• Improve the MSC/MSFSC work package content

–Eliminate ambiguities, unattainable and/or un-biddable requirements and confusion with regard to work requirements between the originator , the executor (Shipyard) and the vessels.

–Transparency of work requirements should reduce costs and reduce possible production delays.

–Better forecasting of repair requirements will reduce reliance on AGR and maximize M&R dollars by achieving competitive pricing as compared to shipyard RFP pricing.

• Standard Work Items (SWI 000)

–Serves many purposes:

•Standardize general requirements expectations by enforcing the use of a common set of requirements for all availabilities

•Reduce unnecessary requirements sometimes added into these items.

• Ensure an appropriate level of technical requirements

•Reduces potential financial risks to MSFSC

• Shipyards know what to expect... reduces the “unexpected”

•  Standard Work Items for Repetitive Repair Requirements (SWIRRR) (old Lant Standard Items)

–A set of common work requirements which were identified and established in the late 1980s to reduce repetitive work statements for common maintenance and repair requirements.

–Re-write updates requirements, adopts modern work practices, and modifies format.

• Specific Standard Items (SSI)

–Goal is to establish certain SSI that should be used for all vessels, in order to capture best practices and maintain a consistent approach for the particular work requirement.

–Presently, our only SSI is the Ship Docking and Undocking work item (WI 901).

•  General Technical Requirements (GTRs)

–These requirements were established to delineate the standards of performance expected by the contractors in the execution of our vessel maintenance and repair work packages.

–Presently, GTRs are invoked by reference in individual work items to establish these broad standards of performance.

–Revised items will be invoked in the contract boilerplate, as well as in the work items.

–GTR re-write will separate design development standards from M & R standards, and should make it easier for the PPE, shipyard and ship to identify and follow the applicable requirements.

• The use of these items is mandatory for all shipyard work packages.

• A common set of work items addressing berthing and mooring, ship services requirements, office space, safety and security, heavy and cold weather plans, fire protection, quality assurance, gas freeing, and hazardous waste disposal.

– Items remain consistent for all repair period contracts. Ship services item slightly different by ship class to address differences in specific requirements.

– Reduces bidder’s estimating work for solicitations, as the content of the General Requirements work items is always pretty much the same. Allows the Government to accurately predict services costs for availabilities.

– This effort will reduce unnecessary requirements sometimes added into these items.

• Desire is for continuous improvement of these items. Issues and/or recommendations should be directed to Rick Albert. We have a panel that reviews proposed changes for implementation.

• These work items capture repetitive requirements for common maintenance and repair requirements.

• Intent is for PPE to invoke the SWIRRR item in their base work item rather than re-typing these repetitive requirements. It is not mandatory to use these items, but it is recommended.

• New format also consolidates like items, and is presented in a menu format with universal requirements and optional menu selections in each standard item. The base work item which invokes the standard item will indicate which menu items are included in the statement of work.

• Intent is to standardize and publish common work items.

–Can be either fleet wide or class wide items.

• Many CM groups already have these items.

–Goal is to get them on the MSFSC N7 portal site to gain better visibility for other MSFSC CM staff that may benefit from these items.

WI 023 – Hazardous Waste Disposal at a WI 023 – Hazardous Waste Disposal at a Contractors FacilityContractors Facility

• Intent– Title 10 of the US Code, Part 7311 mandates that the repair or maintenance

of naval vessels shall include identification of potential hazardous wastes that may be generated as a result of the work requirements, and that the contractor shall be compensated for the removal, handling, storage, transportation and disposal of those hazardous wastes.

– This is not a new requirement, and we have had a work item to address these hazardous wastes for many years (WI 099).

– Audits of hazardous waste disposal costs indicate that we may have paid for disposal of many non-hazardous wastes.

– This new item attempts to refine the administrative responsibilities of the contractor to prove that the wastes meet the criteria of local, state and/or federal regulations as a hazardous waste. The item further only compensates the contractor for his actual costs, plus a fee. The fee covers management and handling costs and is a bid rate applied to each accepted disposal invoice.

• How to Use WI 023

–Basic precept of WI 023

•Onus is on the Contractor to prove that they have hazardous wastes

– They must provide a copy of the federal, state and/or local regulations that make the substance a hazardous waste.

– They must provide copies of the testing data, and match these results to the regulations to prove that the substance is considered a hazardous waste.

•We should not authorize payment for any charges against this work item unless all of the required documentation is provided:

– Paragraph 7.6 of WI 023 is clear on the requirements for compensation.

– We pay actual costs based on invoices for transportation and disposal of the hazardous wastes. In addition, the contractor tacks on a fee, identified in their work package bid as a percentage, to cover their costs for management, handling and temporary storage.

•We do not pay for the labor costs to remove the material, if that was already identified in the base work item, whether or not we identified it as a potential hazardous waste.

– Exception is made for special precautions required, like tenting the area, special PPE for workers, special medical screening for workers, … that may be required by OSHA for handling the hazardous wastes. These special precautions shall be compensated via change order against the base work item.

• Recent Changes/ Related Work Items

–We have included an exception for oil contaminated bilge water and oil contaminated tank wash water

• Paragraph 7.3.6 – Bilge Water, and Paragraph 7.3.7 – Tank Wash Water

•Disposal of this product, whether considered to be a hazardous waste in the local area of the shipyard or not, shall not be compensated through WI 023. These costs should be considered part of the requirements of WI 011 for bilge cleaning and WI 021 for tank cleaning and gas freeing.

– To reiterate, there should be no change order compensation or charge against WI 023 for oil contaminated bilge water or tank wash water.

–WI 011 and WI 021 have been updated to include similar language, so that it is clear to the bidder that we consider these costs to be part of the WI requirements.

• Training/ Questions

–We plan to sponsor periodic hazardous wastes training seminars for the Port Engineers to gain familiarity with regulations and MSC /MSFSC expectations.

–Questions are always welcome. If we don’t know, we will find out.

–We do also have capability to hire in expertise to address big ticket issues or concerns.
