EDITOR’S SPACE Cancer is Not the Cancellation of Life (Guest Editor - P.K. Lahiri) Verbal communication is the basic need for connection between 2 persons .I lost my voice due to throat cancer as a result of smoking 50 cigarettes a day. Eventually I had to remove voice box and became dumb. Speechless was a traumatic experience to me. But I made effortlessly to be heard again. I was able to get voice back by using my esophagus/ food pipe with less clarity. Latter I had opportunity to enhance my voice through (AFLA) in Tokyo, since similar opportunity was not available in India. Now it is available at CRC Prince Ali Khan Hospital (VRV PAKH). The above training not only helped me to normalize my voice but also helped other laringectomees who reinstated their voice to be heard to others from CRC PAKH. Sixteen years back I was invited by Cancer rehabilitation clinic of PAKH which was the brain child of eminent oncologist Dr.Sultan Pradhan and formed with the help of a founder member Mrs. Anita Vesuvala a survivor of breast cancer. I joined with her and established esophageal speech training center on fully voluntary basis. Since then my journey started. Activity of CRC PAKH:- It is run by 19 dedicated trained volunteers, including 9 former patients. On average, the clinic supports 500 laryngectomy patients, 300 mastectomies and 100 oestomy patients each year — and these numbers are increasing. All services are provided free of charge, and the Centre does not limit itself to patients of the Prince Aly Khan Hospital; about 20% of their beneficiaries come from other hospitals. Clinic timings:- Breast cancer- Tuesday/ Friday/ 10.30 am to 1pm. Laryngeal cancer/timing:-Wednesday/ Saturday/ 9 am to 12 noon. Laringectomee section is one of the vital parts of centre where a patient takes training month after month through me and other survivors and volunteers. According to my knowledge this unique process of training is rarely available in India except in CRC/ PAKH. Dr Nalini Bhat Head ENT BARC hospital is very much aware of this service. ********** Important Court Cases A. Status of S-21 case (SO-E Group) (Shri M. Venugopalan, Shri M.M.V.Murthy) Note Highlighting the Disparity Between S.21&S.24 as Recommended by CPC 6th wef 1/1/2006 (by M. Venugopalan) Historically and traditionally there was a close similarity between the pay scales at S.21 and S.24. This will be evident from the Table indicated below:

2. Government instructions specifying for operation of S.24 scale as Selection Grade for S.21 are even current which in other words would mean that S.24 is an extension of the lower scale of S.21. The critical job analysis and work assessment undertaken by the past Pay Commissions prompted them to come to the conclusion that both these two scales formed part and parcel of the slot of Junior Administrative Grade which was on consideration of the fact that intermingling nature and integrated entity had subsisted from the beginning when the pay scales were evolved. Truly, endorsing the integral affinity and holistic nature with which the two scales were conjoined, the 6th CPC also in the process of grouping various pay scales in their wisdom and sense of judiciousness felt it appropriate to club both these into Pay Band-3 (Rs 15600-39000). However, ignoring the ingenuity and the rational judgment applied by the CPC in grouping together the two scales (with a distinction by way of only a minor difference in the Grade Pay attached to each), an adhoc Review Committee constituted by the Government bifurcated these integrally attached grades and placed S.24 scale in PB-4. Compared to the pre-revised and revised scale for S.21 the difference is merely Rs 11200/- at the beginning and Rs30200/- at the ending stage whereas for S.24 it is a gigantic leap to the extent of Rs31800/- at the beginning and Rs64000/- at the ending point which is almost a threefold increase which is enormously unparallel in the history of formulation of pay scales. The drastic change as brought about above has given rise to umpteen anomalies, disparities and unfairness to S.21 category since the vital fact that

whatever reasons were found justifiable for placing S.24 in PB-4, the same are equally valid in the case of S.21 also was totally ignored in the process. 3. The Railway Board also submitted similar justification to the Ministry of Finance for moving the incumbents in S.21 grade to that of S.24. 4. The CPC 6th was sensitive in ensuring that a person drawing higher basic pay as per 5th CPC scale is not placed in a lower stage vis-à-vis a person drawing lower basic pay and made recommendation in this regard in para 2.2.21 of their recommendations. They had prepared a detailed fixation chart (Table 2.2.2) giving the fitment in the revised running pay bands for every stage in each of the pre-revised pay scales. However, the indenting idea and spirit of fairness had no sanctity since S.24 scale was jacked up selectively and arbitrarily ignoring the case of S.21 incumbents. 5. It is, therefore, appealed to the acumen and sense of righteousness of the 7th CPC to ensure justice for S.21 category which had become the worst sufferers on the last pay revision, to treat the two scales alike or maintain the minor difference between the two as existed in the past.

