    EDITOR’S SPACE Recommendations to the 7th pay Commission K V Raghavendran, Founder editor 1 The very concept of pension can be traced back to more than 2000 years ago to the times of Kautilya wherein the reference of this can be found in Artha shastra. Chanakya/ Kautilya (Book no 5, chapter 3, Para 28-30 by Shri Soma Sharma in English and published by Government. Of India in 1950) goes on to say that employer should take care of families of employees in bad times and in case of death till the employees’ family becomes self supporting. 2 In 1982 the landmark judgment by full constitutional bench of Honourable Supreme Court lead by Hon. Justice Shri Y V Chandrachud in D.S. Nakra’s case was delivered wherein it was held that pension is a right and not alms. Definition of pension should be therefore amended in the constitution. Article 366(17) also refers pension as “Retired Pay. 3 It is clear that New Pension Scheme (NPS) is unconstitutional, considering the false and imaginary incapacity of the Government to pay when the same Government expects private Corporate Sectors in India to spend 2% of its profit on public social security charities. The government itself goes in opposite direction, unconstitutionally removing pension for its own retired employees. 4 In all fairness the government has to attract people of intelligence, dedication, skill, capability to take risks in duties, with high salaries, model pension, family pension and health benefits. This can only bring in honest, non-corrupt and intelligent employees. Government jobs cannot be less attractive than private sector – but capacity to

    pay cannot come in the way. All important activities of the government in the society should be its own responsibility and not with individuals or group of small individuals. Even if salary/pension goes on increasing, in real terms the continuous upward movement of the cost of living index really means government gives the same salary/pension to live in the same levels in the past to the majority of employees. The government’s pension expenditure has not increased beyond 1.3% of GDP. (Ref in study report of Dr Gayathri Devi’s recommendation commissioned by 6th CPC) Old Pension Vs New Pension 5. The terms of Reference to 7th CPC is considered too restrictive to suggest fair needs of pensioners in particular. 6. Dr Gayathri Devi’s report as per 6th CPC is for continuation of old pension scheme for pre 2004 staff. The defence staff in Uniform are continuing old pension because, then Minister of Defence Shri George Fernandes did not approve NPS for Defence service personnel. Now there was (one rank one pension) OROP case in Supreme Court. Hon. Supreme Court in its judgment dated 31st March 2014 gave one rank one pension for Supreme Court and High Court Judges. (who are directly selected from practicing advocates) by additional 10 years service thereby banning New pension scheme (NPS) to judges of High court and Supreme court. Why not Deptt. Of Atomic Energy? In what way DAE is inferior to Defence forces and judges? Can anybody deny that without DAE, DRDO and ISRO the defence of our country would be near to nothing. 7. The sixth CPC considered the DAE as special among Central Government. Departments but

    failed to give any directions or any privileges to attract talents. 8. Railways are also demanding old pension scheme and scrapping of NPS. 9. Therefore NPS may be scrapped or removed from DAE. As a matter of fact as per the scientific policy resolution of 1958 DAE should have dual retirement policy of having both the old pension scheme and new one rank one pension as given to SC and HC judges by adding 10 years of service. This will enable to attract talented and competent mangers who can serve in tenure posts. 10. Risk of exposure to unknown radiation is more than the risks in other areas. NPCIL is considered as Public Sector Unit where the working conditions are similar to other DAE establishments. Therefore to deny old pension scheme benefits to NPCIL employees will drive away talents in this organization where cutting edge and innovative technology are required to be encouraged for more self reliance. 11. Though all Pay Commissions are supposed to give some good and some bad recommendations the anomalies created by 6th CPC by outsourcing decision making to outside agencies made unwanted recommendations like 4 pay band systems by compressing 34 scales of pay. The gap between the Band 3 and Band 4 being major anomaly was further compounded by the GOI by arbitrarily transferring S-24 to pay band 4 (against the 6th CPC recommendations). There are several cases in the CAT and in other courts for setting these anomalies. In this context it’s worthwhile to mention the case of S-21 scale pensioners. For example: 12. While implementing the 6th CPC wef 1-1-2006, the most affected category of employees was those pensioners who were in the pay scale of 12000-375-16500 (S-21). Though the 6th CPC recommended S-21 (Rs 12000-375-15600) and S-24 grade (Rs 14300-400-18300) for inclusion in PB-3, the Government has approved S-24 alone in PB-4, which was a disproportionate jump, there by created many anomalies among the employees/pensioners in S-21 and S-24 pay scales. The following example may kindly be seen for the disparity. 13. Disparity and anomaly is clear from the following table wherein S-21 pensioner getting

