This year’s funding will be put toward the incorporation of the OGPH onto the GTC website, as well as its ongoing operation and maintenance. When municipalities submit their policies and case studies to the website, they will need

to be audited and approved by an administrator (likely GTC staff). This may also include putting the content in the correct format, or contacting the municipality to clarify or verify information. In addition, standard web updates will be needed to add capacity and structure as the site and database grows.

2. Strengthening the Green Building Network

a) Chapter Membership Engagement, Education and Growth

The GTC’s principal goal is to serve the needs of its members and supporting organizations. In meeting this goal, the GTC strives to deliver value in a variety of formats that include Chapter events, non-workshop educational events and free public education sessions. TRCA funding will go toward the creation, coordination, marketing and delivery of the following events, including content development and market research for educational events:

Minimum three GTC events whose focus is on networking amongst the green building

community. Events may include:Spring: celebration of green buildings and launch of Green Doors Open and Thank You Campaign (see below);Summer: CaGBC post-conference BBQ - Uniting the Greater Toronto Community;Fall: Chapter Gala.

Monthly Lunch and LEED (Leadership in Energy and Environmental Design) sessions,

which are public information sessions on LEED professional training.Minimum three market-specific educational events (non-workshops), for example,

Ontario Building Code 2012, Building-Integrated Photovoltaic Systems.

b) Green Doors Open

Green Doors Open is an initiative to incorporate green buildings into Ontario’s Doors Open events. Started and run by the Clean Air Partnership (CAP) in 2008 and 2009, the initiative was dropped for 2010 and 2011 due to a lack of resources. In late 2011, the GTC contacted CAP to reinvigorate the project for 2012 and substantially increase the network with GTC’s database of over 1,300 Ontario green buildings.

The goal with Green Doors Open is to promote awareness of green buildings in communities across Ontario and engage the public in the impact of green buildings in their communities and the benefits they provide. In collaboration with the GTC’s Thank You Campaign (see below), an online interactive map and database of green building projects and partners will be developed to strengthen and grow the network of green buildings and green practices in Ontario. Funding from TRCA will support an outreach intern, staff time dedicated to the project, and the building of an online database to host these green buildings and green features. The driving purpose of this initiative is to:

increase the inclusion of green buildings into Doors Open tours in communities

throughout Ontario; promote awareness of green buildings in communities across Ontario;

engage the public in the impact of green buildings in their communities and the benefits

they provide: reduction in use of energy, water, greenhouse gas and air pollution emissions; support the goal of increasing the proportion of buildings in Ontario that integrate green

energy, energy and water conservation actions, and other green features.

c) Thank You Campaign

In order to strengthen the green building network, recognize individuals and organizations that have made a contribution to the sustainable built environment, and connect the GTC to organizations who are making a difference on-the-ground, the GTC has launched a Thank You Campaign.

By sending out emailed and printed “Thank You” cards, the GTC acknowledges individuals and companies for achieving their LEED credential or building green and welcomes them to both the CaGBC network and the GTC. It is anticipated that the GTC will achieve a number of objectives through the development and implementation of this campaign:

opening of conversations between individuals and the Chapter on green mandates;

increase brand identity;

increase sponsor exposure.

3. Industry Magazine Supplements: Toronto Focus

a) Toronto Focus

In 2012, the GTC will produce the 3rd and 4th editions of their Toronto Focus supplement through SAB Magazine, the GTC's primary publication. In this initiative, we engage sponsors, members and community at large to produce a 16 – 32 page supplement that includes green building features and success stories from Toronto and the surrounding region. This spring, we are implementing a 32-page spread that educates and engages readers about the impact green building has on our health and the community, not just the environment.

Funding provided by TRCA will go to supporting staff and funding a part-time intern to manage the writing and coordination of content, sponsorship promotions, advertisements, web-compatibility and distribution.

FINANCIAL DETAILSTRCA will provide financial support to the GTC in the form of a $45,000 grant. These funds are available in accounts 415-89 and 129-81, provided by the City of Toronto and Region of Peel.

CARRIEDBACKGROUNDThe Restoration Services Division of Toronto and Region Conservation Authority (TRCA) requires Laboratory Analytical Services in support of TRCA's initiatives for a comprehensive and integrated approach to environmental monitoring within the Toronto region. The necessity for Laboratory Analytical Services is in support of two major programs which are outlined below.