--------------- B. Status of S-29, S-29+ and < 33yrs cases as on 20.12.2014 (Shri BM Misra) 1. After dismissal of Curative Petition by GOI at HSC in the S-29 Group case, the contempt case at PBCAT by the S-29 group came for hearing on 15.5.2014. The court ordered to give the arrears to the 661 applicants wef 1.1.2006 to 24.9.2012 within 3 months. On the next hearing date DOPPW requested for more time to complete the payment to all 661 applicants. The court agreed to their request and asked to complete the payment by 17.12.2014,the final date of hearing. The DOP&PW subsequently issued OMs dated 26th August and 4th September to the concerned Departments of S-29 pensioners to pay the arrears wef 1.1.2006 to Sept 24, 2012 to these applicants. As on date most of the applicants barring a few have received their arrears. The case is now postponed to Feb. 2, 2105. 2. Three SLPs by UOI at HSC, in case similar to above S-29 group, came for hearing on Dec. 2, 2014. It has been now postponed to 13th Jan. 2015. It is hoped that their dismissal may force DOP&PW to issue OM for arrears to all. 3. The pre 2006 S-29+ case OA No. 3789/2013 came for final hearing on 30 October 2014 at PBCAT, Delhi. After the arguments from both sides, the court allowed our OA filed by 53 nos. DAE applicants, to the extent of applicants- Institution asking GOI to not only restore the pension on special pay, withheld since March 2013, but also allowed it to be raised to Rs 2000 wef 1.1.2006 subsequent to 6th CPC revision of special pay to Rs

4000. This order is however subject to final hearing of a Review Petition in a contempt case by Dr R C Garg of ISRO who has won a similar case but the judgment is not implemented by his Dept. 4. A number of DAE S-29 pensioners have approached AERWA to file OA for payment of arrears to them wef 1.1.2006. AERWA is interested to file this OA for all grades of pensioners. . However it is desirable that more DAE pensioners express their willingness to AERWA in this regard. 5. Meanwhile a group of new 330 nos. S-29 pensioners have filed 3 MAsat CAT, Delhi to implement the CAT order dt 15.5.2014 for them. A number of BARC/DAE pensioners have joined that group directly interacting with its main applicants. These MAs came for hearing on Dec. 12 and were admitted. The next date is fixed for Feb. 2, 2015. Some more MAs are being filed by new applicants. 6. A number of pre 2006 S-29+ pensioners who were not member of the group of 53 have also shown interest to file an OA/ MA subsequent to CAT order of 30th October allowing our OA 3789/2013 for pension of Rs 2000 wef 1.1.2006. 7. The post 2010 S-29+ case OA No. 1003/2014 came for hearing at PBCAT Delhi on 27thth Nov. The next date of hearing for final arguments is fixed for 16th December 2014. Arguments from both sides on this day were completed and the judgment is awaited. 8. The case for full pension for < 33yrs of service came for hearing on26th Nov. 2014 at PBCAT. As one of the judges of the bench was not present it was postponed to 15-12-2014.The respondent side mentioned that they are studying the S-30 case of full parity and requested for some time, hence next date of hearing was fixed or 29 Jan. 2015 C. Status on Case of Parity among Pre and Post 2006 Retirees in Grade OS (Shri BM Misra) 9. In a case from pre-2006 S-30 pensioners OA 937/2010 at PBCAT requesting full parity with post S-30 pensioners, the Hon. court in their order dt 20.11.2014 has allowed their OA. The order says “We direct the respondents to consider the revised pay of the applicants corresponding to the pay at which the concerned pensioner had in fact retired, instead of considering the minimum of the said pay scale, thereby determining pension/ family pension to pre-2006 retirees”. The court however rejected the applicants request for fixing their pension based on Rs 75, 500 basic pay

in sustaining one of the main activities of AERWA regular publication and distribution of bi-monthly AERWA News Letter (NL). The two persons mainly responsible are never seen separately. They have always worked together as a team and I generally calthem as “Twin Brothers of AERWA”. They are Shri P K Vaze (P-29, 79 yrs age) and Shri Barve M C (P71 yrs age).