    more pension than S-24 pensioner before 2006 was getting less after 2006. This speaks volumes about the anomaly between pay band 3 and band 4 as Illustrated in the table below)

When such blatant injustice by wrong implementation has been brought to CAT and when courts after courts up to Supreme court has given the verdict in favour of pensioners, the departments in Government have delayed the court procedures, have refused to accept the verdict and appealed for review petitions at the highest court and further asked for curative petition (which were rarely used in the history) The verdict in the case of S-29,30 scales (OA /655) in the Principal CAT court will be implemented to litigants , denying it to other similarly placed pensioners. Does the government expect lakhs of pensioners around the country to appeal in the courts? 16. Category of family Pensioners: Cap on the family pensioner’s income to be increased substantially to accommodate exceptional deserving cases of second category of family pensioners. The interest income on money held as FDs should not be taken as regular income because fixed deposits are held for emergencies. 17. We request that the following for the benefit of DAE pensioners be recommended; A. AERWA should be provided office accommodation in Anushaktinagar. B. Department should help in having old age homes for retirees of DAE C. High quality super specialty hospital should be set up to meet emergencies and peculiar needs of DAE pensioners. D. AERWA should have permanent membership in SCOVA (Special Committee of Voluntary Agencies for Pensioners).

B M Misra, Hon Secretary AERWA; 20-4-2015 -------------- 18th Annual Report of Managing Committee of AERWA for the Year 2014-2015 Dear Members, On behalf of the managing Committee of AERWA, I take this opportunity to present Annual Report for the year 2014-2015 ended on 31st March 2015. Membership: New Members – 2014-15: Patrons-147 (43 Life Members converted to Patron + 104 New Patron members); Life Members-19.

    The total membership as on 31/3/2015: is 1733 (P-1238+L-465+Association Members-35). This number is arrived after removing the names of deceased members. We regret to inform that 12 members left for heavenly abode during the reporting period. We pay homage to them. Donations: AERWA is very much thankful to all members and others who voluntarily donated Rs 28017 for the activities of the association. Another donation of Rs 39,851, contributed by 13 members, was sent to PM National Relief Fund for the J&K flood victims relief. An acknowledgement has been received from PMO. AERWA acknowledges the kind gesture of the members who donated for this cause. AERWA: Annual Day Celebration-2014 The Annual Day Meet was held on June 8, 2014 at Multi-Purpose Hall, TSH, Anushakti Nagar. About 125 members participated in the function. Dr SP Garg, President AERWA welcomed all members present, introduced the Chief Guest Dr S Banerjee, Homi Bhabha Chair Professor, BARC and Ex-Chairman AEC and invited him to deliver the Key note address. Dr Banerjee gave an excellent presentation on “DAE Culture”. He described the various roles of scientists/ engineers during last six decades of DAE programme categorizing in three periods of twenty yrs each, 50s to 70s, 70s to 90s and 90s till date. Dr Banerjee mentioned an important aspect of DAE culture, that in spite of several constraints almost all the projects initiated by DAE achieved their ultimate goals. He gave examples of “Arihant”, India’s first nuclear submarine, nuclear fuel reprocessing plant, world’s largest nuclear desalination plant and most importantly DEA‘s contribution in the field of nuclear agriculture. After the Tea Break, Dr MR Iyer presented an interesting lecture on “Concept of time in Physics and Metaphysics”. He mentioned that ancient treatises of Hindu Philosophical thoughts encompass wide range of time scale from 10-8 to 1022 seconds. In modern science the units relate to atomic/ nuclear times to age of universe and beyond. He mentioned that only Hindu Philosophy propounds the idea of life cycles of Universe i.e. birth and death. He then went in to details of Veda’s quotes and their parallelism to modern physics. The third lecture was given by Shri Tyagrajan P on “Societal Activities by the Vinimay “. A summary of his talk is given below: About Vinimay (www.vinimaytrust.org) Vinimay is a social work organization [NGO] working for under-privileged children and youth staying in, and emerging out of, child welfare institutions (CWIs) in the city of Mumbai. Other details were published in News Letter Vol 15-4.