Item A - Waterfront and Projects Environmental Monitoring ProgramSince 1975, TRCA has conducted an environmental monitoring program to describe biological, physical and chemical conditions in the vicinity of Lake Ontario waterfront parks, Restoration Services habitat and erosion control projects, in support of the Toronto and Region Remedial Action Plan, Aquatic Habitat Toronto and more recently the Lake Ontario Integrated Shoreline Study within Credit Valley Conservation Authority's jurisdictional waterfront. Various studies are being conducted to examine the sediment quality, water quality, sediment deposition rates, bottom substrate documentation and biomonitoring surveys using fresh water clams.

Item B - Fill Quality Control and Site Decommissioning ProgramsThe Lakefill Quality Control Program (LFQCP) requires laboratory services to analyze soil samples taken at various lakefilling sites across the waterfront. The analytical results are used to verify that soil generated from various fill sources meet the Ministry of Environment's lakefilling criteria. The Inland Fill Quality Control Program (IQCP) requires laboratory services to analyze soil samples taken at various landfilling sites located on TRCA-owned lands. The analytical results are used to verify that soil generated from various fill sources meet TRCA quality requirements. Laboratory services are also required to undertake soil characterization and soil remediation work on various TRCA-owned lands, as part of TRCA's site decommissioning and remediation programs.

RATIONALETRCA's 2011 Laboratory Analytical Services contract was awarded to AGAT Laboratories through a competitive process.

A clause in the 2011 contract states that:

It is the intent that the duration of this Contract will extend over the period commencing on or about May 25, 2011 and expiring on May 25, 2012. Subject to terms, conditions and performance satisfactory to Toronto and Region Conservation Authority (TRCA) staff, a provision whereby the successful bidder could request in writing a one year extension to the contract at a specific maximum percent increase or decrease to the unit prices bid.

A letter dated April 24, 2012 was received by TRCA expressing the intent of AGAT to extend the 2011 Laboratory Analytical Services Contract, RSD-11-17 for one year starting on or about May 24, 2012 with no increase in cost. The clear understanding and capability of AGAT to carry out all the required deliverables is evident within their past performance. Staff evaluated AGAT’s performance using the following criteria:

understanding of the assignment;

work plan, project management and scope of service;

proposed fee and resource allocation;

completeness.

As a result, staff recommends extending the contract for one year on a sole source as per Section 1.14.3 of the TRCA's Purchasing Policy as follows:

When the extension or reinstatement of an existing contract would prove most cost-effective or beneficial. The extension shall not exceed one year.

Staff has been satisfied with their services and has no reservations with a continued contract. In addition, AGAT Laboratories has been the contract lab for both Items A and B since 2009. Based on review by TRCA Restoration Services staff it is recommended that the contract be extended to AGAT Laboratories at a cost not to exceed $75,730.00, plus HST.

FINANCIAL DETAILSFunds to implement the Laboratory Analytical Services are provided by the City of Toronto and are available in the Toronto Waterfront Monitoring account 240-01. In addition, Item B (Lake/Inland Fill Program) funding will be provided by private funding sources through the General Inland Fill Account 106-06.

of April, 2012;c) a term of two years following completion of the probation period;d) compensation at the rate of $1,000.00 per week plus HST, based on a work week of 24

to 30 hours; e) expenses to be paid in the amount of $100.00 per month for home office and $200.00

CARRIEDBACKGROUNDThe GTA AAC is comprised of representatives from governments and organizations associated with agriculture, agri-food business and the local food system in the City of Toronto and the regions of Durham, Halton, Peel and York. Under the terms of a Memorandum of Understanding (MOU), TRCA provides administrative and financial services for the GTA AAC, including procurement of services as needed. The GTA AAC is not a legal entity and TRCA enters into contracts on behalf of GTA AAC.

The GTA AAC hired Janet Horner in 2009 to fulfill the role of Coordinator. At Executive Committee Meeting #3/09, held on May 8, 2009, Resolution #B49/09 was approved as follows:

THAT Ms. Janet Horner be paid a daily rate of $450.00, at a cost not to exceed $85,000, plus applicable taxes, plus allowances for travel at a rate of $0.42 cents per kilometre, and other reasonable disbursements to fulfill the needs of the Greater Toronto Area Agricultural Action Committee (GTA AAC) from May 1, 2009 to April 30, 2010.