The NL work during 1997-2011 was managed by a dedicated team of ~10 members mostly belonging to the Navi-Mumbai area. With the change in Management during 2011, the entire work load was ultimately shifted in the Deonar area. However, the new team to manage in the new set-up consists of only two members Twin Brothers. Once the NL Editorial Board finalizesmanuscript and submits to printer (also located in Deonar) the entire work is singlehandedly (or should it be called double-handedly!) accomplished by this team. Among many tasks one important job is to print ~1700 address labels (it requires printing of >65 A4 sizeglossy label sheets for each NL issue. This has been going on till date using Shri Vaze’s Laptop and a heavy duty printer). The twins with help of few others implemented another unique and very useful tradition that is hand-deliveryD) of >250 copies of each NL issue. Out of these 250 copies about 50 are distributed by Shri RC Pant in Kharghar, ~170 copies by Shri M C Barve in Deonar/ Govandi and most interestingly ~30 copies by Shri V C Barve in Vileparle(E) who is 77 yrs old elder brother of Shri M C Barve. They all together are saving ~Rs 6000/yr in postal charges for AERWA News Letter.A more useful aspect of this H-D tradition is that they meet members once in two months and help those to solve their pension related and other problems. Several AERWA members are so impressed that they starteddonating funds to AERWA. The mentoring process of AERWA is actually initiated and catalyzed by the Barve brothers. Returning to our Twin Brothers Vaze/ Barve, they made the most important contribution by creating an AERWA Members “Data-Base”. ************ Government Order/ News (Related Excerpts) Huge relief for senior citizens who have to produce Life Certificates each year to continue receiving pension The Prime Minister, Shri Narendra Modi, today launched “Jeevan Pramaan” – an “Aadhar-based Digital Life Certificate” for pensioners, in a move that could eventually benefit over a crore pensioners. The Prime Minister said that after the push towards self-certification, this digital life certificate was another enabling mechanism which would benefit the common man. The proposed digital certification will do away with the requirement of a pensioner having to submit a physical Life Certificate in November each year, in order to ensure continuity of pension being credited into his account. The Department of Electronics and IT has developed a software application which will enable the recording of the pensioner`s Aadhar number and biometric details from his mobile device or computer, by plugging in a biometric reading device. Key details of the pensioner, including date, time, and biometric information will be uploaded to a central database on real-time basis, ultimately enabling the Pension Disbursing Agency to access a Digital Life Certificate. This will conclusively establish that the pensioner was alive at the time of authentication. The earlier requirement entailed that a pensioner either personally presents himself before the Pension Disbursing Agency, or submits a Life Certificate issued by authorities specified by the Central Pension Accounting Office (CPAO). At present, 50 lakh individuals draw pension from the Central Government alone. A similar number draw pension from State and Union Territory Governments. Several PSUs also provide pension benefits. Over 25 lakh retired personnel draw pension from the Armed Forces. The Aadhar-Based Digital Life Certificate will go a long way in reducing hardship which so many senior citizens have to go through to produce a Life Certificate every year. The software application system will be made available to pensioners and other stakeholders on a large scale at no extra cost. It can be operated on a personal computer or a Smartphone, along with an inexpensive biometric reading device. This facility will also be made available at Common Service Centres being operated under the National e-Governance Plan, for the benefit of pensioners residing in remote and inaccessible areas.

This step brings comfort & convenience. Pensioners will not have to submit physical Life certificates every year for pension continuity.