    In the afternoon session, 17th AGM of AERWA was held between 2: 30 PM to 4:30 PM. 96members attended the AGM. The Minutes of the AGM are already printed in the July-August 2014 issue of the Newsletter. The result of the election for the new MC Committee for the year2014-16 was announced in the AGM and got approved. PENSIONERS’DAY CELEBRATION Pensioner Day programme held on December 17, 2014 was a grand success. More than 160 members participated in the function. Shri R.C.Pant, President, AERWA welcomed the members and invitees. Dr V.K.Manchanda , Vice President , AERWA anchored the programme and introduced all the speakers Shri S A Bhardwaj Homi Bhabha Chair Professor and Former Director Technical, NPCIL and President Elect, Indian Nuclear Society was the Chief Guest. Founder Members of AEWA led By Shri K V Raghavendra (Membership No. P-1) were felicitated on this occasion for their excellent foresight, dedication and untiring hard work to create an organization like AERWA. The other founder members felicitated were, Shri T K Chaudhry, Shri S Rama Rao and Shri N S Kimsen. The members gave a brief of their memorable association. Memorable photographs were printed in the January-Feb 2015 issue of Newsletter. Shri Bhardwaj gave an excellent presentation on 3-phase Atomic Energy programme of the country. He also gave an account of future directions of nuclear power proramme not withstanding the hurdles caused by liability act passed by Indian Parliament.. He suggested that AERWA members can contribute in the DAE Outreach Programme. Incidentally, Shri Bhadwaj himself is overseeing the programme Dr B B Singh gave a presentation on the need to make a WILL before it is too late. He presented a sample of the WILL which can be suitably modified based on individual choice. He referred many court cases which he had taken up to avoid hardship to successors. He offered any help from members required. There was an inspiring presentation by Mrs Meera Suresh from Sneh Bandhan Trust on “Donate Organs and Save Lives”. She presented cases dealing with donation of organs like eye, skin and even the whole body after death. She also distributed leaflets on organ donation and suggested how members can join the organ donation campaign. In the Afternoon Session, (which was conducted by the Shri R.C.Pant, President, AERWA and Dr B.M.Misra, Secretary AERWA) pensioner related issues were discussed in an open forum. The felicitated members gave a brief account of their memorable association with AERWA..(Memorable photographs have been printed in the January-Feb 2015 issue of