The GTA AAC has been extremely satisfied with the leadership and progress Ms. Horner has brought to the project. As a result the GTA AAC board extended her contract for 2011 and 2012. Ms. Horner has been assigned the title of Executive Director to oversee the implementation of the recently completed Golden Horseshoe Agricultural and Agri-Food Strategy. The GTA AAC wishes to extend Ms. Horner's employment contract for an additional two years effective immediately. This would ensure the efficient and effective delivery of the work of the committee. The lengthy process of advertising, recruiting, interviewing and selecting, and then the time for a new candidate to transition into the position is not considered a reasonable option by the GTA AAC for an additional two years considering the history of the position to date.

The contract for GTA AAC project and program coordination services was approved by the Greater Toronto Area Agricultural Committee to assist the Executive Director with the implementation of specific actions recommended in the Golden Horseshoe Agriculture and Agri-Food Strategy. The MOU between TRCA and GTA AAC requires that TRCA policies with respect to purchasing be followed. The decision to contract with Mekmek Heavy Industries to provide the services of Mr. Hans Feldman was made as a part of a non-competitive procurement process in accordance with Section 1.14.5 of TRCA's Purchasing Policy as follows:

The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise, or experience that cannot be provided by any other suppliers

More specifically, Mr. Feldman is an experienced strategic decision-maker, process planner and manager with extensive experience in policy development, communications and issues management related to agriculture, food and rural issues across different agencies and levels of government. He is a confident communicator skilled in explaining complex concepts and issues, experienced in team management, problem solving and networking with governments, agencies and stakeholders, and creative in designing meaningful options and advice for decision makers.

He has held positions as Senior Policy Advisor for the Ontario Ministry of Agriculture (OMAFRA), Food and Rural Affairs, Advisor to the Minister of OMAFRA and Assistant Director of Policy for the Ontario Legislative Assembly.

FINANCIAL DETAILSNon-competitive contracts in excess of $50,000 and less than $200,000 require approval of the Executive Committee. The value of the two employment contracts for the two year period is not to exceed $150,000. Funds for this contract and other expenses related to the GTA AAC, are provided by the Province of Ontario, the Greenbelt Foundation and Canadian Agricultural Adaptation Program. TRCA holds the money in trust for the GTA AAC and manages the administrative and financial requirements of the GTA AAC through a memorandum of understanding.

CARRIEDBACKGROUNDAt Authority Meeting #11/11, held on January 6, 2012, Resolution #A263/11 was approved as follows:

THAT the new Participating Municipality Funding Arrangements Policy dated November 22, 2011 be approved as the basis for allocating the annual operating levy amongst Toronto and Region Conservation Authority's (TRCA) participating municipalities, for the 2012 fiscal year;

AND FURTHER THAT staff be directed to proceed with further negotiations with the participating municipalities and report back in 2012.

RATIONALEAs directed, TRCA staff has met with finance staff from the regions of Peel, York and Durham and discussed the issues by phone and e-mail with staff of the City of Toronto, Town of Mono and Township of Adjala-Tosorontio. The items discussed included:

possible changes to the method of calculating the apportionment of the general levy using 1."governance" as opposed to current value assessment (CVA) for the operations and maintenance category;opportunities to better categorize capital projects to distinguish tangible asset capital 2.projects from other capital programs and special projects.

Staff also discussed TRCA's proposed changes with staff of TRCA's neighbouring conservation authorities because of the need for consistency in municipal submissions.

The discussions with regional staff were helpful and the consensus of opinion was that TRCA should not consider changing the existing apportionment based on modified current value assessment. The use of CVA is understood and widely accepted. Any change would require TRCA to submit recommendations to the respective regional councils. None of the regional staff were prepared to recommend such a change.

The use of modified CVA to apportion administrative costs as defined in the Conservation Authorities Act is required. The use of modified CVA for apportionment of maintenance and operation costs, the largest portion of the general levy, can be done by methods other than CVA if there is unanimous consent. TRCA staff do not believe that unanimous consent by the six participating municipal councils can be achieved.

TRCA has included "non-CVA levy" for purposes of operations and maintenance in its budget submissions since 2010 and specifically in 2012 as per direction of the Authority. None of the staff of the participating municipalities has advised that this is inappropriate and the general levy has been approved accordingly. This practice enables TRCA to accept additional general levy funding when individual participating municipalities have the financial capacity to make such funding available.

Further, discussions with municipal finance staff indicate support for the effort to rationalize the categorization of capital project and program funding. The need for this change is also supported by TRCA's partner conservation authorities. Staff is continuing these discussions to achieve a common, clear and concise categorization of capital budgets.