***************** DAE / ISRO News India, Russia Ink New Nuclear-Deal (Excerpts from Indian Express dated 12th Dec, 2014) A strategic vision document on nuclear power signed on Thursday said India and Russia would strive to complete the construction and commissioning of “not less than 12 units” in the next two decades, in accordance with the 2008 agreement. Towards this objective, the Indian side agreed to expeditiously identify a second site, in addition to Kudankulam, for the construction of the Russian-designed nuclear power units in India. We have just signed a document of great significance for strengthening Indian-Russian cooperation in the peaceful use of nuclear power. It contains plans to build over 20 nuclear power units in India, as well as cooperation in building Russia-designed nuclear power stations in third countries, in the joint extraction of natural uranium, production of nuclear fuel and waste elimination. This will lay the foundation for our long-term mutually beneficial cooperation in the nuclear sector,” said Russian President Vladimir Putin. Prime Minister Narendra Modi pitched for “at least 10 more (nuclear) reactors” with the highest standards of safety. “It will include manufacture of equipment and components in India. Russian government officials said Moscow has “in principle” agreed to the Indian nuclear liability law, factoring in the costs involved in the process. This led to the signing of the supplement to the General Framework Agreement (GFA) for Units 3 and 4 of Kudankulam nuclear power project between Nuclear Power Corporation of India Limited (NPCIL) and Atomstroyexport on Thursday. The issue of nuclear liability has been dogging the sector, as the American and French firms have not been able to overcome the issue. This has prevented the US and French nuclear firms from starting work on setting up the nuclear power projects in the last five years.

--------------------- Win-Win Pact with Australia By B B Singh (Member AERWA) Published in: The New Indian Express, 23/10/ 2014 The Indo-Australian civil nuclear cooperation has covered a long journey of seven years, that had begun in 2007 by the Liberal Party Prime Minister of Australia John Howard. The subsequent Labor government under Kevin Rudd shelved it. His successor Labor Prime Minister Julia Gillard realised that the issue was hindering good relations between the two countries. She could revive it in 2012 against several odds. The

Indo-Australia civil nuclear agreement finally fructified on September 5 under the leadership of Liberal Party Prime Minister Tony Abbott and India’s BJP government led by Narendra Modi. Australia holds the highest uranium reserves (31 per cent) of the world. It has neither any nuclear power plant operating nor any immediate plan to introduce this source of energy. Uranium produced in Australia is, thus, mainly for export. Australia produced 6,350 tonnes of uranium last year, the third highest behind Kazakhstan and Canada. The major buyers of Australian uranium are the US, Japan and EU nations including Belgium, Finland, France, Germany, Spain, Sweden and the UK where demands have become almost stagnant. Other small-scale purchasers like Taiwan, China, Canada and South Korea constitute just about 25 per cent of the uranium Australia sold to the US. In such a situation the agreement opens a new market for Australia in India with a vibrant economy and an ambitious nuclear industry. India already has 20 power generating reactors under operation and plans are in place to indigenously build nuclear reactors of 10,080MW capacity by 2017. In addition, India plans to purchase nuclear reactors from the US and France once the liability issue is resolved. With a growing demand for nuclear fuel, India already has entered into bilateral cooperation agreements with several countries, the most significant one being Kazakhstan which holds the second highest (12 per cent) of the world’s uranium reserves. The present agreement opens for India a choice of the market that holds over 40 per cent of the world’s uranium. At the same time, Australia gets a prosperous new buyer with steadily increasing demand for uranium and a stable government. The Indo-Australian Cooperation in Peaceful Uses of Nuclear Energy is rightly hailed as a win-win situation for both the parties. It is significant that unlike with the US, France or Japan the liability law does not hinder Indo- Australian nuclear cooperation since it is mainly concerned with the transfer of uranium. Thus, the nuclear liability issue does not figure in the agreement text. Despite this and despite the NSG (Nuclear Suppliers Group) waiver to India way back in 2008, it took a long time for Australia to be convinced that India has honest commitment to use nuclear energy only for peaceful purposes and it fully subscribes to the objectives of nonproliferation. Australia took time to believe that India has made a commitment to identify and separate its civilian and military nuclear facilities and also to place its civil facilities to international safeguards. India has indeed concluded the agreement for safeguards and the additional protocol with IAEA (International Atomic Energy Agency) and it believes and supports the