    Newsletter). Shri S S Ramachandran, Advisor, Bharat Pensioner Samaj gave the introductory remarks and appreciated AERWA efforts in supporting the pensioner’s. Some of the members participated in the subsequent discussions. The meeting ended with vote of thanks. AERWA PICNIC The AERWA Picnic-2015 was held on January 18 at Modak Van “Modak Samajik Vanikaran and Vrikshlagvad Sahakari Sanstha Maryadit", Nasarapur Village, Karjat, Raigad District. ~70 Km. from Kharghar. Shri Swaraj Agrawal and Shri Keshav Chandra, the members of the Sahkari Sanstha, made excellent arrangements for snacks and lunch at the picnic site. AERWA’s recognition by Pensioners’ DP&PW Portal It is heartening to inform the members that AERWA has been recognized as one among few Pensioner’s Association in India to be part of the DP&PW portal. This allows direct communication with DP&PW on many issues relevant to pensioners including lodging grievances in pension matters. These Associations are also given an annual grant of Rs 75,000/ for office maintenance expenses including hiring an assistant, office rental, internet charges, stationery etc. This grant however does not allow expenses on Newsletter, our major expenditure head. The first installment to AERWA was received last year and a separate account was opened at HDFC, Govandi, as mandated by DP&PW. .AERWA has been able to utilize this grant partially on above activities this year and an audited account is ready to be submitted to DP&PW, requesting release of next year grant. The usual excuse given by the concerned department, whenever an old case was brought to their notice, was that they are short of staff, which was not tenable at all. The issue has been repeatedly taken up by the President and Secretary of AERWA with BARC and finally the Controller has assured that this will be carried out on a priority basis.     The Hon’ble Prime Minister has launched “Jeevan Aadhaar” (Aadhaar based biometric verification system for pensioner). To make its implementation successful Department of Financial Services has constituted a sub-group comprising of RBI, Indian Bank’s Association (IBA), State Bank of India, Punjab National Bank, Bank of Baroda and Canara Bank. Accordingly; ·RBI, IBA and Department of Financial Services have issued necessary guidelines/ instructions to all banks. To implement Jeevan Pramaan it is necessary on the part of banks to feed the Aadhaar number with Pension Payment Order and bank account number. To complete this task, all banks have to take special drive to collect the Aadhaar number. of pensioners and make it a part of their master data. In the above context Addl. CGA has taken a meeting on 24.12.2014 to discuss further the strategy for speedy implementation of the system. For this purpose, they will call the pensioners to come to bank along with their original Aadhaar card and its photocopy for identification. The designated officer of the bank will identify the pensioner with reference to the PPO and KYC document and seed his pension account with Aadhaar server. He will keep the photocopy of Aadhaar Card in the pensioners’ folder for record. The bank will apply this strategy immediately with those pensioners whose life certificates are still pending and are interested to opt for digital certification of their life. Thereafter, they may complete this task well before November, 2015, when life certificate becomes dues. A column for Aadhaar number has been provided in the format of master data and made available on CPAOs website. All CPPCs are advised to update their master data duly seeded with PPO number & bank account numbers and send the same to CPAO by e-mail at [email protected] at the earliest so that CPAO also updates its master data for validation purpose. This task must be completed on top priority basis.

CPC-VII News: National Council (Staff Side), Joint Consultative Machinery for Central Government Employees (Excerpts) No.NC/JCM/2015 Dated: March 25, 2014 The 7th CPC had asked the JCM Staff Side to present their case before the Commission for wage revision on 23rd and 24th March 2015. Accordingly, the Standing Committee of the Staff Side met on 22nd March and again 23rd March 2015. The presentation was made on 23rd and 24th March 2015 before the Commission. We have discussed the memorandum, chapter wise and the Commission made a very patient hearing and interacted with us seeking clarifications on certain matters. It is not possible to provide a detailed account of the discussions. However, we are to inform you that we came out of the discussion with a very good impression and satisfaction.

    1. The Commission will adopt Minimum Wage Concept (Dr. Aykhrod Formula) as the principle of wage determination. They will however, collect the retail rates of the commodities that go into the basket.

    2. We have pleaded for the adoption of the best international practices while fixing the highest salary. On the demands for Interim Relief and Merger of DA, the Commission finally said that those can only be considered if Terms of Reference are amended. The Commission agreed that there had been reduction in the sanctioned strength and working strength over the years despite the increased workload.

    3. They have also noted that there was substantial reduction in percentage terms of the expenses on salary and wages over the years.

    4. The Commission enquired, as to how multiplication factor of 3.7 was arrived at. The same was explained in detail.

    5. Fitment Formula and the demand on Fixation of Pay on Promotion were appreciated as the rationale was explained.

    6. Date of effect: No commitment or comment was made by the Commission. The Staff Side explained, as to how they compromised by shifting the date from. 01.01.2011 to 01.01.2014.

    7. The institution of Special Pay, especially in the wake of de-layering was explained.

    8. Common Categories: We have requested the up gradation and amalgamation of the cadres of LDC with UDC and the need for bringing about parity in pay scales of the Subordinate Offices with the Central Secretariat. The problems of Staff Car Drivers were also elaborated. The contractorisation and casualisation at lower level positions and the consequent exploitation of the labour were discussed at length. The Commission has made a proposal to do away with the

    contractorisation/casualisation. Staff side will discuss the proposal and will send its views to the Commission in due course.

    9. Classification of Posts: Our proposal has not been found favour.

    10. GDS: While sympathizing with the Staff Side, the Commission wanted them to approach the Government with a view to amend the Terms of Reference.

    11. Allowances and Advances: Detailed discussions were held on HRA, CCA, Transport Allowance, CEA and Special Allowance for personnel posted at North East Region. Chapters dealing with the facilities were also discussed at length, including compassionate appointment. On holidays, we have requested to include May Day in the list of holidays. The background of observance of May Day was enquired by the Commission and explained. Pension and Retirement Benefit – NPS: Commission stated categorically that NPS being an Act of Parliament, they will not make any comment thereon. Pension Computation: The rationale of 67% was explained and appreciated. Minimum Pension: our demand for 2/3rd of the Minimum Wage was also explained. Parity in pension of past and present pensioners was fully explained, linked with one rank -one pension scheme for Defence Personnel. We have pleaded that Civilian Pensioners should not be discriminated against. Demand for Additional Pension for both Pensioners and Family Pensioners was explained. All matters concerning Family Pension were also discussed. So also, gratuity to be computed in accordance with the Gratuity Act. There was good response for the demands from the Commission. Restoration of commuted value of pension: The Commission will enquire the views of the Government as to what is their objection to the demand. Medical facilities for pensioners and discrimination between Pensioners in CGHS area and CCS (MA) Area as also the Postal Pensioners was brought home including the higher Fixed Medical Allowance for ESI persons. Certain clarifications/elucidations have been asked for by the Commission. To provide such clarifications, another meeting with the Commission might be held after the Commission’s interaction with other organizations. For further details, please contact: [email protected] CHAPTER – II, New Pension Scheme (NPS) (Only excerpts are presented here – Ed) 2.1 The contributory pension system brought in by the GOI through their notification dated 22.12.2003, now renamed as National Pension System under PFRDA Act, has been imposed on Government employees who entered service on or after 1.1.2004. 2.2 This is an illegal act in as much as the Supreme Court of India had held Pension as an enforceable inalienable fundamental right. Therefore it should be scrapped or at least not made applicable to Government employees. This has also divided the CG employees into two categories and therefore it is discriminatory in respect of persons who have entered service on or after 1.1.2004 who had been denied the statutory pension. Any discriminatory scheme is illegal and ultravires of Article 14 of the Constitution. On this count also the NPS cannot be made applicable to the Government employees. 2.3 The Centre for Economic Studies and Policy, Institute for Social & Economic Change, Bangalore in a Study of Terminal Benefits of the Central Government Employees sponsored by the VI CPC had also observed that Civil Services Pension is in the nature of a deferred wage. It is well known that the principle guiding the pay package of civil servants is one of intentionally spreading out the compensation over a long period of time, thereby the wages paid out during the course of the work tenure is kept low by design, and the pension payments made during the retirement phase compensate for the low working wages. 2.4 The above mentioned study under the heading “Arguments against pension reforms” states as follows: “Deferred Wage: In the context of civil servant pension payments, it is argued that, the principle guiding the fixation of pay package is one of intentionally spreading out the compensation over a long period of time, whereby the wages paid out during the course of work tenure is kept low by design, and the pension payments made during the retirement phase compensate for the low working wages. The Supreme Court of India held that pension is neither a bounty nor a matter of grace depending upon the sweet will of the employer. It is not an ex-gratia payment, but a payment for past services rendered. It is a social welfare measure, rendering socio-economic justice to those who in the heyday of their life ceaselessly toiled for the employer on an assurance that in their old age, they would not be left in the lurch.” “Larry Williams observes “Actually, civil service pensions, because they are not based on contributions,

    are best described as deferred wages. Civil servants accept a lower current wage in exchange for the promise of a pension in their old age. If this pension were contributory, they would insist on a higher wage and government would have to either increase taxes or borrow (issue debt) to pay it. The real cost of civil servants is thus much higher than recorded under the current system of cash accounting. A good reform would be to move to a system of accrual accounting setting up at least a notional fund to pay these deferred wages” (Larry Wilmore, 2004)” “Public and private sector pay differentials: A comparison of the public and private sector wages reveals that while the public sector wages for the lower grades compares well with that of the private sector, the salaries of the employees belonging to the higher grades are highly unfavorable to the public sector employees.     2.6 The above study had also pointed out that expenditure on pensions of civil servants of high income OECD countries on an average is 2% of GDP (less than 1% in Ireland and more than 3.5% in Austria*)(* Source: OECD Social Expenditure Database). But in the 8 South Asian countries it is less than 1% of GDP (Source: World Bank Data base). However, in India between 1964-65 and 2004-05 on an average pension payments (Civil Service pension paid by Central