objectives of the statutes of IAEA. Australia took time to appreciate that India has an impeccable record of being a responsible nuclear weapons state and it has in place stringent legislation for security of nuclear materials and for physical and radiological safety and environmental concern. India also possesses over four decades of experience in building, maintaining and operating nuclear power reactors of various types and capacity. The export of Australian uranium to India would thus be in safe and secure hands to be used only for peaceful purposes under strict international safeguards. The most important aspect of the agreement for India is the assurance for continuous supply of uranium by providing the initial validity of the agreement for 40 years and automatic renewals every 20-year period unless desired otherwise by any party. The agreement provides for termination but emphasises it to be highly unlikely. Still, the agreement is not free from criticism. It is contended that Australia has granted the consent to reprocess the spent fuel to EU and Japan after duly specifying the “down stream” facilities that may use the separated plutonium. Unlike the above condition, the consent to reprocess the spent fuel by India will be subject to “arrangements & procedures” based on India’s commitment to the US under their 2008 agreement. Non-proliferation enthusiasts believe that the above restriction is vague and may allow India to use the separated plutonium in nuclear weapons. This is an unjustified skepticism since Article VII(1) of the agreement is very clear for plutonium to be used only for peaceful purposes. It also ensures that the parties will annually exchange information on tritium as well. “Fallback safeguards” and “right of return” of the nuclear material on termination of the agreement are the other contentious issues. The agreement provides under Article VII (5) that if the IAEA decides that the application of IAEA safeguards is not possible, the parties shall consult and agree on appropriate verification measures. It essentially covers the provisions in the 20-odd Australian agreements with 40 other countries that, if IAEA safeguards cease to apply, the parties have to establish safeguards arrangements that will conform to the IAEA safeguards principles. This is exactly what the parties shall “consult and agree about” as mentioned in the present agreement. The essential obligations of the parties on breach/termination of the agreement are provided under Article XIV in generalities. There still remains some uncertainty. The agreement is yet to be presented before the Joint Standing Committee on Treaties which will have the opportunity of scrutinizing it before ratification by the Australian parliament. ---------- Japan Governor Approves Sendai Reactor Restart (Excerpts from Japan Times , Nov 7, 2014) Two reactors at Japan's Sendai nuclear plant are due to become the first to be restarted in the country since the 2011 meltdown at the Fukushima facility. The governor of Japan gave his approval, marking the final hurdle for the restart, which is now likely to happen next year. Before the accident, caused by a massive quake and tsunami, about 30% of Japan's power was nuclear-generated. All 48 plants were shut down but PM Shinzo Abe has lobbied for a restart. Mr Abe's government has argued that the shutdown has hurt the economy, forcing Japan to import expensive fossil fuels to make up the power shortfall. The reactors, operated by Kyushu Electric Power, are likely to restart next year as further operational checks need to be passed. In a vote on Friday 38 out of 47 of the Kagoshima's prefectural assembly backed the restarting of the reactors. Protesters present in the assembly hall stood up before the vote with pink signs that said "NO restart", reported Reuters. Yelling from opponents drowned out the final vote. In September, Japanese regulators gave the Sendai reactors their final approval saying safety standards introduced after the Fukushima disaster had been met.

As Diploma holder in Mechanical Engineering, by hard work rose steadily in various positions of Reactor Group including Chief Maintenance Superintendent. He was a great devotee of Satya Sai Baba and was active with social works in this group. 3. D P K Kurup (P-180 b. 26-9-1947 d. 25-11-2014) He retired from Radio Metallurgy Division. 4. Dr. SK Mahajan (P-1093; DoB 10-8-1942 ). Dr. Mahajan was a Microbiologist of reputation and retired as Head MB &AD/BARC. He had intellectual flavor in his work and presentation. He gave a new and important dimension to BARCOA. He leaves behind wife Bakhtawar Mahajan and two daughters. 5. Shri K Gopalkrishnan (P-370, DoB 10/06/1931) staying in Geetanjali, Sector 17, Vashi expired on 11-Nov 2014. He was survived by well settled son and daughter. AERWA expresses its heartfelt condolences to the bereaved families.