    Government) have constituted 0.51% share of GDP. The Pension liability would continue to increase and reach 0.54% level by 2024-25 and remain at that level for some years after which it would decline as a percentage of GDP according to the same study. These figures argue themselves in favour of continuation of the Defined Benefit Pension Scheme for all Central Government employees instead of throwing a section of them to market based NPS. According to 2011 census 62.8% are in the age group of 15 to 60 and only 8.2% are above the age of 60. 2.7 From the above projection it is very clear that the benefit of NPS will commence only after 2044. And during the period it will increase exponentially as in addition to the Statutory pension liability the Government will be contributing to the NPS also @ 10% of annual salary bill of the CG Employees who have entered service on or after 1.1.2004. 2.8 The final conclusion of this study team has been as under: “Mainly given the fact that the future liability although may be large in terms of the absolute size is not likely to last very long and does not constitute an alarmingly big share of the GDP which is also on the decline, it appears that pursuing the existing Pay As you Go to meet the liability would be an ideal solution.” 2.9 Applying this conclusion we may suggest that the NPS may not be made applicable to the Government employees and all those who had been covered under NPS may be reverted back to statutory pension scheme. The Government may be asked to study the experiences of this scheme in several other countries in the world. In Chile such a scheme has been reversed as because the return which the low paid employees got out of the annuity purchased was not as good as 50% of LPD but as low as 20% of LPD. The UK Government had to pay out of the exchequer large amount by way of subventions in order to ensure that that annuities purchased yield 50% of LPD as pension. It is well known that in USA where there were similar pension schemes dependent upon the market had collapsed during the financial melt down from 2008 onwards. It is estimated that more than 3.5 trillion dollars worth of pension wealth was lost. The workers not only lost their pension but also their jobs. Our respectful submission is that taking into account the demographic considerations of India which is a country of young does not need any such market oriented pension scheme, particularly when the international experience is that such schemes had failed and our country can afford to pay pension to civil servants which stand at level of 1% of the GDP. We conclude by quoting the opinions of experts on the future of market dependent pension Scheme.

    Mr Joseph Stiglitz (Chief economic advisor to former president of USA Bill Clinton, former vice-chairman and chief economic advisor, World Bank, Nobel Prize winner, Professor of economics, Columbia university) said that “Stock market does not guarantee returns. It does not even guarantee that the stock values will keep up with inflation. Privatization would not protect retirees against the social security systems insolvency. Argentina’s privatization of its pension system was at the centre of its fiscal woes”. Mr Dean Baker (Co-director for centre for economic and policy research, Washington) said “Privatization means that you would not have a guaranteed benefit that you have today. It would depend on how will your investments do or how well they have done at the point you retire. He quoted the collapse of NASDAQ and Enron. In Britain, Insurance companies could not honor their promises and the Government had to compensate with 8 billion pounds.

    from1.1.2006 to 24.9.2012 for all 661 nos. of S-29 applicants came for hearing on 10.1.2015 at CAT, Delhi. As all the applicants were not paid the arrears till date, the next date of hearing was postponed to 13.2.2015. It has been further postponed to April 9, 2015.The CP could not be heard on this day and next date is 27.5.2015

    2. 3 SLPs by UOI at Supreme Court, similar to case of 661 members S-29 group and many other cases for release of arrears wef 1.1.2006, were fixed for 13th Jan. 2015. As the bench was busy. These SLPs were heard at HSC on 17th March and have been dismissed. The court ordered to implement the order in 4 months’ time; meanwhile all intervention applications to be withheld.

    3. Five MAs from about 800 new S-29, S-26 and S-21 members were filed at CAT, Delhi for arrears wef 1.1.2006. The case came up for hearing on 2.2.2015 &6.2.2015. The next date of hearing was fixed for April 9; 2015.The case came for hearing on April 9, where the Govt. advocate argued that no implement / intervention application can be allowed as per HSC order of 17.3.2015. The court asked the Govt. counsel to get the instruction form GOI whether the benefit is

    The Managing Committee of AERWA celebrated 80th birthday (DoB March 27, 1935) of the man behind the success and growth of AERWA Shri P K Vaze on April 11, 2015. However, Shri Vaze himself has celebrated his 80th birthday by donating Rs 5000 to AERWA.

    ************* Letter to Editor 1. Received Rs11.2 Lakhs as Arrears due to Wrong Estimation of the Pension by the Dena Bank To, President/Secretary, AERWA I am a life member of AERWA (P-870). I am writing this (unfortunately a very long) email to bring to the notice of AERWA an experience regarding my father's pension. It is a typical example of ignoring the Office Memorandum by a bank and also by DOPPW. It also stands as an example of one-sided approach of DOPPW about pensioners' complaints. My father, Dr.R.T.Chitnis, retired from B.A.R.C. in 1984. He is receiving his pension through Dena Bank. After the implementation of recommendations of sixth CPC, his basic pension was revised and he received the arrears too. His total pension includes additional age-based quantum also.

    Last year I realised that there is a major mistake in the revision of his basic pension. He was getting 30% less pension. This difference was due to '4.2based' pension being higher than '4.1Henceconsider it unless CPAO instructs them to do so. Hence, I wrote to CPAO and obtained PPO, a copy of which was received by Dena Bank also. My doubt proved to be true and my father's basic pension had to be much hcontacting bank again, bank revised the basic pension to a correct figure based on the new PPO. After repeated follow01.01.2008, which amounted to about Rs. 11.2 lakhs.As thepension, I requested the bank to pay the interest on the arrears as per point no. 34 of Master Circular Disbursement of Pension by Agency Banks [no. RBI/201415, dated Julcompensation at a fixed interest rate of 8 per cent should be paid for all delayed pension payments made since October 1, 2008. Accordingly, my father was expected to get interest of about Rs. 3.1 lack.After repeatedinterest, but based only on the date of receipt of new PPO, i.e. 11.04.2014 and not from 01.10.2008 as requested by us. (It was only about Rs. 35,000). Bank is not at all ready to take the responsibility of this lodelay in the payment of pension. Our request for getting interest since 01.10.2008 is based on the Office Memorandum issued by Ministry of Personnel, Public Grievances & Pensions [no. 38/37 /08dated 14th October, 2008]. Para 4 of the this Memorandum clearly attributes the responsibility of revision and disbursement of the enhanced pension and arrears to the pension disbursing public sector banks. Moreover, it instructs the banks to disburse the same within one month from the date of Memorandum dated 01.09.2008. Accordingly, Dena Bank should have accepted the responsibility of the delayed payment of pension/arrears and should have paid the interest from 01.10.2008.On registering an on(DOPPW/P/2015/0041even DOPPW also upheld the bank's decision through a blind acceptance of the email sent from the Zonal Office of Dena Bank. This is clearly violation of DOPPW's aboveonly by Dena Bank, but ais doubtful whether DOPPW takes into consideration their own Office Memoranda or not.Present status is that the complaint is disposed off and the case is closed. After repeatedly pursuing the matter, the bank paid the interest, but based only on the date of receipt of new PPO, i.e. 11.04.2014 and not from 01.10.2008 as requested by us.     reopen the case. But I have doubt whether it will be done so. N.B. Meanwhile I approached Banking Ombudsman. Unfortunately, Ombudsman has also ruled in favour of bank only. Reply from Banking Ombudsman also includes copy of the same email sent by Zonal Office of Dena Bank. I am very sorry for this long narration. But I thought that the case should be known to AERWA, as there may be many more very old pensioners like my father (especially pre-1996 retirees), who are losing a substantial portion of their pension just due to lack of knowledge about the intricacies in the calculation of revised pension.
